**What this law changes (mechanically)

Creates a new, standalone regime for same-day delivery of alcohol by inserting Part 8A into the Liquor Act 2010 (sections 143J–143ZC). The regime defines who is a "same-day delivery provider", a "delivery person", a "delivery order", and when liquor is "supplied by same-day delivery" (s 143J).
Requires same-day delivery providers to notify the Commissioner about who actually sells the liquor before taking orders (s 143K; regulation 30A sets the identifying information).
Makes a range of new criminal and administrative offences aimed at same-day delivery: unauthorised sale (s 143L), daily quantity limits (s 143M), mandatory delay before fulfilment (s 143N), delivery time windows (s 143O), bans on delivery to specified public places (s 143P), offences for advertising to self-excluded customers (s 143Q), and offences for failing to verify age, supplying to minors or intoxicated people, leaving deliveries unattended, and failing to keep records or report incidents (ss 143T–143ZB). Penalties vary (in many cases up to 50 penalty units; some breaches carry higher maximum penalties and some carry imprisonment). Many of the new offences are strict liability.
Introduces a specific responsible-same-day-delivery training and certification track. Approved training providers must issue a separate "same-day delivery RSA certificate" (s 194). Existing RSA certificates and approvals are transitioned into the new categories (Part 26, ss 276–277).

What it does

The Liquor Amendment Act 2025 inserts a new regulatory regime for the same‑day delivery of liquor into the Liquor Act 2010 and makes consequential changes to RSA training, licence discipline, enforcement tools and the Liquor Regulation 2010. Mechanically the Act does the following.

Creates a discrete Part 8A (ss 143J-143ZC) that defines same‑day delivery and introduces new duties, record keeping and offence provisions applicable to same‑day delivery providers and delivery persons (see ss 143J, 143K, 143L, 143M-143ZB).
Distinguishes two RSA certificate types: a general RSA certificate (service at premises) and a same‑day delivery RSA certificate (delivery operations), and reconfigures approval, issuance and expiry rules accordingly (see ss 193-194, ss 189-191, transitional ss 276-277).
Requires same‑day delivery providers to notify the commissioner of the identity of the seller before taking delivery orders (s 143K; regulation 30A prescribes the identifying details).
Establishes operational limits for same‑day delivery, to be fleshed out by regulation and partly prescribed in the Liquor Regulation 2010: minimum delay between order and supply (two hours by reg 30B), permitted delivery hours (10:00-22:00 by reg 30C), daily volume limits (to be prescribed by regulation under s 143M), and excluded delivery locations (prohibited public places defined at s 143P).
Requires training providers approved under the Act to issue either a general RSA certificate or a same‑day delivery RSA certificate, with certificates expiring five years after completion (ss 194(1)-(3); transitional ss 276-277).
Imposes age verification, intoxication and unattended‑delivery prohibitions, plus record‑keeping (s 143T-143X; s 143ZB) and incident reporting (s 143Z) obligations. Regulation 30D sets the required record fields and requires electronic records.

Liquor Amendment Bill 2025

Compliance requires a multi‑strand approach: pre‑operation registration and approvals, training and certification, operational controls for age/intoxication and locations, record‑keeping systems, incident management and liaison with the commissioner. The steps below are organised by actor and map to the statutory references.

