Library Board (State Library) Regulations 1956

Definitions and scope. Regulation 2 defines the shorthand used throughout the instrument. The Act refers to the Library Board of Western Australia Act 1951 (r 2). Board is the Library Board constituted under that Act. In addition, book is defined broadly to include periodicals, newspapers, music scores, pictures, photographs, maps, charts, plans, manuscripts, film, slides, gramophone records and any similar article forming part of the contents of the library, whether or not the article is the property of the Board (r 2). Library expressly includes the State Library of Western Australia and any rooms, offices, passages, staircases, entrances, exits and gardens forming part of or adjacent to it (r 2). Librarian means the State Librarian and includes any person in charge of any part or section of the library (r 2). Those definitions affect the spatial and subject‑matter reach of the Regulations: they apply to adjacent spaces and to a wide range of material types whether owned by the Board or only forming part of the library’s content.

Control and responsibility. Regulation 4 places general control and charge of the library with the librarian, and makes the librarian responsible to the Board for safe custody of books and other property. This assigns day‑to‑day operational authority and primary responsibility for safekeeping to an operational officer, subject to the Board’s supervisory role that is evident elsewhere (for example, approval, permissions and review powers).

User conduct and directions. Regulation 14 requires compliance with any reasonable direction of the librarian and prohibits wilful obstruction of officers or wilful disturbance of other persons in proper use of the library. The provision operates as a behavioural standard enabling the librarian to manage conduct and to require compliance with rules necessary for operation and preservation of the collection.

Photocopying and reproduction. Regulation 11 governs photographic copies made by the librarian for a person’s personal use. It prohibits further reproduction of such copies without the written permission of the copyright owner and the Board. The Board may impose conditions on reproduction and the person must comply with those conditions. The regulation places two layers of consent before further copying is permitted: the copyright owner and the Board. The Board may also set conditions on how reproduction is carried out.

Exclusions and process. Regulation 32, inserted in 2017, lists specific grounds on which the librarian may exclude a person from the library: disorderly behaviour; appearing to be affected by alcohol or drugs; accessing indecent, obscene or offensive content on a computer or electronic device in a public area and continuing after direction to stop; not using the library for its intended purpose; or committing a breach of the Regulations where continued presence is likely to lead to further breaches (r 32(1)(a)-(e)). The librarian must give a written exclusion notice stating the exclusion, specifying the period (not longer than two years), explaining the reason and informing the person of the right to apply in writing to the Board for a review of the exclusion (r 32(2)-(3)). The excluded person must leave immediately (if applicable), must not enter the library during the exclusion period and may apply in writing to the Board (r 32(4)). The Board may confirm, revoke or substitute a different period of exclusion on review (r 32(5)).

Lending policy. Regulation 34 states that the State Library shall be conducted primarily as a reference library and allows the Board, at its discretion, to lend books to approved libraries, government departments or instrumentalities for official use, and to other persons or bodies only in exceptional circumstances (r 34(1)). No book may be removed without authority of the librarian, who may refuse or impose conditions concerning manner of use, period of loan or other matters; a borrower is deemed to assent to conditions on accepting a loan (r 34(2)). Regulation 34(3) imports the Library Board (Registered Public Libraries) Regulations 1985 to the extent applicable to such loans, as though the State Library were a registered public library.

Enforcement. Regulation 35 permits recovery of any sum or penalty payable under the Regulations in any court of competent jurisdiction by the Board as a debt due to it. Regulation 36 prescribes a penalty not exceeding $100 for breach of the Regulations and makes the person liable to pay expenses incurred as a consequence of the breach.

Amendments and deletions. The Regulations have been amended multiple times, including deletions of several earlier provisions (see compilation notes). Regulation 32 is a recent insertion. The compilation table identifies gazette dates for the original instrument (1956), a 1965 amendment associated with decimal currency, and later amendment regulations in 2013 and 2017 that restructured and removed a number of regulations. Those changes affect the current content and should be consulted where procedural history matters.

Together, these concepts allocate operational discretion to the librarian, preserve the Board’s institutional oversight, set user obligations, and establish civil pathways for enforcement and review.

