Liquor Control (Parnngurr Restricted Area) Regulations 2018

The regulations deploy a cluster of statutory tools familiar in liquor control: area declaration, prohibition on supply/possession, defined exemption, administrative signage, police seizure powers and an express temporal limit. Each concept is narrowly articulated in the text.

• Restricted area declaration: Regulation 6 invokes section 175(1a) of the Liquor Control Act 1988 by declaring the Parnngurr Aboriginal Community a restricted area. The instrument therefore operates as a locality‑specific application of the Act’s area powers.

• Spatial definition: Regulation 3 defines "Parnngurr Aboriginal Community" by a circle, radius 30 km, centred on specified GDA2020 co‑ordinates. The regulation therefore fixes the legal boundary by coordinates and a metric radius, rather than by cadastral parcels or community name alone. The regulations’ compilation notes record that regulation 3 was amended by SL 2021/209 r. 4.

• Offence structure: Regulation 8 creates offences for (a) bringing liquor into or causing liquor to be brought into the area and (b) possessing liquor there. The instrument supplies distinct monetary penalties, with an elevated penalty for licensees, managers of licensed premises and directors of corporate licensees (regulation 8(2)). The regulation expressly distinguishes corporate actors in roles tied to liquor licensing.

• Exemption: Regulation 4 defines "exempt person" by five factual criteria (distance from usual residence, intended duration of stay, not travelling on a regular journey between home and work/education, purpose of travel and not usually a resident of a restricted area declared under s 175(1a) of the Act). Regulation 9 then operates as a narrow operational exception: an exempt person escapes the offence under regulation 8(1) only if they continuously maintain possession of, but do not consume, the liquor. The term "continuously maintains possession" is not further defined in the regulations.

• Signage duty: Regulation 7 requires the Director of Liquor Licensing to take all reasonable steps to post and keep posted notices at each point where a customary access route enters the community describing the offences and specifying penalties. Subregulation (2) states that failure to comply with the posting obligation does not invalidate the declaration.

• Police powers: Regulation 10 modifies the operation of section 155(4) and (5) of the Liquor Control Act by permitting a member of the Police Force to seize and as soon as practicable dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 8. The regulation therefore creates a direct disposal power tied to reasonable grounds for suspicion.

• Temporal limit and amendment links: Regulation 11 sets the end date for these regulations at the close of 7 January 2035 unless sooner repealed. The Part 5 amendment (regulation 13) inserts the new offence reference into an existing Table in the Liquor Control Regulations 1989 (regulation 27(4)), linking the localised prohibition into the broader regulatory scheme.

Those are the core statutory objects and definitional scaffolding that determine the legal effects, who can be exempt, what behaviour is prohibited, how marking and enforcement must happen, and how long the measures stay in force.

The instrument assigns obligations, liabilities and operational tasks across a compact set of actors: persons entering or present in the defined geographic area, liquor licence holders (and their managers/directors), the Director of Liquor Licensing and members of the Police Force.

• People physically in the Parnngurr restricted area: Regulation 8 applies to any person who brings, causes to be brought, or possesses liquor within the area of land defined in regulation 3. That includes visitors, transient travellers, residents and any person physically within the 30 km radius.

• Exempt persons: Regulation 4 and 9 set out a narrowly circumscribed class of persons who may possess liquor without offending regulation 8(1). To qualify as an "exempt person" a person must meet five factual conditions: (a) be staying at a place at least 50 km from their usual place of residence for at least one night; (b) intend to stay away for less than 12 months; (c) not be travelling on a regular journey between their usual place of residence and their place of work or education; (d) be travelling for holiday, visiting friends or relatives, leisure, business or other reasons; and (e) not usually be a resident in a restricted area declared under s 175(1a) of the Act (regulation 4). Even if a person fits regulation 4, regulation 9 requires that they "continuously maintain possession of, but do not consume, the liquor" to be exempt from regulation 8(1). The two regulations together therefore target temporary visitors who retain custody of alcohol and do not drink it in the restricted area.

