Liquid Fuel Emergency Guidelines 2019

The Guidelines organise around several recurring legal and operational concepts. These concepts are defined or used in the instrument and are central to how the Minister’s powers operate in practice.

• Bulk customer. A person or organisation identified under subsection 10(1) of the Act and subject to Guidelines in Part 2. Identification requires a current contractual arrangement to purchase bulk quantities from a relevant fuel industry corporation or relevant person, with the supply contract in place for at least three months (s 8(2)). Identification is excluded if the customer has ceased the activities for which bulk quantities were purchased or does not intend to continue them (s 8(3)).

• Essential user. A person or organisation identified under subsection 11(1) of the Act where their goods or services are essential for preservation of health, safety or welfare and cannot be carried out without a continuing supply of the refined liquid petroleum product (s 11(2)). The instrument introduces a quantitative test for “likely to impair substantially” the health, safety or welfare of the community where services would be otherwise unavailable (s 11(3)). The Minister must take into account expected severity, impact and duration of the supply disruption and the ability to identify users (s 11(5)) and is encouraged to decide as soon as practicable after an emergency declaration when aware a person meets the criteria (s 11(6)).

• Reserve maintenance and contingency planning. Under Part 4 (ss 12-13) and Part 8 (ss 24-25), the Minister can direct relevant fuel industry corporations to accumulate and maintain specified reserve quantities at specified places and times. Part 4 applies to contingency planning (pre-emergency) and Part 8 applies during a declared national liquid fuel emergency. Consultation is required before such directions and the Minister must take into account the expected severity and any submissions (ss 13(1)-(2); 25(1)-(2)).

• Bulk allocation procedures. Part 5 (ss 14-17) sets required content for procedures that wholesalers (specified class in s 15) must prepare and which the Minister may require particulars of. The procedures must include a mechanism enabling equitable allocation consistent with directions, the ability to reduce supplies by specified percentages or amounts, to sustain reduced supplies, and to vary supplies up or down on daily, weekly or monthly bases (s 17).

• Statistical information. Parts 6 and 7 (ss 18-23) authorise directions to specified classes of relevant fuel industry corporations and relevant persons to maintain statistical information (s 18) and to make that information available to the Minister and specified Energy Ministers (s 22). The Guidelines require consultation before imposing these reporting obligations (ss 21(1), 23(1)) and direct the Minister to take into account existing reporting under the Petroleum and Other Fuels Reporting Act 2017 and privacy/commercial sensitivity issues (ss 21(2)(c), 23(2)(d)-(e)).

• Supply regulation and prohibition during emergencies. Parts 9, 10, 11, 12 and 13 (ss 26-37) authorise a range of directions during a declared emergency: output from refineries (ss 26-27), allocation to bulk customers (ss 28-31), and regulation or prohibition of supply to retail or wholesale customers (ss 32-37). The instrument lists specific kinds of supply controls that can be ordered (for example, requiring evidence of entitlement, setting maximum amounts supplied at a time or over periods, specifying times of day) but repeats that limits are found in the Act (see ss 33(1) and 36(1)).

Two cross-cutting procedural concepts are prominent. First, consultation. For almost every power to make an instrument or give a direction, the Minister must inform affected corporations/persons and other liquid fuel emergency Ministers and invite submissions within a reasonable period (for example, ss 7(1), 13(1), 21(1), 23(1), 25(1), 27(1), 29(1)). Second, mandatory consideration lists. The Guidelines frequently distinguish matters the Minister “must” take into account (for example, severity and expected impact, and submissions) from matters the Minister “may” take into account (for example, impacts on national interests and any other relevant matter) , see, for example, ss 13(2)-(3), 25(2)-(3).

Lastly, the Guidelines deliberately point back to existing statutory regimes and limitations. They require coherence with reporting obligations under the Petroleum and Other Fuels Reporting Act 2017 (s 21(2)(c)), and require consideration of privacy protections under the Privacy Act 1988 before ordering data production (s 23(2)(d)). The Guidelines also explicitly repeal the 2008 Guidelines (Schedule 1), making this instrument the current procedural code to be followed under the Act.

The Guidelines allocate rights and duties across three principal groups: the Minister and liquid fuel emergency Ministers, relevant fuel industry corporations, and relevant persons (non-corporate or corporate actors not captured by “fuel industry corporation”), plus secondary groups such as bulk customers and essential users.

