• Service categories. The plan distinguishes between national, commercial, community and open narrowcasting services. The Schedule lists the category for each frequency. For example, Schedule One lists five national services (1431 kHz, 1485 kHz, 95.7 MHz, 97.3 MHz, 98.9 MHz, plus later additions at 90.9 MHz and 1035 kHz in attachments 1.13 and 1.14), two commercial services (96.5 MHz SL4137 and 98.1 MHz SL4128), three open narrowcasting services (1314 kHz, 1575 kHz, 105.3 MHz), and a community service at 106.9 MHz SL2006. Schedule Two lists a community service at 94.1 MHz SL1150163 for Wollongong RA2. The Determination therefore allocates spectrum slots to categories with differing regulatory implications outside the document.

• Licence area. Attachment 1.1 defines Licence Area Wollongong RA1 in terms of Australian Bureau of Statistics areas from the 1996 Census: Wollongong (C), Shellharbour (A), Kiama (A). Attachment 2.1 identifies RA2 and states it is for community radio service licence numbers SL1150163 and SL1150266. The plan uses ABS-defined local government areas to fix the coverage region.

• Technical specification and transmitter data. Each entry in the Schedules refers to a Technical Specification Number (for example TS4137001 for SL4137 on 96.5 MHz) and an Attachment that contains the transmitter site nominal location, Australian Map Grid coordinates, emission band and mode (MF-AM or VHF-FM), carrier frequency, polarisation, maximum antenna height, and sector-by-sector ERP or CMF values. Attachments routinely state that "Site Tolerance: Refer to Technical Planning Guidelines", linking compliance to an external technical planning document.

• Coverage radius and special conditions. Several attachments include explicit coverage radii or special conditions. Attachments 1.9 and 1.10 indicate the open narrowcasting AM frequencies were made available only until 31/12/1999 and include a 'coverage radius' of 20 kilometres from a specified AMG point. Attachment 1.11 sets a coverage radius of 15 kilometres for the 105.3 MHz FM narrowcast. Attachment 1.13 imposes sectoral ERP restrictions and conditions intended to prevent unacceptable interference with specified television services and other users (WIN3 Wollongong, NBN3 Newcastle, WIN3 Narooma, Bombala 2KY HPON), and requires the cessation of WIN3 Wollongong for full use. Attachment 1.14 notes the availability of that AM service is subject to international coordination. Those special conditions are express constraints on deployment and operation.

• Amendment incorporation. Clause (7) expressly provides that a reference to a schedule or attachment includes that schedule or attachment "as amended from time to time". The Table of Instruments and Table of Amendments record the variation notices and dates (for example, Variation - November 2003; Variation No. 1 of 2006), and the internal Table of Amendments shows which clauses and schedules were amended, added or repealed. The plan therefore operates as a living allocation that can be and has been varied by subsequent gazetted instruments.

These main concepts define the Determination’s legal and technical footprint: it is a plan for spectrum allocation within defined geographic licence areas, with concrete transmitter parameters and constraints, and with an intended capacity to be amended over time.

The Determination affects multiple parties who occupy different positions in the value chain of radio broadcasting and spectrum management. All references and impacts below are grounded in the text of the Determination and its schedules.

• Broadcasters assigned service licences. The instrument names service licence numbers for certain services. Commercial operators holding SL4137 (96.5 MHz) and SL4128 (98.1 MHz) must operate in the Wollongong RA1 licence area in accordance with the Technical Specification Numbers linked in Schedule One (TS4137001 and TS4128001 respectively) and Attachment 1.7 and 1.8. Community licence SL2006 (106.9 MHz) is likewise specified with TS2006001 and Attachment 1.12. In RA2 the community licence SL1150163 (94.1 MHz) appears in Schedule Two with TS10008291 and Attachment 2.3. Holders of those licences will be directly bound by the technical details in the referenced attachments and by any special conditions in those attachments.