• Licence holders, managers and directors: Regulation 8(2) singles out licensees, managers of licensed premises and directors of bodies corporate that hold licences by applying a higher penalty where they commit the offence. That elevates compliance risk for businesses and officers associated with licensed premises if they bring or possess liquor in the restricted area.

• Director of Liquor Licensing: Regulation 7 imposes a practical duty on the Director to take all reasonable steps to post notices at customary access routes into the community and to maintain those notices while the area is a restricted area. The duty is framed as an obligation but the regulation also provides that failure to comply does not invalidate the area declaration (regulation 7(2)). The nature of "all reasonable steps" is not further specified in the instrument.

• Police: Regulation 10 authorises members of the Police Force to seize and dispose of opened or unopened containers suspected on reasonable grounds to be tied to an offence under regulation 8, explicitly operating despite s 155(4) and (5) of the Act. That imparts operational discretion to police officers within the restricted area.

• Businesses and third parties outside the area: While not directly named, any suppliers, carriers, transporters or retailers who would otherwise deliver or allow transport of liquor into the restricted area may be affected indirectly because the prohibition on causing liquor to be brought into the area (regulation 8(1)(a)) reaches intermediaries. Those entities face the risk that an act of delivery or carriage into the 30 km zone could expose them or their employees to enforcement action, depending on the carrier’s role and whether the carrier is the person "bringing or causing to be brought".

In short, the regulations primarily constrain possession and introduction of liquor within a precisely defined geographic radius, with tailored exemptions for a narrow class of temporary travellers, elevated fines for liquor industry actors, a posting duty for the Director, and seizure/disposal powers for police. The distribution of duties and penalties means residents, visitors and liquor industry personnel need to work against tightly specified factual tests to avoid liability.

The regulations create and allocate operational duties and conditional rights. These are statutory obligations or permissions that directly change behaviour by legal mandate.

Duties

• Director of Liquor Licensing: Take all reasonable steps to post and keep posted notices at each place where a customary access route enters the Parnngurr Aboriginal Community describing the offences in regulation 8 and specifying penalties (regulation 7(1)). The duty is ongoing: the notices must be kept posted while the area continues to be a restricted area by operation of regulation 6. The duty is qualified by regulation 7(2): failure to comply does not invalidate the declaration.

• Persons (general duty not to bring or possess liquor): The operative prohibition is a normative constraint on actions: no person is to bring, cause to be brought, or possess liquor within the area unless the person falls within regulation 9’s limited exception. This creates a compliance obligation on persons entering, moving through, or staying in the area (regulation 8(1)).

• Police: Regulation 10 confers a duty/authority on police to seize and dispose of containers of liquor suspected on reasonable grounds of being the subject of an offence under regulation 8. While couched as authorisation, the regulation assigns an operative role to police officers in preventing the continued presence of liquor in the area.

Rights and conditional permissions

• Exempt persons: Regulation 4 sets out a defined status that confers a conditional right under regulation 9: an exempt person may possess liquor without offending regulation 8(1) provided they continuously maintain possession and do not consume the liquor. The right is narrowly framed and conditional on satisfying several factual criteria and the additional behavioural limitation (no consumption).

• Disposal by police: Regulation 10 gives the police the right to dispose of seized containers as soon as practicable. The regulations do not set out a process for notifying owners, return of property, or appeals against disposal; the disposal power is expressed as a matter of operational practice once seizure occurs.

• No invalidation clause: Regulation 7(2) is a legal protection for the declaration: it creates a right in the declaration’s legal effect to remain operable even if the Director fails to meet the posting duty. That protects the State interest in maintaining the declared status despite administrative non‑compliance.

Operational consequences of the duties and rights

• Licensees and corporate officers face heightened monetary exposure because regulation 8(2) applies a larger fine to them. That allocation of higher penalties is a regulatory lever designed to influence behaviour of persons involved in the liquor trade or its management.

