Library Purposes Trusts Regulations 2020

The regulations do not define their core terms but rather draw definitions from the Libraries Act 1988. The critical distinction is between two categories of land. "Library land" is land that is currently held on trust for library purposes. An application under section 42(2) of the Act (Schedule 1) deals with surrender of such land to the Crown when it "is no longer required for library purposes." The application must be made jointly by the trustee (who could be a person or entity) and the council of the municipal district. The form requires a declaration that the land is not subject to any mortgage or charge, and if it is subject to a lease, tenancy or licence, particulars must be provided and the lessee's consent obtained (the form includes a consent block for the lessee). Land "formerly used for library purposes" is the second category. A person eligible under section 43(2) , defined in the Act as three classes: (a) a person who has a legal or equitable interest in the land, (b) a person who is liable to maintain or repair the land, or (c) a person who is a trustee of the land , may request a Ministerial declaration that the land is no longer required for library purposes (Schedule 2). That request must include evidence of eligibility and of the land being no longer required, and must be accompanied by a certificate from the chief executive officer of the relevant council certifying that after reasonable enquiries the CEO is satisfied the land has been used for library purposes and is no longer required for those purposes. Following that declaration, an application under section 43(8) (Schedule 3) may be made by an eligible person to either surrender the land to the Crown or transfer/convey it to the council. That form requires details of any mortgages, charges, leases, tenancies, licences, estates, interests or equities of redemption, and requires consents from the council (if not the applicant) and from any lessee, mortgagee or other person with an estate, interest or equity of redemption in the land. The notice published under section 43(10) (Schedule 4) must invite objections within the prescribed 30 days. The regulations thus create a dual-track process: one for currently-held library land (requiring trustee plus council application and Crown surrender) and one for land that has already been removed from library use (requiring an eligible person request, council CEO certification, Ministerial declaration, then application with public notice and objection period). The concept of "eligible person" is broad and includes trustees, interest-holders, and those liable to maintain the land, but not the general public. The final disposition is to the Crown or to the municipal council.

The regulations directly affect several categories of actors. Trustees of library land must use the prescribed form when applying to surrender that land to the Crown (regulation 6). Municipal councils are affected in multiple roles: they must be co-applicants for surrender of current library land (Schedule 1); their CEO must certify the land no longer required for library purposes for a section 43 declaration (Schedule 2); they must consent if the applicant under section 43(8) wishes to transfer or convey the land to the council (Schedule 3); and they may be the applicant themselves if they are an eligible person (Schedule 3 allows the council to be the applicant if it qualifies under section 43(2)). Lessees, mortgagees, and other persons with an estate, interest or equity of redemption in the land are affected because the prescribed forms require their consent to the application. Without that consent, the application is likely incomplete and may not be processed by the Minister. The Minister administering the Libraries Act 1988 is the decision-maker who receives the applications, makes declarations, and grants or refuses authority. The public is affected indirectly: a notice of application must be published (Schedule 4), and any person may lodge a written objection within 30 days of publication (regulation 10). This gives neighbours, community groups, and other interested parties a limited window to oppose the disposal of land that was once dedicated to library purposes. The Crown is a potential recipient of surrendered land, which then ceases to be held on library trust. The regulations also affect purchasers and financiers because the application forms require disclosure of mortgages and charges; the consent of mortgagees is needed, which protects secured creditors from losing their security without agreement. Finally, the regulations bind successors: any person who later deals with the land will need to confirm that the proper procedures were followed, because a defect in the surrender, transfer or conveyance could cloud title. The sunset provision in the Subordinate Legislation Act 1994 (10 years from 25 August 2020, i.e. 2030) means that after that date fresh regulations will be needed for these forms and objection period to remain in force. Anyone relying on these forms after 2030 does so at their own risk unless new regulations have been made.