• The Minister and liquid fuel emergency Ministers. Decision-making power to make instruments identifying bulk customers or essential users and to issue directions under the Act rests with the Minister, often in consultation with other “liquid fuel emergency Ministers” (defined in s 5 as the Minister and each Energy Minister). The Guidelines impose process obligations on the Minister (for example, consultation before acting, see ss 7(1), 13(1), 21(1), 23(1), 25(1), 27(1), 29(1), 31(1), 34(1), 37(1)) and specify matters that the Minister must or may take into account when deciding to act (see, for example, ss 13(2)-(3), 21(2), 23(2)). The instrument also notes the Minister may delegate the Minister’s powers or functions under the Act subject to exceptions provided in the Act (s 5 note 2).

• Relevant fuel industry corporations. The Guidelines repeatedly address corporations that, as a principal or substantial part of their activities, engage in production, processing, refining, wholesaling, retailing or storage of liquid petroleum products (s 19 lists these classes). A separate class for purposes of bulk allocation procedures is wholesalers as principal or substantial activity (s 15). These corporations are the primary objects of directions under the Act; they may be required to maintain reserves (Parts 4 and 8), submit bulk allocation procedures for approval and implement allocation mechanisms (Part 5 and s 17), to maintain and make available statistical information (Parts 6 and 7), to direct refinery output (Part 9) and to regulate or prohibit supplies (Parts 12 and 13). The Guidelines also require that affected corporations be consulted before directions are given (eg s 13(1), 25(1), 27(1), 29(1)).

• Relevant persons. The instrument treats “relevant persons” in parallel to corporations where those persons, as a principal or substantial part of their activities, engage in production, processing, refining, wholesaling, retailing or storage (s 20). During emergencies, the Minister may direct relevant persons in their trading or commercial activities to allocate supplies to bulk customers (Part 11,ss 30-31), and they are within the scope of statistical maintenance and disclosure obligations (Parts 6-7). Consultation obligations apply before directions are given to relevant persons (eg s 31(1)).

• Bulk customers. Persons or organisations who are identified under subsection 10(1) of the Act as bulk customers are directly affected by allocation directions. The Guidelines set out how the Minister must consult on the quantity that constitutes a “bulk quantity” (s 7) and the criteria for identifying bulk customers: contractual arrangement(s) to purchase bulk quantities and contracts of at least three months’ duration (s 8(2)); and the Minister must not identify entities who have ceased activities or do not intend to carry them on (s 8(3)). Once identified, bulk customers may find their future supply quantities reduced or varied under approved allocation procedures (s 17).

• Essential users. Persons and organisations identified under subsection 11(1) of the Act as essential users are prioritised under allocation and supply rules in emergencies. The Guidelines specify the threshold test for essential user identification, requiring goods or services be essential to preserve community health, safety or welfare and that the activity could not be undertaken without continuing fuel supply (s 11(2)-(3)). The Minister must take into account the expected severity and duration of supply disruption and the established need of each category (s 11(5)), and is directed to act promptly after an emergency declaration when aware a person meets the criteria (s 11(6)).

• Secondary stakeholders. The Guidelines require the Minister to take into account “the expected impact of the proposed direction on the broader community” and “Australia’s national interests and international obligations” where relevant (repeated across many Parts , see, for example, ss 13(3)(a)-(b), 25(3)(a)-(b), 27(3)(a)-(b), 29(3)(a)-(b)). While these are not persons the Guidelines directly bind, they are explicitly included as permitted considerations in the Minister’s decision-making calculus.

In practice, the Guidelines place administrative and operational obligations primarily on fuel industry participants (production, refining, wholesaling, retailing, storage) and create potential direct consequences for bulk customers and essential users via identification instruments and allocation directions. They also vest broad discretionary decision-making with the Minister, subject to consultation and to mandatory factors to consider.

The Guidelines establish several duties (mostly procedural duties on the Minister and substantive duties on industry participants) and imply corresponding rights, such as the right to be consulted and, in certain cases, the right to rely on specified identification criteria.

Duties on the Minister

• Consultation duties. Before making identification instruments or before giving specified directions, the Minister must inform affected corporations/persons and the other liquid fuel emergency Ministers of the proposal and invite submissions within a reasonable period (illustrative provisions: ss 7(1), 13(1), 21(1), 23(1), 25(1), 27(1), 29(1), 31(1), 34(1), 37(1)). The content required in the consultation invitation includes specifying a reasonable period to receive submissions (s 7(2)).

• Matters to take into account. In deciding whether to make an instrument or issue a direction, the Minister must take into account specific matters listed in each Part. A recurring mandatory consideration is the expected severity, type, impact and duration of supply disruption during a period of national liquid fuel emergency (appears in, for example, ss 13(2)(a), 25(2)(a), 27(2)(a), 29(2)(a), 31(2)(a)). The Minister must also consider submissions received within the consultation period (eg ss 7(3), 13(2)(b), 21(2)(a), 23(2)(a)).

