Legal Deposit Act 2012

Key statutory concepts are defined in Part 1 and drive the mechanics of the regime. Understanding these definitions is critical because they establish who has duties, what objects are captured and how obligations differ between media.

• Document. The Act adopts a broad, medium‑neutral definition of “document”. It expressly includes writing on material (books, periodicals, reports, maps, pamphlets), information recorded or stored by electronic means (audio and video cassettes, magnetic tapes, optical disks, DVDs), information on film or microform and importantly, information on a website (s 4(1), definition of document). The definition therefore extends to both print and a broad range of non‑print media.

• Public document. A “public document” is a document that is printed or produced in the State, or commissioned to be printed or produced outside the State by a person who is resident in the State or whose principal place of business is in the State, and of which one or more copies are published in the State (s 4(1), public document (a)). The definition expressly excludes documents on the Internet from the general “public document” definition (s 4(1)(b)(i)). The regulations may further exclude classes of document from being “public document[s]” (s 4(1)(b)(ii)).

• Publish and publisher. The Act differentiates publishing by medium. For non‑internet material, “publish” means issuing copies to the public or making copies available on request. For internet material, “publish” is to make the document available to the public on the Internet (s 4(1), definition of publish). The person treated as a “publisher” is the person who publishes the document; for internet material, the “publisher” is the person who has control over the content of the website or the relevant part of the website (s 4(1), publisher).

• WA Internet document. A document on the Internet is a “WA Internet document” if the publisher is resident in the State or has its principal place of business in the State, or if the regulations say the document is to be taken to be a WA Internet document (s 5(1)). A WA Internet document is defined temporally as the document at a particular point in time; if changed significantly it becomes a different WA Internet document (s 5(2)). The regulations can exclude classes of internet documents from being WA Internet documents (s 5(3)).

• State Librarian and Board. The State Librarian is the officeholder appointed under the Library Board Act (s 4(1)). The Board is the Library Board of Western Australia (s 4(1)). The State Librarian is the operational actor who gives directions and receives deposited material. The Board has enforcement functions and may commence civil proceedings (ss 14-15, 16).

• Deposit and assistance. Deposit obligations are statutory for public documents (s 8). For non‑print public documents and WA Internet documents, the State Librarian can direct the publisher to provide reasonable assistance to preserve and access deposited copies (s 18). The regulations may require provision of computer programs necessary for preservation and access (s 18(7)).

• Regulatory scaffolding. The Act gives broad regulatory powers to prescribe the number of copies (not exceeding two under s 8), timeframes, formats, exceptions for reprints, and access limitations to deposited copies (s 19). The Minister must consult “as far as is reasonably practicable” with persons likely to be affected before making regulations (s 20).

These concepts interact in particular ways that matter operationally. Because the definition of “public document” excludes ordinary internet documents (s 4(1)(b)(i)), the Act sets up internet material as a separate category to be managed through WA Internet document rules (s 5) and, ultimately, the uncommenced Part 3 provisions (not in force) which appear by cross‑reference in the Act to provide deposit powers for WA Internet documents. Meanwhile, s 18 , which is in force , allows the State Librarian to require assistance for WA Internet documents for preservation and access even where deposit powers for WA Internet documents might await proclamation. The regulations will fill out operational detail for deposits and access (s 19).

The Act assigns duties and potential liabilities primarily to publishers, and allocates decision‑making authority to the State Librarian and the Board. Several other actors are implicated.

Publishers. The principal burden falls on publishers as defined. For print or analogous non‑internet media, the publisher is the person who issues or makes copies available (s 4(1), publish and publisher). For internet material, the publisher is the person who has control over the website content or the relevant part of the website (s 4(1), publisher; s 5 for WA Internet documents). Where a person is resident in Western Australia, or has their principal place of business in Western Australia and commissions production outside the State, they may be treated as a publisher for the purposes of the public document definition (s 4(1)). Publishers must provide the prescribed number of copies at their own expense (s 8) and provide assistance for non‑print and WA Internet documents when directed by the State Librarian (s 18).

State Librarian. The State Librarian is the central administrative decision maker. The State Librarian may issue directions under s 9 to secure copies where deposit obligations under s 8 have not been met, may grant exemptions under s 10, and may direct publishers to provide reasonable assistance to preserve and access non‑print public documents and WA Internet documents under s 18. The State Librarian signs written notices giving directions (s 9(3), s 18(4)).

Library Board of Western Australia (the Board). The Board enforces compliance through civil proceedings in the District Court to obtain copies or recover costs under s 14, and to compel assistance under s 15. The Board (or an authorised person) is the only body (other than the DPP in its statutory role) that may commence criminal proceedings under the Act (s 16).

Publishers’ customers or users. The Act permits regulations to specify limitations on access to or use of copies obtained by the State Librarian (s 19(3)). That regulatory discretion can affect how deposited copies are made available to researchers, public users or third parties.

The Crown and State agencies. The Act binds the Crown in right of the State and, to the extent constitutionally permissible, in other capacities (s 6). State agencies that publish material in scope could therefore be treated as publishers and be subject to deposit obligations.

Third parties who control web content. For WA Internet documents, responsibility falls on whoever “has control over the content of the website, or the part of the website, on which the document is located” (s 4(1), definition of publisher). Control could be an individual, an organisation or an agency. The Act does not describe how “control” is determined; the statutory risk is that the person or entity that exercises content control will bear the deposit and assistance obligations.

