Libraries Regulations 2013

The Regulations build on a small number of organising legal concepts. Each of the following is present in the text and determines how the regime operates in practice.

Definitions and scope (reg 3)

• Act: the Libraries Act 1982, which is the parent statute.
• Property of the Board: property under the care or control of the Board; the prohibitions and powers apply to libraries and other premises of the Board.
• Vehicle: expressly defined as motor vehicle. This narrows the reach of driving/parking provisions and separates bicycles from “vehicles” under these Regulations.
• Wheeled recreational device: includes rollerblades, rollerskates, a skateboard or similar devices, but explicitly excludes bicycles. This creates a specific prohibition on such devices in libraries (reg 9).

Delegated discretion and approvals (reg 4)

• The Board and authorised officers can give approvals that displace prohibitions. Approvals must be in writing or oral approvals must be confirmed in writing as soon as practicable (reg 4(2)(a)), may be subject to conditions including fees (reg 4(2)(c)), may be varied or revoked at any time (reg 4(2)(d)), and non-compliance with approval conditions is an offence (reg 4(3)). This establishes a controlled exception process with record and conditionality requirements.

Signage-driven rules and local determination (regs 5, 8, 14-15)

• Many prohibitions operate only when an “official sign” is displayed in or near the area (reg 3 definition). The Board decides which parts of its premises are parking permit areas, restricted areas, speed-limited areas or otherwise regulated by signage (reg 5(1), reg 8, reg 14). The practical effect is that much of the regulatory effect is implemented through signage decisions made by the Board or authorised officers.

Behavioural prohibitions and noise control (regs 6-7)

• The Regulations criminalise certain conduct while in a library: speaking on an electronic device in a way likely to disturb others (reg 6(1)), permitting sounds from an electronic device (reg 6(2)), transmitting defamatory, obscene or offensive material or knowingly accessing obscene material (reg 6(3)). Broader prohibitions on abusive or threatening language, disorderly conduct, alcohol and drugs, smoking limitations and restrictions on distribution, erecting structures, selling, canvassing, demonstrations and lighting fires appear in reg 7. Several offences carry modest maximum penalties and corresponding expiation fees.

Protection and temporary custody of property (regs 11-12)

• Prohibitions on removing, defacing or damaging Board property are set with higher maxima (reg 11(1)). The Board or authorised officers may require surrender of bags or items that could conceal library materials for temporary storage (reg 11(2)). The Board “should endeavour” to return surrendered/confiscated items on exit (reg 12(1)) but may retain items if reasonably believed to be evidence for legal proceedings (reg 12(2)). The phrasing in reg 12(1) is aspirational while reg 12(2) is prescriptive.

Exclusion notices (reg 13)

• Authorised officers may issue written notices banning persons from a library or parts of a library for up to 2 years where there is reasonable cause to suspect an offence and the officer believes the ban would prevent further offences (reg 13(1)). The notice must inform the person of a right to apply to the Board for review (reg 13(2)). The Board may invite submissions and may vary or revoke notices (reg 13(3)-(4)). Entering contrary to a notice is an offence (reg 13(5)).

Parking and owner liability (regs 5, 14-16)

• The Board can create library parking permits, set qualifications, fees and conditions and issue permits (reg 5). Driving provisions set speed limits, closed vehicular access and other regulatory signs (reg 14). Parking provisions condition lawful parking on display of appropriate permits (disabled or library) and compliance with conditions (reg 15(1)). Importantly, reg 16 makes the owner of a vehicle guilty of an offence if the vehicle is involved in a driving/parking offence under regs 14-15, subject to procedural steps and defences, and provides that owner and driver are not both liable to be convicted for the same circumstances (reg 16(1)-(2)). The regulation sets an administrative pathway requiring invitation and opportunity to provide a statutory declaration naming the driver (reg 16(3)-(5)), and establishes evidential presumptions and privacy protections for declarants (regs 16(9)-(11)).

Expiation and penalties

• Each offence carries a maximum penalty and, in many cases, a specified expiation fee (e.g. reg 6: max $250, expiation $80; reg 11 damage: max $750, expiation $105; reg 14 driving: max $1,250, expiation $160). The Regulations embed expiation as an enforcement option for a substantial subset of offences.

Transitional mechanics (Schedule 1)

• Approvals, exclusion notices and parking permits issued under the revoked 1998 Regulations and in force immediately before commencement continue under the corresponding new provisions for the balance of their term and subject to the same conditions (Schedule 1, Part 2, regs 2-4).