• Time-critical decisions. Where an emergency is declared and the Minister is aware a person meets the essential user criteria, the Guidelines require the Minister to make a decision to identify or refuse to identify as soon as practicable after the declaration (s 11(6)). This creates an affirmative timeline duty in an emergency context.

Duties on relevant fuel industry corporations and relevant persons

• Prepare and implement allocation procedures. Corporations in the class of wholesalers (s 15) must have bulk allocation procedures that include mechanisms to equitably allocate available refined product to bulk customers and to enable specified percentage or amount reductions and adjustments on daily/weekly/monthly bases (s 17). The Minister may direct particulars of such procedures and approve them under the Act (see Part 5 summary and s 17).

• Maintain statistical information. The Minister may direct specified classes of corporations and persons (listed in ss 19 and 20) to maintain statistical information in a specified form after a specified day (s 18). Before imposing such obligations, the Minister must consult (s 21(1)).

• Make statistical information available. The Minister may direct corporations or relevant persons to make available to the Minister and any specified Energy Minister the statistical information they are required to maintain under s 14 of the Act (s 22). Consultation is required and the Minister must consider privacy and commercial sensitivity (s 23(1)-(2)).

• Comply with directions in an emergency. During a declared national liquid fuel emergency, relevant fuel industry corporations and relevant persons may be required to maintain reserves (Part 8), to adjust refinery output (Part 9), allocate to bulk customers (Parts 10-11), or regulate/prohibit supply (Parts 12-13). These directions must be in accordance with these Guidelines (multiple Parts).

Rights implied by the Guidelines

• Right to be consulted and to make submissions. The Guidelines give a procedural right to affected corporations and persons to receive notice and to make submissions before most instruments or directions are made (see the consultation provisions listed above).

• Right to identify thresholds. For bulk customers and essential users, the Guidelines create specific threshold criteria. For example, a bulk customer must have a current contractual arrangement to purchase bulk quantities and contracts for at least three months before being identified as a bulk customer (s 8(2)). An entity meeting the essential user criteria is to be identified if the conditions in s 11(2) and (3) are met; where an emergency exists and the Minister is aware of eligibility, the Minister should act promptly (s 11(6)).

• Rights vis-à-vis approved procedures. The Minister must take approved bulk allocation procedures into account when issuing allocation directions (s 29(2)(c)). Once the Minister has approved procedures under the Act, those procedures constrain how allocation directions should be worked out.

Limits and omissions

• Limits in the Act. The Guidelines repeatedly point to statutory limits in the Act for particular directions (for example, they note that “there are limitations on directions” produced by particular sections of the Act , see Parts 4, 8, 9, 10 and 12 where the Guidelines refer to limitations in the Act such as subsections 12(3), 17(2), 20(2), 21(2)-(4), 23(2)-(4) and section 25 of the Act). The Guidelines do not themselves specify enforcement mechanisms, penalty provisions or appeal rights; those matters are handled by the Act and other legislation.

• Consideration vs. entitlement. The Guidelines require the Minister to take certain matters into account but many clauses use permissive language (“may take into account”), preserving substantial ministerial discretion in balancing competing considerations (for example s 13(3)). The instrument therefore sets duties of process and minimum threshold criteria but leaves significant room for Ministerial judgement.

The Guidelines themselves do not create new criminal offences or civil penalty regimes, nor do they prescribe enforcement mechanisms. They are procedural and substantive guidance that constrain and instruct Ministerial exercise of powers under the Act and the content of instruments and directions the Minister may issue. For an understanding of penalties and enforcement one must therefore look to the Act and to any other applicable statutes the Guidelines reference; the Guidelines consistently refer instruments and directions back to the Act and repeatedly note where the Act contains limits on directions (for example, Parts 4 and 8 refer to “limitations on directions” in subsections of the Act , see ss 13 note, 25 note and other Parts).

What the Guidelines do as to enforcement mechanics

• Constrain the Minister’s power. Enforcement begins with Ministerial directions under the Act. The Guidelines set mandatory consultation requirements and matters the Minister must take into account when directing corporations or persons to do things such as maintain reserves, alter refinery output, implement allocation procedures, or make statistical information available (see ss 13(1)-(2), 21(1)-(2), 23(1)-(2), 25(1)-(2), 27(1)-(2), 29(1)-(2), 31(1)-(2)). Those process obligations are compliance points the Minister must observe; failure to follow the Guidelines could affect the validity of instruments or directions insofar as they are required “to be in accordance with these guidelines” (each Part repeatedly states that an instrument or direction “must be in accordance with these guidelines”).

