18 Providers other than tied providers may be approved to do tied work
(1) The Attorney‑General may approve a particular legal services provider other than a tied provider to undertake tied work.
(2) The approval may be subject to one or more conditions.
Note 1: For example, conditions could be:
(a) that:
(i) any advice prepared by the provider is to be settled in consultation with, and reflect any comments made by, a tied provider; and
(ii) the instructing entity pay the costs of the tied provider to consider and prepare comments about the advice; or
(b) that where one or more entities are instructing on the matter, the approval applies only to that entity or those entities, and that matter.
Note 2: If a tied provider wishes to engage a legal services provider other than a tied provider to undertake tied work, it will need approval to do so (see section 13). However, this does not apply when a tied provider, for the work in respect of which it is a tied provider, briefs counsel or another legal expert (see subsection 13(3)).
