Library Board (Conduct of Proceedings) Regulations 1955

The regulations are compact and focused on one primary concept: the governance of internal leadership elections for the Library Board through a set of prescribed procedural rules. The regulations define a small number of core concepts and operational mechanisms:

• Defined terms: "deputy member" (a person appointed pursuant to section 5(9A) to (9D) of the Act) and "the Act" (the Library Board of Western Australia Act 1951 and any Act passed in amendment or substitution) are defined in regulation 2. Those definitions fix the scope of who is a deputy member for the ineligibility rule in regulation 5(1) and anchor references to the parent statute.

• Timing and annual trigger: an annual election is placed at the first meeting on or after 1 December each year (regulation 3(1)). That fixed temporal trigger organises annual office renewal around a date rather than a fixed interval after the preceding election.

• Administrative actor: the Executive Officer is assigned multiple express duties. The Executive Officer must give notice to members and deputy members of the meeting time and place (regulation 3(2)), send nomination papers not less than seven days before the election (regulation 4), receive nominations (regulation 5), conduct the election before other business (regulation 6(1)), read names of nominees (regulation 7), declare an unopposed nominee elected (regulation 8), conduct the poll and apply the counting and scrutiny provisions of the Electoral Act (regulation 11), announce and publish results (regulation 14), and destroy nomination papers at the end of the meeting (regulation 16). The Executive Officer thus combines notice, receipt, conduct and record functions.

• Eligibility and formalities: deputy members are disqualified from nomination (regulation 5(1)). Nominations must be formal, in writing, signed by proposer and seconder, countersigned by the nominee and delivered to the Executive Officer (regulation 5(2)). There is a strict cut-off for acceptance of nominations tied to the time fixed for the commencement of the meeting, except for the contingency where no nominations have been received prior to that time (regulation 5(3)-(4)).

• Balloting method and vote formality: the regulations distinguish two procedural voting regimes. With two nominees a simple single-name vote suffices (regulation 9(1)(a)). With more than two nominees the ballot is preferential and requires the voter to number every candidate in order of preference, marking 1 for first preference, 2 for second, and so on (regulation 9(1)(b)-(2)). Failure to comply with the prescribed marking renders the vote informal and it is rejected (regulation 10). The absence of an alternative counting method in the regulations means the precise mechanics for transferring votes and eliminating candidates are to be found in the Electoral Act 1907 provisions imported by regulation 11.

• Scrutiny and transparency: regulation 12 grants each nominee the right to appoint one scrutineer to attend and inspect the scrutiny, and mandates that scrutiny proceedings be open to inspection by those scrutineers.

• Resolution of equality: ties are not resolved by chance mechanisms in the regulations; instead an equality of votes is to be followed by further ballot(s) for the same candidates (regulation 13).

• Publication and finality: the Executive Officer must publish the poll result in the Government Gazette and that publication is declared conclusive evidence of correct election for the office of Chairman (regulation 14(1)-(2)).

• Vice‑Chairman continuity: regulation 15 creates a mechanical linkage between the two offices by deeming unsuccessful candidates for Chairman to be nominated for Vice‑Chairman; the same procedural rules apply for the Vice‑Chairman election.

Conceptually the regulations prioritise formal written nominations, administrative centralisation through an Executive Officer, preferential voting where there are multiple candidates, transparency via scrutineers and Gazette publication, and an express destruction requirement for nomination papers. The regulations deliberately avoid detailed internal counting rules by importing the Legislative Assembly electoral scrutiny rules from the Electoral Act 1907 "mutatis mutandis" (regulation 11), which is a drafting choice that leaves the detailed elimination and transfer mechanics to that other statute.

The regulations operate narrowly and affect a small, identifiable group of actors within the Library Board framework:

• Members of the Library Board: all members are addressees of the notice and recipients of nomination papers (regulations 3(2) and 4). They are the electorate that records votes in the election and may be nominees for Chairman and Vice‑Chairman, subject to the qualification that deputy members are ineligible (regulation 5(1)).