• Indirect enforcement via obligations on corporations and persons. The Guidelines specify the content of allocation procedures (s 17) and the categories of corporations and persons who may be directed to maintain and disclose statistical information (ss 19-20). Once the Minister gives directions under the Act (which the Guidelines regulate), affected parties will be obliged to comply with those directions under the Act. The Guidelines do not itself state the penalties for non-compliance; those are matters for the Act.

• Data handling and privacy considerations. When directing disclosure of statistical information, the Minister must consider whether personal information is likely to be collected and whether measures exist to protect commercially sensitive and personal information (s 23(2)(d)-(e)). The Guidelines make privacy and commercial sensitivity considerations mandatory in the decision to require disclosure, which may limit the scope of compelled disclosures and thereby indirectly influence enforcement outcomes.

Enforcement gaps and reference points

• No express penalties in the Guidelines. The instrument is silent on the mechanics of enforcement (for example, notices, sanctions, criminal or civil penalties, injunctive relief, or administrative review). It assumes enforcement and limitation provisions are contained within the enabling Act (the Liquid Fuel Emergency Act 1984) and possibly other statutes. The Guidelines therefore function as a mandatory decision-making template rather than an enforcement code.

• Role of the Act. Because the Guidelines must be read and applied in the context of the Act (s 3), any penalty, enforcement jurisdiction, civil remedies, delegated decision-making, and judicial review pathways will be specified in the Act and relevant complementary legislation. The Guidelines themselves repeatedly flag those statutory limits and cross-references (for example, notes in Parts 4, 8 and 9).

• Practical enforcement in emergencies. In a declared national liquid fuel emergency many of the Minister’s powers to direct industry will be usable immediately (Parts 8-13). The Guidelines mandate consultation even in the emergency context (eg ss 25(1), 27(1), 29(1), 31(1), 34(1), 37(1)), but because an emergency may require expedited action the “reasonable period” for submissions and the “as soon as practicable” timelines (s 11(6)) create areas of operational judgement that will affect how and when enforcement steps are taken.

To determine precise penalties and means of enforcement, or to assess procedural remedies and rights of review for affected parties, the reader must consult the Act itself and any other statutes that the Act incorporates or references. The Guidelines provide mandatory processes the Minister must follow but do not themselves prescribe sanctions for non-compliance by corporations, relevant persons or the Minister.

The Guidelines expressly situate themselves within a statutory ecosystem by cross-referencing the Liquid Fuel Emergency Act 1984 (the Act), the Petroleum and Other Fuels Reporting Act 2017 and the Privacy Act 1988. The instrument repeatedly instructs the Minister to ensure directions and requirements are consistent with or take account of obligations under those statutes. The instrument also notes that the Minister’s powers may be delegated under the Act (s 5 note 2), indicating the Act’s delegation framework prevails.

Key statutory interactions set out in the Guidelines

• Liquid Fuel Emergency Act 1984. The Guidelines are made under the Act (s 3) and repeatedly state that instruments and directions made under various provisions of the Act must be “in accordance with these guidelines” (for example, ss 6, 9, 12, 14, 18, 22, 24, 26, 28, 30, 32, 35). The Guidelines therefore function as prescribed rules governing the exercise of the Act’s powers. They also repeatedly refer to limitations contained in the Act governing particular directions, for instance: the Guidelines advise that there are limitations on directions given under subsections 12(1), 17(1), 20(1), 21(1), 23(1) and 24(1) of the Act (see notes in Parts 4, 8, 9, 10, 12 and 13). The Guidelines do not restate those statutory limits but require the Minister to remain within the Act’s bounds.

• Petroleum and Other Fuels Reporting Act 2017. The Guidelines require the Minister to take into account current statistical information available to the Minister, including information given under the Petroleum and Other Fuels Reporting Act 2017, when deciding whether to give directions to maintain statistical information under s 14 of the Act (s 21(2)(b)-(c)). This directs the Minister to avoid duplicative or inconsistent reporting regimes and to calibrate new statistical requirements against existing reporting obligations.

• Privacy Act 1988. Where the Minister considers directions to make statistical information available, the Guidelines require the Minister to address whether personal information is likely to be collected and how commercially sensitive and personal information will be handled and protected (s 23(2)(d)-(e)). This provision integrates privacy considerations into the Minister’s decision whether to order data disclosure and signals that the Minister must align with privacy law obligations when specifying disclosure forms and handling.

