Legal Profession Uniform Continuing Professional Development (Barristers) Rules 2015

The Rules establish several interconnected concepts. CPD year is defined in rule 5 as beginning on 1 April, meaning the compliance period is out of step with the calendar year and with many financial years, requiring careful diary management. CPD activity is defined in rule 5 as an activity meeting rules 6 and 6A. Rule 6(1) requires that the activity have “significant intellectual or practical content”, deal “primarily with matters related to the practice of law”, be conducted by persons qualified by practical or academic experience, and be relevant to the barrister’s professional development needs in relation to the practice of law. Notably, the barrister bears the burden of ensuring the activity meets these criteria before claiming points (r 6(2)). This shifts risk to the individual; if an activity is later judged by the designated authority not to meet the content requirements, points may be disallowed. CPD point is defined in rule 7 as one point per completed hour of engagement in a CPD activity. The unit is time‑based, not quality‑based; a low‑value lecture earns the same point as a rigorous workshop. CPD program includes the Bar CPD program (likely the Australian Bar Association’s program) and other activities that satisfy rule 6 (r 5). Categories are a key concept: rule 9(1) lists five mandatory categories. The 2025 amendment inserted “Equality and Wellbeing” as a fifth category, effective 1 April 2026. Being mandatory means a barrister who earns ten points but fails to allocate at least some points to each category is non‑compliant. Category assignment is governed by rule 10: if the designated authority or the activity organiser has assigned a particular activity to a category, the barrister cannot reassign it. Otherwise, the barrister may assign points to any category they reasonably consider appropriate. This creates a potential conflict: a barrister may attend a conference that touches multiple categories but the organiser assigns it to only one; the barrister cannot split the points across categories to meet the distribution requirement. Pro rata reduction is provided in rule 8(2) for barristers who commence or recommence practice after the start of the CPD year. The table reduces requirements based on the month the practising certificate is issued, from ten points for an April certificate down to zero for February or March certificates. This pro‑rating is mechanical and does not consider the actual amount of practice during the year; someone starting in January is deemed to need only one point, even if they take on a full workload. Exemptions under rule 13 are discretionary, not automatic, even for clear grounds like illness or parenting leave. The barrister must apply in writing, and for the current year must apply as early as practicable and at least one month before year‑end (r 13(2)(b)). For a prior year, the application must be within 21 days of becoming aware of non‑compliance (r 13(2)(c)). The authority may consider late applications in special circumstances (r 13(3)). This gives the authority significant discretion, which is a compliance risk for barristers. Records must be kept in the form provided by the authority and retained for at least three years (r 12). That retention period creates a burden: a barrister must store CPD records from three different years at all times, potentially across changes in chambers, technology or practice. Audit can be conducted by the authority for the current year or any of the previous three years (r 15). That means a barrister cannot safely discard records until four years after the CPD year. Rectification (r 16) applies when a barrister certifies non‑compliance, or the authority is not satisfied after verification, or the barrister fails to certify or verify. The authority can require a rectification plan within 21 days. The Rules do not specify what happens if the plan is not submitted or is rejected; that is left to the Uniform Law. Finally, transitional provisions (r 17) allowed activities completed between 1 April 2015 and the commencement date of the Rules (1 July 2015) to count towards the 2015/2016 year. This is now of historical interest only.

