The source defines several concepts, all procedural. An endnote is a section at the back of a compiled law that provides metadata about the compilation and its amendment history. Endnote 1 explains the purpose and structure of the endnotes themselves. Endnote 2 is the abbreviation key. Endnote 3 is the legislation history, which lists every law that has amended the compiled law, along with commencement dates and details of application, saving or transitional provisions not included in the compilation. Endnote 4 is the amendment history, which records amendments at the provision level (usually section or equivalent) and notes any repealed provisions. A misdescribed amendment occurs when an amending law does not accurately describe how an amendment is to be made. Under section 15V of the Legislation Act 2003, if despite the misdescription the amendment can be given effect as intended, it is incorporated through an editorial change. If it cannot be given effect as intended, the amendment is not incorporated and (md not incorp) is added to the amendment history. The abbreviation key defines standard drafting abbreviations: ad (added or inserted), am (amended), amdt (amendment), c (clause), Ch (Chapter), def (definition), Dict (Dictionary), Div (Division), exp (expires/expired), F (Federal Register of Legislation), gaz (gazette), LA (Legislation Act 2003), LIA (Legislative Instruments Act 2003), mod (modified/modification), No (Number), par (paragraph/subparagraph), Pt (Part), r (regulation/rule), rep (repealed), rs (repealed and substituted), s (section/subsection), Sch (Schedule), Sdiv (Subdivision). The key also uses underlining to indicate that whole or part of a provision has not commenced or is to be commenced. Paragraph includes subparagraphs and sub-subparagraphs. Section includes subsections. The endnotes are governed by the Legislation Act 2003 and the drafting conventions of the Office of Parliamentary Counsel. None of these concepts is a legal right or duty. They are all documentary conventions for legislative drafting and publication. The endnote template is standard across Commonwealth Acts, meaning this material could belong to any Act currently in force. The text provides no content that would allow a reader to identify the subject matter, scope, or operation of the underlying legislation.

The endnote apparatus directly affects legislative drafters, publishers at the Office of Parliamentary Counsel, and anyone who uses the Federal Register of Legislation to research the current text and history of a Commonwealth Act. Legal practitioners, compliance professionals, journalists, and researchers rely on the endnotes to determine whether a particular provision has been amended, repealed, or is yet to commence. The abbreviation key and the notation for misdescribed amendments matter when assessing whether a provision is legally operative. For example, if an amendment is labelled (md not incorp), a reader cannot assume the amendment took effect. This can affect statutory interpretation and legal advice about the state of the law at a given date. The endnotes also affect anyone who needs to identify transitional or saving provisions that may preserve rights or obligations after an amendment. The legislation history in endnote 3 is critical for determining commencement dates, especially where different provisions of an amending Act commence at different times. The distinction between a misdescribed amendment that can be given effect and one that cannot is a technical drafting point, but it can have real consequences for enforcement actions and private rights. A person who relies on an amendment that was never properly incorporated could be misled about their legal position. Conversely, a person who assumes an amendment did not take effect when it could have been editorially corrected under section 15V of the Legislation Act 2003 may inadvertently breach the law. The endnotes do not directly regulate members of the public. They are a secondary source of information about the primary legislation. The compliance burden falls on those who produce, maintain, and interpret the compilations. For the general public, the main effect is that the endnotes increase transparency and reduce the risk of relying on outdated or incorrect versions of the law. However, the complexity of the notation system can itself create confusion for non-specialist readers. The use of underlining to indicate uncommenced provisions, for example, is not intuitive and requires explanation.