Operational implications of these interactions

• Coherence with existing reporting regimes. Because the Guidelines require consideration of obligations under the Petroleum and Other Fuels Reporting Act 2017 (s 21(2)(c)) and the form in which information is required (s 23(2)(f)), the Minister is instructed to seek harmonisation. Corporations and relevant persons subject to those reporting obligations will have an expectation that any additional data requirements should be consistent in form and manner with existing statutory reporting.

• Data protection constraints on disclosure. The Guidelines make data protection considerations mandatory when directing disclosures (s 23(2)(d)-(e)). The Minister must, in deciding to compel data, assess the risk of collecting personal information and whether adequate protections for commercially sensitive material are in place, which will shape the scope and format of any compelled disclosures.

• Delegation and administrative law. The instrument notes the Minister may delegate powers under the Act subject to exceptions (s 5 note 2). This preserves the Act’s delegation structure and administrative law framework. The Guidelines themselves create procedural constraints the Minister must follow; failure to follow those procedures may engage administrative law review mechanisms under the Act, though the Guidelines do not describe those remedies directly.

• Limits of the Guidelines. The Guidelines do not operate in isolation. They repeatedly reference the Act for substantive limitations on directions and the correct legal authority for enforcement. They do not purport to override other laws nor to displace existing reporting or privacy obligations; rather, they require the Minister to take those laws into account when exercising powers under the Act.

In short, the Guidelines function as an instrument-specific layer of procedural and substantive instruction that must be applied alongside the Act, the Petroleum and Other Fuels Reporting Act 2017 and the Privacy Act 1988. They do not abolish or replace obligations arising under those statutes; instead, they direct the Minister to coordinate with them when setting directions and data requirements.

The Guidelines were made by the Minister for Energy and dated 25 March 2019 (front page) and commenced on 29 March 2019, the day after registration (s 2, commencement table). The instrument contains a formal Schedule 1 which repeals the Liquid Fuel Emergency Guidelines 2008 in their entirety (Schedule 1 item 1). The instrument’s own Part 1 includes a “Schedules” provision (s 4) specifying that instruments listed in its Schedule(s) are amended or repealed as set out, and that any other Schedule item has effect according to its terms.

Material points from the instrument about its own life-cycle and amendment posture

• Original instrument commencement mechanics. Section 2 provides the instrument’s commencement detail in a two-column table structure, confirming the whole instrument commenced on 29 March 2019. The note in s 2(2) clarifies that the table relates only to the instrument as originally made and will not be updated to reflect later amendments in published versions. This is a standard formatting note emphasising the table describes the original commencement and not later changes.

• Repeal of prior Guidelines. Schedule 1 expressly repeals the Liquid Fuel Emergency Guidelines 2008, meaning the 2019 instrument replaced the 2008 instrument immediately upon commencement. No transitional provisions are provided in the instrument itself concerning the effect of repeal on ongoing matters under the 2008 Guidelines; the Schedule simply repeals the earlier instrument.

• Amendment route. The instrument is made under the Act (s 3), so any future modification to the Guidelines would be via the same Commonwealth legislative instrument-making processes authorised by the Act and relevant legislative instrument rules. The instrument does not itself specify a sunset, staged commencement or automatic variation mechanism beyond the standard commencement provisions in s 2.

• No amendment history contained within. The text supplied contains no entries or notes indicating subsequent amendments to the 2019 Guidelines after the original commencement date. The instrument therefore, as provided, is the 2019 iteration that replaced the 2008 Guidelines at commencement.

• Delegation references and consequences. Section 5 note 2 highlights that the Minister may delegate the Minister’s powers or functions under the Act subject to some exceptions and refers the reader to section 49 of the Act. This cross-reference signals that any amendments to the Act that affect delegation may have downstream effects on how the Guidelines are applied, but the instrument does not itself alter the delegation framework.

For researchers needing an authoritative track record, the instrument as supplied contains no internal amendment history beyond the replacement of the 2008 Guidelines. To determine if this instrument has been amended after commencement, or whether later instruments have changed any of its parts, one must consult the legislative register or Federal Register of Legislation for subsequent versions, amendments or revocations. The Guidelines’ own Schedule 1 documents the principal historical change it effected: repeal of the 2008 instrument.

The instrument itself contains no judicial decisions, appeal histories, or litigation references. It is a statutory instrument setting out guidelines and does not record or summarise any cases. The text supplied contains only the Guidelines’ procedural and substantive rules and does include cross-references to provisions of the Act and to other statutes (for example, the Petroleum and Other Fuels Reporting Act 2017 and the Privacy Act 1988) but it does not refer to any judicial interpretation, precedent or litigation outcome.

