Licence Area Plan – Roxby Downs Community Radio

Licence area plan. Under Part 3 of the Broadcasting Services Act, the ACMA may determine licence area plans for the purposes of community and commercial radio broadcasting. Each plan defines a "licence area" - a geographic area within which a broadcasting licence provides coverage and outside which the licensee is generally not permitted to broadcast. The plan also sets the technical specifications: frequency, maximum radiated power, antenna height, and modulation type. For community radio, the plan may also specify the category of community licence (e.g. "community radio" vs "community television") and any special conditions (such as restrictions on sponsorship announcements). In the Roxby Downs case, the original 2004 plan would have defined a very limited area corresponding to the townsite and immediate surrounds, consistent with the small population (around 4,000 at the time). The 2023 variation likely expanded or adjusted this area in line with the Roxby Downs growth and changes in the local settlement pattern.

Variation. The 2023 variation is itself a legislative instrument that amends the original plan. It is a "variation" rather than a new plan, meaning the underlying 2004 instrument continues in effect as amended. The variation substituted the whole of clauses 1 and 2, added clauses 3 through 7, and amended the schedule and attachments. This is a common pattern: the original determination was brief (perhaps only a title, commencement, and the mapping schedule). The variation adds interpretative provisions (such as definitions), transitional arrangements, and more detailed technical specifications. The use of "Attachment 1.1" and "Attachment 1.2" suggests maps or technical diagrams that set out the licence area boundary and transmitter location parameters.

Community radio. Under the Broadcasting Services Act, community radio is defined as a broadcasting service that is not commercial (i.e. not funded primarily by advertising) and is operated by a community organisation on a not-for-profit basis. The Roxby Downs plan is specifically for "Roxby Downs Community Radio". The licence for community radio in Roxby Downs is typically held by a local incorporated association (e.g. Roxby Downs Community Radio Inc.). The plan therefore directly affects the operational scope of that organisation. Community radio licensees must comply with the plan as a condition of their licence; operating outside the defined area or on unauthorised frequencies is a breach of the licence conditions and may lead to enforcement action by the ACMA.

ACMA's role. The ACMA is the regulator. It makes the plan, varies it, and enforces compliance. It also issues the actual licence to the community organisation. The plan is a legislative instrument registered under the Legislation Act 2003, giving it legal force. The ACMA's discretion in licensing is constrained by the plan: it cannot issue a licence that is inconsistent with the plan.

Spectrum allocation. The assignment of a radio frequency is a scarce resource. The licence area plan is one mechanism for allocating spectrum to community broadcasting as a public benefit, rather than through market mechanisms (e.g. auction). This is a deliberate policy choice that suppresses the price mechanism. The Roxby Downs community radio service occupies a slice of the radio spectrum (likely in the FM band) that could alternatively be used for commercial broadcasting, emergency services, or other purposes. The plan therefore has an opportunity cost: by reserving that spectrum for a community service, it excludes other higher-value uses, such as a commercial station that might pay licence fees and provide more diverse programming. The economic efficiency of this allocation is rarely tested because the spectrum is not priced. The plan also restricts the community station's ability to expand its coverage if that would interfere with other licensed services, thereby capping its audience potential and limiting its economies of scale.

The primary entities affected are: the Australian Communications and Media Authority (ACMA), which must administer the plan; the licensee of Roxby Downs Community Radio (likely an incorporated community association); any other radio broadcaster whose frequency or coverage may overlap with Roxby Downs; residents in and near Roxby Downs who listen to the station; and potential applicants for any future community radio licence in the same area. Because this plan covers community radio, it does not directly affect commercial broadcasters unless there is spectrum interference. However, the plan can indirectly affect commercial operators because it fixes the spectrum allocation for that area: if the community service uses a frequency that blocks a commercial service from expanding into Roxby Downs, that is a constraint on competition. The residents are affected as listeners: the geographic coverage determines whether they can receive the signal. If the plan's coverage is limited to the townsite, rural residents on properties outside the boundary may not receive the service. The 2023 variation presumably addressed some of these coverage issues, but the source does not specify. The mining company operating the Roxby Downs mine (BHP) may have a practical interest, because community radio can serve as an emergency broadcast facility and a source of local information for its workforce. The plan also affects the local council and community organisations that rely on the radio station for advertising community events (community radio may broadcast sponsorship announcements). Because this is a legislative instrument, it also affects the Commonwealth Parliament, which has power to disallow the instrument (though no disallowance has been recorded). Legal practitioners advising the licensee or the ACMA on licensing compliance must be familiar with the plan's exact terms. Accounting firms dealing with the licensee's financial statements should note that the licence is not a tradeable asset: it is tied to the plan and cannot be sold or moved. The plan is also relevant to any potential purchaser of the licensee's assets (if the station were to change hands), because the new operator would be bound by the same plan.

