Library Board of Western Australia Act 1951

The Act’s core concepts are defined in s 3 and elaborated through operational provisions. They form the vocabulary that determines legal entitlements and obligations.

• Board: The Library Board of Western Australia, the statutory body created under s 5 and given corporate form and powers in s 7. It has a prescribed membership composition, meeting procedures and indemnities (ss 5, 7, 9).
• Participating body: Defined in s 3 as a local government or an approved body that elects and is declared by the Governor to participate in a scheme. Participation is voluntary at the local government level but may require a ratepayer poll if the local council does not resolve to participate (s 4(2)(b)).
• Approved body: A non-local government organisation which elects and the Governor declares suitable to participate (s 3 definition; s 4).
• Scheme: A scheme for the promotion, organisation or supervision of free libraries and library services under the Act (s 3). A scheme is the structural vehicle for Board-assisted library services.
• Registered public library: A free library registered by the Board under s 15(1)(c). Registration is a prerequisite to certain Board actions such as subsidy allocation and inspection (s 15(1)(d)).
• State Reference Library: The State Reference Library of Western Australia, historically the Public Library and The State Library (s 3). Control and management is a statutory duty (s 15(1)(Aa)).
• Account: The Agency Special Purpose Account called The Library Board of Western Australia Account into which all moneys for Board purposes are credited and from which funds are applied (s 16(1)-(2)). The Account’s operation is subject to prescribed rules and FMA processes (s 16(3); s 20).
• Financial assistance and rates: The Act establishes a core finance architecture. The Board may subsidise registered public libraries on a one-for-one basis with conditions (s 18(a)), and the local government may impose a registered public library services rate subject to precise caps (s 19(1)-(2)). The Board may recommend additional grants for initial stocking where justified by locality-specific metrics (s 18(b)).
• Administrative controls: The Governor and Minister exercise important appointment and oversight roles. The Governor declares and cancels participating bodies (s 4), may appoint members on Ministerial recommendation (s 5), and must approve borrowing by the Board in certain cases (s 18(c)). The Minister nominates members and receives panels for selection where certain representative interests are prescribed (s 5(3)-(4)).
• Integration with other statutory regimes: The Board’s financial administration is governed by the Financial Management Act 2006 and audit/reporting is governed by the Auditor General Act 2006 (s 20). The Board has functions under the Legal Deposit Act 2012 (s 15(2)(c)), and various cross-references to public sector or education Acts affect membership and agency relationships (s 5(3), s 6(3)).

Operationally the Act combines central oversight (Board control of State Reference Library, registration, inspections and allocations) with a partnership model for local delivery (participating bodies, subsidised maintenance and local rates). It provides a framework for intergovernmental financial transfers and conditional subsidies while embedding the Board into state financial management and audit regimes.

The Act affects a defined set of actors in predictable ways because it assigns roles, rights and funding mechanisms.

• The Board and its members: The Board itself, its Chairman, Vice Chairman and members are created and governed by s 5. Members include two ex officio chief executive officers (the CEO under s 228 of the School Education Act 1999 and the CEO of the Department for the Arts as specified in s 5(3)) and 11 Governor-appointed persons chosen by the Minister or selected from panels submitted by the Australian Library and Information Association, the Cities of Perth and Fremantle, and WALGA representing categories of local governments (s 5(3)-(4)). Members and deputies have specified tenure, vacancy rules, and entitlement to travel and out-of-pocket expenses (s 5(5)-(9B), (15)).
• Participating bodies: Local governments and approved bodies that elect to participate and are declared by the Governor become participating bodies (s 3; s 4(1)). Their status confers both access to Board subsidies and obligations, such as subjecting their libraries to Board registration and possible inspection (s 15(1)(c)-(d); s 18(a)). The Governor can cancel a participating-body declaration based on Board report or other triggers (s 4(4)(a)-(b)). For local governments, electing participation may require a poll of ratepayers if the council does not resolve to participate, and ceasing participation may also require a poll (s 4(2)(b); s 4(4)(c)).
• Local governments and ratepayers: Local governments have the statutory power to levy an additional registered public library services rate on all rateable land in their district subject to strict caps (s 19(1)-(2)). Ratepayers are affected directly by the imposition of this rate and indirectly by decisions about participation and borrowing that affect local expenditure. Local governments may appropriate these proceeds to pay contributions to other local governments for library services rendered (s 19(3)).
• Approved bodies and representative organisations: Non-local-government entities may become approved bodies and be declared participating bodies if they elect and the Governor declares suitability (s 3; s 4). WALGA and professional bodies such as the Australian Library and Information Association are specified to provide nominee panels for Board membership (s 5(4)).
• State Treasury and Auditor General functions: The Board’s Account is an agency special purpose account under the Financial Management Act 2006 so the Treasurer and Auditor General have roles with respect to investment directions (s 17) and audit/reporting (s 20; s 16(2)(a)). The Treasurer can direct temporary investments of Account funds (s 17).
• State Library staff and former Trustees: Transitional provisions transfer staff, collections and certain land and contracts from the Trustees of the former Public Library to the Board within the terms of s 20A. Officers and employees of the former Public Library become Board employees on the appointed day and their rights are preserved (s 20A(4A), (7A), (7B)).
• Donors and beneficiaries of gifts and bequests: Gifts and bequests made to or for the Public Library are automatically deemed to be to or for the Board after the transition (s 20A(5A)). The Governor may allocate legacy gifts between the Board and other institutions (s 20A(5B)).
• Users of libraries: The Act contemplates rules regulating use of library premises, borrowing limits and lodgement of deposits or guarantees against loss (s 21(5)(c)-(e)). Regulations may provide for exclusion or removal of persons committing offences against the regulations (s 21(5)(d)). Private profit-making libraries and services are explicitly excluded from the definitions of library and library service (s 3).
• Ministers, Governor and executive: The Minister retains nomination powers and policy influence (s 5(3)(a)). The Governor has declaratory and cancellation power over participating bodies (s 4(1), (3)-(4)), approval power for borrowing (s 18(c)), and an explicit role under s 20A for validating transitional transfers and settling deficiencies via Orders in Council (s 20A(8)-(9)).

