Liquor Commission Act 2018

This Act is short and focused; a number of core statutory concepts structure its operation.

• Commission as a corporate body. The Commission is a body corporate with perpetual succession and a common seal; it may acquire and dispose of property and sue or be sued in its corporate name (s 5(1)-(2)). The Act requires courts and judicial officers to take judicial notice of the common seal and to presume it was duly affixed (s 5(3)). The Act also declares that the Commission is an emanation of the Crown in the right of the Territory (s 5(4)). Those provisions place the Commission within the public law architecture of the Territory for issues of legal personality, service, and contractual capacity.

• Functions and scope. The Commission has the functions imposed by this Act and by the Liquor Act 2019 and must do anything necessary or convenient to perform those functions (s 6(1), (3)). More specifically, the Commission must make decisions on matters referred to it under the Liquor Act 2019 (s 6(2)). In practice, the Commission is therefore the statutory decision-maker for many licensing, disciplinary and administrative matters arising under the Liquor Act 2019.

• Membership, appointments and qualifications. The Minister appoints members by Gazette notice (s 7(1)). The Commission consists of not less than four members, though the Minister decides the precise number (s 7(2)). A person is qualified for appointment if the Minister is satisfied of appropriate knowledge, experience and expertise (s 7(3)). There are express disqualifications, including holding an interest in a club or an entity that holds a liquor or gaming machine licence, recent disqualification from holding a liquor licence, and certain bankruptcy-related conditions (s 7(4)(a)-(c)). At least one member must have health-related qualifications or equivalent clinical experience and be of good standing (s 7(5)-(6)). The Chair and Deputy Chair must be lawyers admitted for at least five years and of good standing (s 8(2)).

• Panel constitution and hearing procedure. For dealing with a matter, the Commission must be constituted by a presiding member (Chair or Deputy Chair) and at least two other members, at least one of whom must have health expertise (s 17(a)-(b)). Quorum is three members (s 19). Panels may sit concurrently on different matters (s 18). Questions are decided by majority, and the presiding member may determine a question if there is an equal split (s 20(1)). The Commission must keep records of proceedings and may determine its own procedures, subject to the Liquor Act 2019 when relevant (s 20(2)-(3)).

• Disclosure and conflicts of interest. Members who have a direct or indirect pecuniary interest in a matter must disclose that interest promptly, and thereafter must not take part in deliberation or decision-making on the matter and must be disregarded for quorum purposes (s 21(1)-(3)). The Commission must publish guidelines specifying the types of interests to disclose (s 21(4)). Failure to disclose is a ground for termination of appointment (s 14(1)(d)).

• Evidence-gathering and coercive processes. The Commission can issue summonses to require persons to appear and give evidence or produce evidentiary material, either on application by a party or on its own initiative (s 22). Failure to comply is a criminal offence with specified maximum penalties and some strict liability elements (s 23). Documents produced may be inspected and copied by the Commission and originals returned after the hearing (s 24).

• Contempt and conduct offences. The Act defines contempt of the Commission and criminalises intentional conduct constituting contempt where the person is reckless as to that result (s 25). Section 26 specifies conduct that constitutes contempt, including refusal to take an oath, refusal to answer questions, contravention of Commission orders, breach of undertakings, insulting or obstructing members, and behaviour equivalent to contempt in face of the court (s 26(1)-(5)). The Commission may order a person engaging in contempt to leave and proceed in the person’s absence (s 27).

• Review of Director's decisions. Part 4 gives most affected persons a statutory right to apply to the Commission to review decisions of the Director under the Liquor Act 2019, subject to limited exceptions (s 29(1)-(5)). The Commission reviews decision-making, must follow rules of natural justice and is empowered to confirm, vary or set aside and substitute decisions (s 31-32). Applications must be in a prescribed form, accompanied by a prescribed fee, and lodged within 28 days unless the Commission allows a later date (s 29(3)-(4)).

• Offences tied to administration. The Act creates offences for unauthorised disclosure of confidential information obtained in administering the Act (s 35) and for intentionally giving misleading information or documents to the Commission (s 36). The Act applies Part IIAA of the Criminal Code to offences under the Act (s 4).

• Administrative framework. The Commission may delegate powers to the Chair, members, the Director, or public sector employees (s 37). It must produce an annual report to the Minister (s 38). Members and persons acting in good faith are afforded protection from civil or criminal liability for acts or omissions done in good faith in the exercise of Commission functions, with certain savings for the Territory or the Commission’s own liability (s 39). The Administrator may make regulations (s 40).

These concepts combine to create a specialist statutory adjudicative body with evidentiary and enforcement tools, formal appointment and qualification checks, and a statutory channel for review of administrative decisions taken under the broader Liquor Act 2019 framework.

The Act creates legal effects for a range of actors in the Northern Territory liquor regulatory system; the text identifies particular classes of affected persons and the likely behavioural impacts.

• The Minister. The Minister appoints the Commission’s members by Gazette notice (s 7(1)), determines the number of members (subject to a minimum of four) (s 7(2)), and appoints the Chair and Deputy Chair (s 8(1)). The Minister may grant leave to members (s 12) and may terminate appointments on enumerated grounds (s 14). Appointment power concentrates selection and oversight authority with the executive branch.

