Liquor Control (Bayulu Restricted Area) Regulations 2013

The regulations operate through a small set of interlocking concepts: restricted area declaration, spatially framed offences, administratively mandated public notice, enhanced seizure and disposal powers for police, and a fixed statutory sunset.

Restricted area declaration. Regulation 5 declares the Bayulu Aboriginal Community a restricted area for the purposes of s 175(1a) of the Act (reg 5). The declaration is the legal trigger enabling the prohibitions and enforcement powers in the regulations.

Geographic specificity. Regulation 3 furnishes a concrete description of the restricted area: Crown Reserve 35197, being specific deposited plan lots (reg 3). The definition fixes the spatial boundary to surveyable land parcels rather than a free‑text description.

Criminal prohibitions tied to conduct. Regulation 7 criminalises three forms of conduct in the defined area: bringing liquor into, causing liquor to be brought into, and having liquor in one’s possession within the Bayulu Aboriginal Community (reg 7(1)). The structure captures direct carriage, inducement of carriage, and possession as distinct bases for liability.

Differential penalties by role. The penalty regime distinguishes persons connected with licensed operations from other individuals. If the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence, the fine is $5,000; for others, it is $2,000 (reg 7(1)-(2)). The text thereby places a higher monetary cost on regulated commercial actors who commit the same conduct in respect of the restricted area.

Notice obligation. Regulation 6 obliges the Director of Liquor Licensing to take all reasonable steps to post, and keep posted while the area remains restricted, a notice at each place where a customary access route enters the community. The notice must describe the offences in regulation 7 and specify the penalties (reg 6(1)). The regulation also states that failure to comply with posting obligations does not invalidate the declaration in regulation 5 (reg 6(2)).

Expanded seizure and disposal. Regulation 8 authorises members of the Police Force to seize and, as soon as practicable, dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7, expressly stating that this power operates despite sections 155(4) and (5) of the Act (reg 8). The regulation therefore permits prompt disposal upon seizure where reasonable grounds exist.

Temporal limit. Regulation 9 sets the regulations to expire at the close of 28 June 2027 unless earlier repealed, and the compilation notes show multiple statutory instrument renewals and amendments up to 2024 (reg 9 and compilation table).

Taken together, these concepts create a geographically delimited prohibition backed by criminal sanction, administrative notice duties, and a police power to remove and destroy suspected liquor containers promptly, with an explicit sunset to the instrument.

Individuals entering or present in the Bayulu Aboriginal Community are directly affected because reg 7 makes it an offence to bring liquor into, cause liquor to be brought into, or possess liquor in the area (reg 7(1)). That creates a compliance obligation on members of the public who might otherwise carry or possess alcohol while entering or moving through the lands defined in reg 3.

Licensees, managers of licensed premises, and corporate directors who hold a licence are a distinct group the regulations treat as paying a higher penalty. Where one of those persons commits an offence under reg 7(1), the fine is $5,000 rather than $2,000 (reg 7(2)). That differential exposes commercially licensed actors to greater monetary risk for the same prohibited conduct within the restricted area.

The Director of Liquor Licensing is the decision-maker with an express administrative duty under reg 6 to cause notices to be posted at each place where a customary access route enters the Bayulu Aboriginal Community and to keep them posted while the restriction continues (reg 6(1)). This places an operational obligation on that office for communication and ongoing maintenance of signage.

Members of the Police Force are directly empowered to act under reg 8: they may seize and dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under reg 7 (reg 8). Police therefore bear enforcement responsibilities and discretionary authority to determine reasonable grounds and to dispose of seized containers as soon as practicable.

Owners of liquor containers intercepted in the area are affected because the regulations authorise disposal of those containers by police once seized, and the text does not state any process for compensation or retention pending court proceedings (reg 8). The regulations do not specify any administrative remedy or return process for seized containers.

Local businesses and service providers that operate on Crown Reserve 35197 or adjacent land may be indirectly affected. The regulations do not permit liquor possession within the area, so businesses that previously might have transported, stored or consumed liquor on those lots will need to alter conduct to avoid offences under reg 7. The regulations treat the conduct of bringing in and possession as separate offences, so both transportors (including suppliers) and recipients (including consumers) face direct exposure.

Regulatory time horizon affects all of the above. The regulations run until 28 June 2027 unless sooner repealed (reg 9), so affected parties must plan compliance, enforcement and business decisions with that end date in mind.

Duties imposed by the regulations are specific and narrow. The principal duties are:

• For all persons: do not bring liquor into, cause liquor to be brought into, or possess liquor in the Bayulu Aboriginal Community, otherwise risk prosecution and fines under reg 7(1)-(2).