Checklist for same‑day delivery providers

Pre‑start notice to commissioner. Before taking delivery orders selling liquor supplied by a specific seller, give written notice to the commissioner stating the seller’s name and the prescribed identifying details (s 143K(1)-(2); reg 30A requires licence unique identifying number or interstate licence number). Keep proof of the notice transmission and confirmation.
RSA certification.
- Ensure the provider (where an individual) or each person with day‑to‑day control of delivery operations in a corporate provider holds a current same‑day delivery RSA certificate (s 143R(1), (5)).
- Ensure each delivery person who supplies liquor under delivery orders holds a current same‑day delivery RSA certificate (s 143R(2)-(3)).
- Keep copies of current same‑day delivery RSA certificates for providers, controllers and delivery persons and retain them as required (s 143S(1); s 143ZB(5)).
Record keeping system.
- Implement an electronic record system that captures the fields prescribed in reg 30D(1)(a)-(j), including provider name, seller id, timestamps for order and delivery/refusal, liquor name and volume, customer and delivery address details, whether a meal was delivered, reason and identity for refusals.
- Ensure records are stored in secure, retrievable electronic form and retained for at least six years (s 143ZB(3)-(5); reg 30D(2)).
Operational constraints.
- Implement workflows to enforce the minimum delay between order and delivery (reg 30B prescribes 2 hours) unless a regulatory exemption applies (reg 30E for meal‑accompanied sales within defined limits).
- Restrict deliveries to the permitted times specified by regulation (reg 30C prescribes 10:00-22:00).
- Identify prohibited public places (s 143P(4)) and prevent deliveries to those locations.
Age and intoxication checks.
- Adopt an age verification process compliant with any prescribed regulation (s 143T(1)). Ensure the delivery person asks for ID at delivery and is trained in acceptable forms of ID and verification procedures.
- Empower delivery persons to refuse supply where ID is not shown (s 143V) and provide an internal escalation and recording process for refusals (s 143ZB(1)(j)).
- Train delivery persons to identify intoxication and refuse delivery where appropriate (s 143W).
Self‑exclusion and marketing.
- Provide, at the time of offering to take an order, a compliant way for customers to self‑exclude (s 143Q(3)). Implement suppression of direct marketing to self‑excluded persons (s 143Q(1), (5)).
Incident reporting and staff protection.
- Create an incident response process to report abusive, threatening or intimidating behaviour within 24 hours to the commissioner and capture required report fields (s 143Z(2)-(3)).
- Put policies in place to prohibit victimisation of delivery staff by the provider (s 143ZA) and train supervisors in lawful responses to delivery person refusals (s 143Y).
Contracts and indemnities.
- Contractually require independent delivery persons and subcontractors to hold same‑day delivery RSA certificates and to comply with record keeping and ID verification. Reflect different penalties and responsibilities in contractual allocation, but recognise criminal and administrative liability remains with the provider in many instances.
Monitor regulatory changes. The Act delegates details to regulations; monitor subordinate instruments for changes to daily volume limits, any additional age verification requirements, and any exemptions.

Checklist for delivery persons

Obtain and maintain a same‑day delivery RSA certificate (s 143R(3)).
Carry authorised identification and be trained to request and verify customer ID at delivery (ss 143T, 143V).
Refuse supply where ID is not produced, where recipient is intoxicated, or where recipient is a child or young person (ss 143U, 143V, 143W). Immediately record any refusal in the provider’s prescribed electronic record and follow incident escalation procedures.
Never leave supplied liquor unattended (s 143X).

Checklist for licensees who arrange same‑day delivery

Ensure contractual and operational oversight of the provider. Implement “reasonable steps” policies (documented checks of provider’s certificates, records, reporting processes and incident handling) to satisfy s 183(1)(l).
Keep records of the due diligence conducted on providers (copies of provider notices to commissioner, provider RSA certificate copies, record‑keeping practices, and incident reports relating to delivery of the licensee’s liquor).

Checklist for approved RSA training providers

Update course offerings and approvals to include responsible same‑day delivery courses where appropriate (ss 189-191).
Issue general RSA certificates for responsible service of alcohol courses and same‑day delivery RSA certificates for responsible same‑day delivery courses, with certificates stating completion date and expiry (s 194(1)-(3)).
Track expiry dates and provide re‑training or renewal courses to conform to the five‑year expiry rule (s 194(3)).

Regulatory and enforcement liaison

Register processes for sending seller notices and incident reports to the commissioner and monitor replies or directions under s 144.
Implement an internal audit program to test the provider’s compliance against records required by reg 30D and certificate holdings per s 143S.

Transitional and review considerations

Review whether existing RSA certificates held by staff are treated as general RSA certificates by the transitional provisions (ss 276-277) and plan for procurement of same‑day delivery RSA certificates for staff engaged in delivery duties where needed.
Prepare for the Minister’s statutory review (s 230) by capturing baseline compliance data and incident statistics to inform the review due after three years.

Practical operational sequences

Before launch: obtain or verify same‑day delivery RSA certificates for controllers and delivery persons; notify the commissioner of sellers (reg 30A); deploy electronic record‑keeping with fields from reg 30D; train staff on ID, intoxication checks and refusal/incident protocols.
Day‑to‑day: enforce minimum delay and delivery window, verify IDs, update records contemporaneously, report incidents within 24 hours, retain records six years.
Ongoing: track certificate expiries and re‑training, respond promptly to any commissioner directions under s 144, and maintain documented proof of “reasonable steps” for licensees who arrange delivery.

Following these steps aligns operations with the statutory obligations enumerated in Part 8A and the related Liquor Regulation 2010 provisions (regs 30A-30E), reduces exposure to strict liability offences, and creates an evidentiary trail for compliance in the event of enforcement action.