• Prospective entrants and spectrum applicants. The Determination declares the number and categories of services to be available in RA1 and RA2 (clauses (2)-(6)). By setting the available slots, it constrains which categories of applicants can apply for available frequencies in the stated licence area. For example, the plan identifies only two commercial services available in RA1, which limits the number of commercial allocations available under this plan. The document therefore affects competition for spectrum by defining available categories and frequencies.

• Engineers and technical planners. The attachments provide precise transmitter coordinates, antenna heights, polarisation, carrier frequencies, and sector-by-sector ERP or CMF values. Technical officers designing transmission systems, and contractors installing equipment, must match these parameters. Attachments repeatedly refer to "Site Tolerance: Refer to Technical Planning Guidelines". Compliance will therefore require technical work in accordance with both the attachment specifics and the referenced planning guidelines.

• Spectrum managers and regulators. The Australian Broadcasting Authority (ABA) is the maker of the Determination (Determination preface and last line). The schedules and the Table of Instruments show the ABA's role in amending the plan through variations and Gazette notifications. The document affects how the ABA administers allocations within the Wollongong licence areas and the authority’s decisions on interference, international coordination matters, and timing (for example, the temporary open narrowcasting availability until 31/12/1999).

• Users potentially affected by interference. Although not licensees under this plan, users of adjacent spectrum or services named as potential interference recipients are directly implicated. Attachment 1.13 lists specific services (WIN3 Wollongong, NBN3 Newcastle, WIN3 Narooma, Bombala 2KY HPON) and sets sectoral ERP caps until measures are taken to prevent unacceptable interference. Those other licensees or spectrum users are stakeholders because the plan conditions allocation on steps being taken to avoid interference with their reception.

• Local communities and licence area residents. The licence area definition (Attachment 1.1) and the coverage radii in several attachments define which populations may receive particular services. Community broadcasters allocated by the Determination, for instance SL2006 and SL1150163, are intended to serve Wollongong and Wollongong/Nowra areas respectively. Those residents are affected by the availability of community programming, and by the technical limits that shape service reach.

The Determination does not itself list fees, administrative processes for licensing, or a schedule of penalties. It therefore affects these parties primarily by dictating which frequencies and technical parameters apply within the defined licence areas, and by constraining who can operate which kinds of services in those areas.

The Determination creates obligations and confers a set of technical entitlements rather than administrative rights or financial obligations. The most concrete duties and rights flow from the allocated frequencies, associated technical specifications, and the special conditions contained in attachments and schedules.

• Duty to observe technical specifications. Each service entry in the Schedules is linked to a Technical Specification Number and an Attachment that sets transmitter coordinates, carrier frequency, band and mode, emission limits, polarisation, maximum antenna height, and sector-by-sector ERP or CMF values. For example, Attachment 1.4 mandates a carrier frequency of 95.7 MHz, mixed polarisation, maximum antenna height 167 m and ERP values by sector of 40 kW over 0°T-160°T and 150 kW over 160°T-350°T. Operators using these channels must conform to those specified parameters; the Determination establishes those parameters as the operative technical plan. The attachments also repeatedly state "Site Tolerance: Refer to Technical Planning Guidelines", which creates an obligation to comply with the technical planning guidance referenced.

• Entitlement to allocate and use specified frequency and coverage. The plan grants the right to use a stated frequency in the licence area subject to the technical limits in the attachment. That right is bounded by sectoral ERP limits, antenna heights, polarisation and coverage radii where present. For instance, Attachment 1.11 provides an entitlement to operate on 105.3 MHz FM with maximum ERP up to 2 kW over certain azimuth sectors and a declared coverage radius of 15 kilometres from the nominal transmitter site. The entitlement is thus both spatially and technically qualified.

