168 Limit on monetary penalty (1) No monetary penalty may be imposed against a licensee for a contravention of this Act if: (a) the licensee is issued an infringement notice in relation to that contravention; or

Liquor Act 2019 93 (b) the licensee is being prosecuted for an offence in relation to that contravention. (2) However, a monetary penalty may be imposed by the Commission against a licensee specified in subsection (1) if: (a) the infringement notice is withdrawn; or (b) the prosecution is discontinued. (3) The Commission must take into account any penalty imposed by a court of competent jurisdiction on a licensee when taking disciplinary action against a licensee.