The source text does not create any duties or rights. It is a metadata framework. No person is required to do anything, or entitled to anything, by reason of the endnotes themselves. The only operational provision referenced is section 15V of the Legislation Act 2003, which confers a power on the legislative publisher to make editorial changes to correct misdescribed amendments. That section is a power, not a duty. It allows the publisher to incorporate an amendment if it can be given effect as intended despite the misdescription. If the amendment cannot be given effect as intended, the publisher must not incorporate it. The notation (md not incorp) serves as a formal record that the amendment was not made. This is a safeguard against erroneous or unauthorised changes to the statute book. It reflects a conservative approach: the publisher does not guess at legislative intent. The duty of accuracy and completeness rests on the Office of Parliamentary Counsel and the Federal Register of Legislation. The endnotes are the mechanism by which that duty is discharged. For the reader, there is a practical responsibility to check the endnotes before relying on a compiled text. An experienced legal researcher knows to verify the legislation history in endnote 3 and the amendment history in endnote 4, especially where a provision appears to have been added, repealed, or substituted. The abbreviation key must be consulted to interpret the notation. The risk of error lies primarily with those who skip the endnotes. The endnotes themselves impose no legal obligation on private parties. They are purely informational. However, in litigation or regulatory proceedings, the endnotes can be cited to establish the text of the law as at a particular date. A court may rely on the endnotes to determine whether an amendment has validly commenced. In that sense, the endnotes have evidentiary significance, but they do not create substantive rights or duties.

There are no penalties or enforcement provisions in the source text. The endnote apparatus is not a regulatory instrument and does not create offences, civil penalties, or enforceable undertakings. Section 15V of the Legislation Act 2003 is a procedural provision about editorial corrections; it carries no penalty. The consequence of ignoring the endnotes is informational, not punitive. If a person relies on a compiled provision without checking the endnotes and the provision has been repealed, they may make an error in legal analysis or compliance. That error may expose them to liability under the substantive Act, but the liability flows from the Act itself, not from the endnotes. The endnotes are part of the official compilation and are published on the Federal Register of Legislation. They are therefore part of the authoritative text for evidentiary purposes under the Legislation Act 2003. However, there is no separate penalty for misreading them. The enforcement risk is indirect. For example, if a practitioner fails to notice that a provision is marked as uncommenced (underlined) and advises a client that the provision is in force, the practitioner may face professional misconduct claims or liability for negligent advice. That risk arises from the duty of care owed by the practitioner, not from the endnotes themselves. The same applies to a business that relies on a compiled text without verifying commencement: it may inadvertently breach the substantive law. The endnotes are a tool to avoid that outcome, not a source of enforcement.

The source text interacts with the Legislation Act 2003 (Cth), specifically section 15V, which authorises editorial modifications to compiled laws. The endnotes are produced pursuant to the standards set under that Act. The abbreviation key includes the Legislation Act 2003 (as LA) and the former Legislative Instruments Act 2003 (as LIA). The Legislation Act 2003 governs the publication, commencement, and compilation of Commonwealth legislation. The endnotes are the mechanism by which the compilation records its own history. The endnote template is standardised across all Commonwealth compilations. It does not interact with state or territory legislation unless a Commonwealth Act incorporates or refers to such legislation. The interaction is procedural, not substantive. The endnotes have no direct interaction with the common law. They are a statutory publication mechanism. However, the misdescribed amendment rules under section 15V interact with the rules of statutory construction. If a court is asked to interpret a provision that was the subject of a misdescribed amendment, the notation (md not incorp) will inform the court that the amendment was never validly made. The court must then interpret the provision as it stood before the attempted amendment. This can affect the outcome of a case. The endnotes also interact with the Acts Interpretation Act 1901 (Cth) and its successor provisions in the Legislation Act 2003, particularly those concerning commencement and the effect of repeals. The legislation history in endnote 3 provides the commencement information required to apply those rules. The interaction is wholly informational: the endnotes supply the data that enables proper application of the general interpretative principles.