These concepts show a regime that relies heavily on Board-determined signage and permits, authorised officer discretion, and an administrative enforcement model using expiation fees and owner-liability mechanisms for vehicle-related offences.

The Regulations allocate duties, rights and liabilities across a relatively compact set of actors. Identify who pays, who decides, and who changes behaviour.

The Board (decision-maker and enforcer)

• The Board decides whether to determine entitlements to library parking permits, designate library parking permit areas, set fees and conditions for permits, and vary or revoke those determinations (reg 5(1)-(2)). The Board or authorised officers control signage that activates many prohibitions (reg 3 definition of official sign; regs 8, 14-15). The Board may require surrender of items (reg 11(2)) and is the body to which persons may apply for review of exclusion notices (reg 13(2)). The Board also bears the administrative costs of managing permits, signage, expiation processes and any retention of property for evidentiary purposes (reg 12(2)).

Authorised officers (operational agents)

• Authorised officers implement and enforce the regime: they give approvals (reg 4), direct closure of areas and signs (reg 8), remove animals when the owner cannot be located (reg 10(2)), require surrender of items (reg 11(2)), and issue exclusion notices where they have reasonable cause to suspect an offence and consider exclusion would prevent further offences (reg 13(1)). Their decisions engage review by the Board (reg 13(2)-(4)). The Regulations rely on their judgement for applying standards such as “likely to interfere” with others’ comfort (reg 6(1)), and “due care or reasonable consideration” when driving (reg 14(e)).

Library patrons and visitors (directly regulated)

• All persons while in a library or on other premises of the Board must comply with behavioural rules (regs 6-7), smoking restrictions (reg 7(f)), food/drink prohibitions for designated areas (reg 7(g)), bans on wheeled recreational devices (reg 9), and animal prohibitions subject to disability exceptions (reg 10). Patrons who are required to surrender bags or items must comply (reg 11(2)). Persons banned under an exclusion notice must not enter the specified library or part of a library (reg 13(1), (5)).

Vehicle owners and drivers (dual liability and procedures)

• Drivers who commit vehicle offences on Board premises are liable (regs 14-15). The owner of a vehicle is also guilty of an offence if the vehicle is involved in an offence under regs 14-15, but the regulation sets an administrative pathway to identify the driver via statutory declaration and protects against double convictions (reg 16(1)-(2), (3)-(6)). Owners who transfer vehicles and have complied with the Motor Vehicles Act 1959 must provide transfer particulars in the statutory declaration process (reg 16(3)(b)). Owners receive expiation notices in accordance with the Expiation of Offences Act 1996 when applicable (reg 16(3)).

Persons with disabilities and accredited assistance animals

• The Regulations expressly permit accredited disability, guide or hearing dogs for persons who are wholly or partially blind, deaf or otherwise disabled, and impose a duty on the person responsible for the dog to keep it under effective control by physical restraint (reg 10(1)(a)-(b)). Disabled persons with a disabled person’s parking permit under the Motor Vehicles Act 1959 (or a similar interstate/territory permit) are accommodated in designated parking areas (reg 3 definition; reg 15(1)(b)(i)).

Third parties (vendors, campaigners, those seeking to distribute material)

• The Regulations prohibit distribution of printed matter, erecting structures, displaying signage, selling goods, soliciting contributions or membership, holding demonstrations and other meetings without approval (reg 7(j)-(p)). Those activities can be permitted if the Board or authorised officer grants approval under reg 4.

Legal/administrative actors

• Complainants, courts and administrative personnel engaging expiation and prosecution for offences on Board premises will interact with reg 16 procedural requirements when vehicle offences are alleged. The Expiation of Offences Act 1996 is invoked in relation to expiation notices for vehicle offences (reg 16(3)).

In sum, the regime places primary decision-making with the Board and authorised officers, places compliance duties on patrons and vehicle owners/drivers, and contains procedural protections and obligations (particularly for vehicle owner liability and exclusion notices) that require administrative handling by the Board and complainants.

This section identifies the concrete statutory duties the Regulations impose on persons and the rights the text recognises.

