Library Board (Registered Public Libraries) Regulations 1985

The Regulations organise library administration and patron conduct around a small number of recurring legal concepts, each carrying a specific set of practical rules.

• Registered reader and reader’s ticket. A registered reader is a person issued a reader’s ticket by a library authority (reg 5(3), (4); definition in reg 2). The reader’s ticket is the primary instrument of access and borrowing rights. It is time-limited (normally two years unless otherwise determined, reg 9(1)), non-transferable (reg 9(2)), and is the basis of responsibility for books borrowed on that ticket (reg 9(4)). Loss or destruction of the ticket must be reported (reg 9(5)); replacement tickets may be issued on proof and payment of any prescribed fee (reg 9(6)).

• Permanent resident and service area. Eligibility for registration in the primary category is tied to being a permanent resident of the library authority area, a fact to be established to the librarian’s satisfaction (definition in reg 2; reg 5(1)). For non-local-authority library authorities, the library authority area is defined by agreement with the Board (reg 2).

• Recognized organisations and special registrations. The instrument allows non-residents to be registered subject to recommendation or payment of a refundable deposit determined by the library authority with the Board’s concurrence (reg 6). Organisations may be authorised to borrow for official business after application and authorisation (reg 7).

• Board concurrence. Several powers and fees require the Library Board’s concurrence: opening hours (reg 4(1)), refundable deposit amounts and the option to dispense with them (reg 6(1)(c), (3)), replacement ticket fees (reg 9(6)), penalties for overdue books (reg 14(1)), and suspension/cancellation measures (reg 14(4) gives authority to suspend or cancel in circumstances of frequent lateness).

• Librarian’s operational authority. The librarian controls daily operations, has authority to refuse messengers (reg 12), require visitors to deposit bags and open them (reg 21(1)-(2)), decide on issue/renewal of loans (reg 13(1)-(4)), and exclude or remove persons for misconduct (reg 29). The librarian is responsible to the library authority (reg 28).

• Liability for loss and damage. A borrower whose loan is lost or damaged after notice or return may be required by the Board to pay replacement costs, possibly the cost of the entire work if a single volume cannot be replaced (reg 16). Damaged books found on return must be reported (reg 17) and remain Board property even if replaced or paid for (reg 17(2)).

• Patron behaviour and exclusions. A suite of behavioural rules govern conduct in libraries, prohibiting lying on furniture, smoking outside special areas, offering goods for sale without consent, disorderly conduct and so on (reg 22). Specific access constraints include restricted areas (reg 25), animal exclusions with a guide-dog exception (reg 23), and vehicle restrictions (reg 24).

• Enforcement and remedies. Monetary sums and penalties are recoverable in court by the Board or the library authority (reg 30). The maximum penalty for a breach is set out as up to $100 plus any expense incurred (reg 31). There are administrative remedies such as suspension and exclusion (reg 29).

These concepts are implemented through a combination of prescriptive text (for example, non-transferability of tickets, reg 9(2)) and permissive discretion (for example, the library authority may determine loan periods, reg 13(1)). The result is a regulatory framework that sets minimum behavioural and administrative rules while leaving local authorities and the Board scope to set particulars consistent with the Regulations.

The Regulations allocate rights and duties across a clear set of actors. For compliance and risk mapping, identify these principal parties and their statutory obligations.

• Library authorities. Defined as participating bodies controlling a registered public library (reg 2). They decide opening hours with the Board’s concurrence (reg 4(1)), issue reader’s tickets (reg 5(3)), determine loan periods (reg 13(1)), fix replacement ticket fees and deposit amounts with Board concurrence (regs 6(1)(c), 9(6)), decide overdue penalties with Board concurrence (reg 14(1)) and may suspend or cancel a registration (reg 14(4)). They are also responsible for exhibiting opening times (reg 4(2)). The library authority is a plaintiff for recovery of sums and penalties in court (reg 30).

• The Library Board. The Board’s role is supervisory in the areas where its concurrence is required and it can itself require replacement or compensation for lost or damaged books (reg 16(d)-(e)). The Board receives requests for books not in stock (reg 19(1)) and may take steps to supply them (reg 19(2)). The Board is also one of the parties authorised to recover sums in court (reg 30). The Regulations refer to the Library Board of Western Australia Act 1951 as the enabling Act.