• The definition of exempt person and the continuous possession/no consumption condition sets a behavioural standard for travellers aiming to carry liquor into the area. The "continuously maintain possession" element imposes a custody requirement that may constrain common behaviours like temporarily stowing bottles with third parties or consuming during transit.

• Police disposal discretion operates contemporaneously with seizure, meaning that, once seized, the container need not be retained for long periods; the text requires disposal "as soon as is practicable". The regulations do not prescribe procedural safeguards around disposal in this instrument.

These duties and rights reallocate day‑to‑day decision points: the Director must manage signage; individuals must decide whether they satisfy exemption criteria and whether to carry liquor at all; licensees must decide not to bring liquor into the area; and police have an operational role in removing liquor through seizure and disposal.

The regulations establish monetary penalties and operational enforcement powers, and they shift certain procedural relationships between the Liquor Control Act and police action within the restricted area.

Monetary penalties

• Offence and fines: Regulation 8(1) makes it an offence to bring or cause liquor to be brought into the area, or to possess liquor there, subject to regulation 9. The penalty table in regulation 8 provides two quantums: if regulation 8(2) applies, that is, where the offender is a licensee, manager of licensed premises or director of a corporate licence holder, the fine is $5,000; in any other case the fine is $2,000. The regulations therefore differentiate between individual offenders and persons connected to the licensed liquor industry.

Enforcement powers

• Police seizure and disposal: Regulation 10 authorises a member of the Police Force to seize and, as soon as is practicable, dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 8. The provision operates "despite section 155(4) and (5) of the Act", which the regulations therefore displace for the purposes of these offences. The phrase "suspected on reasonable grounds" imports an objective standard for seizure, but the regulations do not set out procedural safeguards, retention periods, or notice obligations in relation to seized property within this instrument.

• Notices and administrative warnings: Regulation 7 requires the Director to post notices at customary access routes describing the offences and penalties. The posting obligation is a preventive enforcement mechanism intended to inform persons before entry. However regulation 7(2) makes clear that a failure to post does not affect the legal validity of the restricted area declaration. In enforcement terms that means lack of signage is not a defence to an alleged offence under regulation 8.

Operational discretion and evidentiary interactions

• "May seize" versus mandatory action: Regulation 10 uses permissive language ("may seize"), which leaves discretionary room for police to decide whether to act in particular cases based on operational assessment of reasonable grounds, resource allocation and other priorities.

• Reasonable grounds threshold: The seizure and disposal power is expressly limited to containers suspected on reasonable grounds to be the subject of an offence under regulation 8. The regulations do not define "reasonable grounds" or prescribe evidential thresholds, leaving typical criminal evidentiary and judicial review processes to govern contestation of seizures.

• Elevated penalties for licence holders: The higher fine for licensees, managers and directors (regulation 8(2)) creates differentiated enforcement stakes. While the instrument does not create a separate pathway for disciplinary action against licences, the criminal fine exposure is larger for persons in those roles.

Interaction with the Liquor Control Act procedural provisions

• Displacement of s 155(4) and (5): Regulation 10 operates "despite" the cited sections of the Act, indicating an intentional legislative override of whatever constraints sections 155(4) and (5) impose on seizure and disposal in general. The instrument therefore narrows the procedural gap that might otherwise have restricted disposal by police. The regulations do not elsewhere specify retention or appeal rights relating to seized and disposed property.

Consequences for regulated parties

• Immediate removal of liquor: The police disposal power reduces the practical possibility that seized liquor will be held pending court outcome; operationally it allows immediate removal of containers from circulation within the community.

• Risk allocation for businesses: Elevated fines for industry actors reassign financial risk onto licensees and responsible officers, which may affect supply and service decisions related to travel, events and deliveries near the restricted area.

• Administrative notice insufficiency: Because failure to post notices does not invalidate the declaration, persons cannot rely on lack of signage to negate criminal liability; a posted notice is therefore a preventive aid rather than an absolute precondition of enforcement.