Primary duties on persons while in a library or on Board premises

• Avoid creating nuisance or annoyance via electronic devices: do not speak via a mobile phone, computer or other electronic device in a way that is likely to interfere with comfort of others (reg 6(1)); do not use sound-capable devices unless they do not allow sound to interfere with others (reg 6(2)); do not transmit defamatory, obscene or offensive material or knowingly access obscene material (reg 6(3)). Maximum penalties and expiation fees are attached (reg 6).
• Behavioural restrictions: do not use abusive, threatening or insulting language; do not behave in threatening, intoxicated, indecent or otherwise disorderly or offensive manners; do not consume alcohol except in licensed premises; do not consume unlawful substances; comply with smoking areas; comply with eating/drinking prohibitions; do not deposit litter except in receptacles; do not damage plants; do not distribute printed matter or erect structures; do not display bills or signage or sell or solicit or organise meetings, rallies or demonstrations without approval (reg 7).
• Obey restricted area signage and do not enter areas closed to public access (reg 8).

Duties relating to animals

• Do not bring animals into a library except accredited assistance animals for disabled persons; responsible person must keep such dogs under effective physical restraint (reg 10(1)). Authorised officers may remove animals if the owner cannot be located (reg 10(2)).

Duties protecting Board property and surrender of items

• Do not remove, deface or damage Board property (reg 11(1)). If required, a person must surrender bags, cases or other articles that could conceal library materials for temporary storage (reg 11(2)). Failure to comply with a condition of an approval is also an offence (reg 4(3)).

Parking and driving duties

• Comply with signage indicating maximum speed limits, areas closed to vehicles, and other driving prohibitions (reg 14). Park only in areas where parking is permitted and in compliance with permit display and conditions, including disabled permits and library parking permits (reg 15). Do not park so as to impede pedestrian or vehicular passage (reg 15(3)).

Owner and driver obligations and procedural duties

• If a vehicle is involved in an offence under regs 14-15, the owner is prima facie guilty (reg 16(1)). The owner must respond to an expiation or reminder notice and is invited to provide a statutory declaration naming the driver (reg 16(3)). Where a complainant proposes proceedings against an owner, they must send particulars and invite the owner to provide a statutory declaration within 21 days (reg 16(4)). The owner has defences under reg 16(6),for example, proving lack of possession due to unlawful act or providing the required statutory declaration, subject to an exception if the declaration is knowingly false (reg 16(7)).

Rights and procedural protections

• Right to be given a notice of exclusion in writing, and the right to apply to the Board for review of that notice (reg 13(1)-(2)). The Board may invite submissions and may vary or revoke the notice (reg 13(3)-(4)).
• Privacy protection in the statutory declaration process: particulars furnished to the person named in the declaration must not include the address of the person who provided the declaration (reg 16(9)).
• Evidential presumptions: in proceedings against a person named in a statutory declaration, the person is presumed, absent proof to the contrary, to have been the driver (reg 16(10)). Also, allegations that a notice was given under reg 16 will be accepted as proof in the absence of contrary evidence (reg 16(11)).

Limited aspirational duties of the Board

• The Board “should endeavour” to return surrendered/confiscated items to the person when leaving the library (reg 12(1)), but can retain items that it reasonably believes may constitute evidence for legal proceedings (reg 12(2)). This creates a directional obligation with a clear exception.

Approval regime rights and conditions

• Persons may request or receive approvals from the Board/authorised officers (reg 4). Approvals may be conditional and may impose payment of a fee (reg 4(2)(c)). Where approvals are given, they must be recorded in writing or recorded in writing following oral approval (reg 4(2)(a)). Holders of approvals have a duty not to contravene approval conditions; breach attracts a maximum penalty (reg 4(3)).

Penalty and expiation rights

• Many offences carry specified expiation fees (for example, reg 6 expiation $80; reg 11 expiation $105; reg 14 expiation $160; reg 15 expiation $55). The Regulations thus create an administrative enforcement pathway where offenders may discharge liability by paying the expiation fee in accordance with expiation processes governed by the Expiation of Offences Act 1996 (referenced in reg 16(3)).

Overall, the Regulations impose behavioural and parking duties on patrons and vehicle owners/drivers, while granting procedural entitlements to persons subject to exclusion notices and to vehicle owners in the owner-liability process.

The Regulations specify maximum penalties and expiation fees for the enumerated offences and set out enforcement processes that rely on authorised officers, the Board and expiation procedures.