Primary affected parties. The Regulations directly affect users and occupants of the State Library of Western Australia, defined as the “library” in r 2. That definition includes not only rooms and offices but also passages, staircases, entrances, exits and gardens adjacent to the library; therefore, people in those adjacent spaces are covered by the Regulations when the Board or librarian takes action under them, including exclusions (r 2 and r 32).

Library staff and management. The Regulations place operational authority and responsibility on the librarian (r 4). The librarian and any person in charge of a part or section of the library are empowered to direct users and to exclude people under set grounds (r 2 and r 32). Officers and servants of the Board are protected by r 14, which prohibits wilful obstruction of their duties. The Board itself is both the supervisory entity and the decision maker for certain permissions and reviews: it can impose conditions on reproduction (r 11), decide lending policy and exceptional loans (r 34(1)), and it is the body to which an excluded person may apply for review (r 32(2)(d), 32(4)(c), 32(5)).

Approved libraries and government entities. Regulation 34 expressly contemplates lending to “an approved library” and to government departments or instrumentalities of the Government of Western Australia or the Commonwealth for official use (r 34(1)(a)-(b)). Those entities are potential beneficiaries of lending but must comply with any conditions imposed and with the Registered Public Libraries Regulations insofar as those are applicable (r 34(2)-(3)).

Copyright owners. Regulation 11 requires the written permission of the owner of copyright for any further reproduction of photographic copies made by the librarian for a person’s personal use (r 11). The Board must also give its written permission. Copyright owners therefore have a statutory gatekeeping role with respect to reproduction arising from library‑made copies; the Board may also set conditions.

Persons who use electronic devices in public areas. Regulation 32(1)(c) specifically targets people who access “indecent, obscene or offensive content on a computer or other electronic device in a public area of the library” and continue to do so after being directed to stop by the librarian. This provision affects users of electronic devices and gives the librarian authority to exclude for continued viewing of such material.

Persons excluded. Individuals excluded under r 32 are directly affected by the exclusion process and its consequences. An excluded person must leave immediately, must not enter during the exclusion period, and may apply in writing to the Board for review (r 32(4)). The exclusion may last up to two years as determined by the librarian (r 32(3)), and the Board may confirm, revoke or substitute a different exclusion period on review (r 32(5)).

Courts. Regulation 35 makes the Board the enforcing party for recovery of penalties and sums, and provides that those amounts may be recovered as a debt in any court of competent jurisdiction. Courts are therefore the forum for monetary enforcement under the Regulations.

People incurring expenses through breach. Regulation 36 makes persons who breach the Regulations liable not only to a fine not exceeding $100 but also to pay any expense incurred as a consequence of the breach. Those who cause damage, require remedial action by the Board, or otherwise impose costs on the library through non‑compliance will be subject to expense recovery in addition to a penalty.

Indirectly affected parties. Suppliers, researchers, donors and third parties whose materials form part of the library’s contents are subject to the practical effects of the librarian’s authority over custody, access and reproduction. Because the definition of book includes items that may not be Board property (r 2), owners of deposited or loaned material should expect the library’s rules to apply to those items while they form part of the library’s collection.

In summary, the Regulations allocate decision rights and obligations across the librarian, the Board, library patrons, approved libraries and government departments, copyright owners, and the courts. Operational power is concentrated in the librarian for day‑to‑day control and in the Board for permissions and review.

Duties placed on the librarian. Regulation 4 assigns the librarian general control and charge of the library and makes the librarian responsible to the Board for the safe custody of books and other property (r 4). Under r 11, the librarian may make photographic copies for personal use but must ensure that further reproduction does not occur without the permissions required by that regulation. Under r 14, the librarian may give directions to users, which users must comply with so long as the directions are reasonable. Under r 32 the librarian has an express duty to follow the written notice requirements when excluding a person (r 32(2)) and to determine the period of exclusion (r 32(3)), subject to the statutory limit of two years.