• For licensees, managers and corporate directors: avoid the prohibited conduct or incur the higher fine ($5,000) specified in reg 7(2).

• For the Director of Liquor Licensing: take all reasonable steps to cause notices to be posted, and to be kept posted, at each access point where a customary access route enters the community; notices must describe the offences in reg 7 and specify penalties (reg 6(1)). The Director’s duty is framed as taking "all reasonable steps" to post and keep posted the notices, indicating an obligation to act but limited to reasonable efforts (reg 6(1)).

• For Police: exercise powers under reg 8 to seize and, as soon as is practicable, dispose of opened or unopened containers of liquor suspected on reasonable grounds to be subject to an offence under reg 7 (reg 8). The regulation creates an operational duty to act on reasonable suspicion and authorises disposal promptly.

Rights and constraints embedded in the instrument include:

• The declaration’s legal effect is not conditional on perfect public notice. Regulation 6(2) expressly provides that a failure to post the notices required by reg 6(1) does not invalidate the declaration in reg 5. Thus persons cannot rely on lack of signage to challenge the existence of the restricted area as declared (reg 6(2)).

• The regulations set criminal penalties as fines rather than imprisonment or other penalties. The text specifies monetary fines of $5,000 or $2,000 for offences under reg 7 (reg 7(1)-(2)). The instrument therefore confines statutory sanctions to pecuniary penalties as written.

• Police may dispose of seized containers "as soon as is practicable" when they are suspected on reasonable grounds to be subject to an offence under reg 7, operating "despite" ss 155(4) and (5) of the Act (reg 8). The regulations therefore grant police an express right to dispose of seized liquor containers promptly; the regulations are silent about return procedures, interim custody or compensation.

• The regulations have a built-in temporal limit: they cease to have effect at the close of 28 June 2027 unless earlier repealed (reg 9). That creates a right of temporal expiry rather than indefinite restriction (reg 9).

Practical implications of these duties and rights include allocation of enforcement discretion to police, an administrative posting duty for the Director of Liquor Licensing, and a higher pecuniary exposure for persons associated with licensed premises. The duties are spatially bounded by the definition in reg 3, and the legal effect of the declaration is designed to remain irrespective of any shortfalls in notice posting (reg 3; reg 5; reg 6(2)).

The penalties created by these regulations are monetary fines and the enforcement apparatus combines administrative notice requirements with police seizure and disposal powers.

Penalties. Regulation 7 prescribes two monetary fines for offences under the regulation. Subregulation 7(1) establishes the offence: bringing liquor into, causing liquor to be brought into, or having liquor in possession in the Bayulu Aboriginal Community. The penalty in 7(1) is followed by subregulation 7(2), which applies an elevated fine of $5,000 where the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence; in other cases the fine is $2,000 (reg 7(1)-(2)). The instrument therefore sets pecuniary sanctions as its exclusive stated penalty.

Enforcement powers. Regulation 8 authorises members of the Police Force to seize and to dispose of seized liquor containers where those containers are suspected, on reasonable grounds, to be the subject of an offence under regulation 7. The disposal is authorised to occur "as soon as is practicable" after seizure. Crucially, reg 8 states this power operates "despite section 155(4) and (5) of the Act" (reg 8). The text therefore narrows the practical constraints on police disposal that might otherwise apply under the Act, and explicitly permits prompt disposal after seizure upon reasonable suspicion.

Administrative notification. Regulation 6 imposes obligations on the Director of Liquor Licensing to post and keep posted notices at each place where a customary access route enters the community, describing the offences and specifying penalties (reg 6(1)). The notice requirement is an enforcement adjunct: it communicates the criminal prohibitions and penalties to persons approaching the restricted area. Regulation 6(2) curtails a defence based on non-notification, by providing that a failure to post the notices does not invalidate the restriction (reg 6(2)). Practically that increases the legal enforceability of the ban even where signage is incomplete.

Standards and evidentiary thresholds. Two standards appear in the enforcement provisions. For seizure and disposal, the standard is "suspected on reasonable grounds" to be the subject of an offence under reg 7 (reg 8). For the Director’s posting duty, the obligation is to take "all reasonable steps" to cause and keep notices posted (reg 6(1)). Both phrases invoke reasonableness as the controlling standard for police action and administrative effort respectively. The regulations do not define those standards further.

What the regulations do not state. The text prescribes fines but does not provide procedural detail in relation to prosecution, contested seizure, return of property, or compensation for disposal. Nor does the instrument create non‑monetary sanctions or special civil orders. It also does not specify a process to challenge the "customary access route" designation or the location of notices. The absence of that procedural detail places reliance on general criminal and administrative process to be invoked in enforcement and contestation.

