62  Claims in respect of which this Part applies

 (1) This Part applies in respect of a monetary claim made by or against the Commonwealth or an entity, if the claim is not required to be determined under a legislative or contractual mechanism.

Note: For example, this Part would not apply in respect of the determination and payment of a Comcare benefit, the arbitration of a disputed contractual right, or an action to obtain or enforce a penalty imposed under Commonwealth legislation.

 (2) This Part also applies, with appropriate modifications, in respect of a monetary claim made by or against an eligible person within the meaning of Part 9, where a decision-maker grants an approval mentioned in that Part that covers the costs of settling the claim.