Duties placed on users and persons in the library. Users must comply with any reasonable direction of the librarian and must not wilfully obstruct any officer or servant of the Board in the execution of their duty or wilfully disturb, interrupt or annoy other persons in the proper use of the library (r 14). If the librarian excludes a person under r 32(1), the excluded person must, if applicable, leave immediately and must not enter the library during the exclusion period (r 32(4)(a)-(b)). A person who borrows a book from the State Library must comply with any conditions the librarian imposes on manner of use, period of loan or other matters, and acceptance of a loan constitutes assent to those conditions (r 34(2)). A person who receives photographic copies for personal use must not reproduce them further without written permission from the copyright owner and the Board, and must comply with any conditions the Board imposes on such reproduction (r 11).

Rights of the librarian and Board. The librarian may refuse to authorise removal of a book, may impose conditions on loans, and may determine exclusion periods of up to two years (r 32(1)-(3); r 34(2)). The Board may impose conditions on reproduction under r 11, may decide lending policy and discretion to lend to approved libraries or government instrumentalities or in exceptional circumstances (r 34(1)), and is the review body for exclusions under r 32(4)(c)-(5). The Board is also the enforcing party for recovery of penalties and expenses as debts in court (r 35).

Rights of excluded persons. A person excluded by the librarian is entitled to a written notice that specifies the exclusion, period, reason and their right to apply to the Board for a review (r 32(2)). The excluded person has a right to apply in writing to the Board for review of the exclusion (r 32(4)(c)) and, on review, the Board may confirm, revoke or substitute a different period of exclusion (r 32(5)). The Regulations do not create any further statutory appeal beyond the Board review; the Regulations do, however, require written notice explaining the right to the Board review.

Borrowing and acceptance conditions. Under r 34(1) the State Library is to be conducted primarily as a reference library, which constrains borrowing as an exception rather than the norm. Loans may be made to approved libraries, government departments or instrumentalities, or in exceptional circumstances to others, at the Board’s discretion. The librarian’s authority to impose conditions and refusal power over removal is explicit in r 34(2); a borrower is statutorily deemed to have assented to any conditions by accepting a book on loan.

Reproduction permissions. Regulation 11 creates a two‑party gate for further reproduction of photographic copies made by the librarian for personal use: written permission from the copyright owner and written permission from the Board are both required. The Board may impose conditions on reproduction and the person must comply with those conditions (r 11). This imposes contractual and statutory compliance obligations on the person who sought the original copy.

Monetary enforcement. Any sum or penalty payable under the Regulations may be recovered by the Board as a debt in any competent court (r 35). The Regulations impose a penalty not exceeding $100 for breaches and additionally require payment of any expenses incurred as a consequence of the breach (r 36). These financial mechanisms create both a criminally denominated penalty cap and a civil recovery path for expenses.

Procedural and operational duties. The librarian must give written exclusion notices containing specified content (r 32(2)) and must impose exclusion periods no longer than two years (r 32(3)). The Board must consider written review applications and has three enumerated options on review (confirm, revoke or substitute a different period) (r 32(5)). Those are the main procedural rights and duties related to exclusion.

In short, the Regulations create operational duties for the librarian, behavioural duties for users, conditional rights for borrowers, a two‑stage permission requirement for further reproduction of librarian‑made photographic copies, and monetary liability mechanisms for breaches.

Statutory penalty and expense recovery. Regulation 36 prescribes that a person who commits a breach of these Regulations is liable to a penalty not exceeding $100 and, in addition to any penalty imposed, must pay the amount of any expense incurred in consequence of the breach (r 36). The Regulations therefore create two distinct monetary consequences: a penalty capped at $100, and an open‑ended liability to reimburse expenses caused by the breach.

Recovery mechanism and forum. Regulation 35 provides that any sum or penalty payable under the Regulations may be recovered in any court of competent jurisdiction by the Board as a debt due to the Board (r 35). This makes the Board the civil claimant for recovery and places monetary enforcement in ordinary civil courts, not in an administrative tribunal specified by the Regulations. The phrase “any court of competent jurisdiction” leaves venue and procedure to be determined by ordinary rules of jurisdiction and practice.