• Deputy members: the regulations define "deputy member" by reference to the Act (regulation 2) and then treat deputy members in two ways. Deputy members are to receive notice and nomination papers (regulations 3(2) and 4), but regulation 5(1) expressly disqualifies deputy members from being nominated for Chairman or Vice‑Chairman. Thus deputy members are included in administrative communications and the electorate but are excluded from candidacy.

• The Executive Officer: the Executive Officer has multiple mandatory duties and is the central officer for implementing these regulations (regulations 3(2), 4, 5(2)-(4), 6(1), 7(1), 8, 11, 14, 16). The Executive Officer effectively controls the procedural integrity of the election, including notice, receipt and validation of nominations, conducting the poll, rejecting informal votes, applying counting procedures, announcing and publishing results and destroying nomination papers.

• Nominees and proposers/seconder: anyone acting as proposer, seconder or nominee for the offices must comply with the nomination formality requirements (regulation 5(2)). A nomination that is not written and signed as required will not satisfy the regulations.

• Scrutineers: each nominee may appoint one scrutineer to inspect the scrutiny (regulation 12). Scrutineers are actors with rights to observe the counting and proceedings during scrutiny and thus are participants in ensuring transparency.

• The Chair (or vacant chair): the election is conducted while the chair is vacant (regulation 6(1)). This creates an interim procedural condition affecting how the meeting is chaired for the duration of the election; the regulations do not appoint an acting chair but place the Executive Officer in the role of conductor.

• The public record: while the public is not directly a participant in the internal ballot, the Government Gazette is used to publish the results and that publication is conclusive evidence of election (regulation 14(1)-(2)). This affects anyone who relies on the official announcement of office-holders.

Actors not explicitly mentioned in the regulations are not provided administrative roles or rights by the regulations themselves. The regulations do not create duties for external bodies, specify fees, or create criminal offences. The principal operational burden falls on the Executive Officer, the Board members (as voters and potential nominees), and the nominees (who must secure a proposer and seconder and sign the nomination).

The regulations allocate a set of mandatory duties and specific rights to defined actors. Below are the key operative duties and rights as expressed in the text, with references to the relevant regulations.

Duties imposed on the Executive Officer

• Send meeting notice: The Executive Officer must send written notice of the time and place of the meeting to each member and each deputy member (regulation 3(2)).
• Distribute nomination papers: Not less than seven days before the election day the Executive Officer must send nomination papers to each member and deputy member (regulation 4).
• Receive and validate nominations: The Executive Officer must accept nominations delivered to him in accordance with the formality rules (regulation 5(2)-(3)). The Executive Officer must not accept nominations after the fixed time for commencement of the meeting, except where no nomination had previously been delivered, in which case nominations called from the meeting must be accepted if they comply with regulation 5(2) (regulation 5(3)-(4)).
• Conduct the election: The Executive Officer must conduct the election before other business of the meeting, and the chair is to be vacant while the election takes place (regulation 6(1)).
• Read list of nominees: The Executive Officer must read to the meeting the names of members nominated for Chairman; the process of withdrawal and remaining nominations is then managed under the regulations (regulation 7).
• Declare an election if unopposed: If only one nomination exists, the Executive Officer shall declare that member elected (regulation 8).
• Apply the counting rules: The Executive Officer must ensure that counting of votes is conducted as prescribed by the Electoral Act 1907 for Legislative Assembly elections, applied mutatis mutandis (regulation 11).
• Announce and publish results: At the conclusion of scrutiny the Executive Officer must announce the name of the member elected and notify the results in the Government Gazette (regulation 14(1)).
• Destroy nomination papers: The Executive Officer must destroy the nomination papers at the conclusion of the meeting (regulation 16).