• Commission members, Chair and Deputy Chair. Members are directly affected by the Act’s qualification and disqualification criteria (s 7(3)-(4)). The Chair and Deputy Chair have additional administrative responsibilities, with the Chair administering the Commission’s affairs and performing functions imposed on the Chair (s 9(1)-(2)). Appointment and removal conditions, duties to disclose interests (s 21) and liability protections (s 39) shape member behaviour and risk assessment.

• The Director under the Liquor Act 2019. The Act repeatedly cross-references the Director (definition in s 3; review of Director decisions in Part 4). Decisions made by the Director under the Liquor Act 2019 are generally reviewable by the Commission (s 29(1)), and the Commission may confirm, vary or substitute decisions after review (s 32(2)). The Commission may also accept delegations from the Director under s 37(1)(b). The interaction places the Director’s decisions within a two-tier administrative framework.

• Applicants, licensees and persons affected by liquor regulation. Section 29(2) enumerates who may apply for review of a Director’s decision: the applicant affected by an application, any person affected by disciplinary action, licensees, persons who made submissions, complaints or objections, and others granted rights under the Liquor Act 2019 (s 29(2)(a)-(e)). Those persons must comply with form, fee and time limits for review applications (s 29(3)-(4)). The Act therefore directly affects businesses and individuals regulated by liquor licensing and disciplinary regimes under the Liquor Act 2019.

• Witnesses and third parties who may be summoned. The Commission has power to issue summonses to require attendance and production of documents (s 22). Persons served with summonses are criminally liable for intentional failure to attend or produce documents, with maximum penalties specified (s 23(1)-(2)). Subsection (3) applies strict liability to the service component of the offence elements (s 23(3)); that influences the evidentiary posture in prosecutions.

• Public sector employees and the Director as delegates. The Commission may delegate its powers to the Chair, another member, the Director, or a public sector employee (s 37(1)). This affects internal public administration, as delegation reallocates operational decision-making and resource responsibilities.

• Health professionals and those with health expertise. The Act requires at least one Commission member to have health-related qualifications or equivalent clinical experience (s 7(5)-(6)). The Commission further must include at least one health-expert on any constituted panel (s 17(b)). This affects the pool of potential appointees and privileges health expertise in deliberations on matters referred from the Liquor Act 2019.

• Legal practitioners. The Chair and Deputy Chair must be lawyers with at least five years admission (s 8(2)). Similarly, deputies to the Chair or Deputy Chair must satisfy the same legal qualification requirement (s 10(2)). The requirement shapes recruitment and ongoing legal involvement in the Commission’s operations.

• Persons who may be the subject of confidentiality. The Act criminalises unauthorised disclosure of confidential information obtained in administering the Act if done intentionally and recklessly (s 35(1)), applying strict liability to the element that the person obtained the information in the course of performing connected functions (s 35(2)). This affects staff, members, and anyone with access to Commission records; it also creates exceptions where disclosure is for the administration of the Act or with consent, or where information is publicly available (s 35(3)).

• The broader public and stakeholders who engage in submissions or objections under the Liquor Act 2019. Those who make submissions may obtain review rights under s 29(2)(d), and the Commission’s obligation to give reasons after a review (s 33(2)(a)) affects the public record and transparency for stakeholders.

Behavioural changes the Act incentivises include increased use of the Commission review route for challenging Director decisions (subject to fee and form), caution among witnesses and staff about compliance with summonses and confidentiality obligations, and structuring of legal and health inputs around panel composition requirements.

Who pays: costs are borne by applicants for review via prescribed fees (s 29(4)(b)) and by the public sector for establishment, convening and staffing of the Commission. Criminal penalties and potential imprisonment shift financial and liberty risks to non-compliant individuals or entities.

Who decides: the Minister makes appointments and can remove members in specified circumstances (s 7, s 14); the Commission decides on substantive matters referred under the Liquor Act 2019 (s 6(2)); the Commission decides review applications and may stay Director decisions (s 30); the Commission determines its procedures subject to statutory constraints (s 20(3), s 32(1)(b)). The Act therefore fragments decision authority between the Minister, the Director and the Commission whilst embedding review as a statutory control.

This section sets out the principal statutory duties the Act imposes and the rights it confers, with section references to the text.

Duties and obligations

• Duty to convene and keep records. The Commission must convene as often as necessary for performance of its functions, and the Chairperson must make arrangements to enable the Commission to convene (s 16(1), (3)). The Commission must keep records of its proceedings (s 20(2)).

• Duty of members to disclose interests. A member who has a direct or indirect pecuniary interest in a matter must disclose the nature of the interest promptly, to the Chairperson or to the Minister if the Chairperson is the member (s 21(1)-(2)). After disclosure, the member must not participate in deliberation or decision-making on the matter and must be disregarded for quorum purposes while the matter is considered (s 21(3)(a)-(b)). The Commission must publish guidelines specifying types of interests to be disclosed (s 21(4)).

• Duty to administer affairs and perform Chair functions. The Chairperson administers the affairs of the Commission and must perform functions imposed on the Chairperson under the Act or another Act, with power to do all things necessary or convenient for administration (s 9(1)-(2)).