The primary target is every barrister who holds a local practising certificate in Western Australia. The Rules define “barrister” by reference to the Uniform Law: a person who is a barrister under that law, which generally means a legal practitioner who is restricted to barrister work or who holds a barrister‑only practising certificate. Solicitors who also appear as advocates are not directly subject to these Rules; they have their own CPD regime under the Uniform Law (likely the Legal Profession Uniform Continuing Professional Development (Solicitors) Rules). However, barristers in WA who are employed by law firms or government as in‑house counsel may still be required to hold a barrister’s practising certificate and therefore fall under these Rules, depending on the terms of their employment and the authority’s interpretation. The Rules also affect organisations that provide CPD: legal publishers, bar associations, commercial training providers, and universities whose postgraduate courses are relevant to the practice of law (r 6A(b), (c), (e)). The authority (the designated local regulatory authority, which in WA is the Legal Practice Board of Western Australia) is the rule‑maker and enforcer; its policies on caps, format and audit have direct compliance cost implications. New barristers in their first three years of practice are a distinct subgroup: the authority may impose additional CPD requirements (r 11). That rule does not specify a maximum, so the authority could theoretically double or triple the ordinary ten‑point requirement. This creates a heightened compliance burden on the cohort least able to bear it - junior barristers who are building their practices and have lower incomes. The opportunity cost of CPD time is proportionally higher for them than for established silks. Barristers on parenting leave, those suffering long‑term illness, and those absent from practice for other reasons are affected by the exemption process (r 13). The onus is on them to apply; the exemption is not automatic. This means a barrister who is incapacitated or caring for a newborn must proactively navigate a written application process while dealing with the underlying personal circumstances. The authority’s discretion to grant or refuse exemptions (even on listed grounds) creates uncertainty. Barristers who practise part‑time or who commence mid‑year are affected by the pro‑rata table (r 8(2)). The table is generous to those starting in the last quarter (three points for November, two for December, one for January, zero for February and March) but does not account for actual practice intensity. A barrister who starts in October and works full‑time for the remaining six months must earn only four points, while one who starts in May and works heavily for eleven months must earn nine. The asymmetry is arbitrary. Finally, retired or non‑practising barristers who maintain a practising certificate - for example, to do pro bono work or to appear occasionally - must still comply unless exempted. The Rules do not carve out low‑volume practitioners.

The core duty is to earn at least ten CPD points each CPD year (r 8(1)). The secondary duty is to ensure those points are spread across all five categories listed in rule 9(1). A barrister who earns eleven points but allocates them all to “Substantive Law” and none to “Equality and Wellbeing” has breached the Rules. The duty extends to the quality threshold: the activity must meet the criteria in rule 6(1) (significant intellectual content, law‑related, conducted by a qualified person, relevant to the barrister’s development). Rule 6(2) places the responsibility for checking compliance on the barrister, not the provider. This is a non‑delegable duty; relying on a provider’s marketing that a seminar “qualifies for CPD” does not shield the barrister if the designated authority later determines the activity lacked sufficient content. A duty arises to maintain records in the form specified by the authority (r 12). The form is not set out in the Rules; it is a matter of policy. Barristers must proactively ascertain what form is required and keep it for at least three years. The duty to certify compliance arises at each practising certificate renewal (r 14). The barrister must state whether they have complied in the just‑ended CPD year. This certification is mandatory; there is no provision for a “did not comply” certification without consequences - the rectification process (r 16) is triggered regardless. If audited, the barrister must produce records and give a statement of reasons for claiming activities satisfy the rules (r 15(2)). This duty arises within 21 days of the authority’s request. The authority may request verification for the current year or any of the three previous years (r 15(3)). The rights of barristers under the Rules are relatively few. A barrister has the right to apply for an exemption in whole or in part from any requirement (r 13(1)). The grounds are not exhaustive but include illness, disability, absence from practice (e.g., parenting leave), hardship or other special circumstances (r 13(4)). The right is qualified by the time limits in rule 13(2): for a current year, the application must be made as early as practicable and at least one month before year‑end; for a previous year, within 21 days of discovering non‑compliance. The authority may consider late applications in special circumstances, but that is a discretion, not a right. A barrister subject to a rectification notice under rule 16 has the right to submit a plan within 21 days. The Rules do not give a right to object or to appeal the authority’s decision on an exemption or rectification plan. Those appeal rights would come from the Uniform Law or from general administrative law, not from these Rules. In terms of allocating points, rule 10 gives the barrister a limited right to assign points to a category if the provider has not pre‑assigned it. But if the provider has assigned the activity, that assignment is binding; the barrister cannot argue that a seminar labelled “Ethics” also covers “Practice Management” and split points. This reduces flexibility. Overall, the Rules impose a one‑sided compliance framework: the authority sets categories, caps, audit processes and policies with no requirement of consultation or cost‑benefit analysis, and the barrister bears the burden of proof in showing compliance.