Operational enforcement by the librarian. The librarian has operational enforcement powers in the sense that the librarian may give directions (r 14) and may exclude persons from the library for specified reasons (r 32(1)). Exclusion is an immediate administrative remedy that can be exercised without first resorting to court processes, subject to the written notice requirements in r 32(2) and the right to apply for Board review in r 32(4)(c).

Exclusion as non‑monetary sanction. Exclusion is a non‑monetary but significant sanction. The librarian may exclude a person for up to two years (r 32(3)). Exclusion is subject to written notice specifying the period and reasons (r 32(2)), and an excluded person may apply in writing to the Board for review (r 32(4)(c)). On review the Board may confirm, revoke or substitute a different exclusion period (r 32(5)). The Regulations do not prescribe further appeal rights beyond Board review; the enforcement and remedial architecture is therefore internal, with the court pathway reserved for monetary recovery.

Scope of punishable conduct. The Regulations define a range of behaviours that can lead to exclusion (r 32(1)), require compliance with reasonable directions (r 14), and prohibit obstruction of officers and wilful disturbance of other persons (r 14). A breach of these duties is captured by r 36’s penalty provision. Additionally, non‑compliance with reproduction conditions under r 11 or with loan conditions under r 34 may trigger liability under r 36 and expense recovery under r 35.

Practical enforcement implications. Given the monetary cap in r 36, the most direct legal remedy for significant damage or misconduct may be expense recovery under r 36 in combination with r 35 rather than reliance on the capped penalty alone. The Board’s option to recover expenses as a debt could be used to seek sums beyond the penalty cap to cover remediation, repair or other costs incurred as a result of a person’s breach.

Who enforces. The Board is the enforcement claimant for monetary recovery and the reviewing body for exclusions. The librarian is the front‑line enforcer with authority both to direct and to exclude. The Regulations thus separate operational enforcement from judicial recovery: the librarian acts immediately to maintain order; the Board pursues monetary recovery and conducts reviews.

In summary, enforcement under the Regulations relies on a combination of immediate administrative measures (directions and exclusion by the librarian), an internal review process to the Board for exclusions, and civil recovery in court for penalties and expenses. The monetary penalty is capped at $100 but expense recovery is open‑ended, and the Board is the party responsible for seeking recovery.

Primary statutory linkage. The Regulations are made under the Library Board of Western Australia Act 1951 as indicated by the defined term Act in r 2. The Act is the parent statute that establishes the Board and provides the institutional foundation for the Regulations. The Regulations refer explicitly to that Act by defining “Act” as the Library Board of Western Australia Act 1951 (r 2).

Interaction with registered public library regulations. Regulation 34(3) imports the Library Board (Registered Public Libraries) Regulations 1985, stating that those Regulations “shall apply, in so far as they are applicable, as if the State Library were a registered public library and any person borrowing a book shall comply with those regulations.” The compilation note amplifies that under the Interpretation Act 1984 s 16(1), a reference to the Regulations for the Conduct of Public Libraries may be read as including the Library Board (Registered Public Libraries) Regulations 1985, and indicates that the earlier Regulations for the Conduct of Public Libraries were repealed and replaced by the 1985 Regulations. The effect in practice is that the State Library, when engaged in lending, is subject to the statutory framework applicable to registered public libraries to the extent those provisions fit the State Library’s role (r 34(3) and compilation notes).

Copyright implications. Regulation 11 requires written permission from the owner of the copyright and from the Board before further reproduction of photographic copies made by the librarian for a person’s personal use (r 11). While the Regulations themselves do not set out or modify the substantive law of copyright, r 11 operates alongside copyright law because it explicitly conditions permissible reproduction on the copyright owner’s permission. The regulation therefore creates an administrative requirement that sits on top of any federal copyright obligations; both permissions would be necessary under the Regulation, as written.

Civil enforcement and jurisdictional rules. Regulation 35 allows the Board to recover sums and penalties as a debt in any court of competent jurisdiction (r 35). That provision invokes ordinary civil procedure and jurisdictional rules. It does not specify a particular court or tribunal, and so ordinary rules about monetary jurisdiction, limitation periods and procedural requirements will apply, subject to the Board’s practical choices.