Rights and duties of members and nominees

• Receive notice and nomination papers: Each member and deputy member has the right to receive written notice and nomination papers (regulations 3(2) and 4).
• Nomination formalities: Any nomination must be in writing, signed by a proposer and seconder and countersigned by the nominee (regulation 5(2)). A deputy member is not eligible to be nominated for Chairman or Vice‑Chairman (regulation 5(1)).
• Withdrawal: After the Executive Officer reads the list of nominees, any nominated member may request his name be removed; the prior nomination is cancelled and remaining nominations are processed (regulation 7(2)).
• Voting rights: Members (and deputy members? the regulations require notice to deputy members and distribute nomination papers to them; the text does not explicitly state whether deputy members may vote; the regulations describe "persons recording a vote" without limiting by class) record votes in the manner prescribed (regulation 9). The regulations treat voters generically; they require the method of voting to be followed (regulation 9) and allow rejection of informal votes (regulation 10).
• Scrutineer appointment: Each nominee may appoint one scrutineer to represent him at the scrutiny; proceedings at scrutiny are open to inspection by those scrutineers (regulation 12).
• Deemed nomination for Vice‑Chairman: Any candidate unsuccessful for Chairman is deemed to have been nominated for Vice‑Chairman; they are therefore automatically included among nominees for the Vice‑Chairman election without separate paper nominations (regulation 15).

Rights and procedural constraints on speech and campaigning

• Prohibition on addressing the meeting: Regulation 6(2) states a person shall not address the meeting in support of or opposition to any candidate's candidature. This places a procedural restriction on speech at the meeting during the election process itself.

Procedural safeguards and declaration of finality

• Publication as conclusive evidence: The Executive Officer’s publication of the election result in the Government Gazette is declared to be conclusive evidence of the person’s election as Chairman (regulation 14(2)). That rule gives finality to the administrative act of Gazette publication.

Other operational duties and consequences

• Equality of votes: The Executive Officer must announce equality and cause a further ballot to be taken for the same candidates (regulation 13). The regulations do not provide for any method other than repeating the ballot.

Absent or non-specified duties or rights

• The regulations do not specify any monetary penalties, sanctions, or disciplinary processes applicable to failures to comply with the rules set out within them. They do not set out a formal appeals process within the regulations themselves. The mechanism for counting and scrutiny is provided by importing the Electoral Act 1907 provisions, which are applied mutatis mutandis (regulation 11), but the regulations do not reproduce or summarise those rules within their text.

Taken together, the regulations create a formalised, tightly specified election procedure with an emphasis on written nominations, a strong administrative role for the Executive Officer, an express speech restriction in the meeting, scrutineer access for candidates, and Gazette publication that conclusively evidences the outcome.

The text of these regulations focuses on procedural prescription and administrative duties; it does not directly create express criminal offences, monetary penalties or administrative fines within its own provisions. The regulations allocate enforcement and gatekeeping functions primarily to the Executive Officer, rather than to a sanctions regime. Specific enforcement and evidentiary mechanisms in the regulations are:

• Administrative enforcement by the Executive Officer: The Executive Officer is the official tasked with implementing and enforcing the procedural rules at the meeting. Functions carried out by the Executive Officer that have an enforcement quality include: refusing to accept late nominations (regulation 5(3)), rejecting informal votes (regulation 10), ensuring the chair is vacant and conducting the election (regulation 6(1)), applying counting and scrutiny rules from the Electoral Act 1907 (regulation 11), and publishing results in the Government Gazette (regulation 14). These are administrative acts that give effect to the regulatory scheme.

• Rejection of informal votes: Regulation 10 provides a direct procedural sanction in the form of rejection of a vote if the ballot paper is not marked in accordance with regulation 9. This is a built‑in mechanism for enforcing the formality of voting.

• Application of Electoral Act 1907 provisions: Regulation 11 requires that the counting and scrutiny be conducted in the manner prescribed by the Electoral Act 1907 for Legislative Assembly elections, applied mutatis mutandis. The Electoral Act provisions referenced will contain their own procedural rules and may contain sanctions or formalities relating to the conduct of election scrutiny and challenges, but those content details are not reproduced in these regulations. The regulations thus import the Electoral Act’s mechanisms for counting and scrutiny without themselves specifying penalties.

