Plain English Summary

3/10 complexity

This text explains what endnotes in a compiled law must contain (abbreviation key; legislation and amendment histories) and how "misdescribed amendments" are treated. Mechanically, if a misdescribed amendment can be given effect it may be edited into the compilation under section 15V of the Legislation Act 2003; if not, it is left out and marked “(md not incorp)”. The rules affect those who compile, publish or rely on consolidated legislation by clarifying editorial discretion, disclosure and the signal that an amendment was not incorporated.

Misdescribed amendments

A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under section 15V of the Legislation Act 2003.

If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.
