#### 89 Provisions relating to making of late hour entry declaration 89 Provisions relating to making of late hour entry declaration > > (1) The Secretary must give written notice of a proposed late hour entry declaration— > > > > > (a) to each licensee whose licensed premises are the subject of the proposed declaration, and > > > > > (b) to the local consent authority for those premises. > > > (2) Any such licensee or the local consent authority may, within 21 days after the notice is given to the licensee or the authority (as the case requires), make a written submission to the Secretary in relation to the proposed declaration. > > > (3) The Secretary must, before deciding whether to make a late hour entry declaration, take into consideration any submissions received by the Secretary under subsection (2). > > > (4) The regulations may prescribe other requirements that the Secretary must comply with before making a late hour entry declaration.
