40 The model litigant obligation
The Commonwealth, and a Commonwealth entity other than a GBE:
(a) must handle claims and conduct litigation in accordance with sections 41 to 43 (the model litigant obligation); and
(b) must not start legal proceedings unless satisfied that litigation is the most suitable method of dispute resolution.
