97  Refusing an application where the eligible person failed to give notice in reasonable time

  A decision-maker must consider refusing to grant an approval where:

 (a) the eligible person failed to notify the responsible entity of the proceeding, inquest, inquiry or compulsory notice within a reasonable time of becoming aware of it; and

 (b) the delay may prejudice the entity’s position.