• Librarians. Defined as the person appointed by the library authority to be in charge of the library or an authorised delegate (reg 2). The librarian has general control and charge of the library and is accountable to the library authority (reg 28). Specific powers include refusing to issue books to messengers (reg 12), requiring deposit and inspection of bags (reg 21), enforcing behaviour rules (reg 22), excluding or removing persons for breaches (reg 29(1)), and suspending reader’s tickets or denying library use (reg 29(2)). The librarian also handles notifications about lost tickets and may require proof before issuing replacements (reg 9(5)-(6)).

• Registered readers. Persons who hold a reader’s ticket, including permanent residents by default (reg 5(1), 5(4), reg 2). Registered readers must present tickets to borrow (reg 11), are responsible for books borrowed on their ticket (reg 9(4)), must report lost or destroyed tickets (reg 9(5)) and are liable for replacement costs or compensation for lost or damaged books in specified circumstances (reg 16). Minors under 18 may require a parent or guarantor signature accepting financial responsibility for borrowed books (reg 5(2)).

• Non-resident employees, students and organisations. The Regulations permit registration of non-resident employees or students upon employer or principal recommendation or payment of a refundable deposit (reg 6). Organisations, including government departments, may be permitted to borrow books for official business on application (reg 7).

• Visitors and the public. The Regulations regulate behaviour and access for anyone entering a library, not only registered borrowers. Provisions require compliance with reasonable directions from librarians (reg 22(1)), prohibit animals (with guide-dog exception, reg 23), control vehicles and conveyances (reg 24), restrict entry to staff-only areas (reg 25), and allow requirement to deposit bags and open them for inspection (reg 21).

• Courts and police. Courts of competent jurisdiction are the recovery forum for outstanding sums and penalties (reg 30). Police stations are the destination for unclaimed deposited articles after seven days (reg 21(3)).

The distribution of rights and obligations is asymmetric: registered readers enjoy borrowing privileges but carry primary liability for borrowed items (reg 9(4), 16); librarians are empowered with immediate operational enforcement action (reg 29); library authorities hold financial and policy setting responsibilities often subject to Board concurrence (regs 4, 6, 9, 14). The Regulations therefore create clear role-based obligations but also allocate significant discretionary authority to librarians and library authorities, mediated in specified areas by the Board.

This section collects the principal duties imposed and rights granted under the Regulations, linked to the specific provisions.

Rights

• Right to borrow. A registered reader is entitled to borrow books from any library in the State on production of a current reader’s ticket, subject to conditions imposed by the issuing library authority (reg 5(4)).

• Organisations and non-residents. Recognised organisations may borrow for official business (reg 7(1)). Non-residents may be registered where recommended or on payment of a refundable deposit (reg 6(1)).

• Appeals. A person aggrieved by a librarian’s decision to suspend or deny access may appeal to the library authority (reg 29(2)).

Duties of library authorities and the Board

• Hours and notice. Library authorities must open libraries on days and hours as determined with the Board’s concurrence and keep a conspicuous statement of opening times in or on the library (reg 4(1)-(2)).

• Registration and ticketing. Authorities must administer registration forms, issue reader’s tickets (reg 5(1), (3)), and manage ticket renewals and cancellations (reg 9(1), 10).

• Fee-setting, deposits and penalties. Authorities decide deposit amounts and replacement ticket fees with Board concurrence; overdue penalties are set by the authority with the Board’s concurrence (regs 6(1)(c), 9(6), 14(1)).

• Recovery and offsets. A deposit must be returned where the depositor becomes a permanent resident or ceases to borrow and returns all books, but outstanding amounts may be offset against the deposit (reg 6(2)).

• Record keeping and notification. Librarians must track reservations and requests, notify when reserved items become available (reg 18(2)), and inform the Board of requests for books not in stock (reg 19(1)).

Duties and obligations of librarians

• Operational control. The librarian has general control and charge of the library and is responsible to the library authority (reg 28).

• Issuing and renewals. The librarian controls issue and renewal of loans and may decline to reissue on the day of initial issue (reg 13(2)-(4)).

• Security measures. The librarian may require deposit of bags and inspect them, and may forward unclaimed deposits to police after seven days (reg 21(1)-(3)).

• Conduct enforcement. The librarian may exclude or remove disorderly persons, refuse issuance to messengers, suspend tickets and deny library use for non-compliance with regulations (regs 12, 29).

