What it does
This instrument is the Licence Area Plan (LAP) for Murwillumbah Radio, made under the Broadcasting Services Act 1992 and compiled by the Australian Broadcasting Authority. The compilation text states it is the Murwillumbah Radio Licence Area Plan dated December 2000, prepared on 28 June 2005 taking into account amendments up to “Licence Area Plan - Murwillumbah Radio - Variation No. 1 of 2005” (see the compilation heading and Note 1). The LAP, as presented, contains a short set of operative elements: a Special Conditions clause addressing adjacent channel interference with a named neighbouring service, and a formal Table of Instruments and Table of Amendments documenting the original notification and an identified variation.
Mechanically, the LAP does three things in the text provided:
- It records the plan as made under the Broadcasting Services Act 1992 (the instrument’s legal basis is expressly stated).
- It imposes at least one technical special condition on the Murwillumbah Radio service, in the form of a requirement to reduce maximum operating effective radiated power (ERP) if that service causes adjacent-channel interference to a specified third-party service. The Special Conditions provision reads, verbatim: “If adjacent channel interference is caused by this service to 4CBL Logan Community service, operating on 101.1 MHz, the maximum operating ERP of this service will be need to be reduced.”
- It records the administrative history: the LAP was notified and commenced on 10 January 2001; Variation No. 1 of 2005 was notified on 1 April 2005 and commenced on 2 April 2005; the compilation incorporates amendments up to that variation (see Table of Instruments in Note 1).
The Table of Amendments in the compilation identifies which clauses, Schedules and Attachments were added, amended, repealed or replaced by Variation No. 1 of 2005. The amendments column uses short codes (ad., am., rs.) and links those codes to specific clauses and attachments: Clause (1)-(4), Schedule 1, Schedule 2, Attachment 1.1, Attachment 1.6, Attachment 2.1. The compilation itself is prepared by the Australian Broadcasting Authority, which is the named preparer on the document.
