81 Commissioner need not decide suitability if requirements not complied with (a) the commissioner has given a person a premises information notice under section 79 and the person does not give the commissioner the certificate, plan or information in accordance with the notice; or (b) the commissioner has given a person an inspection notice under section 80 and the person does not allow the commissioner to inspect the premises in accordance with the notice. (2) The commissioner need not decide whether the premises are suitable premises for the licence or permit.