The instrument imposes duties primarily on the ACMA and on any licensee. The ACMA's duty is to ensure that any community broadcasting licence issued for Roxby Downs is consistent with the plan. If the ACMA were to issue a licence with a different frequency or coverage area, that would be ultra vires. The ACMA also has a duty to maintain the register of legislative instruments and to review the plan periodically (though no specific review interval is stated in the source). The licensee has the right to operate subject to the plan, and the right to apply for a variation of the plan if its needs change. However, there is no private right to a variation: the ACMA has discretion to amend the plan only if it is satisfied that the variation is in the public interest and does not cause undue interference to other services. The licensee also has the duty to operate within the technical parameters set out in the plan, including staying within the defined licence area and not exceeding the maximum authorised power. Breach of these duties is a breach of the licence conditions under section 45 of the Broadcasting Services Act. The instrument also likely confers rights on other parties: for example, a person living outside the licence area has no right to demand coverage, but they may make representations to the ACMA for a future variation. The plan does not create any private rights of action: a listener who cannot receive the signal cannot sue the licensee or the ACMA; any enforcement is public law enforcement by the ACMA. The 2023 variation, by adding clauses 3 through 7, may have introduced savings and transitional provisions (clause 7 often deals with transitional arrangements), which protect existing licences from immediate compliance with the new parameters for a grace period. That would give the licensee a right to a transition period. Without seeing the text, it is not possible to specify the exact transition or savings rights.

The instrument itself does not create pecuniary penalties; enforcement occurs under the Broadcasting Services Act. The key provision is section 45: a licensee must not breach a condition of its licence. Operating outside the licence area or on an unauthorised frequency is a breach. The ACMA can issue a remedial direction under section 134, requiring the licensee to cease broadcasting on the unauthorised parameters. Failure to comply with a direction can lead to civil penalties of up to $250,000 for an individual and $1.25 million for a body corporate (section 137). In egregious cases, the ACMA may suspend or revoke the licence (section 44). Criminal penalties also exist under section 134(3) for failing to comply with a direction. Additionally, unlicensed broadcasting (e.g. operating on a frequency not assigned by the plan) is an offence under the Radiocommunications Act 1992, with penalties including imprisonment (section 162). The ACMA can also seek injunctions to prevent ongoing breaches (section 166). For the Roxby Downs community radio licensee, the practical risk is relatively low because the licensee is likely a volunteer-run organisation with limited resources; the ACMA typically uses a graduated enforcement approach, starting with informal warnings. However, the plan itself, as a legislative instrument, is also subject to disallowance by either house of Parliament within 15 sitting days of tabling. If disallowed, the plan (or the variation) ceases to have effect, but that is a parliamentary remedy, not a penalty. There is no provision within the instrument for liquidated damages or compensation to affected parties. The enforcement regime creates a compliance burden: the licensee must self-monitor to ensure that its transmitter output, antenna pattern, and coverage remain within the plan's limits. Any modifications to the transmitter (e.g. antenna height increase) require prior approval, adding time and cost. The penalty structure creates a strong incentive for licensees to operate conservatively, potentially underutilising their authorised power to avoid accidental interference.

This licence area plan sits within a broader legislative framework. The primary Act is the Broadcasting Services Act 1992 (Cth), under which the plan is made (specifically section 26). That Act governs all forms of broadcasting in Australia: commercial, community, national (ABC/SBS), and subscription. The plan is one of many such plans across Australia; each licence area plan is standalone but collectively they comprise the national spectrum planning for broadcasting. The plan must also be consistent with the Radiocommunications Act 1992, which governs the allocation and use of spectrum. Under that Act, the ACMA issues apparatus licences for each transmitter, and those apparatus licences must reference the relevant licence area plan. The Radiocommunications Act also imposes interference standards: the plan's technical parameters must ensure that the Roxby Downs community radio service does not cause undue interference to other licensed services (including commercial stations in nearby areas like Port Augusta). If interference occurs, the ACMA may require modifications under the Radiocommunications Act, overriding the licence area plan if necessary (though a plan variation would typically follow). The plan also interacts with the Australian Communications and Media Authority Act 2005, which establishes the ACMA and gives it the power to make legislative instruments. The Legislative Instruments Act 2003 (now Legislation Act 2003) governs the registration, tabling, and disallowance of plans. The plan may also interact with local planning laws: the transmitter site may require council approval or development approval under South Australian planning legislation. If the licensee wishes to move or rebuild the transmitter, the licence area plan may restrict the options. For example, if the plan specifies a particular transmitter location (e.g. at a latitude/longitude coordinate), any relocation would require a variation to the plan, which is a federal legislative instrument, not a local council matter. That creates a two-layer regulatory hurdle. The plan does not directly interact with competition or consumer law, but if the community station holds a monopoly on local radio, the ACCC's merger provisions could apply if the station were to merge with another, but that is unlikely. The instrument also interacts with freedom of speech protections under the implied constitutional freedom of political communication, but the plan itself only regulates technical parameters; it does not restrict content. Content regulation for community radio occurs under the Broadcasting Services Act codes of practice, not the plan.

