Licence Area Plan - Merredin (Radio) - September 1996

The plan uses the following core concepts and instruments, each appearing in the text and attachments.

• Licence area. The plan defines licence areas by reference to Australian Bureau of Statistics geographic units from the 6 August 1991 Census. The Merredin licence area is a list of named shires, towns and ABS CD codes with an aggregate population number of 17,210 (Attachment 1.1). The Bruce Rock community licence area is a list of ABS CD codes with an aggregate population of 6,332 (Attachment 2.1). These ABS-derived boundaries are the operative service footprints for allocation and technical planning.

• Categories of service. The plan distinguishes at least four categories: commercial, national, community and open narrowcasting. The Schedules show which category applies to each transmitter or service. The explanatory header to the Schedules emphasises that service licences are required only for commercial and community services "as the Broadcasting Services Act 1992 only requires service licences for commercial and community services."

• Service licences and transmitter specifications. The Schedules pair service licence numbers (where applicable) with transmitter specification numbers (TS numbers). For example SCHEDULE ONE lists Commercial SL010003 with transmitter specification TS001312 (Attachment 1.2) and Commercial SL010008 with multiple transmitter specification numbers TS005158, TS005160, TS005161, TS005163, TS005166, TS005204 which correspond to transmitters in Merredin, Beacon, Hyden, Kondinin, Narembeen and Southern Cross (SCHEDULE ONE and Attachments 1.3-1.8).

• Technical parameters. Each transmitter attachment specifies: frequency band and mode (MF-AM for the AM entry; VHF-FM for FM entries), carrier frequency in kHz or MHz, polarisation, maximum antenna height in metres, maximum ERP in watts or kilowatts, output radiation pattern (in all attachments the output radiation pattern is stated as "At all angles of azimuth" with a single ERP/CMF), nominal transmitter site descriptions and Australian Map Grid references, and a site tolerance referral to "Technical Planning Guidelines" for tolerances (Attachments 1.2-1.14, 2.2).

• Availability and allocation trigger. The plan states that the Bruce Rock community radio service "is to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Merredin radio licence area plan has been made" (Determination paragraph). This makes Gazette publication the allocation trigger for that community licence.

• Reference instruments. The plan explicitly invokes subsection 26(1) of the Broadcasting Services Act 1992 as its legal basis and repeatedly refers to the Technical Planning Guidelines for site tolerance. The plan therefore sits in a framework of statutory licensing, administrative instruments and technical planning guidance.

• Population and market footprint. By providing ABS populations for each ABS area included in the licence areas, the plan supplies a quantitative market footprint: Merredin 17,210 persons; Bruce Rock 6,332 persons (Attachments 1.1 and 2.1). These figures are embedded in the determination and serve as the demographic basis for allocating service categories and transmitter reach.

• Distinction between main transmitter and repeaters. The commercial SL010008 service, for example, is associated with multiple transmitters listed under the same service licence number but with distinct TS numbers and frequencies for different towns (Attachments 1.3-1.8). This permits single commercial services to be relayed via multiple low-power FM transmitters to cover a dispersed rural licence area.

These concepts make the licence area plan an instrument that prescribes where and how radio spectrum is to be used within specified geographic footprints, what technical constraints apply to each transmitter, which services require a service licence, and how a nominated community service is to be released for allocation.

This determination affects identifiable groups in narrowly described ways.

• Potential and incumbent broadcasters. The plan lists two commercial service licences (SCHEDULE ONE: SL010003 and SL010008) and one community licence (SCHEDULE TWO: SL010318). Holders of those service licences, applicants for available licences, and parties operating national or open narrowcasting services in the footprint will be directly affected: they must operate within the frequencies, ERP limits, antenna heights and site tolerances recorded in the Attachments (for example Attachment 1.3: commercial FM 105.1 MHz, maximum ERP 10 kW; Attachment 2.2: community Bruce Rock FM 100.9 MHz, maximum ERP 2 kW).