• Duty to comply with summonses and orders. Persons served with a summons must attend and produce material as required (s 22). Failure to comply intentionally is an offence and carries specified penalties (s 23). Similarly, persons must comply with Commission orders; contravention may constitute contempt (s 26(2)).

• Duty of confidentiality. Persons who obtain confidential information in the course of performing functions connected with administering the Act have a duty not to disclose it intentionally and recklessly (s 35(1)). There are statutory exceptions for disclosures for administration purposes, with consent, for legal proceedings, or where information is public (s 35(3)).

• Duty not to mislead. Persons intentionally supplying misleading information, or providing misleading documents without disclosing their misleading aspects and correcting them where reasonably possible, commit an offence with substantial penalties (s 36(1)-(3)).

Rights and discretionary powers

• Right to be appointed under qualification criteria. Applicants satisfying the Minister’s satisfaction test on appropriate knowledge, experience and expertise are eligible for appointment as members (s 7(3)). However disqualifications apply (s 7(4)).

• Right to be reappointed and tenure protections. Members are appointed for terms not exceeding five years and are eligible for reappointment; unless they vacate or are removed the member continues in office until a successor is appointed (s 11(1)-(2)).

• Rights around natural justice in reviews. In conducting a review of a Director’s decision, the Commission must comply with the rules of natural justice (s 32(1)(c)). After review, the Commission may confirm, vary or set aside and substitute a decision (s 32(2)).

• Right to apply for review of Director decisions. A range of persons affected by Director decisions may apply to the Commission for review: applicants to licensing processes, persons affected by disciplinary action, licensees, those who made submissions during the decision process, and others given review rights under the Liquor Act 2019 (s 29(2)). Applications must follow form, fee and timeframe rules (s 29(3)-(4)).

• Discretion to issue summonses and to order leave from sittings. The Commission can issue summonses on its own initiative or on application by a party (s 22) and may order a person who is engaging in contempt to leave and continue a proceeding in that person’s absence (s 27).

• Discretion to stay Director decisions on review. Application for review does not automatically stay operation of the Director’s decision (s 30(1)); however the Commission may stay the decision pending the review (s 30(2)).

• Delegation powers. The Commission may delegate its powers and functions under this Act or the Liquor Act 2019 to the Chairperson or another member, the Director, or a public sector employee (s 37(1)), and some delegations to the Chairperson or Director may be further delegated subject to limits (s 37(2)).

• Protection from liability for members acting in good faith. Members and persons acting in good faith in the exercise of Commission powers or functions are not civilly or criminally liable for acts or omissions done in good faith (s 39(1)-(2)), subject to savings for Territory or Commission liability (s 39(3)).

Procedural and administrative rights

• Right to be notified of decisions and reasons. After making a decision on review, the Commission must give written notice to the applicant and each person who has a right to apply for review or appeal under the Act under which the Director’s decision was made (s 33(1)). The notice must state the decision and reasons and details of any rights to further review or appeal under the underlying Act (s 33(2)(a)-(b)).

• Right to appeal or further review under other Acts. The Act contemplates that rights of review or appeal may exist under the legislation under which the Director’s decision was made, and requires notice to identify those rights (s 33(2)(b)). The Act’s Part 4 is expressly subject to other Acts (s 34).

Practical effect of duties and rights

• The duties to disclose conflicts and the termination ground for failure to disclose create a direct governance incentive for members to be proactive in making disclosures (s 21; s 14(1)(d)).

• The coercive powers to summon and the criminal offences for non-compliance create enforcement leverage but also impose exposure on third parties who might be compelled to produce material (s 22-23).

• The combination of prescribed form and fee for review applications (s 29(4)(a)-(b)) with the Commission’s power to reject frivolous or vexatious applications (s 31(2)) affects access to review and allocates administrative costs to applicants.

• The protection from liability for good faith acts (s 39) reduces litigation risk for members and staff, but does not remove exposure for the Commission or Territory as organisations (s 39(3)).

These duties and rights determine daily operational behaviour: members must manage conflicts and attend sittings; applicants and licensees must comply with form and fee requirements for review; witnesses must comply with summonses or risk criminal liability; staff and members must treat confidential material carefully to avoid a s 35 offence.

The Act creates several criminal offences and prescribes maximum penalties. It also establishes enforcement mechanisms available to the Commission to manage non-cooperative behaviour in hearings and proceedings.

Criminal offences and penalties

• Failure to comply with a summons. A person commits an offence if the person has been served with a summons to appear as a witness and intentionally fails to attend or intentionally fails to appear as required (s 23(1)). The maximum penalty is 100 penalty units or imprisonment for six months (s 23(1) penalty). The Act also criminalises intentional failure to comply with a summons to produce documents or evidentiary material with the same maximum penalty (s 23(2)). Strict liability applies to the elements that the person has been served with a summons to appear or to produce (s 23(3)), meaning that for those elements the prosecution need not prove mens rea.