In sum, the instrument pairs a clearly described criminal prohibition with a police disposal tool and a signage duty; the combination privileges immediate removal of liquor and places higher monetary risk on licensed industry actors.

The regulations operate as a schedule of rules layered onto the existing Liquor Control Act 1988 and the Liquor Control Regulations 1989. The instrument repeatedly references provisions of the Act and effectually amends the 1989 regulations, creating pointwise interactions that affect scope, procedure and penalty regimes.

Primary interaction with the Liquor Control Act 1988

• Section 175(1a): Regulation 6 expressly declares the Parnngurr Aboriginal Community a restricted area "for the purposes of section 175(1a) of the Act". That means the regulations utilise the Act’s defined power to declare restricted areas, applying the Act’s overarching framework to a specific locality. The instrument does not reproduce section 175(1a); instead it uses the Act’s statutory mechanism to create the restricted area effect.

• Section 155(4) and (5): Regulation 10 expressly operates "despite section 155(4) and (5) of the Act", thus altering the usual interaction between police seizure/disposal powers and the Act’s general constraints. The regulations therefore create an exception to whatever procedural or substantive limitations s 155(4) and (5) would otherwise impose on seizure and disposal of liquor containers.

Amendment to Liquor Control Regulations 1989

• Regulation 13 amends regulation 27(4) of the Liquor Control Regulations 1989 by inserting the citation "Liquor Control (Parnngurr Restricted Area) Regulations 2018 regulation 8(1)" in the Table. The precise table context within regulation 27(4) is not reproduced in this instrument, but the insertion ties the new offence into the regulatory architecture of the 1989 regulations. This can be read as an indexation step to ensure the offence under regulation 8(1) is listed where other offences are tabulated for purposes such as prescribed procedures, fees or seizure consequences under the 1989 regulations.

Temporal and amendment interactions

• Period of effect: Regulation 11 fixes the endpoint of this instrument as the close of 7 January 2035 unless earlier repealed. The compilation table records the initial 2018 commencement and subsequent amendments in 2021 and 2024 that altered definitions and the period (SL 2021/113; SL 2021/209; SL 2024/273). That temporal bracket interacts with any other statutory regimes that have time‑limited application or require periodic renewal; those external regimes must be consulted in tandem with this instrument to determine concurrent applicability.

Procedural gaps and latent interactions

• No procedural return/appeal in the instrument: The regulations do not set out procedures for contesting seizure, obtaining return of seized property, or seeking compensation after disposal. Any such remedies would thus depend on the procedural machinery contained in the Act and the general law, subject to the express displacement created by regulation 10. The instrument leaves these cross‑legal questions to be resolved under the parent Act or general procedural law.

• Licensing consequences beyond fines: While the instrument imposes higher fines on licensees, managers and directors, it does not itself state whether contraventions will generate licensing disciplinary actions under the Act. Disciplinary or licence suspension powers belong to the Act and associated regulatory mechanisms; this instrument operates alongside them but does not specify that interaction.

In short, the regulations are a specific localised application of the Liquor Control Act, they use the Act’s restricted‑area power, they modify the Act’s usual seizure/disposal constraints for this locality, and they cross‑reference the Liquor Control Regulations 1989 to integrate the new offence into the established regulatory table. Procedural details not present in these regulations remain matters for the Act or general administrative and criminal procedure.

The instrument’s compilation table and marginal notes record several amendments since initial publication. The key chronological points, as reflected in the instrument text and compilation table, are:

• Initial enactment and commencement: The Liquor Control (Parnngurr Restricted Area) Regulations 2018 were published on 6 July 2018. Part 1 (preliminary) came into effect on the publication day, with the rest of the regulations commencing on 7 July 2018 (see r. 1 and r. 2 in the compilation table).

• Amendment: Liquor Control (Parnngurr Restricted Area) Amendment Regulations 2021 (SL 2021/113): Published 2 July 2021. The compilation table records that r. 1 and r. 2 of that instrument commenced on 2 July 2021 and the remainder on 3 July 2021. Regulation 11 (the period of effect) was inserted by SL 2021/113 (as the main text records: "Regulation 11 inserted: SL 2021/113 r. 5").