What can be said from the instrument about potential litigation touchpoints

• Administrative law review potential. Because the Guidelines impose mandatory consultation duties and prescribe matters the Minister must take into account before issuing instruments or directions “in accordance with these guidelines” (see multiple Parts), affected parties may have administrative law grounds to challenge decisions if the Minister fails to follow the Guidelines. The instrument itself does not set out judicial review mechanisms; the Act and general administrative law (not contained in the Guidelines) will govern reviewability and remedies. The Guidelines’ repeated use of “must” (for example, in consultation and mandatory consideration clauses such as s 13(1) and s 21(2)) creates procedural expectations that could be central in any review alleging breach of lawful procedure.

• Discretionary “may” clauses and judicial deference. Many of the Guidelines’ decision factors are permissive (“may take into account”) and the Minister retains broad discretion to consider “any other relevant matter” (examples include ss 13(3)(c), 25(3)(c), 27(3)(c)). Courts traditionally give weight to statutory discretion, so any challenge may turn on whether the Minister exercised discretion in a way the Act or Guidelines intended, rather than the mere existence of discretion. The Guidelines themselves do not contain litigation examples or a rubric for judicial review; affected parties will need to rely on general administrative law principles and the Act’s procedural architecture.

• Evidence and definitional disputes. The Guidelines create definitional criteria (for example, bulk customer criteria in s 8 and essential user thresholds in s 11). Disputes about whether an entity meets these criteria could give rise to legal challenges to an identification instrument. The Guidelines’ specification of evidentiary thresholds (such as a three-month contractual arrangement in s 8(2)) offers concrete points of contention that could be litigated, but the instrument does not provide a dispute resolution process for identification decisions.

• Data disclosure and privacy. Directions compelling statistical information must be assessed against privacy and commercial sensitivity considerations (s 23(2)(d)-(e)). If the Minister directs disclosure in a way that an entity alleges breaches the Privacy Act 1988 or improperly exposes commercially sensitive material, affected parties may seek relief under privacy or administrative law mechanisms. The Guidelines anticipate these tensions by requiring the Minister to take privacy and commercial sensitivity into account before issuing disclosure directions.

In short, while the Guidelines contain no litigation history, they create multiple procedural touchpoints , mandatory consultation, mandatory consideration lists, definitional thresholds, and data protection requirements , that could form the basis of administrative or statutory challenge. To identify any actual cases litigating these Guidelines, one must search Australian court databases and the Federal Register of Legislation for subsequent disputes, as neither the instrument nor the provided text records any litigation history.

The Guidelines contain multiple features that produce legal and operational friction points. The following are specific items, grounded in the instrument text, that practitioners, compliance officers and industry should flag as potential pitfalls.

1. “Reasonable period” and “as soon as practicable” are undefined. The Guidelines require consultation and invite submissions within a “reasonable period” in many provisions (for example, ss 7(2), 13(1)(b), 21(1)(b), 23(1)(b), 25(1)(b), 27(1)(b), 29(1)(c), 31(1)(b), 34(1)(b), 37(1)(b)). The instrument does not define “reasonable” and offers no minimum timeframes. Similarly, s 11(6) requires the Minister to decide “as soon as practicable” after an emergency declaration when aware an entity meets essential user criteria. These open-ended time standards create operational uncertainty and a risk that affected parties may be given very short windows to respond.

2. Mandatory but limited criteria for bulk customers. Section 8(2) gives two mandatory criteria for identification as a bulk customer: a current contractual arrangement and at least three months’ term. But the Minister “must not” identify a person if they have ceased the activities or do not intend to carry them on (s 8(3)). The “current contractual arrangement” language may capture short-term contracts that are nevertheless current; practitioners need to ensure contract documentation evidences both quantity and intended activity continuity.

3. Essential user threshold is potentially high and uses qualitative language. The essential user test requires goods or services provided to be “essential for the preservation of the health, safety or welfare of the community” and that failure to provide them would be “likely to impair substantially” members of the community (ss 11(2)-(3)). The instrument does not quantify “likely to impair substantially” and thus invites contest over evidentiary standards and risk assessments during emergencies.

4. Significant Ministerial discretion via “may take into account” and “any other relevant matter.” The Guidelines frequently allow the Minister to consider broad contextual factors (for example, ss 13(3)(c), 25(3)(c), 27(3)(c), 29(3)(c)). This openness can make outcomes difficult to predict and complicates delivery of compliance strategies for industry participants who may face sudden directional changes based on intangible national interest judgments.

