What it does
These Regulations set out how the Legislation Revision and Publication Act 2002 is to operate in relation to (a) what subordinate instruments count as "legislation" for the purposes of that Act, (b) limited editorial powers when revising legislation, (c) how publication under the Act can be achieved by electronic means, and (d) which online source is prescribed for evidentiary purposes.
Mechanically the instrument does four discrete things. First, regulation 4 prescribes particular classes of subordinate instruments as "legislation" for the purposes of paragraph (c) of the definition of legislation in section 3 of the Act. The list includes environment protection policies under Part 5 of the Environment Protection Act 1993 with a specific exclusion, aquaculture policies made on or after 1 January 2005, rules and proclamations made by the Governor from set dates, certain Governor notices published in the Gazette, and two categories of COVID‑19 directions or requirements (one issued by the State Co‑ordinator under s 25 of the Emergency Management Act 2004 and one issued by a Chief Executive under the Emergency Management Act as applied by the South Australian Public Health Act 2011), each subject to the conditions that they apply generally throughout the State and are issued as written instruments (regulation 4(a)-(g)).
Second, regulation 5, explicitly pursuant to section 7(1)(i) of the Act, permits the reviser when revising legislation to rephrase language that indicates, or could be taken to indicate, gender so as to avoid gendered references. That is an authorised textual alteration for the purposes of revision.
Third, regulations 6(1)-(3) permit publication of legislation under the Act by publishing an electronic copy from the SA legislation website. Regulation 6(2) makes an electronic copy downloaded from that website, or a print of it, be treated as having been published under the Act if two conditions are met: the publication was authorised by the Commissioner and the statement "Published under the Legislation Revision and Publication Act 2002." appears at the foot of each page of the electronic copy. Regulation 6(2a) creates a specific exception to the second condition for legislation of the kind referred to in regulation 4(f) or (g) (the COVID‑19 directions), removing the requirement for the footnote statement in respect of those instruments.