Duties and liabilities of readers

• Ticket use and non-transferability. Present the reader’s ticket when borrowing (reg 11). The ticket is not transferable (reg 9(2)). A borrower remains responsible for books borrowed on their ticket (reg 9(4)).

• Notification obligations. Notify the librarian of lost tickets and of change of address or cessation of use (regs 9(5), 10).

• Care of books. Report damage present on issue and any injury sustained while in custody and return books by the prescribed methods (regs 17, 15).

• Financial liability. Pay replacement costs or compensate for lost or damaged books when required by the Board (reg 16(d)-(e)). Pay postage or other expenses incurred by the library in securing the return of overdue books if required (reg 14(2)).

• Behavioural compliance. Comply with reasonable directions, avoid proscribed conduct such as disorderly behaviour, smoking outside authorised areas, soiling or damaging books, misplacing or secreting books (reg 22).

Other operational rules that create duties

• Reference-only items. Items designated for reference use only must not be borrowed without the librarian’s agreement (reg 20).

• Reservation and inter-library request protocol. Reserve stock items through application, and request non-stock items which the Board may attempt to supply (regs 18-19).

• Minors’ registration. Authorities may require that applications from persons under 18 be signed by a parent or guarantor who accepts financial responsibility (reg 5(2)).

Overall, rights principally centre on borrowing privileges tied to the reader’s ticket, while duties and financial exposure centre on return, care and liability for loss or damage. The Board and library authorities share duties for setting fees, hours and penalties, with the librarian empowered to enforce rules on the ground.

The Regulations provide a mix of administrative and legal enforcement mechanisms. They combine immediate operational measures available to librarians with monetary sanctions recoverable through courts.

Administrative enforcement and immediate powers

• Exclusion and removal. The librarian may exclude or remove a person from the library for disorderly conduct, offensive behaviour, intoxication, misuse of facilities or repeated breaches likely to lead to further breaches (reg 29(1)(a)-(e)). This is an immediate, on-the-spot power tied to conduct observed by library staff.

• Suspension and denial of access. The librarian may suspend a reader’s ticket and refuse to issue books or deny library use to persons who refuse or neglect to comply with the Regulations (reg 29(2)(a)-(b)). An aggrieved person may appeal such a decision to the library authority (reg 29(2)).

• Refusal to issue to messengers. Librarians may require borrowers to attend in person and refuse issuance to messengers (reg 12). This reduces proxy borrowing and simplifies identification and liability.

• Property and safety controls. Librarians can require deposit and inspection of bags (reg 21(1)-(2)). Unclaimed deposited items can be forwarded to a police station after seven days (reg 21(3)), which creates a link to criminal justice processes for abandoned property.

Monetary and judicial enforcement

• Recovery of sums and penalties. All sums and penalties payable under the Regulations may be recovered by the Board or the library authority in any court of competent jurisdiction (reg 30). This creates a civil enforcement route for outstanding fees, replacement costs and expenses incurred in securing returns.

• Penalty for breach. A person who commits a breach of these Regulations is liable to a penalty not exceeding $100 and to pay any expense incurred as a consequence of the breach (reg 31). The monetary cap is expressed as the maximum; the Regulations do not specify minimum penalties or a schedule for particular breaches.

• Financial liability for loss or damage. Where a book is not returned after notice, is lost on loan, or is returned damaged, the registered reader may be required by the Board to pay replacement cost as determined by the Board (reg 16(a)-(e)). In some cases the cost of replacing an entire work may be required where replacement of a single volume is impracticable (reg 16(d)). The Board may require compensation for loss or damage (reg 16(e)).

• Overdue penalties and costs. A registered reader who retains a book beyond the loan period shall incur such penalties as the library authority may determine with Board concurrence (reg 14(1)). The library authority may require payment of postage and other expenses incurred in attempting to secure the return (reg 14(2)). Persistent lateness can lead to suspension or cancellation of registration (reg 14(4)).

Practical enforcement implications and allocation of enforcement responsibility

• Day-to-day enforcement is vested with librarians and library authority staff through exclusion, suspension and refusal powers (regs 12, 21, 29). They may also set and collect administrative fees determined with Board concurrence (regs 6, 9, 14).

• Recovery of unpaid sums and enforcement of monetary obligations is through civil courts (reg 30). The Regulations do not create a separate penalty regime for every breach; instead they combine targeted financial liability for loss/damage and an across-the-board maximum fine.

• The Board has the authority to require payments for replacement and to make decisions on requests for non-stock items (regs 19, 16). Where the Board is the responsible claimant, it may pursue recovery in court under reg 30.