In short, the Act creates interactions among the Board, participating bodies, local governments and ratepayers, and embeds the Board in state financial oversight. The financial incentives for participating bodies are explicit: access to a dollar-for-dollar subsidy from the Board should reduce net local cost of library maintenance when conditions are met (s 18(a)). Local governments decide whether to participate at council or poll level (s 4(2)-(4)). The Act removes private-for-profit library services from its ambit, so private suppliers are not directly regulated or funded under its provisions (s 3 definition exclusions).

This section extracts statutory duties placed on the Board and other actors, and the rights granted by the Act, with section references.

Board duties and powers

• Control and manage The State Reference Library: The Board has an explicit duty to control and manage the State Reference Library (s 15(1)(Aa)). That is a non-delegable statutory duty in the text of the Act.
• Assist and advise participating bodies and the Minister: The Board must assist participating bodies and advise the Minister and participating bodies on policy matters relating to schemes (s 15(1)(a)-(b)).
• Registration and inspection: The Board registers public libraries as registered public libraries (s 15(1)(c)), and inspects libraries and services that apply for grant allocations, with a duty to recommend allocation between applicants (s 15(1)(d)).
• Implement Legal Deposit Act functions: The Board may perform functions conferred under the Legal Deposit Act 2012 (s 15(2)(c)). That imports statutory obligations from that Act into Board operations where relevant.
• Manage libraries and provide training: The Board may provide, control and manage libraries and library services and may provide for training of librarians and assistants to Library Association requirements (s 15(2)(a)-(b)).

Financial duties and entitlements

• Maintain and operate an agency special purpose account: All funds for Board purposes must be credited to The Library Board of Western Australia Account and applied to purposes of the Act and the Legal Deposit Act (s 16(1)-(2)). The Account is subject to operation rules and the Financial Management Act 2006 (s 16(3); s 20).
• Accountability under Financial Management Act and Auditor General Act: The Board is subject to the financial administration, audit and reporting provisions of those Acts (s 20). That creates statutory duties of reporting, compliance with public sector financial controls, and submission to audit oversight.
• Investment and borrowing duties: Funds not immediately required may be invested as Treasurer directs and the Board may, with Governor approval and on conditions, borrow money for the Act’s purposes (s 17; s 18(c)). Borrowing requires ministerial/governorial approvals set out in the Act.
• Provide financial assistance: The Board may subsidise participating bodies one dollar for each dollar expended on maintenance subject to prescribed conditions and may recommend additional grants for initial stocking in special cases (s 18(a)-(b)). The Board therefore has a duty to apply conditions fairly and a discretion to recommend extra funding where criteria such as district area, population and potential local revenue justify it (s 18(b)).

Local government duties and rights

• Power to levy registered public library services rate: Local governments may levy a rate in addition to other rates to be called the registered public library services rate on all rateable land in their district (s 19(1)). The Act requires that the provisions relating to rates in the Act that constitutes the local government continue to apply for this rate.
• Rate caps: The rate is capped in each financial year at 5/48 of a cent per dollar for unimproved capital value rated land and 5/6 of a cent per dollar for annual rental value rated land (s 19(2)). That is an express legislative ceiling.
• Use of collected rates: Rates levied under s 19 must be used for the purposes of the Act and may be appropriated as payment contributions to other local governments for library services provided (s 19(3)). This enables inter-council cost-sharing.