• Manufacturers, installers and maintenance contractors. The attachment-level technical parameters define equipment and installation requirements. Specifications such as maximum antenna height, polarisation, ERP, and map grid coordinates constrain antenna structures, transmitters and feeders; contractors who supply or install the systems will be constrained by these parameters and by the referenced Technical Planning Guidelines for tolerances.

• Spectrum planning and coordination bodies. The Australian Broadcasting Authority (the decision-maker here) and the technical planning unit charged with frequency coordination must enforce these parameters. The plan refers to "Technical Planning Guidelines" for site tolerance, thereby involving those guidelines and the officials who administer them in every installation, modification or reconfiguration.

• Local communities and advertisers. The plan defines licence areas by ABS units and population totals; these determine the catchment for local content obligations (if any under separate instruments) and for commercial targeting. A commercial licence that carries multiple low-power transmitters to cover outlying towns (for example SL010008 with transmitters in Beacon, Hyden, Kondinin, Narembeen and Southern Cross) determines where advertisers can reach audiences, and where localised programming may be targeted.

• National broadcasters and open narrowcasters. While the plan lists "N/A" for service licence numbers for national and open narrowcasting services , with the Schedules noting that service licences are required only for commercial and community services , national services and open narrowcasters are included as authorised transmitters with technical parameters (for example Attachments 1.9-1.12 for national FM transmitters; Attachments 1.13-1.14 for open narrowcasting FM transmitters). Operators intending to run national or open narrowcasting services must still meet the transmitter specifications recorded here.

• Regulators and administrators dealing with allocation. The plan makes a specific allocation promise: a community radio broadcasting service for Bruce Rock is "to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Merredin radio licence area plan has been made." The timing condition imposes a procedural obligation on the regulator to publish the Gazette notice and makes the licence available thereafter.

• Technical consultants and lawyers advising clients. The plan contains technical, geographic and administrative detail that will guide advice on entry, equipment, compliance and likely coverage. The reliance on 1991 ABS boundaries and the referral to external Technical Planning Guidelines will shape due diligence steps.

Who pays and who decides, in practice. The Authority (the Australian Broadcasting Authority as stated at the top) decides the plan; costs are borne largely by licensees and applicants who must fund transmitter construction, equipment, and compliance with the technical parameters and referenced guidelines. The plan does not set fees or payments in the text; those financial terms will be administered under broader licensing rules and the Broadcasting Services Act 1992 framework, which the plan invokes but does not reproduce.

The document itself sets technical constraints and availability rights rather than broad operational duties. The operative obligations and entitlements in the plan are explicit and narrow.

Rights created or recorded by the plan

• Right to operate particular transmitters in the licence area consistent with the attachment specifications. Each transmitter attachment lists carrier frequency, frequency band/mode, polarisation, maximum antenna height and maximum ERP or CMF. For example Attachment 1.3 permits a commercial FM transmitter on 105.1 MHz at a maximum ERP of 10 kW and maximum antenna height 64 m; Attachment 2.2 permits a community FM transmitter on 100.9 MHz at a maximum ERP of 2 kW and antenna height 30 m.

• Right of availability for allocation. The document expressly states that the Bruce Rock community radio broadcasting service "is to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Merredin radio licence area plan has been made" (Determination paragraph). That is a right to proceed to allocation governed by the Gazette timing trigger.

• Right to operate national and open narrowcasting transmitters subject to the transmitter specifications even though the schedule lists "N/A" in the service licence column; the transmitter specifications for national and open narrowcasting entries remain part of the plan (Attachments 1.9-1.12, 1.13-1.14).

Duties or constraints imposed by the plan

• Duty to operate within the stated technical parameters. Each attachment provides maximum limits that the transmitter must not exceed: ERP, antenna height, polarisation and carrier frequency. The AM entry (Attachment 1.2) sets a "Maximum CMF" of 450 V at all angles of azimuth and notes that "The CMF at all elevations is not to exceed the specified CMF at 0 degrees elevation for all angles of azimuth."

