Licence Area Plan - Arnhem Land (Radio) - January 2006

Licence Area Plan (LAP) - This is a statutory instrument made under s 26(1) of the Broadcasting Services Act 1992 (BSA). A LAP determines the number and categories of broadcasting services that are to be available in a particular area using the broadcasting services bands, and the technical characteristics of those services. The LAP does not grant a licence; it merely identifies the services that may be provided and the spectrum allocated. The actual licence (in this case SL1130001) is issued separately under Part 5 or 6 of the BSA, and the licensee must also hold apparatus licences under the Radiocommunications Act 1992 for each transmitter.

Community radio service - Under the BSA, a community broadcasting service is a service that is not a commercial, national, or subscription service, is provided for community purposes, and is not operated for profit. It must be owned and controlled by a community organisation and its programming must be available to the general community. The plan allocates only one community licence for the entire area, which means that a single entity will serve a huge, dispersed population from urban Darwin to remote island and desert communities.

Technical specifications - Each transmitter is defined by its carrier frequency (MF-AM band), transmitter site (nominal location described by Australian Map Grid coordinates zone, easting and northing), and output radiation pattern. The radiation pattern is expressed as maximum cymomotive force (volts) at each bearing or elevation. For omnidirectional patterns, the value is constant at all angles of azimuth. The site tolerance is stated as "Refer to Technical Planning Guidelines", meaning the exact allowable deviation from the nominal site is not specified in the plan itself but is governed by ACMA’s separate guidelines.

Licence area boundaries - The licence area is defined using ABS 2001 Census geographical units. This is a common technique in LAPs to create a stable, verifiable boundary that can be updated with each census. It includes both urban and remote areas, implying that the service must meet the needs of very different communities. The inclusion of Darwin city areas within an "Arnhem Land" plan is notable; it may reflect historical licence allocations or a desire to ensure coverage to the regional hub.

Service licence number SL1130001 - This single licence authorises operation of all five transmitters. That means the licence conditions (community obligations, program standards, etc.) apply across all sites. The licensee must ensure each transmitter complies with its individual technical specification, but the service as a whole is treated as one broadcast service.

The licensee - The immediate entity affected is the holder of service licence SL1130001. This is likely a community organisation, perhaps an Aboriginal media association, given the region. The licensee must fund, construct, maintain and operate five separate transmitters in widely separated, often remote locations. This imposes significant capital and ongoing operational costs: equipment, power, land access or lease payments, maintenance personnel, and compliance testing. The use of AM rather than FM or digital may limit audience reach and advertising revenue potential (to the extent community stations can accept limited advertising under the BSA). The licensee is also subject to the general BSA regime for community broadcasters, including compliance with codes of practice, the requirement to be non-profit, and the obligation to provide community access and participation.

Listeners in the licence area - Residents in the defined ABS areas (Darwin suburbs, Nhulunbuy, Elcho Island, Gapuwiyak, Yathalamarra, and many smaller localities) will receive this single community radio service. They have no choice of other radio services allocated under this plan (no commercial or other community service). Depending on the programming, this may serve local information needs but also limit diversity. Listeners near transmitter sites may be affected by radio frequency exposure, though AM transmission at these power levels (maximum 620 V cymomotive force corresponds to relatively modest power, likely 1-5 kW) is generally not a health concern.

Other broadcasters and spectrum users - No other broadcasting services are allocated under this plan. However, other spectrum users (e.g. other broadcasting services on different frequencies in the same region, or non-broadcasting services in adjacent bands) may be affected by co-channel or adjacent-channel interference. The technical specifications are designed to minimise this, but interference complaints could affect the licensee. The reverse also applies: if the licensee deviates from the specifications, other users may suffer interference.

ACMA - As the plan maker and regulator, ACMA must monitor compliance with the technical specifications, handle any amendments to the plan, and enforce any breaches. The plan gives ACMA a clear instrument against which to assess interference issues or licence breaches.

State and local governments - The transmitter sites require planning approvals, land tenure, and possibly environmental assessments. The plan does not provide any right to occupy land; that must be secured separately. The inclusion of Darwin suburbs means the Ludmilla transmitter site may be subject to local government planning controls.

Rights of the licensee - The plan confers the right to use the specified frequencies (1476, 1503, 1530, 1566, 1593 kHz) at the nominated transmitter sites. This right is exclusive in the sense that no other service is allocated the same frequencies within the licence area, though other licences may use the same frequencies elsewhere if interference is avoided. The licensee also has the right to rely on the plan as authorisation for the technical parameters; if the licensee operates within those parameters, it is generally protected from interference complaints (subject to the Radiocommunications Act).