No express privative clause or ouster of judicial review. The Regulations provide an internal review mechanism in r 32(4)(c)-(5) for exclusions, enabling a person to apply in writing to the Board and obliging the Board to confirm, revoke or substitute a different exclusion period. The Regulations do not purport to oust external judicial remedies. The text does not address remedies outside the instrument. Because this exercise must rely only on the Regulations as the source, the Regulations themselves do not record any explicit ouster of judicial review or external oversight mechanisms.

Compilation, citation and interpretation legislation. The compilation table and notes record changes to the Regulations (Gazette amendments in 2013 and 2017). The compilation note also refers to the Interpretation Act 1984 s 16(1) for reading earlier regulatory citations. Those references show how the Regulations have been tied into the general framework of statutory interpretation and reprinting in Western Australia.

Interaction with criminal law. The Regulations include a penalty provision (r 36) but frame enforcement primarily through civil mechanisms: the Board may recover sums or penalties as a debt in court (r 35). The text does not specify criminal procedure or prosecution mechanisms beyond the penalty cap. The Regulations instruct recovery as debt rather than specifying a criminal sanction administered by a prosecuting authority.

In sum, the Regulations operate within an identifiable statutory ecosystem: the Library Board Act 1951 provides the parent authority, the Registered Public Libraries Regulations 1985 are applied for lending, the Interpretation Act informs how earlier references are read, and r 11 places administrative reproduction permissions alongside substantive copyright ownership. Enforcement is framed as civil recovery by the Board in the courts, with immediate administrative measures available to the librarian.

Compilation table overview. The compilation notes attached to the Regulations list the origin and amendment chronology. The Regulations were originally published as the Regulations for the Conduct of the State Library on 3 August 1956 (Gazette p. 1913‑16). An amendment associated with the Decimal Currency Act 1965 is recorded in the compilation table, noting different commencement dates for sections. The Regulations were reprinted as at 6 December 2002, incorporating the 1965 amendment information.

2013 amendments. The Library Board (State Library) Amendment Regulations 2013 were gazetted on 6 December 2013 (p. 5737‑8). The compilation table records that r 1 and r 2 commenced on 6 December 2013, while the other Regulations commenced on 7 December 2013. The marginal notes beside regulations indicate that r 1 and r 2 were amended in that 2013 Gazette (Regulation 1 amended: Gazette 6 Dec 2013 p. 5737; Regulation 2 amended: Gazette 6 Dec 2013 p. 5737). Several intermediate regulations were deleted in that amendment round: regulations 3, 5-10, 12-13 and 15-31 are listed as deleted with reference to Gazette 6 Dec 2013 p. 5737‑8.

2017 amendments and insertion of Reg 32. The Library Board (State Library) Amendment Regulations 2017 were gazetted on 23 June 2017 (p. 3177‑9). The compilation table indicates that r 1 and r 2 of the amendment commenced on 23 June 2017, and the other Regulations commenced on 24 June 2017. Regulation 32, governing exclusion from the library, was inserted by that 2017 Gazette (Regulation 32 inserted: Gazette 23 Jun 2017 p. 3178‑9). The same amendment notice deleted regulation 33 (Deleted: Gazette 23 Jun 2017 p. 3178).

Reprints. The Regulations were reprinted as at 6 December 2002 (first reprint) and as at 7 February 2014 (second reprint), the latter incorporating the 2013 amendments. The compilation table notes Reprint 2 as including the 2013 amendments and records the 2017 amendments separately.

Deleted provisions. The marginal notes attached to various regulations indicate deletions of a number of provisions: r 3 was deleted in 2013; r 5-10 deleted in 2013; r 12-13 deleted in 2013; r 15-31 deleted in 2013; and r 33 deleted in 2017. The repeated deletions indicate a significant consolidation and updating in the 2013 and 2017 amendment rounds, leaving the current instrument shorter and focused on core operational provisions.