• Duty to comply with special conditions. Specific attachments carry additional mandatory conditions. Attachment 1.9 and 1.10 note the open narrowcasting AM frequencies were made available "until 31/12/99". Those temporal conditions impose a duty to cease or seek further authorisation after that date. Attachment 1.13 sets sectoral ERP restrictions pending measures to prevent unacceptable interference to enumerated television services and requires WIN3 Wollongong to have ceased operating prior to commencement of the service, in order to remove certain caps. Those are explicit operational constraints tied to interference considerations.

• Duty to accommodate international coordination. Attachment 1.14 states the availability of the 1035 kHz AM service is "subject to international coordination". That language places an obligation on the operator or the regulator to ensure that international frequency coordination requirements have been satisfied before full operation. The Determination thereby recognises external coordination duties.

• Right to be referenced to the latest amended attachment. Clause (7) provides that a reference to a schedule or attachment includes the schedule or attachment "as amended from time to time". This produces a procedural right for operators to have their technical entitlement read with subsequent variations, and a concurrent duty to monitor and comply with amendments listed in the Table of Instruments and Table of Amendments, because the operative technical plan is the attachments as they stand from time to time.

• Administrative right of the ABA to vary the plan. The Table of Instruments records variations (for example 26 November 2003, 15 December 2006), and the Table of Amendments sets out which clauses or schedules were affected. Those entries demonstrate the ABA’s administrative right and power to vary the licence area plan by Gazette notice. Operators therefore have a right in their basic allocation but must expect possible variation by the regulator.

The Determination does not itself contain an enforcement schedule, nor does it prescribe fines, licence suspensions or revocation processes. The document records which services "are to be available" and specifies technical parameters, site locations, antenna heights and sector-by-sector ERP or CMF limits in attachments, but it does not prescribe sanctions for noncompliance within the instrument itself.

From the text the only explicit enforcement implication is the Australian Broadcasting Authority’s role as the maker of the Determination. The document begins by stating it is "made by the Australian Broadcasting Authority" (Determination preface). The Table of Instruments and Table of Amendments record the ABA’s power to vary and amend the plan via gazetted variations. That demonstrates an administrative pathway for the ABA to control availability and the technical plan over time.

Where the Determination imposes operational constraints, such as sectoral ERP caps in Attachment 1.13 until measures are taken to prevent unacceptable interference, or the temporal limitation on open narrowcasting frequencies in Attachments 1.9 and 1.10 (available until 31/12/99), compliance will be required to effect operation. The document, however, does not specify what consequences flow from failure to comply with these constraints. Any enforcement, remedial action or penalties must therefore be sought in the broader legal and regulatory framework under which the ABA operates, including the Broadcasting Services Act 1992, the licences issued to commercial and community operators (for example SL4128, SL4137, SL2006), and any regulatory instruments or licence conditions that are not reproduced in this Determination.

Practical enforcement levers that arise from the text include:

• Technical denial of service by refusing to register or permit a transmitter that does not meet the attachment parameters or that would exceed the permitted ERP or antenna height in a sector. The attachments set concrete technical thresholds which will be used to determine acceptability.

• Administrative variation or withdrawal of allocation by the ABA, exercised through the amendment machinery reflected in the Table of Instruments. The existence of multiple variation entries shows the ABA has used amendment powers to change the plan.

• Reliance on international coordination. Attachment 1.14’s "subject to international coordination" condition means that international spectrum coordination outcomes can prevent operation until coordination is resolved. That mechanism functions as a constraint enforced by international agreements and bilateral or multilateral coordination processes.

In short, the Determination itself does not create an enforcement mechanism or penalties; it establishes technical obligations and special conditions and leaves enforcement to the ABA and to the broader legal framework referenced in the Determination.

The Determination explicitly situates itself under the Broadcasting Services Act 1992 by making the plan "under subsection 26(1) of the Broadcasting Services Act 1992" (Determination (1)). That is the single direct statutory cross-reference contained in the instrument. The practical implication is that the Determination is an instrument made under, and operating subject to, the Broadcasting Services Act 1992. Any enforcement, licensing terms, or administrative action that rely on statutory power will be located in that Act and associated regulations, rather than in the Determination text on its own.