Who pays and who decides. Monetary penalties are paid by offenders subject to prosecution and conviction under reg 7. Police decide, operationally, whether there are reasonable grounds for seizure and whether disposal is "as soon as is practicable" (reg 8). The Director of Liquor Licensing decides on placement and maintenance of notices subject to taking "all reasonable steps" (reg 6(1)). Thus, enforcement designates ordinary criminal process for penalty imposition and delegated administrative and police discretion for notice and seizure functions.

The regulations are framed as instruments under the Liquor Control Act 1988 and operate by invoking particular sections of that Act. Regulation 5 declares the Bayulu Aboriginal Community a restricted area for the purposes of section 175(1a) of the Act (reg 5). The instrument also expressly operates "despite section 155(4) and (5) of the Act" in relation to police seizure and disposal powers (reg 8). Those two cross‑references are the only explicit inter‑statutory connections contained in the regulations.

Scope of interaction with the Act. The declaration under reg 5 relies on s 175(1a) of the Act as the enabling provision for restricted area declarations, although the regulations do not recite or reproduce the text of s 175(1a). The spatial prohibition and criminal offences in reg 7 are therefore enacted as subordinate instrument powers flowing from the Act’s restricted area machinery. The regulations, being subordinate legislation under the Act, sit within the Act’s overall regulatory architecture.

Override of specific Act subsections. Regulation 8 specifies that the seizure and disposal power operates despite ss 155(4) and (5) of the Act. The regulations therefore adjust the application of the Act’s seizure/disposal regime within the defined restricted area, permitting police to dispose promptly of seized containers when reasonable grounds exist. The regulations do not, however, attempt to override other provisions of the Act or to define the content of ss 155(4) and (5).

Silences and delegated detail. The regulations do not define "liquor", "customary access route" or other key terms within their text. The absence of a definition for "liquor" in the regulations suggests reliance on the Act or general statutory definitions elsewhere, but the regulations themselves do not reproduce or restate any such definitions. Similarly, "customary access route" is used but not defined in the instrument; the duty to post notices at each customary access route entry therefore depends on an operational interpretation of that phrase by the Director in practice (reg 6(1)).

Procedural and criminal law interaction. The regulations create offences with pecuniary penalties and therefore interact with the general criminal procedural framework for the prosecution of regulatory offences in Western Australia. The instrument itself does not set out prosecutorial procedure, evidentiary rules, or appeal mechanisms. Enforcement action (seizure, disposal, prosecution, imposition of fines) will operate within the broader suite of criminal and administrative law processes applicable under Western Australian law.

Temporal interaction. The regulations expressly provide that they have effect until 28 June 2027 unless sooner repealed (reg 9). The compilation table records subsequent amendment instruments across 2013-2024, showing administrative and technical modifications over time. Any interaction with the Act will therefore be bounded by the temporal duration specified in the regulations.

In sum, the instrument operates as a focused subordinate law under the Liquor Control Act 1988, invoking the Act’s restricted area machinery and modifying the seizure/disposal application of two subsections of the Act while leaving broader procedural regimes and definitions to the Act and general law.

The regulations have been subject to multiple amendments and periodic renewals since their original enactment in 2013. The compilation table appended to the instrument records the sequence of instruments that created and amended the regulations. The key historic entries in the compilation table are:

• Liquor Control (Bayulu Restricted Area) Regulations 2013: originally published 28 June 2013; regs 1 and 2 commenced on 28 June 2013 and the remainder on 29 June 2013 (compilation table).

Specific text changes recorded in the instrument include:

• Regulation 3 was amended, as indicated by the marginal note "[Regulation 3 amended: SL 2023/26 r. 4.]" following the definition of the Bayulu Aboriginal Community. The amended regulation supplies the formal land description used in the current instrument (reg 3).

• Regulation 4 was deleted, as noted by the marginal annotation "[4. Deleted: SL 2022/63 r. 4.]" The original regulation 4 no longer appears in the consolidated text provided.

• Regulation 9 has a bracketed note indicating multiple amendments across several Gazette notices and statutory instruments: Gazette 29 Nov 2013 p. 5466; 27 May 2016 p. 1549; 28 Oct 2016 p. 4917; 11 Jun 2019 p. 1862; 29 Nov 2019 p. 4108; SL 2022/63 r. 5; SL 2023/26 r. 5; SL 2024/109 r. 4; SL 2024/273 r. 4. Those entries show that the expiry date and possibly period of effect have been actively maintained by subsequent instruments (reg 9; compilation table).