Specific insertions and amendments referenced in the text. The text of the Regulations identifies that r 1 and r 2 were amended in 2013 (Regulation 1 amended: Gazette 6 Dec 2013 p. 5737; Regulation 2 amended: Gazette 6 Dec 2013 p. 5737) and that r 14 was amended in 2013 (Regulation 14 amended: Gazette 6 Dec 2013 p. 5738). The insertion of r 32 was effected in 2017 (Regulation 32 inserted: Gazette 23 Jun 2017 p. 3178‑9). The penalty in r 36 was amended earlier by Act No. 113 of 1965 s 8(1), as recorded in the marginal note to r 36.

Interpretation Act connection. The compilation notes contain a reference to the Interpretation Act 1984 s 16(1) regarding reading earlier references to the Regulations for the Conduct of Public Libraries as including the Library Board (Registered Public Libraries) Regulations 1985. That interpretive linkage is recorded in the compilers’ notes and affects how r 34(3) should be read.

Practical effect of the amendment history. The recorded amendments and deletions show that the instrument has been pruned and modernised at least twice in recent decades, with a material structural change in 2013 that removed a number of earlier provisions and a 2017 insertion of a new exclusion regime (r 32). The reprints noted reflect those consolidation steps and provide point‑in‑time versions that incorporate the amendments up to the reprint date.

For practitioners and researchers, the compilation table and gazette citations in the marginal notes are the source of historical amendment detail. The Regulations themselves cite the specific amendments for the provisions that were changed or inserted.

The Regulations as published do not record any litigation history. The instrument itself contains no judicial decisions, reported cases, or references to litigation outcomes. The text includes only the regulatory provisions, the compilation table and marginal amendment notes; it does not list cases or judicial interpretations.

Because the source provided is the Regulations text and compilation notes only, there are no cases named in the source to report. The Regulations do not contain statutory examples of judicial consideration, nor do the marginal notes cite relevant judicial authorities. Accordingly, within the confines of this source, there is no recorded litigation history to summarise.

Users seeking judicial treatment or precedents involving these Regulations would need to consult court databases, law reports or secondary sources outside this Regulations text. The Regulations themselves do not include any commentary on how courts have interpreted provisions such as r 14 (reasonable directions), r 32 (exclusion process), r 34 (lending conditions) or r 11 (reproduction permissions), and therefore this instrument provides no statutory litigation trail.

The absence of litigation history in the instrument means that any questions about how courts might construe “reasonable” directions (r 14), the limits of exclusion power (r 32), the Board’s discretion over lending (r 34), or the interplay with copyright law (r 11) must be resolved by reference to external case law and broader legal principles. Those materials are not part of this Regulations compilation and are not summarised here.

Scope of the definition of “book.” Regulation 2 defines book to include an extensive and varied list of materials, explicitly stating that the list covers items “whether or not the property of the Board” (r 2). The practical implication is that the Regulations’ rules on custody, removal, reproduction and lending apply to items that may still be owned by third parties while those items form part of the library’s contents. Owners of deposited or consigned material should not assume property ownership alone removes the material from regulatory constraints while it is in the library’s possession.

Spatial reach of the Regulations. The definition of library in r 2 includes adjacent passages, staircases, entrances, exits and gardens. That spatial breadth means actions such as exclusion under r 32 can be enforced with respect to individuals in areas adjacent to, but not strictly inside, the building. Practitioners should note the Regulations cover a wider geographical footprint than simply public reading rooms.

Concentration of front‑line discretion. Regulation 4 vests general control in the librarian and r 2 defines librarian to include any person in charge of a part or section. Operational powers to give directions (r 14), to authorise or refuse removal of books and to impose loan conditions (r 34(2)), and to exclude persons (r 32) are given directly to the librarian or to persons acting as librarian. This decentralised textually authorised discretion can lead to variable application in practice across different library sections because “librarian” includes sectional managers (r 2 and r 4).