• Amendment: Liquor Control (Parnngurr Restricted Area) Amendment Regulations (No. 2) 2021 (SL 2021/209): Published 17 December 2021. The compilation table notes commencement on 17-18 December 2021. The main text records that regulation 3 was amended by SL 2021/209 r. 4, indicating a change to the defined terms section , notably the Parnngurr Aboriginal Community definition or related terminology.

• Amendment: Racing and Gaming Regulations Amendment (Liquor Control) Regulations (No. 5) 2024 (SL 2024/273): This Part (Pt. 3) was published 18 December 2024 and commenced 19 December 2024. The compilation table records an amendment at Pt. 3 of that instrument and the main text notes that regulation 11 was amended by SL 2024/273 r. 6. That amendment adjusted the period during which the regulations have effect (resulting in the current end date of 7 January 2035).

• Deletions: Regulation 5 is noted as deleted by SL 2021/113 r. 4. The main text includes "[5. Deleted: SL2021/113 r. 4.]" showing that the original instrument contained a regulation 5 that was later removed.

• Editorial amendments: Regulation 3 records that it was amended by SL 2021/209 r. 4. The text of regulation 3 in the version provided includes the 30 km radius coordinates and the marginal note indicating amendment.

These compilation notes and amendment references are the only amendment history embedded in the instrument. They indicate targeted alterations, particularly to definitions and the temporal scope. The instrument’s current operative terms, including the geographic coordinates, the definition of "exempt person" (regulation 4), the seizure/disposal provision (regulation 10), and the end date (regulation 11 as amended), reflect those changes. The insertion into the Liquor Control Regulations 1989 (Part 5, regulation 13) is presented as a current amendment to the 1989 regulations.

No other amendment history, such as policy rationales for the amendments or retrospective modifications to penalty amounts, is recorded in the instrument text or the compilation table supplied.

The statutory text and the compilation table supplied contain no judicial decisions, case references or specific litigation history connected to these regulations. The instrument does not cite any cases, and there is no section in the compilation notes that records legal proceedings against the regulation or judicial challenges to particular provisions.

What the instrument records as litigation‑relevant content is limited to textual and amendment annotations: the regulations modify enforcement powers (for example regulation 10’s operation "despite section 155(4) and (5) of the Act"), which in other contexts may give rise to judicial review applications or evidentiary disputes about seizure and disposal. However, the instrument itself contains no description of litigation outcomes or precedents. Therefore, a practitioner or researcher seeking litigation history must look beyond this instrument to court databases and decisions under the Liquor Control Act and related seizure and disposal disputes; that material is not contained in the regulation text or compilation notes provided.

For present purposes the regulation is a statutory instrument whose content is self‑contained in the supplied text; there are no case names, judgments, or litigation timelines embedded in the document. Any assessment of how courts have interpreted similar seizure‑and‑disposal powers, the meaning of "continuously maintains possession" or the interaction with the Act’s procedural protections would require independent case law research beyond this instrument.

This instrument contains several textual features and operational details that may create traps for parties relying on plain language assumptions. The following points are concrete, text‑grounded and matter for operational caution.

1. Geographical precision and reliance on co‑ordinates: The restricted area is defined precisely by a 30 km radius around the telecommunications aerial at the listed GDA2020 co‑ordinates (regulation 3). Practical implication: persons must know whether a particular point falls inside or outside a circular 30 km boundary. The instrument does not provide a map, buffer tolerances or guidance on measurement methods, so disputes about whether a particular location is inside the circle will hinge on geospatial measurement. The 2021 amendment to regulation 3 indicates this definition has been revisited previously.