The attachments repeatedly refer to "Technical Planning Guidelines" for site tolerances and planning parameters. Those Guidelines are external to the Determination and, while not reproduced here, are operative in the sense that the attachments make compliance with them a technical requirement. Therefore the Determination integrates with regulatory technical guidance documents and thus depends on external technical frameworks for implementation.

The Determination also interacts with international obligations by reference. Attachment 1.14 states that the availability of the 1035 kHz AM service is "subject to international coordination." That language imports obligations under international frequency coordination rules and treaties, and indicates that the regulator must ensure compliance with those obligations before the service is fully available. The Determination therefore sits alongside international radio regulations and bilateral coordination practices.

The Table of Instruments and Table of Amendments show the Determination has been amended and varied via notices published in the Gazette and registered instruments, with dates of notification and commencement recorded. Those variation processes are exercises of administrative law and delegated legislative power under the enabling statute. The Determination therefore interacts procedurally with the administrative law framework for making statutory instruments, including Gazette notification and commencement processes.

There is no direct reference in the Determination to other Commonwealth Acts, state planning laws, environmental approvals, tower siting approvals, electromagnetic emissions standards beyond the ERP/CMF limits, or to licence fee regimes. Any intersection with those regimes will arise from the actual operation of a transmitter under a licence and will depend on the separate statutes, local government planning instruments, and licence conditions that apply outside the text of this plan.

Finally, the Determination’s clause (7) that references schedules and attachments "as amended from time to time" creates a legal relationship between this plan and future amendments. That procedural linkage ensures the plan is read in conjunction with subsequent variation instruments, and so the legal effect of this Determination is to be understood within an ongoing statutory amendment process that uses the Gazette and registered instruments to affect its content.

The Determination contains an internal record of its own amendment history. The Table of Instruments lists the principal instrument and subsequent variations, including Gazette notification dates and commencement dates. The entries are:

• Licence Area Plan - Wollongong (Radio) - July 1999, notified 14 July 1999, commenced 14 July 1999.

• Licence Area Plan - Wollongong (Radio) - Variation - November 2003, notified 26 November 2003, commenced 26 November 2003.

• Licence Area Plan- Wollongong Radio - Variation No. 1 of 2006, notified 15 December 2006, commenced 16 December 2006.

The Table of Amendments provides a more granular account of how clauses and schedules were affected by those variations. The table notes that Clause (1) through Clause (6) were amended by "No. 1 of 2006", and Clause (7) was both amended by No. 1 of 2006 and had an addition. The Table of Amendments also shows Schedule One was repealed and replaced, varied in 2003 and amended in 2006, while Schedule Two was amended by No. 1 of 2006. Specific attachments were added or repealed: Attachment 1.13 and 1.14 were added by Variation 2003; Attachment 2.2 was repealed by No. 1 of 2006. The table uses shorthand entries such as "ad." for added, "am." for amended, "rep." for repealed, and "rs." for repealed and substituted, and records which instrument effected each change.

Within the main text the Schedules themselves show a Variation - Licence Area Plan: Wollongong Radio - November 2003 reflected in Schedule One and the attachments 1.13 and 1.14 described as "VARIATION - LICENCE AREA PLAN: Wollongong - November 2003". Attachments 1.13 and 1.14 contain new technical specifications added in November 2003, including the 90.9 MHz FM national service with special conditions concerning interference and sectoral ERP limits (Attachment 1.13), and a 1035 kHz AM national service made subject to international coordination (Attachment 1.14). The Table of Instruments entry for Variation No. 1 of 2006 (notified 15 December 2006) shows further amendments took effect the next day, but the Table of Amendments indicates multiple clauses and schedules were subject to that 2006 instrument.