Exclusion process is administrative and paper‑based. The exclusion regime in r 32 includes an immediate operational step (the person must leave immediately, r 32(4)(a)) and a written notice requirement (r 32(2)). The review right is limited to a written application to the Board (r 32(4)(c)) rather than to an appeal to an external tribunal in the Regulations themselves. The Regulations do not set explicit timeframes for the Board’s handling of reviews, nor do they prescribe procedural safeguards beyond the written notice and written application. That leaves practical uncertainty about how long reviews may take and what procedural standards the Board will apply.

Maximum exclusion period and review substitution. The librarian may determine an exclusion period not longer than two years (r 32(3)). The Board on review may confirm, revoke or substitute a different period (r 32(5)). The Regulations therefore give the Board power to reduce or extend a period within the two‑year legislative cap, but do not specify principles to govern substitution or how the Board should exercise that discretion.

Dual permission required for reproduction. Regulation 11 requires written permission from both the owner of copyright and the Board before further reproduction of a photographic copy made by the librarian for a person’s personal use (r 11). Practically, a person who obtains a library‑made copy must secure two distinct written permissions. That double‑gate may complicate lawful reuse where the copyright owner is difficult to identify or contact.

Penalty cap versus expense recovery. The penalty for breach is capped at $100 (r 36). At the same time, r 36 requires the person to pay any expense incurred because of the breach, and r 35 allows the Board to recover sums and penalties as a debt in court. The capped penalty may be modest relative to modern costs, but expense recovery is not capped and could exceed the penalty by a large margin. The combination permits the Board to seek substantive remediation costs in court while statutory fines remain modest.

Implied assent to conditions by borrowing. Under r 34(2), a person accepting a book on loan is “deemed to have assented to any such conditions.” This deeming provision creates an automatic contractual obligation to comply with loan conditions. Borrowers cannot rely on a lack of express signed agreement to avoid conditions the librarian imposes, because the act of accepting the loan is itself the operative assent.

Limited procedural detail for reviews. The Regulations describe the right to apply in writing to the Board for review of an exclusion (r 32(4)(c)) and the Board’s options on review (r 32(5)) but do not prescribe times for lodging an application, service methods, hearing rights, evidence standards, or whether the excluded person may be represented. Those procedural gaps mean that operational practice must be governed by the Board’s internal procedures or by general administrative law principles, neither of which are set out in the Regulations.

Interaction with external copyright law is not specified. While r 11 requires the copyright owner’s permission, the Regulations do not explain how library‑made copies interact with any statutory exceptions that may exist under federal copyright law. Practitioners must therefore treat r 11 as an administrative overlay imposing its own requirements independent of federal licensing or exceptions, at least insofar as the Board enforces it.

No explicit public‑facing complaints mechanism beyond Board review. The Regulations provide an internal remedy for exclusions but do not specify external complaint channels or ombudsman oversight. Entities or individuals seeking further remedies beyond Board review will need to look outside the Regulations to other statutory review or judicial review avenues.

In summary, the key practical pitfalls involve the broad definitions of covered material and space, concentrated discretionary authority in the librarian and Board, a double permission requirement for reproduction, a modest statutory fine but open‑ended expense recovery, and procedural gaps around review processes that invite reliance on supplementary administrative practice or external law.

Practical steps for patrons and users. Comply with reasonable directions of the librarian at all times (r 14). Avoid wilful obstruction of Board officers and wilful disturbance of other patrons (r 14). Do not access indecent, obscene or offensive content on computers or devices in public areas of the library, or if you do, stop immediately when directed by the librarian (r 32(1)(c) and r 14). If you are asked to leave under exclusion grounds, leave immediately if applicable and do not re‑enter during the period of exclusion (r 32(4)(a)-(b)).

Responding to an exclusion. If given a written exclusion notice, ensure the notice contains the elements required by r 32(2): it must state you are excluded, specify the period, explain the reason, and inform you of your right to apply in writing to the Board for review. If you wish to challenge the exclusion, submit a written application to the Board under r 32(4)(c). Expect the Board to either confirm, revoke or substitute a different exclusion period (r 32(5)). Prepare a concise written statement explaining grounds for revocation or reduction and, where possible, include supporting evidence or witnesses.