• Conclusive public evidence: Publication of the poll result in the Government Gazette is declared to be conclusive evidence that the person named was duly elected as Chairman (regulation 14(2)). This is an evidentiary rule that has the effect of finalising and insulating the administrative record, at least as to the fact of publication and its conclusive evidentiary effect. The regulation gives administrative force to the publication rather than creating a punishment.

Notably absent from these regulations are:

• Express criminal or civil penalties imposed by the regulations themselves for breach of nomination formality or other offences; none are specified in the text.
• An internal appeal or review procedure set out within these regulations for a member or nominee to challenge conduct of the election beyond the processes of scrutiny and counting referred to the Electoral Act 1907.

Practical enforcement implications

• The primary immediate enforcement leverage is the Executive Officer’s control of procedural compliance , refusal to accept late or defective nominations and rejection of informal votes will determine who can stand and whose votes count.
• Finality of the Gazette publication creates an administrative bar to further factual dispute about who was elected, insofar as the regulation treats that publication as conclusive evidence.
• Any further enforcement, challenge or sanction that requires statutory penalty or tribunal/court intervention would rely on other laws or the provisions of the Electoral Act 1907 insofar as they apply. The regulations themselves do not set out those mechanisms.

Users of this regulatory scheme must therefore look beyond these regulations for penal regimes or remedies. Within the narrow scope of the regulations, compliance is enforced by mandatory procedural steps and administrative acts carried out by the Executive Officer, with the counting and scrutiny process imported from the Electoral Act 1907.

These regulations expressly reference and rely on two external legal instruments and the parent Act:

• The Library Board of Western Australia Act 1951: Regulation 2 defines "the Act" as the Library Board of Western Australia Act 1951 and any Act passed in amendment or substitution. The regulations therefore operate as subordinate legislation made under that parent Act and are intended to be read in the context of the powers and structures provided by the Act. The definition of "deputy member" in regulation 2 explicitly cross‑references section 5(9A) to (9D) of the Act as the source of that category. The regulations do not purport to supplant the Act; they implement election procedures within the statutory framework the Act supplies.

• The Electoral Act 1907: Regulation 11 imports the counting and scrutiny provisions from the Electoral Act 1907. Specifically, the counting of votes and ascertaining who is to be elected "shall be conducted and the member to be elected shall be ascertained in the manner prescribed by the Electoral Act 1907, for the counting and scrutiny of votes and the election of candidates at an election of a representative of the Legislative Assembly and the provisions of that Act shall, mutatis mutandis, apply." That import serves several functions:

  • It avoids restating detailed elimination, transfer or recount mechanisms for preferential balloting in these regulations.
  • It subjects the Board’s internal counting procedure to the methodologies and standards used for Legislative Assembly elections, with the necessary adjustments that "mutatis mutandis" implies.
  • Any procedural rights, scrutiny formalities and potentially some remedies associated with counting under the Electoral Act will be applicable to the Board’s election to the extent that the Electoral Act’s provisions can be adapted to the Board’s context.

• Government Gazette practice: Regulation 14 requires publication of the poll result in the Government Gazette and declares that publication to be conclusive evidence of the person’s election. The Gazette is a statutory medium for official notices, and the regulation establishes an evidentiary interaction between the internal election process and the public law record.

Absent express cross-references in the regulations

• The regulations do not identify other statutes, regulations or standards that might affect the election apart from the Act and the Electoral Act 1907. For example, there is no direct reference to public records, privacy, archival retention or other administrative law requirements. The only explicit destruction requirement is regulation 16, which mandates that the Executive Officer shall destroy the nomination papers at the conclusion of the meeting.

Consequences of the chosen interactions

• By importing the Electoral Act counting rules, the regulations create a dependency: any relevant changes to the Electoral Act 1907 could alter the practical mechanics of counting preferential votes for the Board’s election if those changes are applicable under a mutatis mutandis reading. The regulations do not themselves fix the counting algorithm.
• The regulation that Gazette publication is conclusive evidence interacts with administrative law principles by converting a publication act into conclusive proof of election; any judicial or statutory review would need to grapple with that conclusive evidentiary statement in the context of remedies or challenges under the parent Act or general administrative law (though such remedies are not specified within these regulations).