• Police involvement is enabled indirectly through the disposal of unclaimed property (reg 21(3)); the Regulations do not create or prescribe criminal offences beyond the monetary penalty which is enforced in civil or summary processes as applicable.

Key enforcement features to note are the mixture of administrative remedies (suspension/exclusion) and civil recovery, the role of the librarian as first-line enforcer, the Board’s role in deciding replacement and compensation, and the relatively modest maximum monetary fine set out in reg 31. Several enforcement levers are subject to the discretionary determinations of the library authority but constrained by the requirement for Board concurrence in specific areas.

The Regulations explicitly reference other statutory contexts and create interaction points with general legal frameworks.

• Enabling statute. The heading identifies the Library Board of Western Australia Act 1951 as the Act under which these Regulations operate. The Regulations must therefore be read and applied within the scope of the Board’s powers conferred by the 1951 Act. The text supplied does not reproduce the enabling sections; it treats the Regulations as subordinate instruments made under that Act.

• Local government legislation and transitional arrangements. Regulation 3 deals with rights and liabilities when a municipality that is a library authority is restructured under the Local Government Act 1960. The compilation notes explicitly state that the 1960 Act is now called the Local Government (Miscellaneous Provisions) Act 1960 and that boundary and district provisions have been repealed and moved into the Local Government Act 1995. The note advises that references to a municipality under the 1960 Act may be read as references to a local government under the 1995 Act where context requires. This creates a statutory bridge between historical municipal references in reg 3 and the current local government legislative architecture.

• Court jurisdiction for recovery. Regulation 30 provides that all sums and penalties payable under the Regulations may be recovered in any court of competent jurisdiction by the Board or the library authority. This links library enforcement to the civil court system and to procedural rules governing recovery actions, garnishment, and enforcement of judgments.

• Police involvement. Regulation 21(3) permits forwarding unclaimed deposited articles to a police station after seven days. This creates a procedural nexus with police property handling processes and potentially any criminal law or lost property laws that might apply.

• Administrative law and appeals. The Regulations provide an internal appeal route against a librarian’s decision to the library authority (reg 29(2)). The presence of an administrative internal appeal layered over exclusion or suspension decisions means that an aggrieved person may also have recourse to broader administrative law remedies where applicable, for example judicial review, if they can establish jurisdictional error or unreasonableness. The Regulations themselves do not specify judicial review, but they do create an internal decision-making route.

• Consumer and privacy laws. The Regulations authorise deposit and inspection of bags and the forwarding of unclaimed items to police (reg 21). While the Regulations do not engage consumer protection or privacy law expressly, those general statutory regimes, such as privacy laws governing personal information, will run alongside in practice. The Regulations do not displace or override other statutory obligations.

Constraints and points of overlap

• Board concurrence requirements. Several local authority actions require the Library Board’s concurrence (for example, opening hours, deposit amounts, replacement fees and overdue penalties). This creates an overlay of Board oversight and can shape interactions with local government obligations in areas like financial management and public service provision.

• Municipal restructuring clause and modern local government law. Reg 3 is framed in terms of the 1960 Local Government Act. The compilation note advises how to read that provision in light of the Local Government Act 1995. Practitioners should therefore treat reg 3 as functionally operative in modern local government contexts subject to the interpretative direction in the compilation note.

• Non-exclusivity. The Regulations do not purport to exhaustively govern all legal relationships in a library. They operate alongside the enabling Library Board Act, local government finance and property law, civil remedies for debt collection and general criminal law where conduct crosses into criminality. The statutory recoveries and police forwarding mechanism create procedural intersections but do not convert civil breaches into statutory criminal offences under these Regulations alone.

In short, the Regulations provide prescriptive operational rules and leave integration with wider legal frameworks (local government law, court procedures, police property processes, and administrative law remedies) to the ordinary operation of those regimes.

The source contains a limited record of the Regulations’ legislative history. The compilation data and notes in the provided text identify the following points.

• Original gazettal. The Library Board (Registered Public Libraries) Regulations 1985 were gazetted on 13 September 1985 (Gazettal: 13 Sep 1985 p. 3554‑8) and commenced on that date (reg 1 and compilation table).

• Reprint. The Regulations were reprinted as at 9 January 2004 (Reprint 1: the Regulations as at 9 Jan 2004). The reprint is noted in the compilation table and the opening page indicates the document is a reprint as at 9 January 2004.

