98 References to ACT law include law containing reference In an ACT law, a reference in general terms to an ACT law of the same kind includes a reference to the law itself. The ABC Act 2001, s 27 gives a power to confiscate property under certain circumstances. Section 93 of the same Act provides ‘If an Act authorises the confiscation of property, the owner of the property has a right of appeal to the Magistrates Court.’ The right of appeal under s 93 also applies to the power given by s 27 because the reference to ‘an Act’ in s 93 includes a reference to the ABC Act 2001.