5. Data disclosure obligations must be reconciled with existing reporting obligations and privacy/commercial sensitivity. The Minister must take into account existing information under the Petroleum and Other Fuels Reporting Act 2017 (s 21(2)(c)) and privacy considerations under the Privacy Act 1988 (s 23(2)(d)) and measures to protect commercially sensitive information (s 23(2)(e)). A “gotcha” arises when the Minister specifies a form of statistical information that differs materially from existing reporting formats; affected parties will need to re-map data systems quickly and consult on protections for sensitive information.

6. Allocation procedure mechanics are prescriptive but operationally demanding. Section 17(2) requires allocation mechanisms that can reduce a bulk customer’s future supply by specified percentages or amounts, sustain reduced volumes, enable further adjustments up or down, and be applied daily, weekly or monthly. Implementing systems and contractual notice regimes to comply with such granular adjustment requirements is potentially costly, particularly for wholesalers and downstream supply chains accustomed to longer lead times.

7. Repeal of 2008 Guidelines without transitional detail. Schedule 1 repeals the Liquid Fuel Emergency Guidelines 2008, but the instrument contains no transitional provisions. Entities relying on practices under the 2008 Guidelines must assume the 2019 Guidelines govern and adjust accordingly; there is no transitional period specified in the text provided.

8. The Guidelines repeatedly refer to “limitations” in the Act without reproducing them. Multiple Parts include notes that “there are limitations on directions” in specified subsections of the Act (for example, Parts 4, 8, 9, 10, 12 and 13). Practitioners must therefore consult the Act to understand limits on the Minister’s direction-making power; relying on the Guidelines alone risks missing statutory constraints.

9. No penalties, but compliance risk remains. The Guidelines themselves do not set penalties. However, directions given under the Act, which the Guidelines regulate, will impose obligations with enforcement consequences in the Act. Entities should not misread the Guidelines as signalling absence of enforcement simply because the Guidelines are silent on penalties.

10. Interaction of retail/wholesale restrictions with contractual norms. The Guidelines authorise directions that can limit supplies by quantum, timing or proof of entitlement (see ss 33(1) and 36(1)). These powers can override commercial practices in an emergency. Parties with long-term supply or take-or-pay contracts may find these directions materially altering contractual expectations; the Guidelines do not address contractual relief, so parties must consider the Act and general contract law.

These “gotchas” flow from the instrument’s combination of precise procedural constraints on the Minister, open-ended discretionary clauses, and operationally demanding obligations placed on industry. Practitioners should plan for compressed consultation windows, ensure contractual documentation is compliant with bulk customer criteria, align internal reporting systems with statutory reporting frameworks, and prepare systems to implement fine-grained allocation mechanics if directed.

Compliance under the Guidelines requires dual preparation: (1) readiness to engage with Ministerial consultation processes and identification instruments, and (2) operational capability to implement technical and reporting directions if issued under the Act. The following practical compliance checklist is grounded in the text and organised by actor.

For relevant fuel industry corporations (production, processing, refining, wholesaling, retailing, storage , see s 19)

• Review and document business classification. Confirm which class(es) under s 19 (and s 15 for wholesalers) apply. Maintain clear organisational charts and statements of principal or substantial activities to demonstrate whether reporting and allocation obligations apply to your entity.

• Prepare bulk allocation procedures. For wholesalers (s 15 and s 17) prepare a formal written bulk allocation procedure that: (a) sets out equitable allocation mechanisms consistent with potential Ministerial directions; (b) provides specific rules for reducing future supply to bulk customers by specified percentages or amounts and for sustaining reduced volumes; (c) details how to implement further reductions or increases and how changes will be applied on a daily, weekly and monthly basis; and (d) includes records and operational systems required to calculate and implement allocation adjustments. Submit particulars when and if the Minister requests, and be ready for Ministerial approval under the Act.

• Reserve and contingency planning processes. Establish procedures to track and, if directed, accumulate and maintain specified reserve quantities at specified places (Parts 4 and 8). Maintain inventory control systems capable of showing reserves by location and date to respond promptly to a direction to maintain or accumulate reserves (ss 12(1), 17(1) as described in ss 13 and 25).

• Data architecture for statistical information. Map existing reporting obligations under the Petroleum and Other Fuels Reporting Act 2017 and build data management systems capable of maintaining statistical information in formats that can be specified by the Minister (s 21(2)(c)). Ensure systems can produce data to the level of granularity likely requested, with audit trails and timestamps.

• Privacy and commercial sensitivity protections. Implement data handling protocols that meet the Privacy Act 1988 standards and safeguard commercially sensitive information. Document technical and organisational measures (access controls, anonymisation/pseudonymisation, data retention policies) so the Minister can rely on those measures when considering a s 23 direction to make statistical information available (s 23(2)(d)-(e)).