• Omission. Regulation 32 is recorded as omitted under the Reprints Act 1984 s. 7(4)(f). The content of reg 32 is not provided; the instrument records only that omission occurred in the reprint process.

• Interaction with local government statutes. The compilation notes state that the Local Government Act 1960 is now called the Local Government (Miscellaneous Provisions) Act 1960 and that provisions relating to district boundaries have been repealed and moved into the Local Government Act 1995. The note advises that references to a municipality under the 1960 Act may be read as references to a local government under the 1995 Act for the purposes of reg 3 where context requires. This represents an interpretive update rather than an amendment to these Regulations.

What the compilation record does not show

• The provided text does not list successive amendments, schedule insertions or dates for changes other than the initial gazettal and the 2004 reprint. No consolidated amendment table (other than the reprint note) is included. There is no record in the provided text of later substantive changes after the reprint date.

• There is no record in the supplied material of regulatory changes to monetary amounts, penalty increases or later Board concurrence practice. For any current compliance analysis practitioners must check the Register of State Laws or the reprint certified as current by the State Law Publisher for amendments after 9 January 2004.

Practical implications

• The reprint note and omission of reg 32 should prompt practitioners to consult the State Law Publisher or official consolidated instrument to confirm any post-2004 amendments or revocations, and to obtain text of any provisions omitted or replaced.

• The small number of recorded changes in the material supplied means that for up-to-date compliance or legal advice it will be necessary to check whether the maximum penalty in reg 31 or any fee or deposit levels have since been altered by later instruments or replaced by new regulations or policies under the Library Board Act.

In sum, the legislative history in the provided text is minimal: gazettal in 1985 and a reprint in 2004 with a recorded omission. Users should treat that as a starting point for confirming the current operative text.

The Regulations as provided do not include any reported case law, judicial decisions or administrative tribunal determinations. The text names no judicial authorities and cites no cases.

What the Regulations do provide is an internal administrative appeal mechanism. Regulation 29(2) permits a person aggrieved by a librarian’s decision under that subregulation to appeal to the library authority. This creates a statutory internal appeal route for decisions such as suspension of a ticket or denial of library use.

Practical consequences for litigated issues

• Absence of cases in the instrument does not mean the Regulations have not been the subject of litigation. The supplied text simply contains no litigation record. Lawyers and researchers should search case law databases and tribunal records for any decisions that interpret particular provisions such as the scope of a librarian’s power of exclusion (reg 29) or the enforcement of liability for lost or damaged books (reg 16).

• Administrative law avenue. Decisions by librarians that involve jurisdictional error, bad faith, procedural unfairness or other public law defects could be subject to judicial review even where an internal appeal to the library authority exists. The Regulation creates an internal appeal but does not exclude external judicial review. The text itself does not discuss or delimit judicial review.

• Enforcement proceedings. Recovery of sums and penalties is to occur in "any court of competent jurisdiction" (reg 30). That implies civil proceedings for debt or judgment enforcement may be the primary route for contested monetary claims under the Regulations. No statutory small-claims pathway is specified in the Regulations themselves; standard court jurisdictions and procedures will apply.

For any matter requiring litigation or adjudication, practitioners must consult current case law databases and local court practice to identify any authorities that have interpreted the Regulations, the librarian’s discretionary powers, or the Board’s role in requiring replacement/compensation (reg 16).

This section flags provisions that commonly create practical problems in administration, compliance and risk allocation. Each point references the regulating clause to support the issue.

• Reader’s ticket liability continues until reported and cancelled. A person remains responsible for books borrowed on a reader’s ticket (reg 9(4)) and, where a ticket is lost, must immediately notify the librarian at the issuing library and at any library where it was frequently used (reg 9(5)). Liability for books borrowed on that ticket continues until the ticket is cancelled. Practitioners should note that loss of a physical ticket does not automatically absolve liability.

• Non-transferability and attempted copying prohibited. Reader’s tickets are explicitly non-transferable and making a copy with the intention of representing it as original is prohibited (reg 9(2)-(3)). Misplaced tickets or unauthorised use can therefore trigger both administrative suspension and civil liability.

• Deposits refundable but subject to offsets. A refundable deposit paid by a non-resident may be returned when the depositor becomes a permanent resident or returns all books and notifies discontinuation. However, any amount owed to the library for reasons including failure to return a book may be offset against the deposit (reg 6(2)). This creates a straightforward set-off mechanism that may reduce recoverability through other remedies.