2. Narrow and conjunctive exempt‑person test: Regulation 4 sets a multi‑part conjunctive test for "exempt person": all five criteria must be satisfied. A common pitfall would be assuming any visitor qualifies; the instrument requires (a) staying at least 50 km from their usual place of residence for at least 1 night; (b) intend stay under 12 months; (c) not on a regular commute between home and work/education; (d) travelling for specified purposes; and (e) not usually resident in a restricted area declared under s 175(1a). Any failure on one limb negates exemption.

3. Continuous possession and no consumption requirement: Regulation 9’s exemption requires the person to "continuously maintain possession of, but does not consume, the liquor." That is a strict custody and non‑consumption rule. Practical questions arise: what constitutes "continuous" possession? Does temporarily handing a bottle to another person break the chain? The regulations include no clarifying examples or tolerances. That imposes evidentiary challenges for anyone claiming exempt status.

4. Elevated fines for industry actors: Regulation 8(2) applies a $5,000 fine to licensees, managers and directors and $2,000 to others. That differential means persons affiliated with licensed premises have materially higher exposure; entities should ensure internal policies prevent staff and officers from bringing liquor into the area.

5. Police disposal power and limited procedural text: Regulation 10 allows police to seize and "as soon as is practicable, dispose of" containers suspected on reasonable grounds. The regulation expressly operates despite ss 155(4) and (5) of the Act, meaning the Act’s usual protections may be circumvented in practice. The instrument does not elaborate on notice, appeal or return procedures following disposal. Parties facing seizure have limited procedural guidance within the regulations themselves.

6. Signage duty does not affect validity: Regulation 7(2) states a failure by the Director to post notices does not invalidate the declaration. Thus, a person cannot rely on absent signage to challenge the legal existence of the restricted area. Operationally, individuals must ascertain the declaration’s status without relying solely on posted notices.

7. Temporal limit: Unless repealed earlier, the regulations expire at the close of 7 January 2035 (regulation 11). Parties assuming permanency should note the fixed term and the recorded amendments that have adjusted the timeframe.

8. "Bringing" and "causing to be brought" are separate prohibitions: Regulation 8(1)(a) criminalises both direct carriage and causation. That reaches actors who arrange delivery, transportation contractors or others who facilitate introduction of liquor into the area. Contracts and logistic decisions should reflect this exposure.

9. No process in the instrument for proving exempt status: The regulations define the exempt person but do not prescribe documentary requirements, authorisations, or exemptions cards. Practical enforcement and defence will depend on evidence at the point of contact with police or in prosecution; the instrument does not create an administrative certification process.

10. Cross‑reference insertion into 1989 regulations: Regulation 13 adds this new offence into the Table in regulation 27(4) of the Liquor Control Regulations 1989. The table’s operational meaning (fees, procedural triggers or other cross‑links) is not reproduced here; parties should verify the other regulation to understand full consequences of that insertion.

Each of these "gotchas" is textually grounded in the regulations provided. They create operational frictions: uncertainty over measurement; strict factual tests for exemption; custody requirements; differential penalty exposure for liquor industry actors; and immediate disposal power for police without procedural details. Practitioners should translate these textual features into concrete compliance checklists for affected clients.

Compliance requires aligning practical behaviour, signage and recordkeeping with the regulations’ strict spatial, factual and behavioural requirements. The following steps are concrete measures drawn from the regulations’ text.

1. Map the boundary and identify customary access routes

• Use the GDA2020 coordinates and a 30 km radius to produce a clear map of the restricted area (regulation 3). Organisations operating near Parnngurr should create geospatial layers in commonly used GIS or mapping formats so staff can determine whether specific locations fall within the restricted circle.

• Identify all customary access routes that enter the 30 km area and log the physical entry points where notices may reasonably be posted (regulation 7(1)). The Director of Liquor Licensing is responsible for posting, but local authorities and community organisations should liaise to ensure routes are correctly identified.

2. For the Director of Liquor Licensing and administrative officers: signage and recordkeeping

• Take "all reasonable steps" to post and keep posted notices at each customary access route describing regulation 8 offences and penalties (regulation 7(1)). Maintain records, dates, locations, photographic evidence and replacement logs,to demonstrate reasonable steps were taken in case of scrutiny, even though posting non‑compliance does not invalidate the declaration (regulation 7(2)).