• The compilation table records the dates of publication and commencement for each amending instrument. For example, the SL 2023/26 amending instrument is recorded as published 6 April 2023 and commenced on 7 April 2023 for its operative provisions (compilation table).

The compilation notes and other notes reiterate that these regulations expire at the close of 28 June 2027 unless earlier repealed (Other notes 1 and reg 9). The presence of numerous amendment instruments, including ones titled under broader "Racing and Gaming Regulations Amendment (Liquor Control) Regulations", indicates that this restricted area instrument has been periodically updated or rolled forward within the broader administrative machinery governing liquor regulations.

The instrument’s amendment history, as recorded, is limited to the statutory instruments and Gazette entries listed in the compilation table and the marginal annotations. The consolidated text reflects the current position after those amendments, including the deletion of reg 4 and the updated reg 3 land description.

The provided instrument contains no record of judicial decisions, appeals, or cases that have interpreted or challenged these regulations. The compilation table and other notes list the statutory instruments, Gazette entries and amendments up to 2024 but do not include any notation of litigation. The regulations themselves do not cite any case law.

Accordingly, within the text supplied there is no litigation history to summarise. There are no recorded court judgments, injunctions, interlocutory rulings, or administrative tribunal decisions referenced in this document. The document therefore presents the statutory terms and the administrative amendment record but contains no primary or secondary material on judicial application or contestation of the regulations.

If users require information on whether these regulations have been the subject of court proceedings, judicial review, or evidence-led prosecutions under reg 7, that information is not contained in this instrument and would need to be sourced from court records, legal databases, or from prosecuting authorities. The instrument does not set out any procedural outcomes or case examples.

Several practical and legal points in the text are likely to create ambiguity, compliance traps or enforcement leverage for authorities. These are identified directly from the regulations.

Signage does not affect validity. Regulation 6(2) provides that a failure to comply with the Director’s duty to post notices under reg 6(1) does not invalidate the declaration made in reg 5. Practically, a person who is unaware of the restriction because notices are absent cannot rely on lack of notice to render the restriction invalid (reg 6(2)). That increases the risk that individuals will be prosecuted even if signage is incomplete.

"Customary access route" is undefined. The obligation in reg 6(1) is to post notices at each place where a customary access route enters the Bayulu Aboriginal Community. The regulations do not define "customary access route" or provide standards for identifying such places (reg 6(1)). This creates administrative uncertainty about where notices must be posted and leaves considerable scope for the Director’s operational judgment. Affected parties or the Director may have differing views on what constitutes a customary access route.

Broad scope of the offence. Regulation 7 makes it an offence to "bring liquor into, or cause liquor to be brought into, the Bayulu Aboriginal Community" and to "have liquor in his or her possession in the Bayulu Aboriginal Community" (reg 7(1)). The "cause to be brought" limb can capture secondary conduct, such as instructing, contracting, or arranging carriers to deliver liquor into the area. The possession limb applies to anyone found with liquor in the area. The threefold framing widens potential liability beyond mere carriage.

Differential penalties for commercial actors. Liability for licensees, managers and corporate directors attracts a higher fine of $5,000 compared to $2,000 for others (reg 7(2)). Entities associated with licensed premises therefore carry a materially higher financial exposure. There is no textual mitigation mechanism or discretion identified in the regulations to reduce those amounts.

Seizure and disposal with limited procedural detail. Regulation 8 authorises police to seize and "as soon as is practicable, dispose" of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under reg 7 (reg 8). The regulation does not state whether disposal requires recording of reasons, a return procedure if prosecutions are unsuccessful, or compensation for wrongful disposals. It also authorises disposal despite specific subsections of the Act (reg 8), although the regulations do not quote or reproduce those subsections. This absence of procedural safeguards in the instrument itself may complicate post-seizure disputes.

Temporal nature and renewals. The regulations expire at the close of 28 June 2027 (reg 9). The compilation table records repeated amendments and renewals. Parties should not assume permanency; the policy instrument has a fixed statutory horizon and must be monitored for extension, amendment or repeal (reg 9; compilation table).

Definition absences. The regulations use the term "liquor" without defining it in the text provided. Practitioners will need to identify which legal definition of liquor applies, presumably from the Act or general law, because the regulation does not supply that definitional detail directly.

Operational burden on the Director. The Director of Liquor Licensing must take "all reasonable steps" to post notices at each customary access entry and to keep them posted while the area remains restricted (reg 6(1)). The parameters of "all reasonable steps" are not specified and will affect resource allocation, record keeping and the Director’s administrative protocols.

Potential evidentiary issues. The "reasonable grounds" standard for seizure in reg 8 places evidentiary burden on police to show a reasonable basis for seizure and disposal. The regulation does not set out how that must be recorded or proved, which may create contested factual inquiries in any subsequent prosecution or civil challenge (reg 8).

