77  Other matters regarding counsel fees 

 (1) An engaging entity must not treat the daily rates mentioned in subsection 75(1) as the standard or starting point for negotiations.

Note: In many cases, the normal market rates of counsel may be less than the threshold rates.

 (2) An engaging entity must not pay counsel more than the reasonable costs of accommodation or travel, taking into account the accommodation and travel allowances for Senior Executive Service officers in the Australian Public Service.