• Contempt of the Commission. Section 25 creates an offence where a person intentionally engages in conduct that constitutes contempt of the Commission and is reckless in relation to that result. The maximum penalty is 100 penalty units or imprisonment for six months (s 25(1)). A reasonable excuse is a defence (s 25(2)). Section 26 sets out conduct that constitutes contempt, including refusing to take an oath, refusing to answer questions, failing to produce documents, contravening Commission orders or undertakings, insulting or intimidating members, obstructing proceedings or creating disturbances (s 26(1)-(5)). If a person is engaging in contempt, the Commission may order the person to leave and continue in the person’s absence (s 27).

• Unauthorised disclosure of confidential information. A person who obtains confidential information in the course of performing functions connected with the administration of the Act and intentionally engages in conduct that results in disclosure, being reckless about that result, commits an offence. The maximum penalty is 200 penalty units or imprisonment for two years (s 35(1)). Strict liability applies to the element that the person obtained the information in the course of performing the connected functions (s 35(2)). There are statutory exceptions for disclosures for administration, with consent, for legal proceedings, or where information is already public (s 35(3)).

• Misleading information. A person intentionally giving misleading information to the Commission, or supplying a document or evidentiary material that contains misleading information knowing it to be misleading, commits an offence. The maximum penalty is 400 penalty units or imprisonment for two years for each offence provision (s 36(1)-(2)). Section 36(3) provides a defence in relation to documents if the person draws the misleading aspect to the Commission’s attention and, to the extent reasonably possible, provides information to remedy it.

Application of Criminal Code provisions

• Part IIAA of the Criminal Code applies to offences under this Act (s 4). That brings general principles of criminal responsibility, defences, and burden of proof into play for prosecutions under the Act, subject to the Act’s express strict liability allocations.

Enforcement tools and procedural controls

• Summonses, inspection and copy powers. The Commission may issue summonses requiring attendance and production of evidentiary material (s 22). Documents produced at a hearing may be inspected and copied by the Commission; originals must be returned as soon as practicable after the hearing (s 24(1)-(2)).

• Contempt powers and immediate control measures. The Commission may treat certain behaviour as contempt (s 25-26) and may order a person engaging in contempt to leave (s 27). This gives the Commission immediate, on-the-spot authority to control hearings without immediate recourse to external court orders.

• Stay powers during review. Applying for review of a Director’s decision does not stay the decision by operation of law (s 30(1)); however, the Commission may stay the Director’s decision pending the review (s 30(2)). That is an important operational tool balancing finality and the risk of irreparable harm pending review.

Practical enforcement implications and evidentiary posture

• Strict liability elements. The Act applies strict liability to certain elements: s 23(3) applies strict liability to whether the person has been served with a summons (subsections (1)(a) and (2)(a)), and s 35(2) applies strict liability to whether the person obtained the information in the course of performing connected functions. Prosecutors therefore do not need to prove fault on those particular elements, which lowers the evidentiary burden for certain offences and increases the risk of conviction where other elements can be proved.

• Heightened penalties for misleading information. The maximum penalties for providing misleading information or documents are the highest in the Act (400 penalty units or imprisonment for two years) (s 36(1)-(2)). This creates a strong legal disincentive to supply inaccurate material and encourages disclosure of known inaccuracies under the legislative safe harbour in s 36(3).

• Criminal defences and natural justice. Reasonable excuse is a statutory defence for contempt offences (s 25(2)). The Commission must observe natural justice in reviews (s 32(1)(c)). These provisions preserve procedural fairness and some legal protections for respondents while providing coercive enforcement options.

• Delegation and administrative enforcement. Delegation to the Director or public sector employees (s 37) permits the Commission to distribute enforcement tasks internally, but also transfers compliance and liability management to those delegates within the bounds of delegated authority.

• Liability protection for members acting in good faith. Section 39 shields persons from civil or criminal liability for acts done in good faith in the exercise of Commission powers, which may reduce defensive behaviour by members during enforcement actions.

Overall, the Act combines administrative coercive powers with criminal sanctions and strict liability elements to strengthen the Commission’s ability to obtain evidence and enforce orders, while preserving natural justice requirements in review processes. These enforcement mechanisms create compliance costs and criminal exposure for individuals and regulated entities that must be managed through legal and operational controls.

The Act is designed to operate as part of a broader statutory framework. Its most important statutory interaction is with the Liquor Act 2019, but there are other cross-references and hierarchical constraints.

Primary interaction with the Liquor Act 2019

• The Director. The Act defines Director by reference to section 4(1) of the Liquor Act 2019 (s 3). The Commission’s core function is to make decisions on matters referred to it under the Liquor Act 2019 (s 6(2)). Consequently, the Liquor Act 2019 is the primary substantive law that determines the subject matter of many Commission decisions, including licensing, disciplinary, and enforcement matters.

• Reviews of Director’s decisions. Part 4 of the Liquor Commission Act provides that most decisions of the Director are reviewable by the Commission, except a decision under s 161(2) of the Liquor Act 2019 and certain delegate decisions reviewable by the Director (s 29(1)). The Commission must take into account matters the Act under which the Director’s decision was made requires the Director to take into account (s 32(1)(a)). After review, the Commission can confirm, vary or set aside and substitute decisions (s 32(2)). Notices after review must include details of any rights to further review or appeal under the underlying Act (s 33(2)(b)). In short, the Commission functions within the decision-making architecture established by the Liquor Act 2019 and is expressly constrained to respect the substantive statutory criteria of that Act.