Based solely on the source provided (endnote 3 and the amendment table), the history is brief. The original instrument was the Licence Area Plan - Roxby Downs Community Radio - February 2004, registered on 13 April 2005 (F2005B00710) and coming into effect on 5 February 2004 (the date of determination before registration, which is possible under Legislative Instruments Act transitional provisions). It remained unamended for over 18 years. The variation instrument, Variation to Licence Area Plan - Roxby Downs Community Radio - 2023 (No.1) (F2023L01488), was registered on 13 November 2023 and commenced the next day, 14 November 2023. The variation made extensive changes: it repealed the old "Determination" heading and the entire "Determination" paragraph as well as the "Schedules text" (which likely contained the original mapping schedule). It substituted the whole of clause 1 (the name of the instrument) and clause 2 (commencement). It added new clauses 3 through 7. Clause 3 likely contains definitions, clause 4 the licence area specification, clause 5 the technical parameters, clause 6 the conditions, and clause 7 transitional provisions (this is a common structure, but not confirmed from the source). It amended Schedule One, and within that schedule, Attachments 1.1 and 1.2 were amended. The amendment table shows that the name of the instrument itself was changed (the original heading and title were amended). The variation also repealed the old "Determination" formulation, which suggests the original was drafted as a determination, while the revised instrument is more structured as a legislative instrument with formal clauses. This is a modernisation consistent with the Legislation Act 2003 requirements for clarity and structure. No application, saving or transitional provisions were included with the 2023 variation (the relevant column in endnote 3 is blank). The lack of transitional provisions in the table may be because any transitional arrangements are included in the instrument itself (clause 7) rather than in a separate provision. The amendment history shows no other amendments; the plan is now at Compilation No. 1 (C1 likely). The registration numbers and dates indicate compliance with legislative drafting rules. The variation was not disallowed, so it remains in effect.

The source does not mention any litigation, and there are no reported cases from the Federal Court, High Court, or Administrative Appeals Tribunal involving this specific licence area plan. Given that the plan applies to a single community radio station in a remote area, litigation is unlikely. The plan has been in place since 2004 without judicial challenge. If there were litigation, it would most likely be an application for judicial review of an ACMA decision under this plan (e.g., refusal to vary the plan, or enforcement action against the licensee). But no such case is recorded in the source. The absence of litigation may indicate that the plan is uncontroversial, or that the costs of challenging an ACMA decision are prohibitive for the small community licensee. It could also mean that disputes are resolved informally. Under the Administrative Decisions (Judicial Review) Act 1977, a decision by the ACMA to refuse to vary the plan could be reviewable, but there is no record of such an application. Any challenge to the validity of the variation instrument itself (e.g., on grounds of procedural error) would be brought in the Federal Court, but none has occurred. The plan is not listed in any known trade practices or constitutional litigation. This lack of contestation may reflect the fact that licence area plans are technical instruments that are rarely the subject of legal disputes; they are more often negotiated with affected parties before being made. The 2023 variation may have been preceded by a public consultation process (required under the Broadcasting Services Act), which would reduce the likelihood of later litigation. The source does not, however, mention any public consultation or objections.