Procedural and administrative duties

• Appointment and governance: The Minister and prescribed bodies supply nominee panels; the Governor appoints members and may appoint deputies for nominee members. The Board has specified meeting rules including quorum (7 members) and voting (majority with chairman having one vote; tie negative) (s 5(3)-(4), (9A)-(12)).
• Secretary and State Librarian: The Board must appoint a State Librarian who is a qualified librarian and who serves as Executive Officer and Secretary (s 6(1A)-(1B)). The Board may appoint additional officers as required (s 6(1C)).
• Minutes and recordkeeping: The Board is required to keep minutes of proceedings in a manner approved by the Minister (s 5(16)). The Board’s documents and seals receive judicial notice and are presumptively authentic (ss 10, 14).
• Transitional obligations: The Board must effect the transfer of property, contracts, staff, gifts and archives as set out in s 20A and operate under restrictions for certain transferred land (s 20A(3A)-(5B), (7A)-(8)). Where the Act omits provision, the Governor may make Orders in Council to address difficulties (s 20A(8)).

Rights and immunities

• Corporate capacity: As a body corporate the Board can enter contracts, hold property, sue and be sued (s 7). Contracting formalities are specified and the Board is given procedural powers to determine disputes under contracts (s 8).
• Legal protections for members and officers: No member, officer or person appointed under the Act is personally liable for bona fide acts done in the exercise of powers or performance of duties under the Act (s 9).
• Evidentiary presumptions and representation powers: Courts and tribunals must take judicial notice of the Board’s seal (s 10); documents signed by the Chairman or authorised officer are deemed authentic until the contrary is proven (ss 11, 14); the Board can authorise officers to represent it in courts or in Legal Deposit Act proceedings (s 12).

Regulatory and enforcement rights

• Regulations and penalties: The Governor may make regulations, including fees and penalties not exceeding $100, and those regulations may create conditions for exemptions and authorise staff of participating bodies to exclude or remove persons committing offences against the regulations (s 21(1)-(5)). The Board has statutory procedural tools for enforcement via the regulations.

Collectively, these duties, rights and immunities define operational responsibilities for the Board and participating bodies, allocate financial entitlements to be managed within the state’s financial framework and create clear procedural avenues for administration and enforcement.

The Act contains a limited direct sanctions framework and a range of administrative enforcement mechanisms. The primary enforcement levers are regulatory, financial and administrative rather than large criminal penalties.

Regulatory penalties

• Regulations may impose a penalty not exceeding $100 for breach of a regulation (s 21(2)(a)). Regulations may also provide that any expense incurred as a consequence of a breach must be paid by the offender (s 21(2)(b)). This is the principal monetary sanction the Act contemplates via delegated instruments, and it is deliberately modest in scale as expressed in s 21(2).

Administrative enforcement powers

• Exclusion and removal from premises: Regulations may authorise officers and servants of any participating body to exclude or remove persons committing offences against the regulations from library premises (s 21(5)(d)). That is an operational enforcement tool for maintaining library order and protecting property.
• Lodgement of deposits/security: Regulations may provide for lodgement of deposits, security or guarantees against loss or injury to library materials or other items used by patrons (s 21(5)(c)). This creates a civil enforcement mechanism by enabling a financial bond or deposit before borrowing or use.
• Contractual enforcement: The Board has express contractual powers including the capacity to specify contractual completion conditions, dispute resolution modes and to compound claims for penalties related to contracts (s 8(a), (b), (e)). Contracts are enforceable in the Board’s corporate name (s 8(c)). This enables recourse against third parties by normal civil processes.
• Cancellation of participating body status: The Governor may cancel a declaration that makes an entity a participating body where the Governor is satisfied on the Board’s report that the entity is no longer suitable to participate (s 4(4)(a)). The Governor must also cancel participating-body declarations in specific cases such as governing-body resolution or ratepayer poll outcomes (s 4(4)(b)-(c)). Cancellation affects access to Board subsidies and other rights under the Act and thus functions as a governance sanction.
• Borrowing approval controls: Borrowing by the Board is subject to Governor approval and such conditions as the Governor imposes (s 18(c)). This operates as a financial control and a constraint on liabilities that the Board can incur.

Legal and evidentiary facilitation

• Presumptions in prosecutions and legal proceedings: The Act contains provisions easing evidentiary burdens in prosecutions or legal proceedings instituted by or under the Board. For example, proof is not required, until evidence to the contrary, of the Board’s constitution, orders to prosecute, appointments or quorum presence (s 13(1)(a)-(f)). Production of a Government Gazette copy or a certified copy of instruments is prima facie evidence of due making and existence (s 13(2)). Official documents purporting to be issued by the Board and signed by the Chairman or authorised officer are admissible as evidence until contrary is shown (s 14). Those rules reduce transaction costs and friction for enforcement actions by the Board.
• Judicial notice of common seal: Courts must take judicial notice of the Board’s common seal affixed to deeds and assume proper affixation (s 10). This streamlines authentication of instruments.