The source text does not contain an amendment history. It contains the template for an amendment history (endnote 4) and an explanation of how that history is formatted. The actual amendment history for the Act in question is not provided. Without the operative provisions or the rest of the compilation, it is impossible to state whether the Act has been amended, when, or by which laws. The abbreviation key indicates the standard notation used to record amendments: ad (added or inserted), am (amended), rep (repealed), rs (repealed and substituted), exp (expires/expired). The key also covers misdescribed amendments. The template itself explains that endnote 4 tracks amendments at the provision level. This is useful information for anyone reading a compilation, but it is not itself an amendment history. The source text is therefore silent on the actual history of any particular Act. To complete this section for a specific Act, the full text would be required.

The source text contains no references to any case law. No cases are cited, and no litigation history is provided. The endnote apparatus does not include heads of jurisdiction, case names, or court decisions. The template is purely about legislative amendments, not judicial interpretation. It is impossible to assess whether the Act to which these endnotes belong has been litigated, in which courts, on what issues, or with what outcomes. There is no data in the source from which to draw any conclusions about judicial treatment of the Act. The abbreviation key does not reference any court or tribunal. The endnotes are a legislative drafting and publication tool, not a legal research resource for case law. This section of the deep dive must remain empty of substantive content because the source provides none.

The most significant trap for the unwary is that the endnote template provided is indistinguishable from the endnotes of any other Commonwealth Act. The reader may assume they have the full Act, but the operative provisions are entirely absent. A researcher who relies only on the endnotes cannot determine what the Act does, who it regulates, or what penalties it imposes. This is not a drafting error; it is a limitation of the source material. However, it points to a broader risk: even with the full compilation, many readers skip the endnotes and rely on the main text, unaware that some provisions may be uncommenced (underlined in the compilation) or that an amendment was misdescribed and never took effect. A second gotcha is the misdescribed amendment notation. If a provision appears in the main text but is marked in the amendment history as (md not incorp), the provision may still be in the text but have no legal effect if the amendment that introduced it was invalid. The reader must cross-check the amendment history to catch this. The abbreviation key uses LA to refer to the Legislation Act 2003 and LIA to refer to the Legislative Instruments Act 2003, but readers unfamiliar with the historical transition may not realise that LIA is a repealed Act and that the relevant provisions are now in LA. The underlining convention for uncommenced provisions is easy to miss in a printed or PDF compilation. A practitioner who assumes all provisions in the text are operative could give erroneous advice. The endnotes also include transitional and saving provisions that are not incorporated into the main text. These may preserve old rights or obligations after an amendment. A reader who only looks at the main text will miss these entirely. The legislation history in endnote 3 is the place to check for such provisions. Finally, the endnotes are updated each time an amendment is made, but the compilation date is critical. A compilation that is even a few days old may not reflect the current law. The Federal Register of Legislation publishes the latest version, but the endnotes are part of that version. Relying on a downloaded PDF without checking the compilation date is a compliance risk.

The endnotes do not impose compliance obligations. They are a tool for understanding the state of the law. The compliance obligation flows from the substantive Act to which these endnotes belong. Without that Act, no compliance steps can be described. However, as a general matter of good practice, anyone relying on a compiled Commonwealth Act should take the following steps: (1) confirm the compilation date on the front page of the compilation; (2) read endnote 2 (the abbreviation key) to ensure you understand the notation; (3) check endnote 3 (legislation history) for commencement information, particularly if the Act has been recently amended; (4) check endnote 4 (amendment history) for any provisions marked with (md not incorp) or with underlining indicating uncommenced provisions; (5) if the amendment history shows a misdescribed amendment, verify whether the publisher has incorporated it under section 15V of the Legislation Act 2003; and (6) if transitional or saving provisions are referenced in endnote 3 but not included in the main text, locate and read those provisions separately. These steps are not legally required, but they are prudent to avoid errors in legal analysis and compliance. The cost of skipping them can be significant: incorrect advice, inadvertent non-compliance, and exposure to enforcement action under the substantive Act. The endnotes themselves are a compliance aid, not a compliance burden. They exist to reduce the risk of error. For compliance professionals, the key output is a verified understanding of which provisions are in force and which are not. The endnotes are the primary source for that verification. No further compliance steps arise from the endnotes alone.