• Duty to adhere to site tolerances as set out in the Technical Planning Guidelines. Each transmitter attachment contains "Site Tolerance: Refer to Technical Planning Guidelines," creating a duty to comply with external guidance for allowable location variation and other planning tolerances.

• Duty to operate within the designated licence area. The Schedules, Attachments 1.1 and 2.1 set the ABS-defined licence area footprints. A licence holder or authorised operator must ensure that the service operates consistent with those footprints; the plan supplies the geographic limits.

• Duty to hold a service licence when required by the Broadcasting Services Act 1992. The Schedules header states that the service licence column shows the "service licence number which has been allocated to the service, if appropriate (column two); N/A = not applicable, as the Broadcasting Services Act 1992 only requires service licences for commercial and community services." That imposes a legal duty on commercial and community operators to hold the prescribed service licence under the Act; the plan records where those have been allocated.

What the plan does not impose

• The plan does not itself articulate content obligations, licence fees, duration of licence, renewal procedures or penalties. It records technical and geographic permissions but is silent on operational licensing processes beyond noting that a community licence is to be made available for allocation after Gazette publication.

• The plan does not set coordination protocols with other spectrum users; it refers to Technical Planning Guidelines for site tolerance but does not reproduce those guidelines.

Practical consequences of these duties and rights

• Compliance is technical and site-specific: operators must measure and document ERP, antenna height, frequency stability and polarisation in accordance with the attachment constraints and Technical Planning Guidelines.

• The plan creates predictable coverage footprints for commercial, national and community interests via explicit frequencies and ERPs. That enables commercial planning, but it constrains where and how operators may extend signals, add repeaters or alter power without revising the plan or seeking regulatory approval consistent with the Broadcasting Services Act 1992 and associated technical guidance.

• The plan allocates a finite number of commercial service licences in the Merredin footprint and a discrete community allocation for Bruce Rock; that allocation affects market entry and the supply of radio services to advertisers and listeners.

The determination itself contains no penalty clauses, sanctions schedules, or enforcement protocols. It records technical specifications, service categories and licence availability; it does not set out the enforcement mechanisms that would follow non-compliance.

What the document states about regulatory authority

• The plan is made by the Australian Broadcasting Authority under subsection 26(1) of the Broadcasting Services Act 1992 and is therefore an administrative instrument created under statutory authority. That legal basis indicates that enforcement of compliance with the plan will be founded in the Broadcasting Services Act 1992 and the Authority's regulatory powers, but the plan does not reproduce those powers or the associated penalties.

What is absent in the text

• There is no schedule of offences tied to exceeding ERP, antenna height or operating on an unauthorised frequency. There is no statement in the determination about licence suspension, cancellation, fines or remedial action for interference or breach of technical limits.

• There is no procedural text setting out monitoring, inspection or audit regimes for technical compliance. The plan refers to Technical Planning Guidelines for site tolerances but does not describe measurement, certification or enforcement processes.

Implications for enforcement risk and compliance cost

• Enforcement will depend on the statutory and administrative framework outside this plan. Because the plan does not specify inspection or penalty processes, operators must rely on the Broadcasting Services Act 1992 and the Authority's published enforcement policies and procedures (not reproduced in this document) to understand consequences for non-compliance.

• The absence of enforcement detail in the plan increases reliance on external instruments and creates an implementation risk: parties must obtain and follow the Broadcasting Services Act 1992 and any more detailed regulatory instruments or guidance from the Authority to know precise enforcement outcomes.

• Practically, operators will face compliance costs in documenting and demonstrating adherence to the technical parameters recorded here. The plan establishes numeric limits that can be measured; that makes technical monitoring straightforward in principle but requires instruments, testing infrastructure and potentially third-party certification to demonstrate compliance to the regulator.

Given the document's silence about specific sanctions, anyone relying on this plan should consult the Broadcasting Services Act 1992 and related regulatory materials administered by the Authority (or its successor) to determine the concrete enforcement and penalty regime that applies to breaches of the plan or of the licences recorded in the Schedules.