The regulations impose few substantive duties but several procedural obligations. The core duty is to use the correct prescribed form for each step. Regulation 6 mandates that an application under section 42(2) "must be in the form set out in Schedule 1." Regulation 7 requires a request under section 43(4) to be "in the form set out in Schedule 2." Regulation 8 requires an application under section 43(8) to be "in the form set out in Schedule 3." Regulation 9 requires a notice under section 43(10) to be "in the form set out in Schedule 4." These are mandatory language provisions. Failure to use the correct form may render the application invalid as against the parent Act, which likely requires the form to be "prescribed" (the regulations are the prescribed form). The forms themselves impose additional requirements: signatories must sign in the presence of a witness; councils must affix their seal; a lessee must give written consent in the body of the form; for Schedule 2, the CEO of the council must certify after "reasonable enquiries" that the land is no longer required for library purposes. The "reasonable enquiries" standard imposes a duty of care on the certifying officer. There is a right of any person to object to an application under section 43(8) to surrender, transfer or convey land formerly used for library purposes. Regulation 10 provides that the objection period is "30 days from the date of publication of the notice." The form in Schedule 4 repeats this period and gives the Minister's address for lodging objections. The regulations do not state what happens after an objection is lodged; that is left to the Act. Objectors are not required to have any particular interest in the land; the form says "any person wishing to object." This is a relatively broad standing right. Consent rights are also embedded: the form in Schedule 3 requires consent from the council (if not the applicant) and from any lessee, mortgagee or other person with a legal or equitable interest in the land. The form in Schedule 1 requires the lessee's consent if the land is subject to a lease, tenancy or licence. These consent requirements give those parties a veto over the application; without their signed consent, the application is incomplete. There is no explicit right to withdraw a consent, but general contract law principles would apply. The regulations themselves do not impose penalties for non-compliance, nor do they create any cause of action. They are purely procedural and their enforcement depends on the parent Act and general administrative law (judicial review of a decision made on an incomplete application, for example). Anyone subject to an adverse decision may have rights under the Act or under the Victorian Civil and Administrative Tribunal or Supreme Court, but that is outside the scope of these regulations.

The Library Purposes Trusts Regulations 2020 contain no penalty provisions. They are a purely procedural statutory rule that prescribes forms and a time period. There are no fines, imprisonment terms, infringement notices, or civil penalties set out in any of the ten regulations or the four schedules. This is typical of a "prescribed forms" regulation under a parent Act that itself contains the operative prohibitions and enforcement mechanisms. If a person submits an application using the wrong form, or fails to include a required consent, the likely consequence is that the Minister rejects the application as invalid or defective, rather than the imposition of a pecuniary penalty. The parent Act, the Libraries Act 1988, is not reproduced here, so one cannot cite its penalty provisions. However, the regulations are silent on enforcement. The only indirect enforcement mechanism is that a person who falsely certifies something in a form (such as stating that land is not subject to a mortgage when it is) could be liable for perjury or making a false statement to a public official under general criminal law, but that is not a penalty contained in these regulations. The sunset provision under the Subordinate Legislation Act 1994 is essentially an automatic repeal mechanism: if no new regulations are made before 25 August 2030, these regulations will cease to have effect, and the forms and objection period would no longer be prescribed. That could be seen as a form of regulatory enforcement through expiration, but it is administrative rather than penal. Practitioners should be aware that while these regulations carry no direct penalties, using outdated forms (such as the revoked 2010 forms) could be treated as non-compliance with the parent Act's requirement to use the "prescribed form." That could lead to refusal of the application, delay, and potential loss of the opportunity to complete the land transaction. The cost of non-compliance is therefore transactional and procedural, not punitive. The regulations also do not create any enforcement role for a regulator; they do not designate inspectors, investigation powers, or offence provisions. The Minister is the decision-maker and would enforce compliance by simply refusing to process defective applications. Compliance risk is borne entirely by the applicant, who must ensure the form is correctly completed, all consents obtained, and the notice properly published.

These regulations are made under section 53 of the Libraries Act 1988 (Vic) and must be read as part of that Act. They do not stand alone. Any person using the forms must comply with the substantive requirements of the parent Act, such as the definition of "library land" in section 3, the powers of the Minister in sections 42 and 43, and the trust obligations that originally bound the land. The regulations also interact with the Subordinate Legislation Act 1994. Endnote 1 notes that the regulations "will sunset 10 years after the day of making on 25 August 2030 (see section 5 of the Subordinate Legislation Act 1994)." That Act provides for automatic repeal of statutory rules unless they are remade. This creates a fixed expiration date, requiring a new set of regulations before 2030 if the forms and objection period are to remain legally operative. The Interpretation of Legislation Act 1984 (ILA) is also relevant. Endnote 1 contains a detailed explanation of how the ILA applies to statutory rules made after 1 January 2001. For example, headings, examples, diagrams, notes, and punctuation form part of the statutory rule (section 36(1A),(2A),(2B),(3A),(3B) of the ILA). Provision numbers (regulation numbers, subregulation numbers, paragraphs, subparagraphs) are also part of the rule (section 36(3C)). A "legislative item" (penalty, example or note) is taken to be at the foot of the provision it relates to (section 36B). Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of the statutory rule (section 36(3),(3D),(3E)). This means that the schedules themselves are part of the regulations, but the explanatory details in the endnotes (such as the sunset note) are not part of the legal text, although they are informative. The regulations revoke the Library Purposes Trusts Regulations 2010 (S.R. No. 89/2010). Any transitional issues (such as applications partly processed under the old regulations) are not addressed; the regulation simply states the 2010 regulations are "revoked" (regulation 4). Practitioners should check whether an application commenced under the old regime can be completed under the new forms, or whether the new forms apply immediately. The interaction with property law (the Transfer of Land Act 1958, the Property Law Act 1958) is not specified in the regulations but is inevitable because the ultimate step after Ministerial authority will be a registration of the surrender, transfer or conveyance at Land Use Victoria. The regulations do not affect that interaction; they only get the applicant to the point of Ministerial authority. Local government legislation (the Local Government Act 1989 or 2020) may also apply when a council is a party (as applicant, consenting party, or recipient of a transfer). Council decisions to consent or to act as applicant must comply with the council's own powers and resolutions, but that is outside these regulations.