The Rules themselves do not create monetary penalties or imprisonment. Instead, they feed into the enforcement machinery of the Uniform Law. The Rules are made under Part 9.2 of the Uniform Law, and non‑compliance is a breach of a Uniform Law requirement. Under the Uniform Law, the designated local regulatory authority can take disciplinary action for failure to comply with CPD requirements, which can include conditions on the practising certificate, fines, suspension or cancellation. Specifically, rule 16 empowers the authority to give a written notice requiring a rectification plan when a barrister certifies non‑compliance, fails verification, or fails to certify or verify. If the barrister does not submit an adequate plan or does not follow it, the authority can refer the matter for disciplinary action. Rule 14 requires certification at the time of renewal; a false certification that the barrister has complied when they have not could amount to unprofessional conduct under the Uniform Law, separate from the substantive CPD breach. The audit power in rule 15 is enforcement‑adjacent: the authority can demand records and reasons within 21 days. Failure to produce or an unsatisfactory response can lead to a rectification notice. The authority’s policy powers (r 6(3)) include setting audit processes, which means the authority can design a random or targeted audit system without further legislative scrutiny. The cost of audit compliance falls on the barrister: time spent collating records, preparing statements, and potentially engaging legal advice. There is no compensation for the authority’s unreasonable demands, although judicial review would be available in principle for capricious exercises of power. The three‑year lookback period (r 15(3)) means a barrister cannot safely destroy CPD records until at least four years after the end of the relevant CPD year. Non‑compliance discovered late could lead to disciplinary action long after the barrister has forgotten the details of a seminar attended years earlier. The exemption process (r 13) does not protect against retrospective audit: a barrister who failed to apply for an exemption for a previous year because they were unaware of the time limit could still face enforcement if the authority does not accept the late application. The Rules do not provide for a warning or grace period before a rectification notice is issued. The authority can move directly from detecting non‑compliance (through audit or self‑certification) to requiring a plan. That plan requirement is itself a legal obligation; failing to submit it within 21 days is a further breach. The cumulative effect is that a barrister who falls behind on CPD by even a few points faces escalating enforcement steps with no obvious off‑ramp other than full compliance or a discretionary exemption. The penalty regime is therefore best described as “compliance by bureaucratic burden”: the cost of defending an audit or challenging an exemption refusal may outweigh the cost of simply doing ten more hours of CPD, even if those hours are low‑value. This creates an incentive for barristers to over‑comply (e.g., earn twelve points to ensure all categories are covered) rather than to tailor CPD to genuine needs.

The Rules are a subordinate instrument under the Legal Profession Uniform Law as applied in Western Australia by the Legal Profession Uniform Law Application Act 2022 (WA). That Act is the jurisdictional legislation that gives force to the Uniform Law in WA. The Rules themselves reference the Uniform Law several times: the objective (r 3) says they set out provisions “contemplated by the Uniform Law”; the authorising provision (r 4) cites Part 9.2; and the definition of “Uniform Law” (r 5) means that law as applied in a participating jurisdiction. The Rules also refer to “designated local regulatory authority” as defined in jurisdictional legislation for the purposes of section 44 of the Uniform Law (r 5). In WA, that authority is the Legal Practice Board, but the Rules do not name it; the WA Application Act would identify it. The Uniform Law itself likely contains overarching provisions about CPD, and the Rules fill in the detail. If there is a conflict between the Rules and the Uniform Law, the Uniform Law prevails. Similarly, the Rules interact with the Legal Profession Uniform Continuing Professional Development (Solicitors) Rules (if any apply in WA), but barristers are subject only to these Barristers Rules. There may be overlap for barristers who also hold solicitor certificates (which is uncommon in WA due to the split profession). The Rules also interact with the Australian Bar Association’s Bar