Penalty schedule (selected items and citations)

• Nuisance/annoyance by speaking on electronic device: maximum penalty $250; expiation fee $80 (reg 6(1)).
• Using sound-capable device such that sound interferes with others: maximum penalty $250; expiation fee $80 (reg 6(2)).
• Transmitting defamatory, obscene or offensive material or knowingly accessing obscene material using device: maximum penalty $1,250 (reg 6(3)).
• Other behavioural offences in reg 7 (abusive language, disorderly conduct, alcohol/drugs, smoking outside designated areas, distribution of printed matter, demonstration etc.): maximum penalty $250; expiation fee $80.
• Restricted area entry (reg 8): maximum penalty $250; expiation fee $80.
• Wheeled recreational devices (reg 9): maximum penalty $125; expiation fee $55.
• Dogs/animals prohibition (reg 10(1)): maximum penalty $125; expiation fee $55. Authorised officers can remove animals where the owner cannot be located (reg 10(2)).
• Damage to Board property (reg 11(1)): maximum penalty $750; expiation fee $105.
• Exclusion notice breach (reg 13(5)): maximum penalty $750; expiation fee $105.
• Driving contraventions (reg 14): maximum penalty $1,250; expiation fee $160.
• Parking contraventions (reg 15): maximum penalty $125; expiation fee $55.

Enforcement actors and tools

• Authorised officers: issue exclusion notices (reg 13(1)), require surrender of items (reg 11(2)), remove animals (reg 10(2)), and give direction for closure of areas or signage (implied by signature and sign authority under reg 3).
• Board: sets permit rules and may vary or revoke determinations (reg 5). The Board receives applications for review of exclusion notices and may invite submissions and vary or revoke notices (reg 13(2)-(4)).
• Expiation notices and prosecution: Expiation processes are available for many offences, as evidenced by the specified expiation fees attached to offences. The Expiation of Offences Act 1996 is explicitly cross-referenced in relation to the expiation notice process for vehicle owner liability (reg 16(3)), indicating that standard expiation administration will apply.

Owner liability enforcement mechanism (reg 16)

• Reg 16 makes the owner of the vehicle guilty of an offence involved in contravention of regs 14-15, subject to procedural steps and defences. The provision is intended to facilitate enforcement where the driver cannot be immediately identified by allowing the owner to be treated as responsible unless the owner complies with invitation to provide a statutory declaration identifying the driver (reg 16(3)-(4)). This shifts enforcement focus to an administrative process directed at owners, but it protects the owner with defences such as showing the vehicle was not in the owner’s possession because of an unlawful act, or by providing the statutory declaration (reg 16(6)). The owner is not convicted if the driver is convicted, conviction of one exonerates the other (reg 16(2)).

Procedural safeguards and evidentiary rules

• Expiation and prosecution must follow statutory processes under the Expiation of Offences Act 1996 when relevant (reg 16(3)). Before commencing proceedings against an owner, a complainant must give notice with particulars and invite a statutory declaration within 21 days (reg 16(4)). A statutory declaration naming a person as the driver creates a presumption that the named person was the driver in the absence of proof to the contrary (reg 16(10)). Where an expiation notice is given to a person named in a statutory declaration or proceedings are commenced against that person, the notice or summons must be accompanied by particulars of the statutory declaration (reg 16(8)), but those particulars must not include the address of the person who provided the declaration (reg 16(9)).

Retention and evidentiary custody (reg 12)

• The Board should attempt to return surrendered items on exit (reg 12(1)) but may retain items it reasonably believes may constitute evidence for legal proceedings (reg 12(2)). This gives authorised officers a basis to preserve evidence for prosecution but requires judgment about what constitutes reasonable belief.

Scope of enforcement discretion and resource implications

• Many offences require judgement calls by authorised officers,e.g., whether speech or device use is “likely to interfere” (reg 6(1)), whether exclusion is desirable to prevent further offences (reg 13(1)), or whether a vehicle was driven without due care (reg 14(e)). Enforcement therefore depends heavily on authorised officers’ observations and record-keeping, and the Board’s administrative capacity to process exclusions, expiation notices, statutory declaration invitations and permit management.

In short, enforcement combines summary expiation processes for lower-level conduct, an owner-liability administrative route for vehicle offences, and authorised officer discretion for on-the-spot operational decisions. The Regulations embed procedural protections for owners and for persons subject to exclusion notices through review and declaration mechanisms.

The Regulations explicitly cross-reference and interact with a small number of other statutes and established administrative processes. The relationship is primarily statutory cross-reference and procedural dependency.