According to the source document, there are no amendments to the Library Purposes Trusts Regulations 2020. Endnote 2, titled "Table of Amendments", states: "There are no amendments made to the Library Purposes Trusts Regulations 2020 by statutory rules, subordinate instruments and Acts." Endnote 3, "Amendments Not in Operation", states: "This version does not contain amendments that are not yet in operation." The regulations are at Version No. 001, indicating they have not been amended since their making on 25 August 2020 and commencement on 6 September 2020. The only amendment history relevant to these regulations is that they themselves revoke and replace the Library Purposes Trusts Regulations 2010 (S.R. No. 89/2010). That revocation is noted in regulation 4 and in Endnote 4, Explanatory details, which cross-references S.R. No. 89/2010. The 2010 regulations would have had their own form and objection period, and the 2020 regulations replaced them entirely. There is no transitional provision in the 2020 regulations; the simple revocation means that as of 6 September 2020, the old forms cannot be used. The 2020 regulations are now the only current prescribed forms. Given the sunset date of 2030, there will likely be a further set of regulations before that date, but no such instrument is yet drafted or referred to. Practitioners should monitor the Victorian Legislation website (www.legislation.vic.gov.au) for any future amendments or replacement regulations. The absence of amendments to date suggests the forms have been stable and uncontroversial since 2020. If future amendments are made, they will appear as a new version number and an updated Table of Amendments in the endnotes. For now, the regulations are in clean, unamended form.

The source document does not mention any litigation history. There are no case references, no notes of court decisions, and no annotations in the endnotes that discuss any judicial interpretation of the regulations or their predecessor. This is consistent with the nature of the regulations: they are procedural, prescriptive, and unlikely to generate standalone litigation. Disputes over the surrender, transfer or conveyance of library land are more likely to arise under the parent Act, such as whether land is truly "no longer required for library purposes," whether a person is an "eligible person," or whether the Minister's decision is valid. In such disputes, the regulations may be cited as part of the procedural framework, but they are rarely the subject of litigation themselves. For example, a court might be asked whether an application was in the "prescribed form" or whether the objection period was correctly calculated. However, the wording of the forms is straightforward, and the 30-day period is clear. A litigant might argue that a notice was not "published" in a way that gave fair notice, but the regulations do not define "publication." That could be a gap leading to litigation over what constitutes valid publication (e.g., newspaper, gazette, website). Similarly, the requirement in Schedule 2 that the CEO certify after "reasonable enquiries" could be challenged if the certification is later found to be inaccurate. But again, that challenge would be under the Act or general administrative law, not under the regulations themselves. No reported Victorian decisions involving these regulations were cited in the source, and a practitioner would need to conduct her own search of databases. The regulations are too recent (2020) to have accumulated a significant litigation history. The absence of case law does not mean the regulations are risk-free; it means the risks are latent and untested. A practitioner advising on a transaction should treat the forms as mandatory and the steps as strict, because any deviation could be the basis for a future objection or challenge by an affected party (e.g., a neighbour who objects, or a subsequent purchaser who claims title is defective).