Amendment history and consolidation

• The compilation table and notes show the regulations were originally gazetted on 9 December 1955 and later reprinted and subjected to formatting standardisation in 2010 (see the compilation table). The Standardisation of Formatting Act 2010 amendment is referenced in the compilation notes and in regulation 2's amendment note. That history confirms the regulations are part of a broader statutory web that is periodically consolidated and reformatted.

In short, these regulations are short and procedural, and they explicitly delegate the detailed counting and scrutiny rules to the Electoral Act 1907 while deriving status and some definitions from the parent Library Board Act. Any actor looking for penal consequences, record retention obligations beyond the destruction requirement, or appeal processes will need to look to the parent Act, the Electoral Act and other applicable statutes and administrative law principles.

The compiled document shows a succinct amendment and publication history limited to the original commencement and subsequent procedural reprinting and formatting standardisation. The compilation entries provided in the source are the only materials available here; they identify the following concrete items:

• Original enactment and commencement: The Library Board (Conduct of Proceedings) Regulations 1955 were originally published in the Government Gazette on 9 December 1955 at pages 2942-2943 and commenced on that date (compilation table).

• Reprint: A reprint exists titled "Reprint 1: The Library Board (Conduct of Proceedings) Regulations 1955 as at 19 Dec 2003." The compilation table lists that reprint without providing details of substantive changes; it reflects the consolidated text as of 19 December 2003.

• Standardisation of Formatting Act 2010: The compilation table records an amendment entry indicating the Standardisation of Formatting Act 2010, section 51, assented 28 June 2010, with a commencement date of 11 September 2010 (per s. 2(b) and Government Gazette 10 September 2010, p. 4341). The notes to regulation 2 explicitly record that regulation 2 was amended by "No. 19 of 2010 s. 51." The nature of that amendment is indicated in the compilation as a formatting or standardisation update, consistent with the title of the amending statute.

• Compilation note: The document is a compilation that includes the amendments made by the other written laws referred to in the compilation table; the table also contains information about reprints.

What the compilation does not contain

• The compilation provided here does not list any other substantive amendments, repeals, or replacement acts affecting the content of these regulations besides the 2010 formatting amendment. It does not provide the text of the parent Act or of the Electoral Act 1907, nor does it include any statutory instruments other than those noted.

Operational effect of the recorded amendments

• The Standardisation of Formatting Act 2010 amendment, as recorded, appears to relate to formatting standardisation rather than substantive policy change; the compilation notes indicate that regulation 2 was amended under that Act. The compilation does not describe substantive policy changes effected by that amendment. The presence of a 2003 reprint and the 2010 formatting amendment indicates maintenance and consolidation activity rather than large-scale substantive redrafting recorded in the provided compilation.

To locate any additional amendment history, or to inspect the precise legislative instrument that authorised these regulations (the parent Act), one would need to consult the original Gazette notice of 9 December 1955, the reprint documentation, and the amending instrument(s). The compilation here provides a minimal but accurate record of the principal dates and the formatting amendment referenced.

The compilation text provided does not record any litigation history, judicial decisions, or tribunal determinations concerned with these regulations. There are no cases cited or legal disputes noted in the document provided.

How to interpret that absence

• The absence of litigation entries in the compilation means the document does not include recorded judicial consideration or reported cases that interpret or challenge the regulations themselves. It does not establish that no litigation has ever occurred in relation to Board elections; it simply records no cases within the compilation notes or the regulation text.

Potential sources of litigation that would be relevant but are not in the compilation

• The regulations import counting and scrutiny rules from the Electoral Act 1907 (regulation 11) and make Gazette publication conclusive evidence of election (regulation 14(2)). Disputes could, in principle, arise regarding:
  • The validity of nominations, acceptance of late nominations, or the Executive Officer’s compliance with procedural duties under regulations 3-5 and 16.
  • The manner of voting and rejection of informal votes under regulations 9-10.
  • The conduct of the counting and scrutiny under the Electoral Act 1907 applied mutatis mutandis (regulation 11).
  • The evidentiary effect of Gazette publication declared in regulation 14(2).