• Procedural provisions in the Liquor Act 2019. The Commission’s procedures are “as the Commission determines, subject to any provisions of the Liquor Act 2019 that apply when the Commission is dealing with a matter under that Act” (s 20(3)). That means the Liquor Act 2019’s procedural mandates take precedence where they apply.

Criminal Code application

• Part IIAA of the Criminal Code applies to offences against this Act (s 4). This imports general principles of criminal responsibility, available defences and burden of proof rules. Where the Liquor Commission Act specifies strict liability for certain elements, those interact with Criminal Code principles to shape prosecutorial strategy.

Other Acts and overarching constraints

• Subject to other Acts. Section 34 explicitly states that Part 4 (review of Director’s decisions) is subject to any other Act. This recognises that other statutory regimes may carve out different or exclusive review or appeal rights; for example, other Acts might confer judicial review or appeal pathways that trump or coexist with the Commission’s review jurisdiction. Section 33(2)(b) obliges the Commission to provide details of rights under the Act under which the Director’s decision was made, indicating an expectation of multi‑instrument interaction.

• Accountability and public administration statutes. The Commission must report annually to the Minister and the Minister must table the report in the Legislative Assembly (s 38). That requirement interfaces with parliamentary oversight and public sector reporting regimes in the Territory.

• Delegation and employment law. The Commission may delegate powers to public sector employees (s 37(1)(c)). Delegation choices will intersect with public sector employment law, administrative law principles and the public sector’s governance and financial controls.

• Evidence and civil process. The Act requires courts and judicial officers to take judicial notice of the Commission’s common seal (s 5(3)), which is a technical interaction with court procedure around authentication and proof of statutory instruments. The Commission’s status as an emanation of the Crown (s 5(4)) may affect claims against the Commission in some civil contexts.

• Contempt and court comparators. Section 26(5)(c) and (d) imports conduct that would constitute contempt in the face of the court if the Commission were a court of record. This provisions allows the Commission to adopt contempt-like standards consistent with existing court practice, but subject to the Act’s specific rules and penalties.

Practical interaction consequences

• The Commission is functionally a specialised tribunal within the liquor regulatory framework and must apply the substantive criteria set out in the Liquor Act 2019 when dealing with matters under that Act (s 6(2); s 20(3); s 32(1)(a)). Practitioners should therefore read the Liquor Commission Act alongside the Liquor Act 2019 to understand applicable substantive tests, rights of appeal, and delegated authority.

• Where the Liquor Act 2019 or other Acts provide for appeal or review rights, those must be acknowledged and communicated to parties by the Commission in its decisions (s 33(2)(b)). The presence of other Acts potentially providing alternative routes means that the Commission’s review jurisdiction is not necessarily exclusive.

• Criminal enforcement under the Act is filtered through the Criminal Code. Prosecutors must consider the Act’s strict liability allocations alongside the Criminal Code provisions (s 4; s 23(3); s 35(2)). Defence counsel must similarly navigate those interactions.

• Delegation to the Director or to public sector employees (s 37) creates a chain of administrative responsibility that intersects with the Liquor Act 2019’s own delegation and procedural provisions, potentially complicating accountability in delegated decision-making.

In sum, the Liquor Commission Act 2018 does not operate in isolation. It is an institutional, procedural and enforcement companion to the Liquor Act 2019 and to the Criminal Code, and it defers to other Acts where they provide alternate or higher order directions, especially as to substantive criteria, appeal routes and procedural mandates.

The Act as supplied includes an endnotes section that records the Act’s legislative history and subsequent amendments up to the reprint date.

Key dates

• Assent and commencement. The Liquor Commission Act 2018 (Act No. 1, 2018) received assent on 16 February 2018 and commenced on 28 February 2018 (Gaz S14, 28 February 2018), as recorded in the endnotes (Endnotes 2).

• Interaction with Liquor Act 2019. The Liquor Act 2019 (Act No. 29, 2019) received assent on 3 September 2019 and commenced on 1 October 2019 (Gaz G39, 25 September 2019, p 2) (Endnotes 2). The Liquor Act 2019 made consequential amendments to the Liquor Commission Act 2018 as recorded in the list of amendments.

Noted amendments and formal changes

• General formal amendments. The Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) made general amendments of a formal nature to several sections (ss 3, 6, 10, 16, 20, 28 and 37), as recorded in the endnotes (Endnotes 3). These are described as formal rather than substantive changes.

• Specific amended sections. The endnotes provide a concise list of discrete amendments to the Liquor Commission Act 2018 effected by later Acts. The list identifies the following amendments:

  • Section 3 amended by No. 29, 2019, s 381.
  • Section 6 amended by No. 33, 2019, s 50.
  • Section 10 amended by No. 33, 2019, s 50.
  • Section 16 amended by No. 29, 2019, s 382.
  • Section 20 amended by No. 33, 2019, s 50.
  • Part 4 heading substituted by No. 29, 2019, s 383.
  • Section 28 repealed by No. 29, 2019, s 383.
  • Sections 29-34 substituted by No. 29, 2019, s 383.
  • Section 37 substituted by No. 29, 2019, s 384.

