24 Exception to consultation requirement—urgency
(1) If the requesting entity needs advice of a kind covered by section 23 on an urgent basis, the entity:
(a) need not comply with section 23; and
(b) must instead, as soon as practicable after receiving the advice:
(i) consult with the administering entity; and
(ii) give the administering entity a copy of the request and the advice.
Note: For instance, this section would apply where the requesting entity needs the advice to enable a response to an urgent request by a Minister or a request arising without notice in litigation.
(2) In subsection (1), a reference to advice means:
(a) draft advice, if:
(i) the advice is provided in draft; and
(ii) it is reasonably practicable, in light of the urgency, to comply with subsection (1) before instructing that the advice be finalised; and
(b) otherwise—finalised advice.