The practical traps in this instrument are subtle. First, the plan is a legislative instrument but is not as widely known as the Broadcasting Services Act itself. A new board member of the community radio station may be unaware that the station's licence is subject to this plan, and may attempt to change the transmitter location or power without realising that a variation to the plan is required, not just a change to the apparatus licence. That could lead to unintentional breaches. Second, the plan may contain mapping errors or outdated coordinates. The fact that the 2023 variation amended Attachments 1.1 and 1.2 suggests the maps were updated, but any discrepancy between the map and the actual terrain could create uncertainty. If the map is imprecise (e.g., not aligned with cadastral boundaries), the licensee may inadvertently broadcast into an area that is not within the licence area, or fail to cover an area they believe is included. Third, the plan may contain a condition that restricts the type of programming or sponsorship. Community radio licences often carry conditions about sponsorship announcements (e.g., maximum of five minutes per hour). Such conditions could be in the plan or in the licence. The instrument as amended in 2023 likely codified some of these conditions. A failure to adhere to sponsorship limits could result in a finding of non-compliance. Fourth, the plan may prohibit the licensee from operating on a specific frequency that the licensee has historically used if the variation changed the frequency assignment. The transitional provisions (clause 7) may allow a grace period, but if the source does not specify the period, the licensee may not have known about the change. Fifth, the plan interacts with the Radiocommunications Act's spectrum licensing. The community station's frequency is reserved under the plan, but that does not guarantee protection from interference by a later-licensed service in the same band. The ACMA resolves interference disputes on a case-by-case basis, and the plan does not create a property right in the frequency. This means the station could be asked to move frequency or reduce power if a new licensee causes interference, with no compensation. Sixth, the plan is likely not available in a simple map form; the attachment may be a technical diagram with latitude/longitude coordinates that require GIS expertise to interpret. A volunteer-run station may struggle to visualise its coverage boundary. Seventh, the plan's compliance burden: the station must test its signal regularly to ensure it does not exceed the permitted field strength at the boundary. This requires equipment and expertise that the station may not have, leading to reliance on the ACMA for monitoring. Eighth, the plan is not static: the ACMA may vary it again without the station's consent, potentially affecting the station's operations. The 2023 variation shows that changes can happen unilaterally. Ninth, the plan may contain a sunset or review clause (not mentioned in the source but common in modern legislative instruments). If the plan is due for review, the station should engage in the process to protect its interests. Finally, the plan is a Commonwealth instrument, meaning any dispute about its interpretation must be resolved in Commonwealth courts, increasing the cost for a small community organisation.

Compliance requires several steps. First, the licensee must obtain and read the current compilation of the plan (the 2004 plan as varied in 2023). The instrument is available on the Federal Register of Legislation. The licensee should identify the specific technical parameters: the authorised transmitter location (likely a grid reference), maximum ERP (effective radiated power), antenna height above ground, and the frequency. The licensee must ensure that the actual transmitter is configured to exactly these parameters. Any change (e.g., replacing the antenna) must be pre-approved by the ACMA. Second, the licensee should confirm that the licence area map (Attachment 1.1 or 1.2) matches the station's actual coverage. This may require drive testing with a field strength meter to ensure the signal does not exceed the plan's limit outside the area. Third, the licensee must keep records of all transmitter tests, modifications, and interference complaints. The ACMA may request these records during an inspection. Fourth, the licensee must monitor the ACMA's website for any proposed variations to the plan and submit comments if a variation is likely to affect operations. The Broadcasting Services Act requires the ACMA to consult before varying a plan. The station should participate in that consultation. Fifth, the licensee should review its own licence conditions (which incorporate the plan) and ensure compliance with any condition about sponsorship announcements or programming. Sixth, the licensee should consider getting professional advice from a broadcasting consultant or lawyer when major changes are contemplated (e.g., moves). The cost of such advice is a compliance burden but reduces the risk of inadvertent breach. Seventh, the licensee should ensure that its board and volunteers are aware that the plan is a legal document with the force of law. A simple operating manual that references the key technical limits can help. Eighth, the licensee should maintain a copy of the plan and its variation at the station office for reference. Ninth, the licensee should check that its apparatus licence (issued under the Radiocommunications Act) is consistent with the plan; if not, the apparatus licence must be amended. Tenth, the licensee should be proactive about interference: if another station causes interference, the licensee should inform the ACMA immediately. The plan does not guarantee interference protection, but the ACMA may take action under the Radiocommunications Act. Finally, if the station wants to change anything (e.g., increase power, move transmitter, or change frequency), it must apply to the ACMA for a variation of the plan. This is not a simple process; it involves a public consultation and approval from the regulator. The application should include technical evidence showing that the change will not cause interference and is in the public interest. The station should budget for engineering reports and legal costs. The 2023 variation shows that the ACMA is willing to update the plan; the station should take advantage of this process if needed. Failure to comply with the plan can result in enforcement action, which for a small community station could be devastating financially. Proactive compliance is the cheapest path.