CPD program, which is referenced in the definition of “CPD program” (r 5). The authority can approve other activities (r 6A(h)). Postgraduate studies in law (r 6A(e)) count as CPD, which means the Rules intersect with university enrolment requirements and exam schedules. The drafting or marking of admission examinations (r 6F(f) - note the source text shows “6F” but likely a typo for “6A(f)”; the enumeration in rule 6A uses (a) to (h)) is also recognised, linking to the admission rules. The Rules do not operate in a vacuum regarding employment law: a barrister who is employed (e.g., as a government lawyer or in‑house) may have their employer require CPD compliance as a condition of employment, but that is a contractual matter, not a statutory interaction. The Rules are silent on relationships with the tax law: CPD expenses may be deductible, but the Rules do not affect that. Critically, the Rules interact with the authority’s own policy‑making power: rule 6(3) allows the authority to make policies on caps, format and audit. Those policies are not part of the Rules themselves and could change without legislative amendment. Barristers must monitor not only the Rules but also any policies published by the Legal Practice Board. The Rules do not require that policies be published or gazetted, creating a risk of hidden obligations. The amendment history shows that the Rules were originally NSW legislation applied in WA by the WA Application Act, which came into force on 1 July 2022. Thus, the Rules also interact with the inter‑jurisdictional registration of CPD: a barrister who moves from WA to another participating jurisdiction (NSW, Victoria, etc.) may have to check whether the receiving jurisdiction’s CPD rules are identical or have different categories, pro‑rating rules, or exemption procedures. The Rules do not address reciprocity; it is an open question whether CPD done in one Uniform Law jurisdiction counts in another.

The Rules were originally made in New South Wales and published on 1 July 2015. They were applied in Western Australia by the Legal Profession Uniform Law Application Act 2022 (WA) from 1 July 2022. The compilation table shows only one amendment: the Legal Profession Uniform Continuing Professional Development (Barristers) Amendment (Mandatory CPD) Rule 2025, published in the Gazette on 15 October 2025 and commencing 1 April 2026. That amendment inserted a new category (e) into rule 9(1): Equality and Wellbeing. Before that, the Rules had only four categories: Ethics and Professional Responsibility, Practice Management and Business Skills, Substantive Law/Practice and Procedure/Evidence, and Barristers’ Skills. The amendment also moved the existing categories (a) to (d) and added (e). The amendment was published as Gazette 15 Oct 2025 p. 1873. The note under rule 9 states “[Rule 9 amended: Gazette 15 Oct 2025 p. 1873.]”. The commencement is 1 April 2026, so the first CPD year in which Equality and Wellbeing is mandatory is the year starting 1 April 2026. Barristers in the 2025/2026 CPD year are still under the four‑category rule. The amendment title - “Mandatory CPD” - is somewhat misleading because the Rules already mandated CPD; the amendment added a new mandatory category. The official rationale for adding Equality and Wellbeing is not stated in the source, but likely flowed from concerns about lawyer wellbeing and diversity. The cost impact is that barristers must now allocate at least some of their ten points to a category that may have little direct connection to their practice area. For a barrister practising solely in commercial litigation, equality and wellbeing content may be of marginal professional value, yet it consumes a share of the ten‑hour budget. This is a classic example of regulatory mission creep: the CPD regime expands to incorporate social objectives beyond maintaining legal competence. Barristers will need to source suitable activities in that category, which may be fewer in number or of lower intellectual rigour than core legal offerings. The amendment also demonstrates that the rule‑maker can add categories unilaterally; there is no sunset clause or cost‑benefit requirement. Future amendments could add further categories without legislative scrutiny, increasing the compliance burden incrementally. The transitional provision (r 17) is now spent; it applied only to the 2015/2016 CPD year in NSW. For WA, the Rules applied from 2022/2023, and there is no WA‑specific transitional provision in the source. Barristers who engaged in CPD before 1 July 2022 presumably could not count it unless the WA authority issued a policy to that effect; the Rules do not provide for it.