The licence area plan explicitly situates itself within and defers to other statutory and administrative instruments. The plan contains several internal references that indicate legal and procedural interactions.

Statutory basis

• The determination opens by saying it is made "under subsection 26(1) of the Broadcasting Services Act 1992." This establishes a statutory relationship: the plan is an administrative instrument made under the Broadcasting Services Act 1992. The plan therefore interacts with all licensing, regulatory, and enforcement provisions that arise under that Act even though those provisions are not reproduced in the plan.

Licensing framework

• The Schedules header states that service licences are listed "if appropriate" and that "N/A = not applicable, as the Broadcasting Services Act 1992 only requires service licences for commercial and community services." This indicates that the plan relies on the Broadcasting Services Act 1992 to define which service categories require formal service licences, and it records assigned service licence numbers for commercial and community services accordingly (SCHEDULE ONE and SCHEDULE TWO). The plan therefore operates as a subordinate instrument within the Act's licensing architecture.

Technical planning and spectrum coordination

• Every transmitter attachment includes "Site Tolerance: Refer to Technical Planning Guidelines." This cross-reference brings in a separate body of technical guidance. Compliance with site tolerance rules will be necessary for implementation; those guidelines will also likely include coordination procedures, interference protection contours and allowed deviations. The plan defers the operational detail of site tolerance to that separate instrument, producing an interaction where the plan sets numeric maxima and the Technical Planning Guidelines deliver the tolerances, site relocation rules and other operational constraints.

Administrative publication

• The plan makes allocation of the Bruce Rock community licence contingent on publication of notice in the Commonwealth of Australia Gazette. This creates an interaction between the Authority's administrative procedures (Gazette publication) and the availability of licences; the timing of allocation flows from a Gazette action.

Use of ABS geography

• The licence areas are specified in terms of Australian Bureau of Statistics census units from the 6 August 1991 Census. This creates an interaction between administrative boundaries used for statistical purposes and the regulatory definition of licence footprints. It implies that any legal or administrative disputes about the licence area will require reference to ABS definitions and that any later ABS boundary changes or more recent census data are not automatically reflected in this plan.

Operative gaps and residual legal regimes

• The plan does not include enforcement, content regulation, fees, or licence duration; these matters are addressed in the Broadcasting Services Act 1992 and related instruments. Therefore, licence holders must navigate the broader statute and administrative instruments (not included here) to understand obligations such as licensee codes of practice, content restrictions, fees, transfer rules, renewal procedures and enforcement mechanisms.

Consequences for cross-border and spectrum matters

• Because the plan specifies frequencies and ERP/antenna heights, it affects spectrum coordination with other users. The plan does not provide coordination agreements with neighbouring licence areas; interference and cross-border coordination will be managed under the Technical Planning Guidelines and any bilateral or multi-party arrangements implemented through the Authority.

In short, the document is an instrument that fixes category, geographic footprint and technical parameters; it operates in a network of laws and instruments: the Broadcasting Services Act 1992 for licensing authority and procedural rules, the Technical Planning Guidelines for site tolerance and technical coordination, and ABS definitions for geographic boundaries. The plan presumes those external instruments will supply licensing procedure, enforcement, detailed planning tolerances and any applicable content or operational rules.

The instrument itself is a single determination dated and "Determined by the Australian Broadcasting Authority on 26 September 1996." The text contains no express amendment schedule, no footnotes indicating prior versions, and no later revision dates within the material provided. The attachments list specific transmitter specification numbers (TS numbers) and service licence numbers where applicable, but they do not include a history of changes.

What the document records about versions and change

• The front matter states only that the Authority "hereby makes this plan for broadcasting services in the Merredin region of Western Australia, under subsection 26(1) of the Broadcasting Services Act 1992." It does not record a prior determination or a series of amendments. The plan therefore appears, on its face, to be the initial determination for the Merredin licence area as at September 1996.

What is not in the text

• There are no amendment entries, no "as amended" notes and no record of revocation or replacement in the provided material.