• Statute Law Revision and Repeals Act 2019. The Statute Law Revision and Repeals Act 2019 (Act No. 33, 2019) has amendments listed in the endnotes and is noted to have parts that were not commenced at the time of the reprint (Endnotes 2). Sections of the Liquor Commission Act 2018 were amended by that Act as indicated above.

What to read from the amendment list

• The Liquor Act 2019 is a significant subsequent instrument that revised provisions of the Liquor Commission Act 2018, including replacement of Part 4 dealing with review of Director’s decisions (ss 29-34), which indicates the Commission’s review function was reworked in light of the Liquor Act 2019’s broader framework (endnotes and the Act text, Part 4).

• The substitution of s 37 and amendments to s 6, s 10 and s 20 suggest the legislature clarified delegation and procedural arrangements following initial enactment.

• The endnotes confirm that some amendments are formal in nature and that other amendments were made by Acts that themselves commenced on various dates. Users should check the Gazette commencement entries (cited in the endnotes) and the reprint date to determine the operative text applicable to a particular point in time.

Guidance for practitioners

• When advising clients or preparing litigation, consult the current consolidated statute and the Liquor Act 2019 together, since the review pathways and many substantive connections depend on the 2019 Act’s provisions as they amended the Liquor Commission Act 2018 (s 3 definition cross-reference; s 6(2); amended ss 29-34).

• The endnotes record that amendments took effect across 2018 and 2019. Always confirm the precise text in force for the date of the transaction or conduct in question, because the Act’s review and delegation mechanisms were the subject of amendment.

• The endnotes indicate that certain amendments were by virtue of the Statute Law Revision and Repeals Act 2019 and other Acts. Those Acts may have their own commencement nuances; consult the Gazette notices cited in the endnotes to confirm commencement particulars.

In short, the Act was enacted in early 2018 and was materially amended in 2019, primarily to align it with the new Liquor Act 2019 and to refine delegation and procedural matters. The endnotes provide a roadmap to which sections were amended and by which Act, but practitioners should verify the text in force for specific applications.

The Act text and the supplied endnotes contain no reported judicial decisions or explicit references to litigation concerning the Liquor Commission Act 2018. The statute itself establishes internal review mechanisms and certain enforcement powers, but does not catalogue any case law.

What the Act makes litigable and where legal challenges are likely to arise

• Reviewability of Director decisions. Part 4 confers rights for affected persons to apply for review of Director decisions (s 29). Once the Commission issues a decision on review, the Act requires notice of the decision and reasons and identification of any rights to further review or appeal under the Act under which the Director’s decision was made (s 33). That procedural architecture creates potential avenues for administrative review and appeals under the Liquor Act 2019 or other applicable Acts; such avenues are the normal source of litigation in administrative law contexts.

• Contempt, criminal offences and appeals. The Act creates criminal offences for failure to comply with summonses, contempt, unauthorised disclosure and misleading information (s 23; s 25; s 35; s 36). Prosecutions under those provisions would proceed within the criminal justice system and could raise arguments about strict liability elements, the application of Part IIAA of the Criminal Code (s 4), and defences such as reasonable excuse (s 25(2)) or the exemptions in s 35(3) and s 36(3).

• Judicial review. Although the Act creates an internal review mechanism, it does not preclude judicial review of decisions on grounds available under general administrative law, unless another Act provides otherwise. Section 34 expressly makes Part 4 subject to any other Act; practitioners should test whether the Liquor Act 2019 or other Acts create exclusive channels or specific appeal rights that modify judicial review options. The Act requires the Commission to comply with the rules of natural justice in review processes (s 32(1)(c)); failure to observe natural justice is a common basis for judicial review applications.

• Enforcement actions and civil claims. The Act provides members and persons acting in good faith with protection from civil or criminal liability for acts done in good faith (s 39(1)-(2)). That protection is subject to savings for the Territory or the Commission’s own liability (s 39(3)). Civil litigation against the Commission or the Territory for maladministration or breaches of statutory duty would therefore continue to engage common law and statutory liability principles, taking into account the Act’s protective clauses.

Practical absence of cases in the Act text

• The statute contains no case references and the supplied endnotes do not list any decisions. Therefore, any account of litigation history must be developed from external legal research (case law databases, NT Supreme Court judgments, administrative tribunal reports), which is beyond what the Act text itself supplies.

Advice for lawyers and researchers

• Expect litigation on three likely axes: (1) review and appeal of licensing and disciplinary decisions under the Liquor Act 2019 where the Commission or Director’s roles intersect; (2) criminal prosecutions under the Act’s offence provisions, with attendant arguments about strict liability and mens rea; and (3) claims related to natural justice or administrative error in Commission or delegated decisions.

• Where a case arises from the Commission’s process, consult the Liquor Act 2019 for appeal or review pathways and check whether the Commission provided statutory notices and reasons as required by s 33. The Act’s internal procedural mandates and its reference to natural justice create potential grounds for judicial review if those mandates are not observed.

• Because the Commission is an emanation of the Crown (s 5(4)) and the common seal is afforded judicial notice (s 5(3)), procedural points relating to service, authentication and the Commission’s legal personality may be points of dispute in litigation.

In short, the Act itself contains no litigation history in the supplied materials; it creates multiple contexts in which litigation is foreseeable, which practitioners should monitor through case law searches in the NT courts and administrative tribunals.