Accountability and audit

• Financial oversight by FMA and Auditor General: Application of Financial Management Act 2006 and Auditor General Act 2006 means the Board is subject to standard public sector financial controls, reporting obligations, and audit scrutiny (s 20). Non-compliance with financial reporting and control obligations can result in audit findings and public accountability consequences in the same manner as other statutory authorities.

Protections for officers and members

• No personal liability for bona fide acts: Members and officers acting bona fide under the Act are protected from personal liability for acts performed in their statutory functions (s 9). That protection supports decision-making without exposing individuals to civil liability for official acts carried out in good faith.

Limits on enforcement power

• Low maximum regulatory fine: The maximum penalty in the regulations is capped at $100 (s 21(2)(a)), which limits the financial deterrent available under the Act itself. For more significant enforcement outcomes the Board would need to rely on contractual remedies, civil proceedings, or other applicable legislation.

In practice enforcement will therefore combine modest regulatory sanctions, contractual and civil remedies, administrative measures (including cancellation of participating-body status), and financial controls under the Financial Management Act. The Act’s evidentiary facilitation (ss 10-14) reduces procedural burdens for Board-initiated legal actions.

The Act is explicitly cross-referenced to several other Western Australian statutes and was amended multiple times to align with broader administrative and financial reforms. Key interactions are set out in the statutory text and compilation notes.

Financial administration and audit

• Financial Management Act 2006 and Auditor General Act 2006: The Act expressly applies the financial administration, audit and reporting provisions of those Acts to the Board and its operations (s 20). This subjects the Board to public sector financial controls, appropriation rules, special purpose account operation and audit/reporting responsibilities. The Library Board Account is an agency special purpose account under s 16(2)(a) and must be operated in accordance with prescribed rules (s 16(3)). Temporary investments are to be directed by the Treasurer in the same securities as the Public Bank Account permits (s 17). These links mean the Board’s budgeting, procurement and investments are governed by FMA principles and oversight.
• Financial Legislation Amendment Acts: The compilation table lists amendments to integrate the Board with state financial administration (for example Acts Amendment (Financial Administration and Audit) Act 1985 and later financial legislation amendments). Those amendments effect statutory alignment with financial oversight regimes.

Legal Deposit Act 2012

• The Board may perform functions conferred on it by the Legal Deposit Act 2012 (s 15(2)(c)). The Act also cross-references the Legal Deposit Act in procedural contexts, including representation in proceedings and evidentiary presumptions under ss 12-14 and 13(2). Where functions under the Legal Deposit Act require action, the Board is the statutory actor performing those functions.

Public Sector and employment law

• Public Sector Management Act 1994 and Public Service Act 1978: The Act makes clear that acceptance of, or acting in, the office of member or deputy member does not by itself render Part 3 of the Public Sector Management Act 1994 or the Superannuation and Family Benefits Act 1938 applicable, nor affect their application if they already applied (s 5(14)). For staff, s 6(2) clarifies that State Librarian and other officers are not appointed under Part 3 of the Public Sector Management Act but remain entitled to certain leave and superannuation rights; if there is inconsistency with the Public Service Act 1978 (now read as Public Sector Management Act 1994 in notes) that other Act prevails (s 6(3)). These cross-references govern employment status and entitlements for Board staff.
• School Education Act 1999: One Board member is the person holding or acting in the office of chief executive officer of the department referred to in s 228 of the School Education Act 1999 (s 5(3)). This embeds an ex officio educational representative on the Board.

Local government law

• Local Government Act 1995: Terms used in s 5(4) for the WALGA representative definitions are to be read as in the Local Government Act 1995 (s 5(4a)). The Act also requires that a local government may exercise its rates provisions in the Act under which it is constituted to make and levy the registered public library services rate (s 19(1)). That anchors the rate-making power within local government legislative frameworks and practice.
• Polls and ratepayer votes: The Act requires ratepayer polls in specified circumstances for both joining and leaving participation, which intersects with local government electoral procedures and local law (s 4(2)(b); s 4(4)(c)).

State Records and archival law

• State Records Act 2000 transitional provisions: The compilation notes and Other notes describe how records that were State archives under the 1951 Act are transitioned to the State Records Act 2000 and certain transitional protections and restrictions apply (Notes, Other notes Pt. 6). Section 20A also handles transfer of collections and archives from the former Trustees to the Board, with the Minister given power to resolve doubts as to what property is transferred (s 20A(4B)). This interacts with archival access rules and recordkeeping plans under the State Records Act.