• Board concurrence creates a two-step rule-making process. Several key operational fees and penalties require the Board’s concurrence (regs 4(1), 6(1)(c), 9(6), 14(1)). This means local authorities cannot unilaterally change those elements and must follow whatever Board processes are in place. Absence of Board concurrence could render a local fee or penalty challengeable.

• Fees for core services are generally prohibited but exceptions exist. The library authority must not charge for registration or for the loan of books (reg 8). However, replacement-ticket fees, refundable deposits, postage and other expenses for recovery and penalties for overdue books are authorised (regs 6, 9, 14). Authorities that attempt to charge for registration or normal loans contrary to reg 8 risk non-compliance.

• Librarian’s power to inspect bags and forward unclaimed items to police. The Regulations permit the librarian to require patrons to open bags and to send unclaimed deposited articles to police after seven days (reg 21(1)-(3)). This intersects with privacy concerns and local police procedures. There is also an express disclaimer of liability for loss or damage to deposited articles (reg 21(4)).

• Damage replacement possibly requires replacing whole works. The Board may require payment for the replacement of an entire work where one volume is impracticable to replace (reg 16(d)). That may lead to high replacement costs for borrowers who damage a single volume that is part of a multi-volume set.

• Modest maximum penalty. The maximum penalty for any breach is $100 plus any expenses incurred (reg 31). That cap may be lower than modern penalty regimes for comparable public order or property offences and could limit deterrence. Practitioners should confirm whether this figure has been updated in subsequent instruments.

• Reference-only limitations may disrupt research plans. Reference books are generally not loaned outside the library unless the librarian agrees special circumstances exist (reg 20). Researchers who rely on reference-only materials must plan for on-site consultation or seek librarian agreement in advance.

• Minors’ financial liability. Authorities may require parental or guarantor acceptance of financial responsibility for applicants under 18 (reg 5(2)). This creates collection avenues against guarantors but also requires careful administrative processes to obtain valid guarantor commitments.

• Ambiguity on service area boundaries for non-local authorities. The definition of library authority area for non-local authorities is the service area "as defined by agreement between that library authority and the Board" (reg 2). Practitioners should ensure these agreements are documented and consistent, as eligibility for permanent residency and services depends on that definition.

• Limited procedural detail for appeals. Although an appeal to the library authority is available for aggrieved persons (reg 29(2)), the Regulations do not specify timeline, process, or standards of review for that appeal. Authorities should create and document fair procedures to reduce risk of procedural challenge.

• No express privacy or data-handling rules. The Regulations do not contain provisions addressing personal data, membership records or data retention. In practice, library authorities must apply applicable privacy laws to their registration and record-keeping systems.

Those practical items are the places where administrative rules and rights collide. A compliance check should emphasise ticket management, clear signage and notices (for hours, deposit amounts and fees), Board coordination for fee-setting, documented appeal procedures and careful handling of information privacy when inspecting bags or keeping borrower records.

This section gives concrete, step-by-step compliance actions for library authorities, librarians and readers. Each step references the relevant regulation to make the compliance burden explicit.

For library authorities (policy and governance level)

1. Establish written policies and keep them public.

   • Publish and conspicuously display opening days and hours in the library in accordance with reg 4(2). Ensure the schedule has documented Board concurrence if required (reg 4(1)).

2. Set fees, deposits and penalty schedules with Board concurrence.

   • Determine refundable deposit amounts for non-residents, replacement-ticket fees and overdue penalties only after obtaining the Library Board’s concurrence where sought by the Regulations (regs 6(1)(c), 9(6), 14(1)). Record the concurrence and publish the amounts in an in-library notice as the Regulations require (reg 6(1)(c)).

3. Create standard forms and recordkeeping systems.

   • Maintain application forms for registration and organisation borrowing (regs 5(1), 7(2)). Track issue dates of reader’s tickets against the two-year standard or longer period as determined by the library authority (reg 9(1)).

4. Implement a deposits and refunds protocol.

   • Record payments of refundable deposits, conditions under which offsets will be applied and ensure prompt return of deposits when a depositor becomes a permanent resident or ceases borrowing and returns all books (reg 6(2)). Ensure documented processes for offsets against unpaid amounts.