None of those possible dispute categories are recorded in this compilation as having produced reported litigation.

Practical consequence for a researcher or practitioner

• A practitioner needing to know whether there are any judicial decisions interpreting or challenging any aspects of these regulations will need to undertake separate research in case law databases and tribunal decisions. The absence of litigation entries here does not relieve an adviser from checking external sources for cases or for administrative reviews that might have considered these rules in concrete disputes.

In short, the compilation does not provide any litigation history; it contains no reported cases or judicial commentary on the regulations themselves.

The regulations are short and prescriptive, but several operational and legal friction points emerge directly from their wording. These are specific items of risk or potential non-obvious consequences that parties should attend to when implementing or relying on the rules set out in the regulations.

1. Executive Officer centralisation and consequential control

• The Executive Officer is the sole official with multiple mandatory duties: notice, distribution of nomination papers, receipt and validation of nominations, conducting the poll, applying the Electoral Act counting rules, announcing and publishing results, and destroying nomination papers (regulations 3-5, 6, 11, 14, 16). Because many procedural gatekeeping actions depend on the Executive Officer’s performance, failures or errors by that officer (for example, failing to send nomination papers within the seven‑day window or failing to accept nominations properly) will materially affect candidacy and voting outcomes.

2. Strict nomination formalities and the ineligibility of deputy members

• Nominations must be written, signed by proposer and seconder and countersigned by the nominee, and delivered to the Executive Officer (regulation 5(2)). A deputy member is expressly ineligible for nomination (regulation 5(1)). A candidate that fails to meet formality requirements or is a deputy member cannot be validly nominated; the regulations offer no remedial procedure within the text for informal nominations.

3. Cut‑off and exception for late nominations

• The Executive Officer "shall not accept any nomination after the time fixed for the commencement of the meeting" (regulation 5(3)), except where no nominations had been delivered before the fixed time, in which case the Executive Officer must call for and accept nominations from the meeting if they comply with the formality rules (regulation 5(4)). The exception operates only when there are zero nominations before the meeting begins; it does not provide flexibility if some nominations were delivered before the meeting but another candidate seeks to lodge a nomination at the meeting. This creates a binary rule that can have exclusionary effects.

4. Prohibition on addressing the meeting in support or opposition

• Regulation 6(2) forbids any person from addressing the meeting in support of or opposition to any candidature. That restriction limits campaign activity at the meeting and narrows the scope for nominees to make oral representations at the election meeting itself. The prohibition applies "to the meeting" during the election; it does not specify whether it restricts pre‑meeting campaigning in notices or circulation outside the meeting.

5. Preferential voting formalities and rejection of informal ballots

• Where there are more than two nominees, the voter must rank all nominees in order of preference, marking 1, 2, 3, etc. If a ballot paper is not marked as required it is deemed informal and rejected (regulations 9 and 10). The consequence is that a single incorrect or incomplete numbering will void a vote entirely. The regulations do not provide provisions for validating partially completed ballots (for example, "optional preferential" marking); they require a full ordering.

6. Dependence on Electoral Act 1907 counting rules

• The counting and scrutiny occur in the manner prescribed by the Electoral Act 1907, applied mutatis mutandis (regulation 11). The regulations do not restate those rules. Practical implication: detailed questions about elimination orders, distribution of preferences, and recount procedures depend on how the Electoral Act rules will be adapted to the Board’s context, potentially creating interpretive work. Changes to the Electoral Act could affect counting unless the mutatis mutandis application is read narrowly.

7. Ties require additional ballots

• Regulation 13 requires further ballots in the event of equality; it does not provide for other tie-breakers, such as drawing lots or delegating to an independent chair. The duty to repeat ballots can prolong the meeting and may be practically inconvenient.

8. Publication as conclusive evidence and limited internal review mechanics

• The Government Gazette publication is declared conclusive evidence of election for the Chairman (regulation 14(2)). That rule magnifies the importance of accurate Gazette notices. The regulations provide no specific internal appeals procedure; any challenge to the election’s validity will therefore need to navigate the parent Act, the imported Electoral Act provisions, or general administrative law remedies outside the regulations.