Motor Vehicles Act 1959 (regs 3, 15, 16)

• Definition and use of disabled persons’ parking permit: reg 3 defines a disabled person's parking permit to include a permit issued under Part 3D of the Motor Vehicles Act 1959 or a similar permit from another State or Territory. Reg 15(1)(b)(i) makes lawful parking in disabled parking areas contingent on a disabled person's parking permit being lawfully displayed and compliance with conditions displayed on the sign or permit.
• Vehicle transfer particulars and owner liability: reg 16(3)(b) requires owners who have transferred ownership prior to the time of the alleged offence and who have complied with the Motor Vehicles Act 1959 in relation to the transfer to provide details of the transfer (including name and address of transferee) in a statutory declaration. This ties the owner-liability administrative mechanism to the vehicle registration and transfer regime in the Motor Vehicles Act 1959.

Dog and Cat Management Act 1995 (reg 10)

• Assistance animal definitions and control: reg 10(1)(a) permits accredited disability dogs, guide dogs or hearing dogs within the meaning of the Dog and Cat Management Act 1995 to accompany disabled persons in libraries. Reg 10(1)(b) imposes a duty on the person responsible for the dog to ensure effective control by physical restraint, cross-referencing the notion of effective control in the Dog and Cat Management Act 1995.

Expiation of Offences Act 1996 (reg 16)

• Expiation processes and the handling of expiation notices for vehicle offences are to be administered under the Expiation of Offences Act 1996 as the Regulations require that an expiation notice or reminder given to an owner for an alleged offence involving the vehicle must be accompanied by a notice inviting the owner to provide a statutory declaration (reg 16(3)). This shows reliance on the Expiation Act’s procedural framework for fines and associated reminders, and it creates an overlay of owner-liability administrative steps that operate within the Expiation Act’s machinery.

Libraries Act 1982 (enabling statute)

• The Regulations are subordinate legislation under the Libraries Act 1982 (reg 3 definition of “Act”). The Act supplies the enabling power for the Board and authorised officers to exercise powers on library premises. The Regulations implement and specify conduct and procedural details that operate within the scope of the Act.

Evidence and procedural law (criminal process)

• The Regulations provide evidentiary presumptions (reg 16(10)-(11)) and impose pre-prosecution notice obligations on complainants (reg 16(4)), thereby interacting with general criminal procedure and rules of evidence. Any criminal proceedings arising from breaches of the Regulations will proceed in the context of South Australian criminal procedure law.

Interplay and practical consequences

• The cross-references create dependencies: enforcement of parking privileges requires reference to Motor Vehicles Act permit regimes; handling of expiation notices follows the Expiation of Offences Act; accommodation of assistance dogs follows the Dog and Cat Management Act. The Board’s processes (signage, permit determinations, approvals and reviews) must be administered consistently with these external regimes to ensure procedural correctness,e.g., ensuring permits displayed comply with Motor Vehicles Act rules, or that statutory declarations satisfy the forms and requirements under relevant statutory declaration provisions.

No other statutes are referenced in the Regulations text. The Regulations do not attempt to displace or override statutory protections in the cited Acts; rather, they rely on and incorporate elements of those statutes into the libraries regulatory environment.

The instrument’s own legislative history is concise. The Regulations were made in 2013 and commenced on 1 September 2013 (reg 2; Legislative history entry). Schedule 1, Part 1 expressly revokes the Libraries Regulations 1998. Schedule 1, Part 2 provides transitional provisions for approvals, exclusion notices and library parking permits issued under the revoked 1998 Regulations that were in force immediately before commencement; these continue under the corresponding new regulations for the remainder of their term and subject to the same conditions (Schedule 1, regs 2-4).

Principal details from the Legislative history block:

• Principal regulations: 2013, No 220, published in Gazette 29.8.2013 p3701, commencement date 1.9.2013 (r 2). Schedule 1 records revocation of the 1998 Regulations and transitional continuity for certain instruments issued under the revoked regime.

There are no amendment entries in the provided text beyond the initial making and commencement. The document does not list any subsequent amending instruments, and the Legislative history section contains only the making details.

Implication for practitioners

• Where dealing with approvals, exclusion notices or parking permits granted under the 1998 Regulations and current at the time of commencement, the transitional provisions preserve their effect under the 2013 Regulations without interruption (Schedule 1, regs 2-4). This avoids any regulatory gap for persons holding such instruments at the transition date.

