What it does
These Regulations postpone the automatic expiry date that would otherwise apply, under Part 3A of the Legislative Instruments Act 1978 (the Act), to a specified list of subordinate instruments that were made before 1 January 2015. Section 4 states that the expiry of the regulations listed in Schedule 1 is postponed for a period of one year, with that postponement period commencing on 1 September 2025. The postponement therefore extends the life of each listed regulation for the year from 1 September 2025 to 1 September 2026 (s 4; Schedule 1).
Separately, the Regulations declare that the two instruments listed in Schedule 2 will expire under the Act on 1 September 2025 (s 5; Schedule 2). Schedule 3 repeals the previous annual postponement instrument, the Legislative Instruments (Postponement of Expiry) Regulations 2024. The short title and commencement clauses set formalities: the instrument is the Legislative Instruments (Postponement of Expiry) Regulations 2025 (s 1) and it commences on the day it is made (s 2). The legislative history records the instrument as No 92 of 2025, Gazette 14.8.2025, with commencement on 14 August 2025.
Mechanically, this instrument is an executive-made regulation that operates by reference to Part 3A of the Act. It does not itself amend or remake any of the substantive provisions of the subordinate instruments listed in Schedule 1. Instead, it changes the temporal status of those instruments by postponing their statutory expiry date. For the two instruments in Schedule 2 it confirms the statutory expiry will take effect on 1 September 2025. For administrative continuity, Schedule 3 removes the 2024 postponement instrument from the statute book. The Interpretation clause defines the Act as the Legislative Instruments Act 1978 (s 3), making clear the legal framework being engaged.