Duties of the licensee - The plan itself imposes limited explicit duties. The main duty is to ensure that each transmitter operates within the technical specifications: carrier frequency tolerance (implied by assignment), output radiation pattern, and site location within applicable tolerances. The duty is not spelled out in the plan; it arises from the licence conditions and the Radiocommunications Act s 100 (which makes it an offence to operate an unlicensed apparatus or to exceed licence conditions). Additionally, the Broadcasting Services Act imposes duties on community radio licensees: to remain non-profit, to provide community access, to comply with applicable codes of practice (e.g. the Community Broadcasting Association of Australia codes), and to not broadcast prohibited content.

Duties of ACMA - ACMA has a duty to administer the plan, including approving any variations to technical specifications, updating the plan if necessary, and enforcing compliance. ACMA must also take the plan into account when making decisions under the BSA, such as granting or renewing licences.

Rights of the public - Members of the public in the licence area have no direct right under this plan, but they have a right to make complaints about interference or non-compliance with community broadcasting codes. The plan does not create any enforceable right to receive a particular service.

No rights for other broadcasters - Because the plan allocates only one service, no other entity has a right to operate a broadcasting service in this area using the broadcasting services bands. They could apply for a licence area plan variation, but there is no guarantee of allocation.

The Licence Area Plan itself does not specify penalties. Enforcement occurs under the Broadcasting Services Act 1992 and the Radiocommunications Act 1992. Key enforcement mechanisms include:

Breach of licence conditions - If the licensee operates a transmitter outside the technical specifications (e.g. exceeding the maximum cymomotive force, using the wrong frequency, or deviating from the approved site beyond the tolerance), that could constitute a breach of the apparatus licence conditions. Under the Radiocommunications Act, a person who operates radiocommunications equipment otherwise than as authorised by a licence commits an offence (s 100). Penalties can include fines (currently up to 500 penalty units for an individual, 2,500 for a body corporate) and injunctions. ACMA can also suspend or cancel the apparatus licence.

Interference - If the licensee causes interference to other authorised services, ACMA can issue a direction to cease operations or to modify the technical parameters. Persistent interference can lead to licence revocation.

Community broadcasting obligations - The Broadcasting Services Act provides for civil penalties for breaches of licence conditions (s 205F). For community broadcasters, failure to comply with the codes of practice or the requirement to be non-profit can result in orders to comply, suspension of the licence, or revocation after a hearing by the Administrative Appeals Tribunal or the Federal Court.

Enforcement by ACMA - ACMA has broad powers to investigate complaints, issue notices to produce documents, inspect premises, and apply to the Federal Court for civil penalty orders. The plan provides a clear standard against which compliance can be measured.

No private right of action - A competitor or listener cannot sue for breach of the plan directly. However, they can complain to ACMA, which may then take enforcement action. The plan may be relevant in proceedings for interference or licensing disputes.

Potential for multiple infractions - Because the single licence covers five transmitters, a breach at one site (e.g. Gapuwiyak) could put the entire licence at risk. This creates a concentrated risk for the licensee.

Broadcasting Services Act 1992 (Cth) - The plan is made under s 26(1) of this Act. The BSA governs all broadcasting services in Australia. The plan is a "licence area plan" as defined in s 9. Under s 26, ACMA must have regard to such plans when allocating and renewing licences. The BSA also sets out the categories of broadcasting service; this plan only allocates a community service. The community broadcasting provisions (Part 6, ss 85-89) require that the service be owned and controlled by a community organisation, be non-profit, and provide community access. The plan does not override those requirements; it merely identifies the spectrum available.

Radiocommunications Act 1992 (Cth) - This Act deals with the allocation and use of spectrum. Each transmitter must be covered by an apparatus licence issued under the Radiocommunications Act. The technical specifications in the plan effectively dictate the conditions of those apparatus licences. The Radiocommunications Act also prohibits unauthorised interference and provides for spectrum licensing in some cases (though broadcasting services use apparatus licences). The plan interacts with s 100 (offence of operating without licence) and s 151 (interference prevention). The site tolerance reference to "Technical Planning Guidelines" likely invokes ACMA’s radiocommunications planning guidelines.

Australian Communications and Media Authority Act 2005 (Cth) - This established ACMA and confers its powers. The plan is an exercise of ACMA’s functions under the Broadcasting Services Act. ACMA’s enforcement and industry standards powers apply.

Environmental and planning laws - Each transmitter site requires compliance with local planning schemes, environmental impact assessments (especially in remote areas with cultural heritage), and native title considerations. The plan does not grant any right to occupy land; the licensee must negotiate access with landowners, which in Arnhem Land may involve traditional owners, Aboriginal land trusts, or the Northern Territory Government. The plan’s site coordinates are nominal; the actual site may need to be adjusted with ACMA approval.