• Maintain a current electronic and physical copy of the regulations and an accessible map to enable police, community members and visitors to inspect the declaration and understand penal consequences.

3. For travellers and visitors: meet exempt person criteria and custody rules exactly

• If planning to carry liquor into the area, confirm all five conjunctive criteria in regulation 4 are satisfied: (a) your stay is at a place at least 50 km from usual residence and at least 1 night in duration; (b) intended stay is under 12 months; (c) you are not travelling as part of a regular commute; (d) travel reason is within the listed purposes; and (e) you are not usually resident in a restricted area declared under s 175(1a) of the Act.

• If qualifying as an exempt person, do not consume the liquor in the area and maintain continuous possession of it. Practically, this means keeping the container under your direct control at all times (for example, in your personal luggage and not left with third parties) to avoid breaking continuous possession. Because the regulation does not define "continuous", adopt a strict custody approach.

• Carry documentation that supports the factual elements (proof of usual residence, travel itinerary showing distances and dates, proof of purpose) to present to police if questioned. The regulations do not require documents, but having them evidences compliance with regulation 4.

4. For licensees, managers and directors: avoid bringing or causing liquor to be brought into the area

• Given the higher $5,000 fine for industry actors (regulation 8(2)), implement firm internal policies forbidding staff, contractors or corporate officers from intentionally bringing or arranging delivery of liquor into the restricted area.

• Review logistics and contractual terms with carriers and event organisers to ensure no action by the business could be characterised as causing liquor to be brought into the area. Document instructions given to carriers and obtain written acknowledgements where relevant.

5. For police and enforcement agencies: seizure and disposal procedures

• Align operational procedures with regulation 10: where there are reasonable grounds to suspect a container is the subject of an offence under regulation 8, officers may seize and, as soon as practicable, dispose of containers. Agencies should draft internal guidelines defining "reasonable grounds", retention intervals, disposal methods and recordkeeping so that disposals are auditable.

• Create a chain‑of‑custody and disposal log capturing time of seizure, grounds for seizure, description of items seized, person from whom the item was seized, disposal date and method, and any witness statements or notifications. The regulations do not prescribe these steps, but good administrative practice reduces risk of challenge on procedural grounds.

6. For community organisations and local government: information and liaison

• Liaise proactively with the Director of Liquor Licensing to ensure notices are posted at appropriate entry points and maintained.

• Inform community members, visitors and local service providers about the restricted area boundary, the exemption criteria, the continuous possession requirement and the disposal powers to minimise accidental contraventions.

7. Incident response and legal contingency

• If seized, persons and businesses should promptly obtain legal advice about potential remedies under the Liquor Control Act and general law. The regulations do not provide an internal appeal mechanism for disposal; remedies will depend on the Act and other procedural law.

• Businesses whose staff are at risk of elevated fines should arrange compliance training and update employment policies to reflect the prohibition on bringing liquor into the area.

8. Review contracts and transport arrangements

• Carriers and transport intermediaries should insert representations and warranties into contracts that goods destined for points within the 30 km radius are not liquor, or obtain express instructions to refuse carriage into the restricted area.

9. Monitor amendment and expiry dates

• Note the regulations are effective until 7 January 2035 unless sooner repealed (regulation 11). Organisations should monitor legislative updates and the relevant Gazette notices for any repeal, amendment or renewal.

10. Record preventive steps

• For persons who might rely on the exemption, keep contemporaneous records demonstrating compliance with regulation 4 and 9: travel itineraries, tickets, accommodation receipts, and proof of continuous custody for liquor containers. Good documentary evidence facilitates rapid resolution in enforcement encounters.

These compliance steps translate the statutory text into operational measures: mapping and signage, strict custody practices for exempt persons, proactive internal policies for licence holders, enforceable procedures for police disposals and training and recordkeeping for community stakeholders.