The source text does not mention any litigation or court decisions involving these Rules. That is not surprising given that the Rules have been in force in WA only since July 2022 and the amendment adding the fifth category does not commence until April 2026. There may have been decisions in NSW, Victoria or other participating jurisdictions that apply the equivalent rules, but the source does not cite them, and I cannot invent them. As a general observation, CPD rules are rarely litigated because the compliance burden is relatively low (ten hours a year) and the cost of challenging a decision on exemption refusal or audit is high compared with simply doing the CPD or accepting a warning. However, potential grounds for judicial review in WA could include: a decision by the Legal Practice Board to refuse an exemption on grounds not permitted by the Rules (e.g., ignoring illness evidence); a policy that unreasonably caps points per activity (r 6(3)(a)) if it prevented a barrister from meeting the category requirement; or an audit demand that is so broad as to be oppressive. The Rules themselves do not create a right of appeal, but the Uniform Law or the WA Application Act likely provides for internal review or external appeal to the State Administrative Tribunal. Without source material, I cannot specify. Barristers who wish to challenge should seek independent legal advice. The absence of litigation history does not mean the Rules are uncontroversial; it may simply reflect the rational apathy of individual barristers who see the cost of fighting as exceeding the cost of complying. That is a feature of small‑scale professional regulation: diffuse burdens are rarely contested because no single barrister has sufficient incentive to fund a test case. The addition of the Equality and Wellbeing category may increase litigation risk if barristers argue it goes beyond professional competence into social engineering, but that argument would face the hurdle that the Rules are authorised by the Uniform Law and the purpose is broad. The litigation history for this instrument is thus a blank slate, but the potential for future challenges exists around the scope of the authority’s policy‑making power and the reasonableness of exemption decisions.

Rule 6(2) is a trap: the barrister is responsible for ensuring the activity meets the criteria before claiming points. If the designated authority later decides that a seminar was not “of significant intellectual or practical content” or did not “deal primarily with matters related to the practice of law”, the points can be disallowed, even if the provider marketed it as CPD‑worthy. Barristers should not assume that any legal seminar qualifies; they should read the program description critically. The format allowance in rule 6A is broad, but the catch‑all (h) (“any other activity approved by the designated local regulatory authority”) means that an activity not on the explicit list requires prior approval. Relying on an unapproved activity is at the barrister’s risk. The pro‑rata table in rule 8(2) looks helpful but can mislead: a barrister who commences in January must earn only one point. If they earn one point but do not ensure it falls into each of the five categories (as of 2026), they will be non‑compliant. One point cannot be split across five categories, so the pro‑rata requirement effectively becomes impossible to meet if the barrister needs points in all categories but only needs one point. The rule is silent on how a single point can satisfy the category requirement. Common sense would dictate that the authority would exempt or deem compliance, but the Rules do not say that. The pro‑rata table may produce absurd results for those starting in the last four months of the CPD year. The category assignment rule (r 10) is a trap for the unwary: if a CPD provider assigns an activity to one category, the barrister cannot reassign points to another category even if the content clearly covers multiple areas. This can force a barrister to attend additional activities just to meet a category quota, increasing the time cost. The timing of the exemption application for a current year is strict: must be made “not less than one month before the end of that year” (r 13(2)(b)). If a barrister falls ill in the last month of the CPD year (e.g., March), they cannot apply for an exemption for that year within the required window. They would have to argue special circumstances for a late application (r 13(3)), which is discretionary. The rule effectively penalises events that occur late in the year. The record‑keeping requirement (r 12) says “in the form provided by the designated local regulatory authority”. If the authority changes the form from year to year, barristers must track which form applies to which CPD year. Keeping records in a generic format might not satisfy the requirement. The audit power (r 15) allows the authority to demand records and reasons within 21 days. A barrister who is on holiday or unwell when the notice arrives could miss the deadline. The Rules do not provide for extension of time in the audit context (unlike the exemption context where late applications may be considered). The rectification notice (r 16) requires the barrister to “submit a plan … within 21 days”. There is no grace period and no provision for an initial warning. The plan must set out steps to rectify the non‑compliance. If the barrister is unable to comply (e.g., the CPD year has ended and they cannot go back in time), the plan may be impossible to fulfil. The authority might then take disciplinary action. The Rules do not provide a mechanism to “cure” a past year’s deficit other than by an exemption. The certification requirement (r 14) is tied to renewal of the practising certificate. If a barrister certifies they have complied when they have not, that is a false statement. The practical consequence is that many barristers will over‑state compliance to avoid the audit and rectification process, but that is a legal risk. Finally, the transitional provisions (r 17) are spent, but note that the Rules were applied in WA in 2022, not 2015. Barristers who started practice in WA in 2022 must have been aware that the Rules applied from 1 July 2022; the CPD year runs from 1 April to 31 March, so the first full CPD year under the Rules in WA was 2022/2023. Anyone who started in March 2023 would need zero points for that year under the pro‑rata table but would need to ensure they have a record of their start date. That is a potential trap if the authority interprets “commence or recommence practice” strictly.