Implication for users seeking current status

• Because the document contains no amendment history, users must not assume this is the current operative plan. The plan is a 1996 instrument and makes use of the 1991 ABS census units; any later administrative changes, successor regulators, revisions to spectrum planning or subsequent determinations would not be visible within this document. The absence of an in-document amendment history increases the need to check the public register of the regulator for later determinations, variations, cancellations, or successor instruments.

Administrative trace and archival status

• The plan's attachments include specific TS numbers and SL numbers; these identifiers provide useful references for cross-checking with administrative records. For example SCHEDULE TWO lists community service licence SL010318 and transmitter specification TS004815 (Attachment 2.2). If a user needs a subsequent amendment, those identifiers will assist queries to the regulator or searches of administrative registers.

Recommendation implicit in the absence of amendment record

• Practitioners should treat this document as a historical administrative instrument and verify whether later amendments, replacements or revocations exist before relying on the technical parameters or licence allocations for current compliance or transaction work. The document itself does not supply such verification.

The material provided contains no references to court decisions, tribunal determinations, administrative appeals or litigation related to this licence area plan. The text does not cite any case law, does not flag disputes, and does not record appeals or conditions that resulted from adjudication.

Consequences of the absence of litigation entries

• Because the plan does not record litigation, a reader cannot infer whether its decisions have been contested, upheld, modified or set aside by subsequent legal processes from this document alone. The plan is silent on any legal challenges.

Practical implications

• For transactional due diligence, disputes or enforcement advice, reliance on this document alone is insufficient to determine whether the plan’s allocations or technical parameters have been the subject of litigation. Practitioners will need to search the public record of courts and administrative tribunals, and the regulator's internal records, for any cases involving the Merredin plan, its service licences, or the technical specifications listed here.

How to proceed if litigation history is material

• Use the specific identifiers in the plan (service licence numbers SL010003, SL010008, SL010318; transmitter specification numbers TS001312, TS005158, TS005160, TS005161, TS005163, TS005166, TS005204, TS000108, TS000174, TS000166, TS001304, TS000109, TS004581, TS004815, etc.) as search terms in administrative and judicial databases and registries. The plan’s date (26 September 1996) and the “Merredin” and “Bruce Rock” labels should assist in locating any regulatory decisions, appeals or litigation record that post-dates the plan.

Because the provided text contains no litigation history, any statements about disputes, outcomes or judicial interpretation would require independent confirmation from court and tribunal records and are not included in this document.

The text contains several features, inconsistencies and external references that create practical traps for users who rely on the plan without further verification.

1. Dependence on external instruments for site tolerance and detailed planning. Each transmitter attachment includes the line "Site Tolerance: Refer to Technical Planning Guidelines." The plan does not reproduce those Technical Planning Guidelines. That creates an implementation risk: critical tolerances, coordination parameters, acceptable site variation and possibly contour methods are delegated to another document. Anyone attempting to build or alter a transmitter site must obtain and comply with those guidelines; failure to do so could result in non-compliance even if the attachment parameters are met on paper.

2. Use of dated ABS census units. The licence area boundaries are defined by ABS units from the 6 August 1991 Census (Attachments 1.1, 2.1). Those geographic definitions and population figures (Merredin 17,210; Bruce Rock 6,332) are frozen to the 1991 census in this plan. For present-day licensing, market valuation, or statutory compliance that depends on up-to-date population or changed local government boundaries, users must not assume the plan reflects current demographics or administrative boundaries.

3. Inconsistency in service licence numbering. SCHEDULE ONE lists commercial service licences as SL010003 and SL010008. Attachment 1.2 and 1.3 present service licence numbers as "SL10003" and "SL10008" respectively. This discrepancy in zero-padding or formatting could cause confusion when cross-referencing with administrative registers or searching for the licences in electronic records. Practitioners should verify the correct SL identifiers with the regulator.