9. Destruction of nomination papers

• The Executive Officer must destroy nomination papers at the conclusion of the meeting (regulation 16). That requirement eliminates the primary documentary record of nominations and could complicate later inquiries, audits or disputes about who nominated whom unless other contemporaneous records are kept under separate authority. The regulation does not explain whether destruction is subject to any archival or record-keeping requirement in other statutes.

10. Vice‑Chairman nomination link

• Regulation 15 deems unsuccessful candidates for Chairman to be nominated for Vice‑Chairman. That automatic nomination may produce unexpected strategic behaviour: a candidate who intended to contest only the Vice‑Chairmanship might be excluded or treated differently, and an unsuccessful candidate for Chairman is automatically in the Vice‑Chairman contest without separate paper nomination. The regulation does not contemplate withdrawal between the two contests.

11. Unclear electorate status of deputy members as voters

• The regulations require that notices and nomination papers be sent to deputy members (regulations 3(2) and 4) and expressly bar deputy members from candidacy (regulation 5(1)). The regulations do not explicitly state whether deputy members are permitted to vote. The generic phrasing "persons recording a vote shall do so" (regulation 9) leaves ambiguous whether deputy members participate in the poll. That ambiguity creates a point of possible procedural dispute.

Each of these "gotchas" flows directly from the statutory text. Parties implementing the regulations should pay attention to the Executive Officer’s obligations and limitations, the strictness of nomination and ballot formalities, the consequences of Gazette publication, and the destruction obligation for nomination papers.

Below is a step‑by‑step operational checklist, grounded in the regulations, that an Executive Officer and Board members can follow to conduct the annual elections for Chairman and Vice‑Chairman in compliance with the regulations. Each step cites the regulation(s) imposing the duty.

For the Executive Officer , preparatory steps

1. Identify the meeting date: confirm the date of the first meeting of the Board on or after 1 December (regulation 3(1)). That meeting is the statutory occasion for the annual election.

2. Notify members and deputy members: send written notice of the time and place of that meeting to each member and each deputy member (regulation 3(2)). Ensure delivery timing allows recipients to act on the notice.

3. Distribute nomination papers at least seven days prior: prepare and send nomination papers to every member and deputy member not less than seven days before the day fixed for the annual election (regulation 4). The seven‑day minimum is mandatory.

Nomination period and acceptance 4. Receive nominations in the required form: accept nominations only if they are in writing, signed by a proposer and a seconder, countersigned by the nominee, and delivered to the Executive Officer (regulation 5(2)). Do not accept nominations that fail those formalities.

5. Check eligibility: verify that any nominee is not a deputy member, because a deputy member is ineligible for nomination for Chairman or Vice‑Chairman (regulation 5(1)). Cross‑reference the parent Act for the definition of "deputy member" if needed; regulation 2 defines the term by reference to section 5(9A)‑(9D) of the Act.

6. Observe the cut‑off: do not accept nominations after the time fixed for the commencement of the meeting (regulation 5(3)). The only exception is where no nomination was delivered to the Executive Officer prior to that time; in that case call for nominations at the meeting and accept those that comply with regulation 5(2) (regulation 5(4)).

At the meeting , conducting the election 7. Ensure the chair is vacant and conduct the election immediately: conduct the election before dealing with other business of the meeting; the chair is to be vacant while the election takes place (regulation 6(1)).

8. Prohibit addressing the meeting: enforce the rule that no person shall address the meeting in support of or opposition to any candidature (regulation 6(2)). This includes candidates and supporters.

9. Read the list of nominees aloud: read to the meeting the names of the members nominated for the office of Chairman (regulation 7(1)).

10. Allow withdrawal: after the names are read, permit any nominated member to request removal of his name; if such a request is made cancel that nomination and proceed with the remaining nominations (regulation 7(2)).

11. Deal with unopposed nominations: if only one nomination exists, declare the candidate elected without a ballot (regulation 8).