Clause (7) of the Determination provides that a reference to a schedule or attachment includes that schedule or attachment as amended from time to time, which is itself a legal mechanism for rolling forward amendments. The Table of Instruments and Table of Amendments operate as the formal record of the Determination’s amendment history and demonstrate that the plan has been updated by Gazette notice on at least two subsequent occasions since the 1999 principal instrument.

For practitioners this history means the operative technical entitlements and constraints must be read against the current versions of schedules and attachments as updated by the 2003 and 2006 variations. The Determination’s own archival material is therefore part of the legal record of its evolution.

The text of the Determination contains no record of litigation. If a practitioner requires the litigation history relevant to the allocation, interference disputes, or licence conditions implicated by this plan, that history will not be found in this Determination. The Determination contains a number of specific details that can catch operators and advisers who fail to read the attachments and tables carefully. These are precise, document-grounded points that have practical implications for technical deployment and regulatory compliance.

• Temporary open narrowcasting availability. Attachments 1.9 and 1.10 explicitly state the AM frequencies 1314 kHz and 1575 kHz "have been made available for open narrowcasting purposes until 31/12/99." If an operator assumes continuous availability beyond that date solely from the schedule entry they will be wrong. Those attachments impose a temporal limit which means the allocation expired unless further action (not recorded here) extended or reallocated the frequency.

• Sectoral ERP caps contingent on interference measures. Attachment 1.13 (90.9 MHz) contains conditional sectoral caps. • Site tolerance references point to external guidelines. Many attachments include the statement "Site Tolerance: Refer to Technical Planning Guidelines." The technical tolerances are not specified in the Determination, therefore compliance depends on an external guidance document. Failing to consult those Guidelines may produce noncompliance even if the attachment parameters are otherwise respected.

• Multiple overlapping national services on one nominal transmitter site with differing sectoral ERPs. Attachments 1.4, 1.5, 1.6 and 1.13 are all sited at Knights Hill with substantial ERP allocations (for example, 150 kW sectoral ERP ranges for some national FM entries). Interference between co-sited services and coordination with television services named in Attachment 1.13 can require detailed engineering and management. The special conditions in Attachment 1.13 make this an explicit constraining factor.

• Coverage radius declarations. Attachments 1.9, 1.10 and 1.11 specify declared coverage radii (20 km for the AM narrowcast entries and 15 km for the 105.3 MHz FM narrowcast). • Discrepancies between licence records and schedule notation. Schedule columns include a note that the frequency and status information is accurate "as at the date of publication." Licence numbers for national services are noted as "Not applicable" while commercial and community services show licence numbers. Practitioners must be alert that the Determination is a planning instrument and that current licence register entries may differ if the ABA has since granted, varied or revoked licences.

• Amendment mechanics. Clause (7) and the Table of Instruments demonstrate that attachments and schedules can change. Relying on an older attachment or ignoring the Table of Amendments risks noncompliance because the plan requires operators to observe the attachments "as amended from time to time." Practitioners must monitor Gazette notices and register updates for changes.

Each of these points arises directly from the text of the Determination and its attachments. They are practical hazards for operators who treat the schedule as static, or who fail to consult external technical planning guidelines, or who do not secure the interference management and coordination measures upon which certain ERP entitlements are conditional.

Compliance with the Determination means operating strictly within the frequency, transmitter site, emission mode, antenna and ERP/CMF limits, coverage radii and special conditions that the schedule and attachments set out, and ensuring adaptation to any subsequent amendments incorporated under clause (7). The following checklist is grounded in the instrument’s text and attachments and outlines the concrete steps an operator or adviser should take.

1. Identify the correct Licence Area and attachment. Confirm whether the operation is in Wollongong RA1 (Attachment 1.1) or RA2 (Attachment 2.1). Match the intended service category and frequency to the correct Schedule entry (Schedule One or Schedule Two) and note the linked Technical Specification Number and Attachment reference (for example TS4137001 and Attachment 1.7 for SL4137 on 96.5 MHz).

