What it does
This regulation, the Legislative Assembly Precincts Regulation 2016, identifies a specific parcel of premises and declares that parcel to be part of the Legislative Assembly precincts for the purposes of the Legislative Assembly Precincts Act 2001. The operative provision is section 3(1), which states: "The required property is to be treated as part of the Assembly precincts for the Act" (s 3(1)). The instrument therefore does not itself create novel offences, controls, or rights; instead, it extends the geographic reach of the Act by adding the "required property" to the precincts to which the Act applies.
Section 3(2) supplies the definition of "required property." That definition is a location-based description: it is "that part of block 22, section 19, division of City, Canberra Central District that is 624m2 of Level 1 (east) of the North Building as indicated in the shaded areas on the plan of premises in schedule 1" (s 3(2)). Schedule 1 is referenced as containing the plan that shows the shaded areas, although in the text provided the plan itself is not reproduced. Practically, the regulation converts the described floor area into a legal extension of the Assembly precincts, so that the statutory regime and attendant powers and prohibitions in the Act apply to that floor area as if it were part of the precincts identified in the Act.
The regulation is entirely short and specific in scope: naming the instrument (s 1) and making the precincts extension (s 3 and schedule 1). It is made under the Legislative Assembly Precincts Act 2001 (title page), and the republication materials record commencement timing: sections 1 and 2 commenced 3 May 2016, and the remainder commenced 4 May 2016 (legislation history). The republication notes the penalty unit values that apply to offences against the law as at the republication date, namely $150 for an individual and $750 for a corporation (endnote on penalties, citing Legislation Act 2001, s 133). The instrument therefore functions as a map-based, narrowly targeted extension of the Act’s territorial coverage, transferring whatever controls, duties, rights and enforcement tools the Act contains onto the specified 624m2 east Level 1 area of the North Building in block 22, section 19 of the City division.