This section highlights traps, technical pitfalls and operational details in the Act that are likely to cause compliance or procedural problems if overlooked. Each item cites the relevant section.

1. Strict liability on service and information-source elements

• The Act applies strict liability to the elements that a person has been served with a summons (s 23(3)) and that a person obtained information in the course of performing functions connected with the administration of the Act (s 35(2)). Practitioners often assume that mens rea must be proved for every criminal element; here the prosecution need not prove fault on those specific factual elements. Defence strategies will need to focus on other elements such as intention or recklessness.

2. Application for review does not automatically stay the Director's decision

• Applying for review does not stay the operation of a Director’s decision (s 30(1)). Parties seeking suspension of an operative decision must apply separately to the Commission for a stay; the Commission may but need not grant a stay (s 30(2)). Practically, affected persons should seek a stay promptly if necessary to prevent irreversible consequences.

3. Time limit and fee requirement for review applications

• The default time limit to apply for review is 28 days from written notice of the Director’s decision (s 29(3)(a)). Applications must be in a form approved by the Commission and accompanied by a fee prescribed by regulation (s 29(4)(a)-(b)). Missing the deadline or failing to pay the fee risks rejection, and the Commission can reject frivolous or vexatious applications (s 31(2)). Confirm the current prescribed fee in subordinate legislation.

4. Composition rules can constrain scheduling

• Panels must include a presiding member (Chair or Deputy) and at least two other members, with at least one possessing health expertise (s 17(a)-(b)). The Commission must have at least four members overall (s 7(2)), and at least one member must have health-related expertise in appointment (s 7(5)). These constraints can slow scheduling where health-expertise members are not available, especially if multiple sittings are required. While s 18 allows different panels to convene concurrently, each panel still needs the required composition.

5. Disclosure obligations affect quorum

• When a member discloses an interest, the member must not take part in deliberations and must be disregarded for quorum while the matter is considered (s 21(3)(a)-(b)). That can reduce the effective number of members available and inadvertently produce quorum problems, potentially delaying determinations.

6. Removal for failure to disclose

• Failure to disclose an interest is expressly a ground for termination of appointment (s 14(1)(d)). Members must be proactive about disclosure, and appointing bodies must manage appointment vetting carefully.

7. Contempt and criminalisation of ordinary conduct

• The Act criminalises a range of conduct as contempt of the Commission (s 26). Acts that might be intended as robust advocacy could, in some cases, fall within s 26(5)(a)-(c) if they insult, intimidate or obstruct members or interrupt proceedings. Practitioners should advise clients to temper courtroom-style advocacy when appearing before the Commission to avoid contempt exposure.

8. Misleading documents carry high penalties but offer a limited safe harbour

• The maximum penalty for supplying misleading information or documents is 400 penalty units or imprisonment for two years (s 36(1)-(2)). Section 36(3) provides a narrow rescue for those who, when providing a document containing misleading aspects, draw attention to the misleading part and, to the extent reasonably possible, supply information necessary to remedy the misleading aspect. Relying on s 36(3) requires pre-emptive disclosure and remedial steps at the time the document is produced.

9. Delegation choices create downstream accountability

• The Commission may delegate to the Chair, another member, the Director, or a public sector employee (s 37(1)). Delegation can be pragmatic but requires explicit limits and governance controls. Delegations raise questions of transparency, record-keeping and audit trails when decisions are made or actions taken by delegates.

10. Protection from liability is limited

• Members acting in good faith are shielded from civil and criminal liability (s 39(1)-(2)), but subsection (3) explicitly preserves liability the Territory or the Commission would otherwise have. This means that while individual members have protection, organisational liability exposures remain.

11. Intersection with the Liquor Act 2019

• The Commission’s procedures are subject to any relevant provisions of the Liquor Act 2019 (s 20(3)). Practitioners must cross-reference that Act to ensure compliance with procedural mandates or substantive decision criteria, and must track any differing appeal or review routes found in the Liquor Act 2019.

12. Commission is an emanation of the Crown

• The Commission being an emanation of the Crown (s 5(4)) affects service and proceedings and could influence remedies available to litigants; administrative and civil law practitioners should account for Crown procedural rules when litigating or engaging with the Commission.

Addressing these gotchas requires operational checklists, early case management, and careful attention to timing, evidence handling, conflict declarations and scheduling given panel composition constraints. Practitioners should verify subordinate legislation and the Liquor Act 2019 for overlapping procedural requirements and prescribed fees.

This section translates statutory obligations into practical compliance steps and a risk-management checklist for regulated entities, witnesses, members, applicants and public sector delegates. Each step references the relevant statutory provision.

For licensees, applicants and persons likely to be affected by Commission proceedings

1. Track Director decisions and deadlines

• When notified in writing of a Director’s decision, note the date of written notice immediately. The default period to lodge an application for review is 28 days from that notice (s 29(3)(a)). Applications may be accepted later only with the Commission’s consent (s 29(3)(b)). Preservation of rights requires filing within the time limit or seeking an extension promptly.