The Regulations themselves do not record any history of amendment after the 2013 commencement. Any later amendments, repeals or consolidations would need to be checked on the official legislation database referenced in the Notes (Index of South Australian Statutes or www.legislation.sa.gov.au).

The Regulations do not name any cases, and the text contains no recorded litigated interpretations or appellate history. The instrument’s text does not include references to judicial decisions, nor does it annotate any statutory interpretation guidance arising from case law.

Consequences for legal research and advocacy

• Because the Regulations themselves contain no litigation history, practitioners should not rely on judicial gloss in the instrument. Where statutory terms invite discretion or subjective assessment (for example, “likely to interfere” in reg 6(1), “due care or reasonable consideration” in reg 14(e), or “reasonable cause to suspect” and “desirable to exercise the powers” in reg 13(1)), questions of how those phrases operate in enforcement and prosecution will be matters for factual findings unless and until appellate courts provide clarifying authority. No such authority is contained within the Regulations.

Recommended next steps for practitioners

• If a dispute arises from enforcement of these Regulations (e.g., contested exclusion notice, challenge to an expiation or prosecution, dispute over an owner-liability statutory declaration), counsel should search South Australian case law databases and tribunals for decisions applying or interpreting the Regulations post‑2013. The Regulations’ silence on litigation history in the text requires external case-law research to identify any judicial treatment since commencement.

This section flags detail-level traps, procedural pitfalls and points likely to generate disputes or administrative friction, grounded in the text.

Signage-centric operation and delegated discretion

• Many prohibitions and obligations only apply where an “official sign” is displayed (reg 3 definition; regs 8, 14-15). This means the Board’s decisions about where to erect signs determine the reach of many rules. Failure to place or properly word signage can vitiate expectations of enforceability. Practitioners should check the presence and content of signs before relying on or contesting enforcement.

Approval formalities and retrospective confirmation risk

• Approvals may be given orally but must be confirmed in writing “as soon as practicable” (reg 4(2)(a)). Oral approvals that are not promptly confirmed may generate disputes about whether an approval existed or about its terms. The approval may be varied or revoked at any time (reg 4(2)(d)), and contravention of conditions is an offence (reg 4(3)). Boards and authorised officers should record approvals and ensure timely written confirmation and clarity on conditions to avoid prosecution risk.

Ambiguous behavioural standards

• Standards such as “likely to interfere with the comfort of, or disturb or annoy, another person” (reg 6(1)) or “due care or reasonable consideration for others” (reg 14(e)) require evaluative judgments. The Regulations do not define objective metrics for these standards. Enforcement will therefore depend on the authorised officer’s assessment, creating potential for inconsistent application and disputes about subjectivity. Drafting or drafting-style disputes are foreseeable where evidence about noise levels, device volume, or apparent disturbance is contested.

Owner-liability procedural traps (reg 16)

• Reg 16 exposes vehicle owners to liability for vehicle-related offences unless they respond to statutory invitations or prove specific defences. Key pitfalls:
  • Owners issued an expiation notice must follow the invitation to provide a statutory declaration if they were not the driver (reg 16(3)). Failure to respond can result in liability that might otherwise have been avoided.
  • A complainant must send notice and invite a statutory declaration before commencing proceedings against an owner (reg 16(4)); failure to do so could be a procedural defect in prosecution.
  • The defence that the vehicle was not in the owner’s possession because of an unlawful act requires proof (reg 16(6)(a)). Owners should keep records of theft reports, bailment or other evidence of unlawful dispossession.
  • Reg 16(7) removes the defence where a statutory declaration is knowingly false; owners must take care when preparing declarations.

Privacy and disclosure rules in declarations (reg 16(9))

• When particulars of a statutory declaration are provided to the person named as the alleged driver, those particulars must not include the address of the person who provided the declaration. This creates a particular evidence-management requirement and a compliance obligation for complainants and the Board.

Temporary custody and “should endeavour” language (reg 12)

• The Board “should endeavour” to return surrendered or confiscated items when the person leaves (reg 12(1)). This is not an absolute right; reg 12(2) allows retention where the Board reasonably believes the item is evidence. Persons expecting automatic return should be advised that items may be retained for legal proceedings; authorised officers should document reasons for retention to withstand review.

