#### 90 Secretary may vary or revoke late hour entry declaration 90 Secretary may vary or revoke late hour entry declaration > > (1) The Secretary may, in accordance with this section, vary or revoke a late hour entry declaration. > > > (2) The Secretary must give written notice of a proposed variation or revocation of a late hour entry declaration— > > > > > (a) to each licensee whose licensed premises are subject to the declaration, and > > > > > (b) to the local consent authority for those premises. > > > (3) Any such licensee or the local consent authority may, within 21 days after the notice is given to the licensee or the authority (as the case requires), make a written submission to the Secretary in relation to the proposed variation or revocation. > > > (4) The Secretary must, before deciding whether to vary or revoke a late hour entry declaration, take into consideration any submissions received by the Secretary under subsection (3).