Ballot administration 12. Prepare ballots consistent with regulation 9: where there are two nominees provide papers where the voter simply inserts the name of the chosen member (regulation 9(1)(a)). Where there are more than two nominees prepare ballots requiring the voter to write the name of the first preference and mark "1" against that name, then write the names of all other nominees and mark the numerals 2, 3 etc. in order of preference (regulation 9(1)(b)-(2)).

13. Reject informal ballots: apply regulation 10 and treat any ballot that is not marked in accordance with regulation 9 as informal; such ballots must be rejected (regulation 10).

Counting and scrutiny 14. Arrange for scrutineers: inform nominees they may each appoint one scrutineer to represent them at the scrutiny (regulation 12). Permit those scrutineers to observe the counting and scrutiny proceedings (regulation 12).

15. Apply Electoral Act counting rules: conduct the counting and ascertain the elected member in the manner prescribed by the Electoral Act 1907 for counting and scrutiny of Legislative Assembly elections, applied mutatis mutandis (regulation 11). Ensure that the adapted process is recorded and that scrutineers have meaningful access in accordance with regulation 12.

16. Address ties by further ballots: if there is an equality of votes, announce the equality and hold further ballot(s) between the same candidates until the tie is resolved (regulation 13).

Announcement and records 17. Announce the result at the meeting: at the conclusion of the scrutiny announce the name of the elected member to the meeting (regulation 14(1)).

18. Publish the poll in the Government Gazette: lodge the notice for publication so that the result is published in the Government Gazette, keeping in mind that such publication is conclusive evidence of election for the office of Chairman (regulation 14(1)-(2)). Ensure the Gazette notice accurately reflects the announced outcome because of its conclusive evidentiary effect.

19. Destroy nomination papers: at the conclusion of the meeting destroy the nomination papers as required (regulation 16). Note that destruction is mandatory under the regulations.

Vice‑Chairman election 20. Conduct the Vice‑Chairman election using the same steps: apply the same nomination, election and counting requirements to the Vice‑Chairman election (regulation 15). Remember that all unsuccessful candidates for Chairman are deemed to have been nominated for Vice‑Chairman, so check the list of unsuccessful candidates and include them as nominees unless they withdraw in accordance with regulation 7(2).

Administrative hygiene and practical notes

• Timing and delivery: ensure notices and nomination papers are delivered with proof of dispatch to guard against disputes about compliance with the seven‑day distribution rule. The regulations require distribution not less than seven days before the election (regulation 4), and failure to meet that timetable could have material consequences for candidacy.

• Formality checks before meeting: validate all nominations as soon as they are received so that any defects can be addressed (where possible) before the meeting; the regulations allow the Executive Officer to refuse late or defective nominations (regulation 5(3)-(4)).

• Scrutineer coordination: provide logistical details to scrutineers in advance so they can attend the scrutiny and inspect proceedings in real time (regulation 12).

• Gazette process: allow sufficient time after the scrutiny to prepare the Government Gazette notice and ensure correct phrasing; the Gazette publication is conclusive evidence of the elected person (regulation 14(1)-(2)).

• Record-keeping tension: the regulations require destruction of nomination papers at the meeting’s conclusion (regulation 16). If any external statutory or organisational record-keeping obligations apply, identify them and reconcile them with the destruction obligation to avoid conflict; the regulations themselves mandate destruction but do not address any other record obligations.

• Clarify voting entitlement of deputy members: because the regulations send notices and nomination papers to deputy members (regulations 3(2) and 4) but disqualify deputy members from nomination (regulation 5(1)) and do not expressly state their voting entitlement, clarify the voting rights of deputy members in advance on the authority of the parent Act or internal rules to avoid uncertainty.

Following these steps will align Board practice with the procedural requirements of the regulations. Where the regulations invoke external statutes (notably the Electoral Act 1907 for counting), the Executive Officer should ensure familiarity with the applicable Electoral Act provisions as they will govern the details of counting and scrutiny when applied mutatis mutandis under regulation 11.