Protest and free-expression tensions (reg 7)

• The Regulations ban distribution of printed matter, erecting structures, displaying signage, selling, soliciting contributions, and holding rallies or demonstrations (reg 7(j)-(p)) unless approval is granted under reg 4. That creates a permit-like requirement for expressive activities on Board premises. Practitioners advising clients planning speech or assembly activities should ensure an approval is sought in advance, and Boards should have transparent approval criteria to reduce legal challenge risk.

Bicycles excluded from “wheeled recreational device” but not from “vehicle”

• The definition of wheeled recreational device excludes bicycles (reg 3). However, vehicle is defined as motor vehicle, so bicycles are neither wheeled recreational devices nor vehicles for the purpose of these Regulations. That means the specific ban on wheeled recreational devices (reg 9) does not apply to bicycles, but bicycles are not addressed elsewhere in driving and parking provisions that apply to “vehicles” (regs 14-15). The absence of express bicycle regulation may create enforcement gaps regarding cyclists inside library premises.

Exclusion notices and limited review (reg 13)

• Authorised officers can immediately issue exclusion notices banning a person for up to 2 years on reasonable cause and a view that exclusion would prevent further offences (reg 13(1)). The person may apply to the Board for review (reg 13(2)), and the Board may invite submissions and may vary or revoke the notice (reg 13(3)-(4)). There is no express right to immediate external administrative or judicial review in the Regulations; review is internal to the Board. Persons subject to exclusion should be advised to apply promptly to the Board for review and to lodge submissions where appropriate.

Expiation fee levels and enforcement incentives

• Many offences have modest expiation fees (e.g., $55-$160). From an enforcement perspective, low expiation fees may be insufficient to deter repeat offenders or to cover administrative costs of processing expiations. The Regulations provide for fines up to statutory maxima, but the expiation option may be used in most cases. Boards should consider operational cost-benefit when relying on expiations.

Recordkeeping and evidentiary requirements

• Various provisions create obligations that require clear records: approvals (written confirmation, reg 4(2)(a)), surrender/confiscation and retention reasons (reg 11(2), reg 12(2)), statutory declaration invitations and particulars (reg 16(3)-(9)), and exclusion notices (reg 13(1)-(4)). Poor administrative records will undermine prosecutions and defence rights.

These “gotchas” flow directly from the regulatory text and indicate areas where clear administrative procedure, signage, notice drafting and recordkeeping will reduce legal risk.

This section sets out concrete, source-grounded compliance steps for the Board, authorised officers and patrons/third parties. It draws directly from the Regulations’ text and indicates processes to implement the statutory duties and manage enforcement risk.

Operational compliance for the Board and authorised officers

1. Signage program

• Identify all premises under the Board’s care or control and implement an official signage program that: designates library parking permit areas, disabled parking spaces, speed-limited areas, areas closed to public vehicular access, restricted (closed) areas, smoking-permitted areas, and eating/drinking prohibited zones (reg 3; regs 5, 8, 14-15). Ensure signs are displayed “in or near the area” as required (see reg 3) because the effect of several offences depends on signage being present.

2. Approval process and recordkeeping

• Implement a standard approval form and process that ensures every approval is recorded in writing or that oral approvals are confirmed in writing “as soon as practicable” (reg 4(2)(a)). Include fields for: applicant details, scope of approval (particular person or class), conditions (including payment of fees), start and end dates, and variation/revocation log (reg 4(2)(b)-(d)). Provide clear notice to approval holders that contravention of conditions is an offence (reg 4(3)).

3. Library parking permits

• Establish determinations under reg 5 in writing: specify persons entitled to permits, premises/areas designated as library parking permit areas, fee schedule (if any) and permit conditions (including display requirements and period of validity). Implement issuance, renewal and revocation procedures to ensure permits are lawfully issued and conditions enforced (reg 5(1)-(2)).

4. Exclusion notice procedures

• Draft a written exclusion notice template required by reg 13(1) that states the factual basis for reasonable cause to suspect an offence and the period of exclusion (not exceeding 2 years), and includes information about the right to apply to the Board for review (reg 13(2)). Implement an internal review process for Board consideration of submissions (reg 13(3)-(4)). Maintain a register of exclusion notices and reasons to support any prosecutorial or administrative defence.