2. Match transmitter site coordinates and nominal location. The attachments provide AMG coordinates and a nominal location (for example Knights Hill, Brokers Nose, Windang). Use those coordinates as the primary datum for engineering design. Do not rely on informal descriptions. The attachments also state "Site Tolerance: Refer to Technical Planning Guidelines", therefore obtain the Technical Planning Guidelines and comply with the stated tolerances.

3. Conform to carrier frequency, emission mode and polarisation. Each attachment specifies band and mode (MF-AM or VHF-FM), carrier frequency and polarisation (for example mixed polarisation for many FM services). Engineering and transmitter configuration must match those specifications exactly.

4. Respect antenna height and sectoral ERP/CMF limits. Attachments set maximum antenna heights (for example 167 m for Knights Hill national FM services, 15 m for Brokers Nose entries, 69 m for the commercial FM service entries) and sectoral ERP or CMF profiles. Configure antenna systems, feeders and transmitters so ERP in each sector does not exceed the specified maxima. For AM services, respect the maximum CMF values by azimuth sectors.

5. Observe declared coverage radii. For narrowcasting services with explicit coverage radii (Attachments 1.9, 1.10, 1.11), ensure service footprint does not exceed the radius measured from the specified AMG point. That limitation could affect transmitter power, antenna siting, and deployment of translators or repeaters.

6. Comply with special conditions before expanding ERP. Attachment 1.13 imposes sectoral ERP caps until measures are taken to prevent unacceptable interference to enumerated services, and requires WIN3 Wollongong to have ceased operating before the service may commence unrestricted operation. Operators must secure the relevant interference mitigation measures and regulatory confirmations before attempting higher ERP usage over specified sectors.

7. Complete international coordination where required. Attachment 1.14 makes availability subject to international coordination. Before commencing operation under that attachment, obtain evidence that international coordination obligations have been satisfied. This may require communications with the ABA’s spectrum coordination office and relevant international bodies.

8. Monitor and apply amendments. Clause (7) requires reading schedules and attachments "as amended from time to time." Regularly check the Gazette notices and the ABA/ACMA instrument register for Variation - November 2003 and Variation No. 1 of 2006 as recorded in the Table of Instruments, and for any subsequent amendments. Ensure licence conditions and technical deployment reflect the current attachments.

9. Align with any licence conditions outside the Determination. For service licences identified in the Schedules (for example SL4137, SL4128, SL2006, SL1150163), operators must ensure they also comply with the terms and conditions of those licences, which may include administrative, content or reporting obligations not reproduced here. The Determination is a technical plan and does not purport to replace licence conditions.

10. Coordinate with affected adjacent services and stakeholders. Where the attachment names specific services that must be protected (for example WIN3 Wollongong, NBN3 Newcastle, WIN3 Narooma, Bombala 2KY HPON in Attachment 1.13), engage with the regulator and those stakeholders to achieve the required measures that remove sectoral caps or enable operation. Record documentary evidence of coordination outcomes.

11. Retain technical records. Maintain records of transmitter settings, field strength measurements, antenna mounting heights, ERP calculations by sector, and any coordination correspondence. The attachments set precise numerical constraints that can be objectively measured and audited.

12. Treat expiry conditions as binding. The temporary availability notations for certain narrowcasting frequencies (available until 31/12/99 in Attachments 1.9 and 1.10) are operational constraints. If an operator is attempting to rely on those allocations beyond that date, verify whether a later gazetted instrument has reallocated or extended the availability; do not assume continued entitlement.

13. Seek regulatory confirmation for material changes. If an operator needs to change nominal transmitter site, antenna height beyond the declared maximum, or ERP beyond specified sectoral maxima, obtain ABA/ACMA approval, noting that the Table of Instruments records the regulator’s practice of varying the plan.

Following this checklist will align an operator’s technical deployment with the Determination’s concrete specifications and conditional constraints. The Determination is a technical allocation instrument with amendment mechanisms.