Borrowing and loan conditions. The State Library is primarily a reference library (r 34(1)). If you borrow a book pursuant to r 34, note that loans are discretionary and typically limited to approved libraries, government departments or government instrumentalities for official use, and otherwise only in exceptional circumstances (r 34(1)). Before accepting a loan, ask the librarian to state any conditions concerning the manner of use, period of loan, and other restrictions, because acceptance is deemed to constitute assent to these conditions (r 34(2)). If the librarian imposes conditions, obtain them in writing where practicable.

Photocopies and reproduction. If the librarian provides photographic copies for your personal use, do not reproduce them further unless you have obtained written permission from both the owner of the copyright and from the Board (r 11). If you intend to reproduce, identify the copyright owner and request written permission, and separately seek written permission from the Board. Anticipate that the Board may impose conditions on any reproduced material and ensure you comply with those conditions.

Avoid behaviours that trigger exclusion. The exclusion grounds in r 32(1) include disorderly conduct, being affected by alcohol or drugs, accessing indecent content in public areas after direction to stop, misuse of the library’s purpose, and breach of the Regulations likely to be repeated by continued presence. Minimise risk by using the library for research and reference, maintaining appropriate conduct and not consuming alcohol or illicit substances on site.

Dealing with breach consequences. Be aware that breaches attract a penalty up to $100 and liability for expenses incurred as a consequence of the breach (r 36). If you are informed that the Board intends to recover expenses, expect the Board can commence civil recovery proceedings in an appropriate court as a debt (r 35). Keep records of any authorisations, permissions, returns of loaned items and communications with staff to counter any expense claims where possible.

Engage with the Board for permissions and exceptional requests. For requests that fall outside ordinary borrowing practice (for example, exceptional loans or extensive reproduction requests), apply to the Board for permission in writing, and ensure you comply with any conditions set by the Board (r 11, r 34). For public bodies and approved libraries seeking loans under r 34(1), maintain documentary evidence of official purpose and adhere to any conditions the Board or librarian imposes.

For owners of material in the collection. If you own items that form part of the library’s contents, be aware that the Regulations’ controls on custody and use apply while the items are part of the collection (r 2 and r 4). Engage with the librarian or the Board about any special conditions you require for custody or reproduction, and record any agreements in writing.

Record keeping and evidence. Maintain written records of any permissions, loan conditions, Board approvals and exclusion notices. The Regulations rely on written notices and written applications for review (r 32(2), r 32(4)(c)). Having contemporaneous documentation will assist with compliance, defence against expense claims, and any review processes.

Internal procedures and staff training. For library management, ensure internal policies mirror the statutory requirements: staff should be trained on giving lawful and reasonable directions (r 14), the process for issuing written exclusion notices with the required content (r 32(2)), and the mechanics for accepting loans on behalf of the library (r 34(2)). Create templates for exclusion notices that include the prescribed information and an administrative timetable for handling Board review requests.

Legal and administrative advice. Where reproductions implicate copyright or where exclusions raise procedural fairness concerns, seek legal advice on how the Regulations interact with external statutes and common law rights. While the Regulations prescribe a written Board review, they do not specify further procedural protections; legal advice can assist in framing review applications and in preparing or contesting expense recovery claims.

Summary checklist for compliance:

• Follow any reasonable directions from the librarian and do not obstruct staff (r 14).
• Do not view indecent content in public areas after being directed to stop (r 32(1)(c)).
• If excluded, leave immediately and lodge a written review application to the Board if you contest the exclusion (r 32(4)(a)-(c)).
• When accepting loans, obtain and record any conditions expressly and understand that acceptance equates to assent (r 34(2)).
• For further reproduction of library‑made photographic copies, obtain written permission from both the copyright owner and the Board and comply with Board conditions (r 11).
• Keep written records of interactions, permissions and notices; these are key evidentiary tools if the Board seeks expense recovery or a review is necessary (r 35, r 36).

Adhering to these steps will align practical conduct with the statutory duties and rights set out in the Regulations and reduce exposure to exclusion and monetary recovery processes.