5. Surrender and custody of property

• Adopt a standard operating procedure for requiring surrender of bags and items that could conceal library materials (reg 11(2)). Include chain-of-custody documentation for temporary storage, notice to the person surrendering the item, and a process to return items on exit wherever possible (reg 12(1)). If retaining items for evidentiary purposes, document the reasonable belief that the item may constitute evidence and record retention duration to satisfy reg 12(2).

6. Animal management and assistance dog protocol

• Ensure staff are trained on the exception for accredited disability dogs, guide dogs or hearing dogs under the Dog and Cat Management Act 1995 (reg 10(1)(a)) and the duty to ensure the dog is under effective physical restraint (reg 10(1)(b)). Create a removal protocol for authorised officers when an owner cannot be located (reg 10(2)), including steps for notifying animal management services.

7. Expiation and prosecution coordination

• Coordinate with the agency administering expiations under the Expiation of Offences Act 1996 to ensure expiation notices, reminders and accompaniments (e.g., statutory declaration invitations under reg 16(3)) are correctly issued. Include procedures to invite owners to provide a statutory declaration naming the driver (reg 16(3)-(4)), and to comply with privacy rules regarding not disclosing the declarant’s address (reg 16(9)).

8. Training and evidential documentation

• Train authorised officers on applying subjective standards (e.g., “likely to interfere”, “due care or reasonable consideration”, “reasonable cause to suspect”) and require contemporaneous incident reports, witness statements and photographs where relevant. Robust documentation will support enforcement and withstand challenges in court or review.

Compliance steps for vehicle owners and drivers

1. Display and compliance with permits

• Ensure a disabled parking permit or library parking permit is lawfully displayed when parking in designated areas and that any conditions displayed on signs or issued with permits are followed (reg 15(1)(b)(i)-(ii)). Keep originals of permits and renewals to hand.

2. Respond to expiation processes and statutory declaration invitations

• If an owner receives an expiation notice or reminder notice under reg 16(3), carefully follow the invitation to provide a statutory declaration within the specified period if the owner was not the driver. Provide accurate and complete statutory declarations as false declarations are excluded as a defence if knowingly false (reg 16(7)). Maintain transfer records if ownership changed prior to the alleged offence and the Motor Vehicles Act 1959 formalities were complied with (reg 16(3)(b)).

3. Keep evidence of unlawful loss or transfer

• If an owner claims the vehicle was not in their possession due to an unlawful act, gather and retain police reports, theft notifications, or bailment agreements to support the defence in reg 16(6)(a).

Compliance steps for patrons and third parties

1. Observe signage and official directions

• Before engaging in activities such as demonstrations, distribution of printed matter, erecting structures, selling or soliciting, seek an approval from the Board or authorised officer under reg 4 and obtain written confirmation when granted. Do not rely on oral approvals unless confirmed in writing.

2. Device use and noise management

• Avoid speaking on mobile phones or using devices in a manner likely to disturb others (reg 6(1)-(2)). If in doubt about acceptable volume or transmission, use headphones or move to an area designated for conversation. Do not transmit defamatory, obscene or offensive material using library equipment (reg 6(3)).

3. Bring assistance animals lawfully

• If accompanied by an accredited assistance dog, ensure credentials are available and the animal is kept under effective control by physical restraint as required by reg 10(1)(b).

4. Responding to surrender requests

• If an authorised officer requires surrender of a bag or item (reg 11(2)), comply and request a receipt or written record of the surrender. If items are retained, request written reasons and, where necessary, apply to the Board for return or for clarification.

Administrative best practice and governance

1. Create templates and logs

• Develop and retain templates for approvals, exclusion notices, permit determinations, statutory declaration invitations, and item-surrender receipts. Maintain a searchable register of approvals, permits, exclusion notices and expiations.

2. Audit and review

• Conduct periodic audits of signage, permits and enforcement actions to ensure consistency with regulatory requirements and to identify areas where policies or training need strengthening.

3. Clear public-facing rules

• Publish permit eligibility criteria, application forms, terms and conditions and clear signage on premises and online so patrons understand the rules and the consequences of non-compliance.

4. Liaise with other agencies

• Coordinate with motor vehicle registration authorities (Motor Vehicles Act 1959 matters), animal management authorities (Dog and Cat Management Act 1995), and the agency administering expiations (Expiation of Offences Act 1996) to ensure legal and procedural consistency.

Following these steps will align on-the-ground practices with the written obligations and procedural protections in the Regulations and reduce legal risk for both the Board and regulated individuals.