Compliance requires a systematic, year‑round approach. First, identify the current CPD year (1 April to 31 March) and calculate the required points based on your commencement date (r 8(2)). Even if you are a barrister who started mid‑year, note the category conundrum: you may need to earn points across all five categories (from 2026) even if your pro‑rata requirement is low. The safest course is to always earn at least one point in each category, even if that means earning more than the pro‑rata minimum. Second, select CPD activities that meet the criteria in rule 6(1). Before registering, check the provider’s description against the criteria: is the content intellectually substantive, primarily law‑related, presented by a qualified person, and relevant to your practice? Document your reasoning at the time. If the activity is not obviously within the listed formats (r 6A), seek written approval from the designated local regulatory authority under rule 6A(h). For category assignment, check whether the provider has pre‑assigned the activity to a category. If so, you cannot reassign (r 10). Plan your CPD program to ensure you cover categories where pre‑assigned activities are scarce. For example, if you attend a commercial law conference that the provider assigns only to “Substantive Law”, you will need separate activities for Ethics, Practice Management, Barristers’ Skills and Equality and Wellbeing. Third, maintain a record in the form specified by the authority (r 12). The form is not in the Rules; check the Legal Practice Board’s website for the current template. Keep a contemporaneous log: date, duration, description, provider, category assigned (and by whom), and any supporting materials (e.g., certificate of attendance, program outline). Retain these records for at least three years after the CPD year (i.e., until 31 March of the fourth year after the activity). Fourth, apply for exemptions as early as possible. If you anticipate that illness, parenting leave, or other special circumstances will prevent compliance, apply in writing to the designated authority well before the end of the CPD year (at least one month before 31 March). If you discover a shortfall from a previous year, apply within 21 days (r 13(2)(c)). Build a file of evidence (medical certificates, evidence of leave, etc.). Fifth, at renewal time (r 14), certify accurately. If you have not fully complied, do not falsely certify: the rectification process (r 16) is triggered by an honest certification of non‑compliance, which is less risky than a false certification. If you certify non‑compliance, be prepared to submit a rectification plan within 21 days if required. The plan should be realistic: propose to attend specific CPD activities in the current year to make up for the shortfall, or explain why an exemption should apply. Sixth, if audited (r 15), respond within 21 days with the required records and a clear statement explaining how each activity satisfies the rules. Do not rely on generic claims. If you have no records, explain why and provide any alternative evidence (e.g., confirmation from the provider). Seventh, monitor the authority’s policies (r 6(3)). The authority can impose caps on points per activity, specify audit processes, and define the record‑keeping form. These policies may change year to year. Subscribe to the Legal Practice Board’s updates. Eighth, for new barristers (within first three years), check whether the authority has imposed additional CPD requirements under rule 11. If so, build those into your annual plan. The additional requirements are separate from the ten‑point minimum, so you may need to earn, say, 15 points and distribute them across categories plus the additional topics. Ninth, consider using the Bar CPD program as a reliable source of compliant activities, since it is specifically mentioned in the definition (r 5). Finally, treat compliance as a professional development opportunity, not a box‑ticking exercise, but be aware that the system incentivises tick‑and‑file behaviour. The highest‑value CPD may not be the easiest to record, but the audit risk is minimal if you maintain good records and stay within the rules. In summary, the cost of compliance is about ten hours per year plus administrative time for record‑keeping and certification. The risk of non‑compliance is an obligation to submit a rectification plan and potential disciplinary proceedings. The rational barrister will budget time and money for CPD as a fixed cost of practice.
