What it does
The Library Regulation 2018 (NSW) is a subordinate instrument made under the Library Act 1939. It replaces the Library Regulation 2010, which would have been automatically repealed on 1 September 2018 under section 10(2) of the Subordinate Legislation Act 1989. The Regulation commenced on the day of its publication on the NSW legislation website, providing no transitional period for libraries or users to adjust. Its core mechanical effect is threefold: first, it grants rule-making powers to the governing bodies of the State Library (the Council) and local libraries (local authorities), covering matters such as access, borrowing conditions, charges and behaviour. Second, it creates a schedule of specific prohibitions and associated penalties (maximum 2 penalty units each) covering conduct in libraries: taking prohibited items beyond the vestibule, reproducing material the governing body has flagged as unsuitable, damaging library material (including by folding page corners, as clarified in cl 11(2)), wilfully misplacing or hiding material, making more noise than reasonably necessary, using the library for a non-library purpose without consent, eating or drinking outside designated areas, and bringing animals in without consent (with an exception for assistance animals under the Commonwealth Disability Discrimination Act 1992). Third, it prescribes the subsidy amounts local authorities may claim from the State for library services: $2.45 per capita for 2019-20, rising to $2.85 from 2022-23 onward, determined using the ABS most recent population table. The Regulation also sets parameters for borrower registration and charges: a local authority may refuse or cancel registration based on non-residency, non-compliance with library rules, or the authority's opinion that the person is not a fit and proper person (cl 5(3)(c)). Late return fees are capped at $50 per item (cl 8), and charges for lost or damaged material can include the original or replacement purchase price plus processing costs, and if the item is part of a series, the full series value (cl 7). The Regulation provides a savings clause preserving acts done under the repealed 2010 Regulation. In terms of compliance burden, the Regulation imposes few prescriptive procedural requirements on libraries themselves (they are free to set rules, fees and registration terms within the stated caps) but creates a relatively dense set of user obligations, each carrying a criminal penalty. The subsidy amounts are fixed figures not indexed automatically, meaning local authorities bear the risk of cost inflation above the prescribed per-capita rate; the Regulation does not tie subsidy to actual library expenditure or performance metrics.
