89  Requests to which this Part applies   

  This Part applies to a request by an individual for financial assistance if:

 (a) the request relates to a proceeding to which this Part applies; and

 (b) the individual, at the time of the event or occurrence that gave rise to the proceeding:

 (i) was employed by a Minister on behalf of the Commonwealth as a member of the Minister’s staff under the Members of Parliament (Staff) Act 1984; or

 (ii) was employed in an entity to which this Part applies; or

 (iii) was an accountable authority or member of an accountable authority of an entity to which this Part applies; or

 (iv) was a statutory office-holder who was an official of an entity to which this Part applies; and

 (c) the proceeding arose out of, or in connection with, the individual’s performance (or non-performance) of the role mentioned in paragraph (b).

Note: For paragraph (c), for a person who is employed by a Minister on behalf of the Commonwealth as a member of the Minister’s staff under the Members of Parliament (Staff) Act 1984, the person’s role refers to their duties assisting the Minister in performing ministerial duties.
