31 Sharing advice that may be significant to other Commonwealth agencies
Where an entity requests or receives legal advice (whether in draft or final form) that it considers likely to be significant to another Commonwealth agency, it must take such steps as are reasonable in the circumstances to:
(a) notify that agency of the request or advice; and
(b) make the advice available to the agency.
Note 1: In some circumstances, it may be reasonable not to take any steps to notify the agency or share the advice; for instance, in the circumstances mentioned in subsection 25(1) or 26(1).
Note 2: To avoid doubt, this obligation extends to sharing advice with operational and portfolio agencies where the entity considers that the advice is likely to be significant to them.