Miscellaneous historical Acts

• Public Library, Museum and Art Gallery of Western Australia Act 1911 and related amendments: Section 20A deals with the transfer of land and manifestations of the former Public Library and Trustees under the 1911 Act. Repeals and allocations of prior gifts and contracts are handled by s 20A(3C)-(5B).
• Repealed or amended statutes: The Act’s notes reflect repealed statutes whose provisions continue to have effect for certain purposes, such as the Superannuation and Family Benefits Act 1938 continuing for particular schemes via the State Superannuation (Transitional and Consequential Provisions) Act 2000 (Notes 3). The compilation table shows the legislative history of amendments, indicating repeated alignment with state financial, public sector and local government reforms.

Regulatory delegation

• Regulations under s 21 enable the Governor to make rules that implement many operational aspects of libraries and services, including fees, borrowing conditions and protection of library contents. The Act expressly permits regulations to delegate discretionary authority (s 21(4)). That affects how administrative powers under other Acts may be exercised by officers or delegates.

Taken together, the Act fits into the state’s constitutional framework for statutory authorities, borrowing and public finance, local government rating powers, recordkeeping and legal deposit obligations. It integrates library governance into state financial controls and audit oversight while preserving specific local government rating options and member appointment linkages to education and arts departments.

The Act has a long amendment record reflecting changing administrative structures, financial frameworks and complementary legislation. The compilation table appended to the Act records the legislative history. Significant amendments and milestones are:

• Original enactment and commencement: Library Board of Western Australia Act 1951, assented 20 December 1951 and commenced by proclamation. Initial funds appropriation for first year is in s 16(4).
• Acts Amendment (Libraries) Act 1955 (No 20 of 1955): Implemented the transfer of the Public Library and related transitional provisions that are now found in s 20A. It commenced 1 December 1955.
• Decimal Currency Act 1965 (No 113 of 1965): Relevant to rate provisions and monetary expressions, with staged commencement of parts in 1965 and 1966.
• Library Board of Western Australia Act Amendment Act 1974 (No 29 of 1974): Amendment recorded 29 October 1974.
• Amendment Acts through the 1980s and 1990s: Multiple amendments adjusted membership provisions, public service interactions and financial arrangements. Notable Acts include the Acts Amendment (Financial Administration and Audit) Act 1985 (No 98 of 1985) which integrated financial administration and audit regime features; the Acts Amendment (Public Service) Act 1987 and Acts Amendment (Arts Representation) Act 1987 which affected appointment and representation; and the Acts Amendment (Public Sector Management) and related 1993-1996 changes that aligned staffing and public sector governance (see compilation table entries for 1987, 1993, 1994, 1996).
• Financial Legislation and Standardisation amendments: Further integration with state financial governance occurred with the Financial Legislation Amendment Acts of 1996 and 2006 (No 49 of 1996; No 77 of 2006), the latter effecting the application of the Financial Management Act 2006 and Auditor General Act 2006 (by insertion of s 20 and amendment of s 16).
• Local government-related updates: Local Government (Consequential Amendments) Act 1996 (No 14 of 1996) and Local Government Amendment Act 2004 (s 13, No 49 of 2004) updated definitions and WALGA representation arrangements referenced in s 5(4) and s 5(4a).
• Legal Deposit Act 2012: The Legal Deposit Act 2012 (No 10 of 2012) inserted references to the Board’s functions under that Act (s 15(2)(c)) and amended provisions concerning Board representation and evidentiary procedures (sections 12-15 amendments noted).
• Compilation and reprints: The Act has been reprinted multiple times to incorporate amendments, with reprints noted in 1963, 1984, 1999 and 2006. Each reprint consolidates amendments up to that date.
• Standardisation of Formatting Act 2010: A technical amendment adjusting headings and formatting (No 19 of 2010).
• State Records consequential provisions and transition: The State Records (Consequential Provisions) Act 2000 (No 53 of 2000) and related notes provided transitional arrangements for archive records previously governed under the 1951 Act, specifying continuance of certain archival statuses and transitional application of recordkeeping provisions.

The compilation table lists many specific amending Acts and commencement dates. The practical effect of these amendments across decades is the alignment of the Board’s governance with contemporary public sector financial controls, audit processes and employment law, while preserving original features such as the participating body model and local rating powers. Section 20, added and amended over time, is the statutory vehicle integrating the Board into the Financial Management and Auditor General frameworks. The transitional s 20A codifies the 1955 transfers and remains a key historical anchor for property, collections and employee transfers.

No provisions appear in the current published text indicating unresolved commencement; uncommenced provisions are identified in the uncommenced provisions table, such as a transitional State Superannuation provision referenced in the compilation notes. Repealed sections 22-33 are noted as deleted by later amendment (No 53 of 2000), reflecting statutory pruning over time.

The Act’s text and compilation notes do not list cases or an explicit litigation history. The printed legislation and its compilation table focus on statutory amendments and transitional arrangements rather than judicial interpretation. Therefore there are no reported judicial decisions cited in the statute itself.