Native Title Act 1993 (Cth) - Much of the licence area is subject to native title claims or determinations. The operation of a transmitter on Aboriginal land may require an Indigenous Land Use Agreement or other native title processes. The plan itself does not address native title; it is a spectrum allocation instrument, not a land use instrument.

Competition law - The plan’s allocation of a single community service (with a single licensee) is not itself an anticompetitive arrangement, but it does limit entry. The Competition and Consumer Act 2010 does not directly apply to spectrum allocation, but ACMA must consider efficient use of spectrum. The plan does not provide for competitive allocation (e.g. auction) because community licences are not auctioned; they are allocated by merit or comparative processes.

Codes of practice - Community broadcasting is subject to codes developed by the Community Broadcasting Association of Australia and registered by ACMA. The plan does not reference these codes, but they apply to the licensee as a community broadcaster.

The plan is dated January 2006 and was made by the Australian Communications and Media Authority (which succeeded the Australian Broadcasting Authority in 2005). The determination includes a standard clause: "A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time." This allows ACMA to update the technical specifications (e.g. transmitter coordinates, frequencies, radiation patterns) without issuing a new determination each time, provided the amendments are made by proper instrument. However, the licence area boundary itself (Attachment 1.1) is likely not mutable under that clause - the attachment refers to the list of ABS areas; a change to the boundary would probably require a new plan.

No explicit amendment history is provided in the source. A search of the Federal Register of Legislation and ACMA’s website would be needed to see if the plan has been amended or replaced since 2006. Given that the plan uses 2001 Census data, it is likely that ACMA has issued a subsequent plan using updated census boundaries (e.g. 2006, 2011, 2016 censuses). The Broadcasting Services Act requires periodic review of LAPs. Practitioners should not rely on this 2006 plan without checking ACMA’s current register; the plan may have been revoked or superseded by the "Regional Radio Plan" or a newer Arnhem Land plan.

The licensee (SL1130001) may have had its technical specifications varied under the amendment clause. For example, the directional pattern at Nhulunbuy might have been adjusted to reduce interference. Any such variations would be made under s 26(3) of the BSA or the Radiocommunications Act. The clause allowing amended attachments is a common administrative efficiency, but it means the current specifications could differ from the 2006 document. Anyone relying on the plan must confirm the current version.

The source document does not record any litigation. The plan itself is a regulatory instrument of a technical nature, unlikely to be the subject of direct challenge. However, legal disputes may have arisen concerning the allocation of the community licence SL1130001, such as appeals under Part 15 of the BSA against ACMA’s decision to grant or renew the licence. Those proceedings would be heard by the Administrative Appeals Tribunal and potentially the Federal Court.

If the plan were to be challenged, a party would need to argue that ACMA acted beyond power under s 26(1) or failed to take into account relevant matters (e.g. efficient use of spectrum, needs of the community). The plan’s definition of the licence area (including Darwin suburbs under an "Arnhem Land" title) might be arguable, but it is within ACMA’s discretion.

The technical specifications (e.g. site tolerances, radiation patterns) could be litigated in interference disputes under the Radiocommunications Act. For instance, if another spectrum user claimed that the Nhulunbuy directional pattern did not prevent interference, a court might examine the plan. However, no known cases are referenced.

If the plan has been amended, the validity of an amendment could be challenged, particularly if the amendment clause is used to change the licence area boundary (which arguably requires a new plan). But again, no specific litigation is indicated.

The absence of litigation history does not mean the plan is uncontroversial; it may simply reflect the low likelihood of challenge from the affected parties (remote communities may lack resources for legal action).

Same licence, five transmitters - The entire service is operated under one community broadcasting licence (SL1130001). That means all five transmitters must comply with the same licence conditions. If one transmitter fails to meet community service obligations (e.g. local content), the entire licence could be at risk. Also, the licensee must manage vastly different communities with one licence; the programming for Darwin listeners may be very different from that for Gapuwiyak, but the licence does not divide the area into sub-areas.

AM frequencies and audio quality - The plan uses only medium-wave AM, not FM or digital. AM has lower audio fidelity and is more prone to interference, especially at night. In remote areas with poor reception, listeners may struggle. This may reduce audience engagement and limit advertising or sponsorship revenue. The choice of AM may also reflect available spectrum and the terrain (AM propagates well over long distances). But it is a constraint on the service’s viability.

No allocation of other services - The plan makes no provision for commercial, national (ABC/SBS) or other community radio services. If the single community station fails, there would be no other local radio service under this plan. National services may be available via other plans, but local content would be lost. This creates a single point of failure.

Boundary using 2001 Census - By 2006 the census data was already five years old. The area definitions may not correspond to current demographics or settlement patterns. Any change in population or local government boundaries could make the licence area outdated, but the plan itself can only be changed by ACMA. This adds regulatory lag and uncertainty for the licensee about which areas are covered.