4. "N/A" entries for national and open narrowcasting service licence numbers. The Schedules record service licence number "N/A" for national and open narrowcasting services and explain this by reference to the Broadcasting Services Act 1992 requiring service licences only for commercial and community services. That creates two operational points: national and open narrowcasting transmitters are nevertheless specified in numerical and technical detail, but their regulatory pathway for authorisation and any subsequent transferability, fees or obligations will differ from commercial and community services. Users who assume identical licence treatment across categories will be mistaken.

5. Ambiguity in technical term "CMF" in AM attachment. Attachment 1.2 for the AM transmitter lists "Maximum CMF 450 V" and a note stating "The CMF at all elevations is not to exceed the specified CMF at 0 degrees elevation for all angles of azimuth." The plan does not define CMF. For implementers and compliance officers unfamiliar with this term in this context, this is a technical ambiguity that requires consultation of the applicable technical standards or the Authority's technical planning guidance to confirm measurement method and units.

6. Single azimuth specification for the output radiation pattern. All transmitter attachments give output radiation pattern as "At all angles of azimuth" with a single maximum ERP or CMF value. This does not provide directional radiation pattern masks for protecting particular co-channel or adjacent-channel services; those directional constraints may be handled in the Technical Planning Guidelines, but they are not in this plan. Assuming omnidirectional operation where directional constraints are required would be a mistake.

7. Multiple transmitters under one commercial licence. SCHEDULE ONE associates multiple TS numbers with SL010008, indicating a single commercial service will operate via several low-power FM transmitters (Merredin main 105.1 MHz at 10 kW plus low-power repeaters in Beacon 88.5 MHz 20 W, Hyden 88.7 MHz 25 W, Kondinin 88.3 MHz 25 W, Narembeen 93.1 MHz 50 W, Southern Cross 102.3 MHz 1 kW). Commercial entrants should note that this structure creates a single-service footprint assembled from multiple transmitters; obligations, coverage and billing practices may flow from the single licence yet require multiple technical deployments.

8. Allocation timing trigger. The Bruce Rock community service is stated to be "available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Merredin radio licence area plan has been made." If a prospective applicant assumes the licence is available prior to Gazette publication, they will be mistaken. The plan establishes a procedural trigger; verify Gazette publication dates.

9. No fees, content rules or duration specified. The plan does not mention licence fees, duration, content obligations, transferability or renewals. Relying on the plan for full licensing obligations will miss those matters which are likely set out in the Broadcasting Services Act 1992 or separate licence instruments.

10. Map grid references but sometimes only nominal location text. Attachments give Australian Map Grid Zone/Easting/Northing references for many sites but combine those with textual nominal locations such as "7.2 km WSW of town MERREDIN", "Ghooli R/T site", or "Lot 3 Clayton Street HYDEN". Relying exclusively on the textual description without checking the provided grid coordinates could lead to site selection errors. Conversely, using the grid reference without obtaining the Technical Planning Guidelines could overlook site tolerance allowances.

Each gotcha creates a specific action point: obtain the Technical Planning Guidelines; confirm current licence numbering and register status; check Gazette publication; verify current ABS boundaries if demographic or legal footprint matters; clarify technical terms such as CMF; and consult the Broadcasting Services Act 1992 and the regulator for fees, enforcement and licensing procedures.

Compliance with the plan requires a combination of administrative, technical and procedural steps grounded in the document and the external instruments the plan references.

1. Confirm licensing status and register entries. Before any operational or transactional step, verify the current status of the service licence numbers and transmitter specifications listed in the Schedules and Attachments (for example SL010003, SL010008, SL010318; TS001312, TS005158, TS004815, etc.). Because the plan dates from 1996 and contains formatting inconsistencies in SL numbers across the body (for example SL010003 vs SL10003), obtain authoritative confirmation from the regulator's licence register.

2. Obtain and follow the Technical Planning Guidelines. Each attachment directs the reader to refer to the Technical Planning Guidelines for site tolerance. Obtain those guidelines and apply them to determine allowable site variation, contour modelling methods, co-channel and adjacent-channel protection requirements, and any measurement protocols. The plan's ERP, antenna heights and frequencies must be implemented in conjunction with those guidelines.