Absent a case list in the statute, potential areas where litigation or administrative review might be expected, based on the Act’s provisions, include disputes that require judicial interpretation of:

• Participating body declarations and cancellations: Disputes could arise under s 4 where the Governor cancels a declaration on the basis of a Board report that a local government or approved body is no longer suitable. Issues may include the standard or evidentiary basis for “suitability” and procedural fairness in cancellation decisions. The Act gives the Governor the cancellation power (s 4(4)(a)-(b)) and contemplates ratepayer polls in certain circumstances (s 4(2)(b); s 4(4)(c)). Challenges might engage judicial review principles regarding the exercise of executive power where affected parties claim procedural unfairness, though no cases are named in the text.
• Membership appointment disputes: The composition and appointment mechanism in s 5 (Ministerial nominations, panels, WALGA representation) could generate disputes about the validity of appointments, deputy appointments under s 5(9A) and (9B), or whether selection procedures were followed, particularly where a panel is not submitted within 28 days and the Governor appoints a person notwithstanding. Questions may arise as to the legality and reviewability of appointments made in such fallback circumstances.
• Rate-making and use of rates: Disputes could arise over a local government’s use of the statutory power to levy a registered public library services rate under s 19(1) and compliance with the capped rates in s 19(2). Legal challenges might focus on whether the rate was correctly levied under the local government’s governing Act and whether funds were applied exclusively for Act purposes (s 19(3)). The Act ties rate-making to the provisions of the Act under which a local government is constituted, so interpretation of that interaction could be an issue.
• Borrowing and financial governance: The Board’s power to borrow subject to Governor approval (s 18(c)) and its obligations under the Financial Management Act 2006 (s 20) could provoke review if borrowing is undertaken without required authorisations or if financial controls are breached. Audit processes under the Auditor General Act may identify noncompliance, generating administrative responses or follow-on litigation in the context of contract or procurement disputes.
• Property and gifting transitions: Section 20A contains tight rules about land vested by proclamation, restrictions on disposal without Governor consent (s 20A(3B)), transfer of collections and contracts (s 20A(4A), (4C)) and allocation of bequests (s 20A(5A)-(5B)). Disputes concerning whether property or gifts were properly transferred, or whether the Governor’s consent was required or properly given for disposal, could lead to judicial resolution.
• Evidentiary and procedural presumptions: Sections 10-14 provide evidentiary presumptions for the Board’s documents and seal and reduce proof requirements in prosecutions. Litigation may arise testing the scope of these presumptions and circumstances in which the “contrary is shown” standard is met.

It is important to note that these are areas of potential dispute based on statutory text rather than records of decided litigation. The Act’s built-in administrative mechanisms, evidentiary facilitation (ss 10-14), and the Board’s integration into the Financial Management Act and Auditor General Act frameworks (s 20) are legislative responses designed to reduce litigation friction and promote administrative accountability. Where disputes do arise they will intersect with administrative law principles and the state’s financial and local government legal frameworks.

Several practical and legal pitfalls are embedded in the Act’s mechanics. They are matters that practitioners and administrators should treat as triggers for careful process and document control.

Governor’s discretionary declaration and cancellation powers (s 4)

• The Governor’s power to declare and to cancel participating bodies is broad (s 4(1), (3), (4)(a)). Cancellation can follow a Board report that a participating body is “no longer suitable” (s 4(4)(a)). That phrasing raises procedural risk: participating bodies can find their status removed by executive fiat, and the Act does not specify procedural steps for contesting the Governor’s decision. Entities should therefore ensure good governance and maintain Board reporting relationships to manage suitability concerns.

Ratepayer polls and local democratic processes (s 4(2)(b) and s 4(4)(c))

• A local government that does not resolve to become a participating body triggers a ratepayer poll requirement to join (s 4(2)(b)), and ceasing participation may likewise require a poll (s 4(4)(c)). Local councils must be careful with timing and electoral procedures; failure to follow prescribed poll conduct could render a participation decision vulnerable. The Act does not set out the poll procedure in detail so compliance requires attention to the “manner prescribed” and integration with local government electoral regulations.

Appointment mechanics and representative panels (s 5(3)-(4))

• For six of the appointee slots the Minister must select a person from a panel of three names submitted by specified bodies and panels must be returned within 28 days of a Ministerial request, otherwise the Governor may appoint anyway (s 5(4)). Delays or failures to submit panels can lead to appointments being made without the intended representative input. Bodies such as WALGA and the Australian Library and Information Association should have active nomination processes to avoid loss of influence.

Quorum and voting rules (s 5(12))

• The Board’s quorum is seven members and votes are decided by majority with tie votes treated as negative (s 5(12)(a)-(b)). That tie rule can produce gridlock; for controversial decisions it is notable that equality of votes does not allow the chairman a casting vote; the tie is regarded as negative. Planning meeting attendance and proxy arrangements are therefore operationally important.