• Contract and customer documentation. Ensure bulk-customer contracts are clearly documented and meet the s 8(2) criterion of being for a period of at least three months if you expect clients to be identified as bulk customers. Maintain documents evidencing ongoing activities so the Minister cannot reasonably conclude the customer has ceased activities (s 8(3)).

• Internal emergency response playbook. Draft an internal playbook reflecting the range of directions the Minister can give during a national liquid fuel emergency (Parts 8-13). Include decision trees for implementing supply caps, evidence-of-entitlement checks, time-of-day rationing, and processes for re-prioritising essential users. Ensure logistic chains can accommodate daily/weekly/monthly allocation changes (s 17(2)(d)).

For relevant persons (non-corporate or non-class entities under s 20)

• Confirm whether you meet the “principal or substantial” activity test in s 20 for any of the listed operations (production, processing, refining, wholesaling, retailing, storage). If so, align your reporting and operational procedures to the same standards as corporations.

• Prepare to receive and respond to consultation invitations. The Minister must inform relevant persons before giving many directions and invite submissions within a reasonable period (eg s 21(1)); maintain contact details and designate an emergency liaison officer to receive notices and prepare submissions swiftly.

For bulk customers and essential users

• Evidence of contractual arrangements. Bulk customers should keep contemporaneous contracts showing quantities, contract periods (to meet s 8(2) the contract duration threshold of at least three months) and the purposes for which the fuel is used. The Minister’s identification hinges on these records.

• Demonstrate essentiality. Entities that consider themselves essential users should prepare written evidence showing how their goods or services are essential to the health, safety or welfare of the community and demonstrate that the activity cannot be carried out without a continuing supply of the specific refined liquid petroleum product (s 11(2)). Quantify likely population impacts to meet the “likely to impair substantially” standard in s 11(3) where possible.

For all affected parties: engagement and submissions

• Timely and high-quality submissions. When the Minister invites submissions (for example under s 7(1) on bulk quantity thresholds), supply concise, evidence-based submissions addressing the specific matters listed in the Guidelines, and consider proposing precise operational forms and timeframes for data and allocation procedures. Record submission dates and retain proof of delivery.

• Keep contemporaneous records. Log all notices from the Minister, submissions made, and any communications with other liquid fuel emergency Ministers. These records will be material to administrative review or disputes about whether consultation obligations were observed.

Operational readiness and technology

• Systems for rapid allocation changes. Build supply chain and billing systems that can support rapid percentage or absolute quantity reductions to customers and can implement adjustments on daily, weekly or monthly cycles (s 17(2)(a)-(d)).

• Data interoperability. Ensure that data systems used for routine reporting under the Petroleum and Other Fuels Reporting Act 2017 can produce the types of statistical reports contemplated by the Guidelines and that these reports can be securely transferred to the Minister (s 21(2)(c), s 23(2)(f)).

Legal and governance steps

• Legal review of directions. When the Minister issues any direction, obtain immediate legal advice on how the direction fits within the Act’s limits and whether the procedural requirements in the Guidelines were followed (for instance, whether consultation was adequate under the multiple “must consult” provisions). The Guidelines’ repeated “must” clauses provide potential grounds for administrative challenge if ignored.

• Contractual risk assessment. Pre-emptively evaluate long-term supply contracts and force majeure clauses in light of the Minister’s emergency powers to limit supply, allocate quantities, or require evidence of entitlement (see ss 21, 22, 23, 33, 36). Consider adding operational clauses to future contracts to allocate risks associated with government directions.

• Data protection compliance. Align internal legal and compliance processes with the Privacy Act 1988 and prepare to document protections for commercially sensitive information in case the Minister seeks disclosure under s 23.

Document examples to prepare

• A standard form of bulk allocation procedure compliant with s 17.

• A reserve-management SOP showing ability to accumulate and maintain reserves by location and date (Parts 4 and 8).

• A statistical reporting matrix mapping existing Petroleum and Other Fuels Reporting Act 2017 reports to potential Ministerial data orders (s 21(2)(c)).

• An essential-user evidence pack template including operational dependency analyses and public interest impact statements (s 11).

In short, compliance requires pre-event planning, documentation, data and inventory systems able to respond to granular and temporally frequent allocation changes, legal readiness to review directions quickly, and robust data protection measures. The Guidelines set procedural constraints that, if not observed by the Minister, may be relied on in challenge; however, they also impose substantive performance expectations and operational demands on industry that require advance investment.