2. Prepare the review application correctly

• Use the form approved by the Commission and include the facts and grounds relied on (s 29(4)(a), (c)). Include the prescribed fee as set by regulation (s 29(4)(b)). Missing the form or fee can justify rejection under s 31(2) which allows the Commission to reject frivolous or vexatious applications. Keep proof of payment and proof of lodgement.

3. Seek a stay if necessary

• An application for review does not automatically stay the Director’s decision (s 30(1)). If the Director’s decision has immediate adverse consequences, apply urgently to the Commission for a stay pending review (s 30(2)). Prepare evidence to justify the stay (risk of irreparable harm, balance of convenience, etc.).

4. Be prepared for Commission procedures and natural justice

• Expect the Commission to determine procedures (s 20(3)) but to observe rules of natural justice in reviews (s 32(1)(b)-(c)). Prepare submissions and evidence accordingly, and expect the Commission to keep records (s 20(2)) and to provide written reasons after decision (s 33(2)(a)).

For witnesses and third parties served with summonses

1. Treat a summons seriously

• A summons requires attendance and production of evidentiary material (s 22). Failure to comply intentionally is an offence with substantial penalties (s 23(1)-(2)). Strict liability applies to whether the person has been served with the summons (s 23(3)), so do not rely on arguments about lack of knowledge of service for those elements.

2. Seek legal advice before asserting privilege or refusing production

• If you are asked to produce documents or answer questions that may attract privilege, consult legal counsel promptly to assess privilege assertions and any potential defences. The Act does not set out privilege rules, but refusal can engage contempt or offence provisions (s 26(1)(b)(iii), s 25).

3. Maintain records and originals

• If documents are produced at a hearing, the Commission may inspect and copy them (s 24(1)). Originals will be returned as soon as practicable after the hearing (s 24(2)). Keep reliable copies and records of materials provided.

For members and deputies

1. Ensure appointment and qualification compliance

• Confirm that appointment instruments meet the statutory criteria, including the Chair and Deputy Chair legal experience requirement of at least 5 years (s 8(2)) and health expertise requirement for at least one member (s 7(5)-(6)). Deputies must satisfy the same qualification requirements where applicable (s 10(2)-(3)).

2. Disclose conflicts promptly and follow guidelines

• Disclose any direct or indirect pecuniary interest promptly when it comes to your attention, to the Chair or Minister as appropriate (s 21(2)). After disclosure, do not participate in deliberations on the matter and accept that you will be disregarded for quorum (s 21(3)). The Commission is required to publish guidelines on the types of interests to disclose (s 21(4)). Non-disclosure is a ground for termination (s 14(1)(d)).

3. Keep accurate records and follow administrative requirements

• The Commission must keep records (s 20(2)), and the Chair must administer the Commission’s affairs (s 9). Members should ensure accurate minutes, attendance records, and documented reasons for decisions to satisfy reporting and potential judicial scrutiny.

4. Use the protections for good faith acts cautiously

• The Act provides immunity for acts done in good faith in the exercise of Commission powers (s 39(1)-(2)). While this reduces personal exposure, it is not a complete shield for organisational liability (s 39(3)). Maintain governance and legal oversight.

For delegates, public sector employees and the Director

1. Ensure delegation instruments are in writing and within limits

• The Commission may delegate in writing to the Chair, another member, the Director, or a public sector employee (s 37(1)). Ensure any delegation instrument is in writing, clearly states limits, and is published or recorded internally to permit audit and review. Delegations to the Chair or Director may be further delegated only subject to any limits the Commission determines (s 37(2)).

2. Maintain administrative competence for delegated functions

• Delegates should keep comprehensive records, act within the delegation, and ensure decisions meet natural justice standards, given that the Commission’s decisions and delegated acts remain subject to review (s 32(1)(c)).

Confidentiality and evidence handling

1. Treat confidential information carefully

• Do not disclose confidential information obtained in the course of administering the Act unless an exception applies (s 35(1)-(3)). The offence carries serious penalties (200 penalty units or two years’ imprisonment), and strict liability applies to whether the information was obtained in the course of connected functions (s 35(2)). Use secure document handling, limited access, and explicit consent processes where appropriate.

2. Avoid providing misleading information

• Do not provide misleading information or documents to the Commission. If a document contains a misleading aspect, draw it to the Commission’s attention and, to the extent reasonably possible, supply corrective information at the time of production (s 36(3)). Doing so mitigates the risk of prosecution under s 36(2).

Operational and governance checklist

• Confirm current regulations for prescribed fees and any procedural rules (s 29(4)(b); s 40).
• Establish scheduling protocols that account for required panel composition and health expertise (s 17; s 7(5)).
• Maintain a conflicts register and enforce disclosure obligations for members (s 21).
• Create a standard operating procedure for responding to summonses, including legal advice contact points and privilege review.
• Record all decisions and reasons carefully to comply with reporting obligations and to support any judicial review that might follow (s 20(2); s 33(2)).
• If a stay is required, prepare an urgent application to the Commission with evidence supporting the stay (s 30(2)).
• Keep training records for staff and members on confidentiality obligations and the offence provisions (s 35; s 36).

By following these steps, affected parties can reduce legal risk, avoid criminal exposure in relation to Commission processes, and ensure that review rights and obligations are exercised effectively within the procedural architecture the Act prescribes.
