> > (1) The Auditor-General may conduct a performance audit under Division 2A of Part 3 of the [Government Sector Audit Act 1983](/view/html/inforce/current/act-1983-152) of—
> >
> > > (a) the activities of the NSW Commissioner, the Bar Council and the Law Society Council for which costs and expenses may be paid from the Public Purpose Fund, and
> >
> > > (b) the present and future liability of the Fund for the payment of those costs and expenses.

> > (2) The performance audit may be conducted whenever the Auditor-General considers it appropriate.
>
> > (3) For the purposes of the performance audit, Division 2A of Part 3 of the [Government Sector Audit Act 1983](/view/html/inforce/current/act-1983-152) applies as if the Attorney General were the accountable authority for the relevant auditable entity within the meaning of that Act.