5. Draft a schedule for loan periods and renewals.

   • Decide loan periods in writing (reg 13(1)) and document acceptable methods of renewal including in-library reissue or alternative methods permitted by the librarian with authority consent (reg 13(4)(b)).

6. Design an appeal process to meet procedural fairness obligations.

   • Create an internal appeals procedure for decisions made by librarians under reg 29(2). Document timelines, decision-makers and rights to representation. Although not specified in the Regulations, a clear process reduces the risk of procedural challenge.

7. Ensure legal enforcement capacity.

   • Maintain processes to identify recoverable sums and forward debt recovery actions to legal counsel for court recovery under reg 30. Keep documentation of notices, attempts to recover, and any offsets applied to deposits.

For librarians and front-line staff (operational compliance)

1. Registration and ticket management.

   • Verify permanent residency evidence before registering a person (reg 5(1), reg 2 definition). For applicants under 18 take a signed guarantor/parent signature if required by authority policy (reg 5(2)). Issue reader’s tickets and record issue dates, and remind holders about non-transferability (reg 9(2), (4)).

2. Loss and replacement of tickets.

   • Require immediate notification of lost or destroyed tickets and record notifications per reg 9(5). Request proof of loss and process replacement tickets only upon production of satisfactory proof and payment of any authorised fee (reg 9(6)).

3. Loan, renewal and return procedures.

   • Enforce the local loan period and renewal practices (reg 13). Track reservations and notify patrons when reserved books are available (reg 18(2)). Specify acceptable return methods (desk, designated place or pre-paid post, reg 15) and issue receipts where practical.

4. Handling of lost/damaged items.

   • On notice or failure to return, follow the library authority’s procedures to notify the borrower and escalate to Board action where the Board may require replacement payment (reg 16). Record damage reports at issuance and upon return as required by reg 17(1).

5. Security and inspection.

   • Implement bag-deposit procedures and signage to inform patrons of the requirement and the seven-day forwarding rule (reg 21(1)-(3)). Train staff on how to legally request that bags be opened and how to log unclaimed items prior to forwarding to police.

6. Behaviour management and exclusion.

   • Apply reg 22 behavioural rules consistently. Use the powers in reg 29 to exclude or remove persons where grounds in reg 29(1) are met. Record reasons for exclusions and suspensions and advise patrons of the right to appeal to the library authority.

7. Record of Board concurrence.

   • Where actions require Board concurrence (hours, deposits, replacement fees, overdue penalties) retain documentary evidence of the concurrence and ensure in-library notices reflect the authorised fees and penalties (regs 4, 6, 9, 14).

For registered readers and organisations (individual compliance)

1. Keep your ticket secure and notify loss immediately.

   • Do not transfer your ticket (reg 9(2)). Report lost tickets immediately to the issuing librarian and to other libraries where it was used frequently as required by reg 9(5).

2. Present your ticket to borrow and return books on time.

   • Always present your ticket at the issuing desk when borrowing (reg 11). Return books by the authorised methods (reg 15) to avoid penalties and possible suspension (reg 14).

3. Report damage and protect materials.

   • Report damage noted at issuance or damage sustained while the item is in your custody (reg 17(1)). If notified to return an item and you fail to do so, the Board may require replacement cost payment (reg 16).

4. Organisations seeking borrowing rights.

   • Apply using the library authority’s appropriate form and ensure the officer signing the application is authorised (reg 7(2)). Confirm whether loans will be for official business only as permitted by reg 7(1).

For systems and IT compliance

1. Data and privacy controls.

   • Implement privacy-compliant processes for registration data. The Regulations do not specify privacy rules; apply applicable privacy legislation to borrower records, notifications and data retention.

2. Signage and online notices.

   • Post opening hours, deposit amounts, replacement ticket fees and penalty schedules physically in the library and, if possible, online. The Regulations require conspicuous exhibition of hours (reg 4(2)) and display of deposit amounts (reg 6(1)(c)).

3. Record retention and audit trails.

   • Keep audit trails of registrations, loan records, notifications for lost tickets, damage reports, suspension decisions and appeals. These records support recovery actions in court (reg 30) and administrative appeals to the library authority (reg 29(2)).

Checklist for first 90 days of compliance implementation

• Confirm and document Board concurrence where required for current fees and hours.
• Produce and display opening hours and fee notices.
• Issue or reissue standard registration forms and ticket templates with expiry periods recorded.
• Publish a documented loan period and renewal policy and train staff on its implementation.