State Librarian appointments and employment status (s 6)

• The Board must appoint a State Librarian who is a qualified librarian and who is the Executive Officer and Secretary (s 6(1A)-(1B)). Officers are not appointed under the Public Sector Management Act but have specified leave and superannuation entitlements (s 6(2)). However s 6(3) preserves that the Public Service Act 1978 prevails in cases of inconsistency for Senior Executive Service members. Employers must therefore reconcile employment conditions and delegations carefully.

Restrictions on disposal of vested land and Governor consent (s 20A(3B))

• Where land and buildings from the former Trustees are vested in the Board by proclamation, the Board is not to sell, lease, mortgage or otherwise dispose of that land without Governor consent (s 20A(3B)). This is a material constraint on asset management and finance planning; practitioners must check whether particular property was transferred by proclamation and whether Governor consent is required before any encumbrance.

Evidentiary presumptions and the “until the contrary is proved” standard (ss 13-14)

• The Act eases documentary proof burdens in Board prosecutions and other legal proceedings (s 13(1)-(2); s 14). However “until the contrary is proved” introduces litigation risk if parties can produce evidence to the contrary, especially where procedural or appointment irregularities are alleged. Proper recordkeeping, timely certification and careful publication of relevant Gazette notices will reduce exposure.

Small regulatory fine ceiling (s 21(2)(a))

• Regulations may impose a penalty not exceeding $100. That modest ceiling may be inadequate for deterring certain conduct or covering recovery costs. For matters requiring more significant sanctions the Board must rely on civil remedies, contractual clauses or other legislation.

Financial integration and audit exposure (s 20; s 16)

• The Board is subject to the Financial Management Act and Auditor General Act (s 20). That results in standard public sector compliance obligations, reporting timetables and audit scrutiny. Non-compliance with procurement, asset management or financial reporting requirements may lead to adverse audit findings and reputational consequences.

Dollar-for-dollar subsidy and conditionality (s 18(a))

• The Board’s subsidy is precisely one dollar for each dollar expended by the participating body on maintenance, subject to prescribed conditions (s 18(a)). That creates margin-sensitive decisions for local governments; failure to comply with conditions or to document expenditure in a manner acceptable to the Board could result in loss of subsidy. Local governments should maintain clear accounting and eligible expense schedules.

Rate cap arithmetic (s 19(2))

• The rate caps are expressed in fractional cents per dollar: 5/48 of a cent for unimproved capital value and 5/6 of a cent for annual rental value rated land (s 19(2)). Translating those fractions into percentage or dollar amounts for rate modelling requires care to avoid inadvertent overcharging. Councils must ensure rate notices and rate calculations comply with these statutory ceilings.

Regulatory delegation and discretion (s 21(4))

• Regulations are not to be regarded as invalid for delegating discretionary authority (s 21(4)). Delegation creates both administrative flexibility and the need for robust delegation instruments and oversight. Bodies exercising delegated regulatory power should maintain clear decision records to reduce review risk.

Transitional allocations of gifts and archives (s 20A(4A)-(5B))

• Gifts and bequests made for the Public Library are automatically deemed gifts to the Board (s 20A(5A)), and the Governor may allocate bequests between the Board and Trustees (s 20A(5B)). Donors and beneficiaries should be aware their donations may be redirected by statutory operation and Governor allocation decisions.

Finally, deleted sections 22-33 indicate that historic provisions have been excised (notes). Always consult the current Act text and the compilation table for up-to-date amendments before advising on transactions or compliance.

This section provides a practical compliance checklist for the Board, participating bodies, local governments, officials and advisers, grounded in the Act’s provisions.

Board governance and meetings

• Ensure membership appointments and panels: Track appointment terms and ensure vacancy procedures are followed under s 5(5)-(8). Request panels from prescribed bodies within the 28-day window to avoid Minister/Governor fallback appointments (s 5(4)). Maintain records of ministerial nominations and Governor appointments.
• Maintain quorum and minute-taking: Prepare for a quorum of at least seven members for meetings (s 5(12)(a)). Keep minutes in the form the Minister approves and make them available for audit (s 5(16)).
• Deputies and proxies: Where nominee members require deputies, ensure the Governor’s deputies are formally appointed as allowed (s 5(9A)). Non-nominee members should nominate senior executive officers in writing to attend meetings in their place (s 5(9B)). Keep written nominations on file.

State Librarian and staffing

• State Librarian appointment: Appoint a qualified librarian as State Librarian who will serve as Executive Officer and Secretary (s 6(1A)-(1B)). Formalise employment terms consistent with s 6(2) benefits and reconcile any inconsistency with prevailing public service law so that the Public Service Act or Public Sector Management Act prevails where relevant (s 6(3)).
• Employment records: Ensure contracts, leave entitlements and superannuation arrangements for staff are documented and aligned with transitional protections where applicable (s 20A(7A)-(7B)).