Site tolerance ambiguity - The site tolerance for each transmitter is not given numerically; it merely says "Refer to Technical Planning Guidelines". These guidelines are not published with the plan. The licensee must locate and understand those guidelines to know how precisely they must locate the transmitter. If the guidelines are later changed, the tolerance may tighten, potentially forcing relocation or adjustment at the licensee’s cost.

Nhulunbuy directional pattern complexity - The Nhulunbuy transmitter has a highly directional pattern with varying cymomotive force at each 10 degree bearing. Maintaining that pattern requires precise antenna design and regular verification. Any antenna damage or change in surrounding terrain could alter the pattern and cause non-compliance. The fine granularity (10 degree steps) suggests a complex array; costly to build and maintain.

Darwin transmitter in Ludmilla - This site is in an urban area. It may be subject to local planning restrictions, heritage overlay, or complaints from neighbours about the tower. The plan does not address land use approval, and the licensee bears all risk of obtaining permits.

Interference with other services - The frequencies (1476, 1503, 1530, 1566, 1593 kHz) are in the standard AM broadcast band. Other stations in nearby regions may be using adjacent channels. The licensee must accept that it may cause or receive interference; the plan does not guarantee a clean signal. For example, 1530 kHz is also used by stations in other areas (e.g. Radio National in some regions). The licensee may need to coordinate with other operators.

Amendment clause trap - The clause allowing amendments to attachments means the technical specifications can be changed without public consultation or a new plan (depending on ACMA’s procedures). If ACMA tightens the radiation pattern or changes the frequency, the licensee must adapt. The clause could be used to impose new obligations without formal notice beyond the Federal Register.

Absence of digital or FM conversion - The plan’s AM-only specification may impede modernisation. If the licensee wants to offer digital radio (DAB+) or FM, a new LAP or variation would be needed. That is a costly and uncertain regulatory process.

Obtain the correct licences - The operator must hold service licence SL1130001 (community broadcasting licence under the BSA) and, for each transmitter, an apparatus licence under the Radiocommunications Act that matches the technical specifications. The apparatus licence application must reference this LAP. The operator should ensure that the licence conditions align with the plan.

Construct transmitters to specification - For each of the five sites: Nhulunbuy, Darwin (Ludmilla), Yathalamarra, Elcho Island, Gapuwiyak, the operator must build a transmitter facility at the nominal location (or within the tolerance allowed by ACMA’s Technical Planning Guidelines). The antenna system must produce the radiation pattern specified: at Nhulunbuy, the directional pattern with distinct values per 10 degrees; at the other sites, an omnidirectional pattern with the maximum cymomotive force given. This requires professional engineering design, modelling, and field measurement. The operator should commission on-air measurements to verify the pattern and file results with ACMA if required.

Site access and approvals - Before construction, the operator must obtain all necessary land tenure (freehold, lease or licence), native title agreements if on Aboriginal land (likely for Yathalamarra, Elcho Island, Gapuwiyak, and possibly Nhulunbuy), and local council planning approvals. The Darwin site at Ludmilla may be on NTA (NT Government) land; a formal lease or occupancy agreement is needed.

Monitor and maintain compliance - The operator must regularly test that each transmitter operates on the assigned carrier frequency (within tolerance, typically ±10 Hz or as per the apparatus licence), that the output power does not exceed the maximum cymomotive force (which relates to effective radiated power), and that the radiation pattern is maintained. Any malfunction that alters the pattern (e.g. a collapsed antenna guy wire) must be rectified immediately. The operator should keep logs of transmitter readings and reports of any interference complaints.

Meet community broadcasting obligations - As a community radio licensee, compliance with the BSA requires the operator to: (a) ensure the service is not operated for profit; (b) allow community access to programming; (c) implement a code of practice (e.g. the Community Broadcasting Codes of Practice); (d) provide adequate local content. The plan does not affect these obligations, but the large licence area means the operator must handle diverse community input.

Stay current with amendments - The operator should monitor the Federal Register of Legislation and ACMA’s website for any amendments to this LAP or to the Technical Planning Guidelines. If ACMA issues a new licence area plan (e.g. using 2006 or 2011 census data), the operator may need to apply for a licence variation. Proactively engaging with ACMA can prevent surprises.

Coordinate with other spectrum users - The operator should check if nearby stations on adjacent frequencies (e.g. 1458 kHz, 1548 kHz) are likely to cause or receive interference. This may require technical coordination agreements, though the plan assumes the technical specs alone are sufficient. If interference arises, the operator must cooperate with ACMA and other licensees to resolve it.

Document everything - Retain records of transmitter site acquisition, construction, antenna design calculations, proof of performance measurements, and all correspondence with ACMA. In case of a complaint or enforcement action, this documentation is crucial to demonstrate compliance. The plan itself should be on hand for reference.
