What it does
The Library Regulation 2026 sets financial, membership, materials-charge and conduct rules for local libraries and, for directions to leave, the State Library as well. It commences on 1 September 2026 (cl 2). On that date, it replaces the Library Regulation 2018, which is repealed under the Subordinate Legislation Act 1989, s 10(2), as stated in the commencement note. The regulation also contains a savings provision preserving the effect of things already operating under the 2018 Regulation immediately before its repeal (cl 10).
For local-library subsidies, cl 4 prescribes an amount of $2.85 for each financial year for the purpose identified as the Library Act 1939, s 13(4)(b). It also specifies which Australian Bureau of Statistics population data is used for the purpose identified as s 13(6): the most recent table of local government area population data published before the financial year for which the subsidy is claimed.
The regulation assigns local authorities responsibility for setting local-library membership procedures and conditions. It sets out specified grounds on which registration may be refused or cancelled, and prohibits non-members from borrowing library material (cl 5). It prescribes a maximum late-return charge of $50 per item (cl 6), and a formula limiting compensation for lost or damaged material (cl 7).
For conduct in libraries, cl 8 authorises staff to direct a person to leave and not re-enter for a specified period, subject to limits set by the library’s governing body. A person must comply with such a direction, with a maximum penalty of two penalty units for non-compliance. The regulation does not reproduce the relevant provisions of the Act, so its references to the Act identify connections rather than supplying the full statutory framework.
