Plain English Summary

2/10 complexity

This declaration extends the lifespan of two tobacco control regulations that were scheduled to automatically expire (or "sunset"). It delays the repeal of the Tobacco Advertising Prohibition Regulation 1993 and the Tobacco Plain Packaging Regulations 2011 until 1 April 2022.

This gives the government time to review whether these rules—which ban tobacco advertising and require plain packaging on cigarette packs—should be kept, updated, or allowed to end. The declaration itself automatically disappears (is repealed) the day after these regulations are repealed.

Who it affects: Tobacco companies, retailers, and health regulators who must comply with advertising and packaging laws.

Why it matters: Without this extension, the regulations would have expired automatically under the Legislation Act 2003, potentially creating a gap in tobacco control laws while the government decided whether to remake them.