In sum, the main practical "gotchas" flow from undefined terms, higher fines for regulated persons, the non‑dependence of the declaration on posted notices, and an authorisation for prompt disposal of seized liquor without a return or compensation mechanism specified in the instrument.

Compliance means avoiding the conduct criminalised by regulation 7, ensuring administrative duties are met where they fall to an entity named in the regulations, and preparing to interact with police powers under regulation 8.

For individuals (visitors, residents, visitors to the community):

• Do not bring any liquor into, cause liquor to be brought into, or have liquor in your possession within the Bayulu Aboriginal Community as defined in reg 3. The prohibition is spatial; check the legal description in reg 3 (reg 7(1); reg 3).
• Observe posted notices where they exist. The Director is required to post notices at each place where a customary access route enters the community, describing the offences and specifying penalties (reg 6(1)). Lack of notice does not invalidate the restriction (reg 6(2)), so absence of signage is not a reliable defence.
• If you must go into or through the area, remove or dispose of liquor outside the defined lots to avoid possession offences.
• Be aware that police may seize and dispose of suspected containers on reasonable grounds (reg 8). Comply respectfully with lawful directions and seek legal advice if seizure occurs.

For licensees, managers of licensed premises, and corporate directors:

• Treat the prohibition as a strict compliance matter. The fine for persons in these categories is $5,000 under reg 7(2). Implement internal policies prohibiting staff from delivering, carrying or otherwise causing liquor to be brought into the Bayulu Aboriginal Community.
• Update licensing compliance manuals, staff training and delivery contracts to ensure no supply chains or third parties cause liquor to enter the defined land.
• Maintain records of instructions given to staff and contractors to demonstrate proactive compliance measures in case of enforcement action.
• Liaise with the Director of Liquor Licensing or seek administrative guidance if activities near the restricted area raise compliance queries.

For the Director of Liquor Licensing:

• Take all reasonable steps to cause notices required by reg 6(1) to be posted at each place where a customary access route enters the Bayulu Aboriginal Community and to keep those notices posted while the restriction continues. Document the steps taken as evidence of compliance with the "all reasonable steps" obligation (reg 6(1)).
• Establish a process to identify and monitor "customary access routes" for the purpose of placing and maintaining notices, including site surveys, consultation with local stakeholders, and scheduled inspections.
• Keep records of posting dates, locations, photographic evidence and maintenance activities to mitigate disputes that might arise even though reg 6(2) preserves the declaration despite posting failures.

For police and enforcement agencies:

• Exercise seizure powers under reg 8 only when there are reasonable grounds to suspect that an opened or unopened container of liquor is the subject of an offence under reg 7. Record the factual basis for those reasonable grounds contemporaneously to support later judicial scrutiny if necessary (reg 8).
• When disposing of seized containers "as soon as is practicable", document the timeline, the reasons for disposal, and any attempts to preserve evidence if needed for prosecution (reg 8). The regulation authorises prompt disposal but does not prescribe the documentary record, so good administrative practice mitigates legal risk.

For landowners, businesses and local service providers adjacent to or within the defined lots:

• Confirm whether any business operations involve liquor carriage, storage or consumption on Crown Reserve 35197 or the listed lots. Where such activities implicate reg 7, cease or relocate those activities to avoid offences (reg 3; reg 7).
• Update supply contracts and delivery instructions to ensure carriers do not deliver into the restricted area and to avoid being captured by the "cause to be brought" limb in reg 7.

Record-keeping and evidence:

• Across all actors, maintain contemporaneous records to evidence compliance measures, signage maintenance and the factual basis for any enforcement steps taken or complied with. Record-keeping will be the primary mechanism to defend against allegations of non-compliance or to challenge the factual foundation for seizure.

Monitoring and temporal planning:

• Note that the regulations operate until the close of 28 June 2027 unless earlier repealed (reg 9). Monitor statutory instruments and gazette updates listed in the compilation table for any amendment, extension or repeal that would affect compliance obligations and enforcement timing.

Legal advice and dispute pathways:

• If prosecuted under reg 7, or if seizure and disposal occur under reg 8, obtain legal advice promptly. The regulations provide the offence definitions and penalty amounts but do not set out procedural processes for challenging seizures, return of property or contesting convictions. Legal advice will be necessary to navigate those broader procedural avenues.

These compliance steps derive directly from the operative text: the offence framing and penalties in reg 7, the posting duty in reg 6, the seizure and disposal authorisation in reg 8, the land definition in reg 3, and the temporal expiry in reg 9.