Several traps lurk in the apparently straightforward regulations. First, the forms require deletions of inapplicable options (indicated by an asterisk and "Delete if inapplicable"). If an applicant fails to delete the inapplicable alternative, the form may be ambiguous; the Minister might reject it as incomplete or require clarification. The form in Schedule 1 includes a block for lessee consent with the instruction "*Delete if inapplicable." Similarly, Schedule 2 has a deletion for "I/We" and for the paragraph of section 43(2). Schedule 3 has multiple deletion choices (surrender vs transfer/convey, is/is not subject to mortgage, etc.). Practitioners must carefully strike through the inapplicable options. Second, the forms expect council seal and CEO certification. Schedule 1 requires both the applicant's signature and the affixing of the council seal. Schedule 2 requires the CEO's signature and certification. If the CEO has not made reasonable enquiries, the certification could be challenged, potentially delaying or voiding the declaration. "Reasonable enquiries" is not defined; a court may find that simply checking council records is insufficient if, for example, there is evidence the land was recently used for a library pop-up. Third, the 30-day objection period in regulation 10 runs from "the date of publication of the notice." The regulations do not specify what constitutes publication; the form in Schedule 4 does not provide for a method of publication (newspaper, government gazette, website). If the notice is published in an obscure place, a court might find the publication defective, and the 30-day period may not start running, or an objector could argue they had no reasonable opportunity to object. Fourth, the forms require disclosure of all mortgages, charges, leases, tenancies, licences, estates, interests and equities of redemption. If a person inadvertently omits a registered easement or a licence, the application may be invalid. The forms also require consent from any lessee, mortgagee, or other person with an estate, interest or equity of redemption. This imposes a duty to identify all such persons. Failure to obtain a mortgagee's consent could mean the mortgage continues to encumber the land after surrender, creating title issues. Fifth, the regulations apply only to land falling under the Libraries Act 1988. Land that was originally granted for library purposes under a different trust arrangement (e.g., under a specific private trust or a different Act) may not be covered. The forms ask the applicant to confirm the land is library land or has been used for library purposes, but ambiguous cases are not addressed. Sixth, the sunset date is 25 August 2030. Practitioners should ensure that any application made after that date uses forms prescribed by successor regulations, or the application will lack a valid prescribed form. Seventh, the forms do not require evidence of advertising or proof of publication of the notice; an applicant might neglect to keep a clipping or screenshot, and later be unable to prove the 30-day period has run. Eighth, the consent of a lessee or mortgagee on the form might be challenged as not being an effective consent if the signing was not witnessed properly or if the signatory lacked authority. Finally, the regulations do not address what happens if objections are lodged; the Minister must consider them under the Act, but the regulations say nothing about the process for dealing with objections, leaving applicants in procedural uncertainty.

Compliance with the Library Purposes Trusts Regulations 2020 is essentially a matter of following the prescribed forms and timelines accurately. Step one: determine which regime applies. If the land is currently held on trust for library purposes (s 42 of the Act), use the process in regulation 6 and Schedule 1. If the land was formerly used for library purposes but the trust has ended (s 43), use the process in regulations 7-10 and Schedules 2-4. The distinction matters: for current library land, the applicant must be the trustee and the council jointly, and the land must be surrendered to the Crown only (not transferred to council). For former library land, the applicant may be any eligible person (including the council) and the land may go to either the Crown or the council. Step two: gather the required evidence. For a section 42 surrender, you need evidence that the land is "no longer required for library purposes" (a statement to that effect, but no certification is required on the form beyond the applicant's statement). For a section 43 declaration, you need "evidence" of no longer being required, plus a CEO certification based on reasonable enquiries. The evidence could include a council resolution, a report on library usage, or correspondence. Step three: obtain all necessary consents. For Schedule 1, get the lessee's consent if there is a lease. For Schedule 3, get the council's consent (if not the applicant) and the consent of every lessee, mortgagee, or other person with an estate, interest or equity of redemption. This may require a title search and communication with all registered interest holders. Step four: fill out the correct form. Use the current Schedule (1, 2, 3 or 4) exactly as it appears. Do not alter the wording; simply fill in the blanks. Delete the inapplicable options by striking through the text, as indicated by the asterisks. Ensure all signatures are witnessed. The witness must be present at the time of signing but need not be a special category (e.g., a JP). The forms do not specify witness qualifications, so a general practice is to use an adult who is not a party to the transaction. For council seals, ensure the seal is affixed in the presence of the proper officer and a second councillor or officer as per council rules. Step five: for a section 43 application, publish the notice in Schedule 4. The regulations do not prescribe where to publish, but best practice is a local newspaper circulating in the area of the land and possibly the government gazette. Keep a copy of the published notice with the date of publication clearly shown. Step six: wait 30 days from the date of publication before lodging the application with the Minister. If any objections are received within that 30-day period, you must consider them; you may need to respond to the Minister or address the objections. The regulations do not give guidance on objection handling, so legal advice may be needed. Step seven: lodge the completed forms with the Minister. The address for the Minister is required in the notice (Schedule 4) but is not specified in the regulations; contact the Department that administers the Libraries Act to confirm. Step eight: upon receiving the Minister's authority or declaration, proceed to register the surrender, transfer or conveyance at Land Use Victoria. The Minister's document will likely be a deed or instrument that needs to be lodged with the titles office. Step nine: keep all records indefinitely. Title investigation decades later may require proof that these procedures were followed. Step ten: monitor the sunset date. If your transaction extends beyond 25 August 2030, check whether the regulations have been renewed or replaced, and if necessary, use the then-current prescribed forms. Non-compliance with any step could result in the Minister refusing the application or a later challenge to the title. For high-value land, engage a property lawyer with experience in statutory trusts.