3. Observe the precise transmitter parameters in each Attachment. For each transmitter operate at or below the listed maxima:

   • AM: Attachment 1.2 (Carrier 1098 kHz, Frequency band MF-AM, Maximum CMF 450 V; note the CMF constraint across all elevations).
   • Major commercial FM: Attachment 1.3 (Carrier 105.1 MHz, Mixed polarisation, Maximum antenna height 64 m, Maximum ERP 10 kW).
   • Small town FM repeaters: Attachments 1.4-1.8 specify frequencies and ERPs ranging from 20 W to 50 W and antenna heights 20-30 m.
   • National transmitters: Attachments 1.9-1.12 specify FM frequencies (107.3, 107.7, 107.9, 106.3 MHz) and ERPs from 50 W to 1 kW with antenna heights 20-70 m.
   • Open narrowcasting: Attachments 1.13-1.14 specify 95.9 MHz and 88.7 MHz at 50 W ERP.
   • Community Bruce Rock: Attachment 2.2 specifies 100.9 MHz FM at 2 kW ERP and 30 m antenna height.

Ensure transmitters are configured to meet polarisation and antenna height constraints; document compliance.

4. Use the provided Australian Map Grid references for siting. Each transmitter attachment includes Zone/Easting/Northing references. Use those coordinates plus the site tolerance rules to determine exact permitted tower locations. Do not rely solely on textual nominal locations.

5. For commercial and community services, ensure possession of the required service licence under the Broadcasting Services Act 1992. The Schedules note that commercial and community services require service licences. Do not commence broadcasting until the appropriate service licence has been obtained and any conditions attached to it have been met.

6. For the Bruce Rock community licence, observe the allocation trigger. The plan states this community service is "to be available for allocation immediately after publication of the notice in the Commonwealth of Australia Gazette stating that the Merredin radio licence area plan has been made." Confirm Gazette publication and then follow the regulator’s allocation process for community licences.

7. Undertake interference and coverage modelling. Because the output radiation pattern is set "At all angles of azimuth" with a single ERP, and because directional constraints and tolerances are not reproduced here, perform contour and interference modelling against neighbouring services and co-channel assignments using the Technical Planning Guidelines' methods. Retain modelling reports as part of compliance records.

8. Document and certify technical parameters. To demonstrate compliance to the regulator, obtain commissioning reports, measurement certificates and, where required by the Authority or Technical Planning Guidelines, third-party testing of ERP, spectral purity, occupied bandwidth and antenna height. For the AM specification’s "CMF" limit, seek an Authority interpretation or a qualified engineer’s certification that the measurement method complies with regulator expectations.

9. Coordinate any changes with the regulator before implementation. If you plan to change transmitter location, ERP, frequency or antenna height beyond site tolerances, obtain prior approval or a variation to the plan or licence as required under the Broadcasting Services Act 1992. The plan itself does not set variation procedures; those will be in the Act or the Authority’s administrative rules.

10. Account for demographic and administrative context. The licence areas are defined by the 1991 Census ABS units and associated population totals. If obligations, service planning or commercial assessments depend on current demographics or LGAs, obtain up-to-date ABS data and verify whether a later plan or amendment has updated the licence footprint.

11. Retain cross-references for auditability. Keep copies of the plan’s Attachments, Technical Planning Guidelines, service licence documents, commissioning certificates and Gazette notice confirming Bruce Rock allocation availability. These documents will be essential in any audit, enforcement or due diligence processes.

12. Seek regulator guidance where terms are undefined. For technical terms not defined in the plan, such as "CMF" in Attachment 1.2, request written guidance from the regulator or obtain the authoritative technical standards referenced by the regulator.

Following these steps aligns practical operations with the plan as drafted while recognising that the plan defers critical operational and enforcement detail to the Broadcasting Services Act 1992 and the Technical Planning Guidelines. Conformance requires attention to both the numeric parameters in the attachments and the external instruments the plan references.
