25  Exception to consultation requirement—where disclosure inappropriate or unlawful

 (1) Section 23 does not apply to a requesting entity where compliance (such as disclosing the request or advice) would result in:

 (a) a breach of law; or

 (b) the inappropriate disclosure of a Cabinet, law enforcement or national security matter.

 (2) In circumstances where section 23 would have applied but for subsection (1), the requesting entity must instead, to the extent that is possible without giving rise to a result mentioned in paragraph (1)(a) or (b):

 (a) inform the administering entity that it has requested the advice in question; and

 (b) disclose the substance of the advice, once received.