Financial management and audit

• Operate the Account under FMA rules: Credit all Board funds to The Library Board of Western Australia Account and manage it as an agency special purpose account in compliance with the Financial Management Act 2006 (s 16(2)(a); s 16(3); s 20). Prepare financial statements and reports for Auditor General review in accordance with the Auditor General Act.
• Investment and borrowing processes: Follow Treasurer directions on temporary investments of Account funds (s 17). Seek Governor approval and observe any conditions before borrowing under s 18(c).
• Document subsidy conditions and expenditure: For the dollar-for-dollar subsidy under s 18(a), maintain clear, audited records of participating-body maintenance expenditure, ensuring expenditures meet any prescribed conditions. Implement application forms and templates to evidence eligible expenditures for subsidy claims.

Participating body processes

• Formal participation decisions: Local governments should resolve to become participating bodies or, if council decides not to, trigger and conduct a ratepayer poll in the manner prescribed before the Governor declares participation (s 4(2)(a)-(b)). Likewise, when ceasing participation ensure any required poll is conducted under the prescribed manner (s 4(4)(c)).
• Apply for registration and grants: Participating bodies seeking registration as registered public libraries should submit applications and be prepared for inspections in connection with grant allocations (s 15(1)(c)-(d)). For initial stocking grants under s 18(b), supply data on district area, population, rateable land and potential local revenue to support the Board’s assessment.
• Rate-setting compliance: If levying the registered public library services rate, local governments must calculate and apply the statutory caps precisely: 5/48 of a cent per dollar for unimproved capital value and 5/6 of a cent per dollar for annual rental value rated land (s 19(2)). Ensure rate notices and rate modelling reflect these caps and maintain a clear audit trail that the rate proceeds are applied to Act purposes (s 19(3)).

Records, legal deposit and archives

• Legal Deposit Act functions: Ensure Board policies implement obligations under the Legal Deposit Act 2012 where the Board performs functions under that Act (s 15(2)(c)). Maintain compliant deposit procedures and documentation for legal deposit items.
• Archive transition and access: Where records were transferred under the historical provisions or under s 20A, apply State Records Act transitional rules and ensure restricted-access archives are managed per the State Records transitional notes. Use Ministerial directions under s 20A(4B) to resolve any doubt over property transfers.

Contracts and procurement

• Contract formalities: Use the contracting provisions in s 8 to ensure contracts are validly executed under the Board’s seal or signed by authorised officers. Where the Board specifies modes of dispute resolution in contracts, document those specifications properly (s 8(a), (b)).
• Procurement compliance: Align procurement and contracting with FMA obligations and procurement policies to avoid audit or legal dispute.

Regulation and enforcement

• Prepare for regulatory powers: Draft regulations (if delegated) and internal policies to cover conduct of libraries, protection of materials, borrowing conditions and exclusions (s 21(5)(a)-(e)). Ensure penalties imposed are within the statutory cap of $100 and that any expense-recovery provisions are lawful and supported by evidence (s 21(2)).
• Security and damage mitigation: Where regulations provide for deposits or guarantees against loss or damage to borrowed items (s 21(5)(c)), design clear terms, receipts and refund mechanisms and retain records of deposit transactions.

Property and gifts

• Confirm title and Governor consent requirements: For land and buildings vested in the Board by proclamation under s 20A, verify the exact terms of vesting and whether Governor consent is required before sale, lease, mortgage or encumbrance (s 20A(3A)-(3B)). For gifts and bequests originally made to the Public Library, confirm treatment under s 20A(5A)-(5B) and obtain Governor allocation directions where necessary.

Documentation and transparency

• Keep Gazette records and certified copies: For legal evidentiary purposes, publish and retain Gazette notices, certified copies and Chairman-authorised certificates because these documents are prima facie evidence of due making and may be used in prosecutions or administrative processes under s 13(2) and s 14.
• Internal audit and compliance programmes: Implement compliance checklists, internal audits and periodic reviews to meet FMA reporting obligations and to prepare for external Auditor General scrutiny under s 20.

Risk management

• Insure against liability and manage indemnities: Although the Act provides personal liability protection for members and officers acting bona fide (s 9), maintain appropriate insurance and legal advice for institutional liabilities and contractual risks.
• Review delegated powers: Where the Board delegates regulatory powers under s 21(4), ensure delegation instruments are clear, records of delegation are maintained and delegations are exercised within defined policies.

Following this checklist aligns operational practice with the Act’s formal requirements and reduces administration, audit and litigation risk. Legal advice should be sought for complex matters such as Governor consent for property dealings, participation cancellation, significant borrowing, or disputes about subsidy eligibility.