Regulatory and political actors. The Governor makes regulations under s 19, and the Minister must consult as far as reasonably practicable with persons likely to be affected before making regulations (s 20). The State Librarian issues directions and grants exemptions; orders are subsidiary legislation and thus subject to Interpretation Act processes (s 10(4)).

Who pays. The Act places the financial burden on publishers for providing copies and for providing assistance, expressly noting “at the publisher’s own expense” for s 8 and s 18. The Board or State Librarian may recover costs via civil proceedings where non‑compliance causes the Board to obtain copies by other means (s 14(1)(b)).

Who decides. The State Librarian decides whether to issue directions or grant exemptions (ss 9, 10, 18). The Board decides whether to initiate civil or criminal proceedings (ss 14-16). The Governor and Minister make regulations and manage the consultative process (ss 19-20).

The Act establishes a compact of duties for publishers and corresponding authorities and remedies for the State. These are set out in specific sections.

Deposit duty. Publishers of public documents must give to the State Librarian, at their own expense, the number of prescribed copies under the regulations, not exceeding two (s 8). The regulations will specify the number of copies, timing, manner of delivery, format, and related matters (s 19(2)). The duty attaches to public documents published on or after the day section 7 comes into operation (s 7(1)).

Direction to comply. If the State Librarian considers a publisher has not complied with s 8, the State Librarian may issue a written direction requiring compliance (s 9(1)-(4)). The direction must be in writing, signed, and provide at least 30 days for compliance and other prescribed particulars (s 9(3)-(4)). Failure to comply without reasonable excuse is an offence with monetary penalties (s 9(5)).

Assistance duty for non‑print and internet material. For a non‑print public document or a WA Internet document, where the State Librarian considers assistance is reasonably necessary to preserve and access copies obtained under the Act, the State Librarian may by written notice direct the publisher to provide, at the publisher’s own expense, reasonable assistance (s 18(2)-(5)). The direction must specify the manner of assistance and provide at least 30 days to comply (s 18(4)-(5)). Failure to comply without reasonable excuse is an offence subject to the monetary penalties set out in s 18(6). The regulations may require the publisher to provide any computer program necessary to enable the State Librarian to preserve and access the deposited copies (s 18(7)).

Exemption power. The State Librarian may exempt a specified person or class of people from the deposit duty (s 10(1)-(3)). Exemptions may include circumstances and conditions and ceases to apply if conditions are not observed. Importantly, an order of exemption is subsidiary legislation for Interpretation Act purposes and is therefore subject to section 42 of that Act (s 10(4)).

Civil remedies. The Board may apply to the District Court where a publisher fails to comply with a direction under s 9 or s 13 for an order that the publisher deliver the copies or pay the Board’s reasonable costs in obtaining those copies (s 14(1)). The Court may make such orders if satisfied the publisher failed to comply without reasonable excuse (s 14(2)). Similarly, where a publisher fails to provide assistance after a s 18 direction, the Board may seek a court order under s 15 to compel provision of the assistance, where the Court finds the assistance was reasonably necessary and not provided without reasonable excuse.

Criminal prosecutions and court powers. Prosecutions under the Act may only be commenced by the Board or by a person authorised in writing by the Board (s 16), without limiting the DPP’s functions under the Director of Public Prosecutions Act 1991. On conviction for failing to comply with directions, a court may order delivery of copies or payment of costs, and may order provision of assistance where appropriate (s 17). Such orders can be made on terms and are additional to any penalty (s 17(3)).

Access and use limitations. The regulations may prescribe limitations on access to or use of deposited copies obtained under the Act (s 19(3)). That is, the Act contemplates that the Board may not be required by the Act itself to make deposited material freely available; limiting access is a regulatory instrument.

Regulatory process safeguards. The Governor makes regulations (s 19(1)), and the Minister must consult as far as reasonably practicable with persons likely to be affected before making regulations (s 20(1)-(2)). Those consultation obligations are not prescriptive about process; they require the Minister to have regard to the number of persons likely to be affected.

Right to seek court terms. In civil proceedings under ss 14 and 15 and in the criminal context under s 17, the Court has discretion to make orders on such terms and conditions as it thinks fit, to enforce orders as judgments, and to fashion remedies that the Court considers appropriate (ss 14(3), 14(4), 15(3)-(4), 17(1)-(3)).

Consequential rights and duties under other acts. The Act amends the Library Board of Western Australia Act 1951 to expressly incorporate proceedings under the Legal Deposit Act into the Board’s jurisdiction and functions, which clarifies institutional authority for enforcement (ss 21-25).

The Act combines administrative directions, civil remedies and criminal sanctions, concentrating enforcement power predominantly in the Board and the State Librarian, with the courts available to make coercive orders.

Monetary penalties for failure to comply with directions. Two specific offences with specified fines appear in the Act. Failure, without reasonable excuse, to comply with a direction under s 9 to deliver copies attracts a prescribed penalty: for an individual, a fine of $1 000; for a body corporate, a fine of $5 000 (s 9(5)). Failure, without reasonable excuse, to comply with a direction under s 18 to provide reasonable assistance likewise attracts the same fines: $1 000 for an individual and $5 000 for a body corporate (s 18(6)). The Act does not prescribe incarceration or other criminal penalties beyond the monetary fines and associated court processes.

Civil enforcement. The Board may apply to the District Court under s 14 where a publisher fails to comply with a direction under s 9 or s 13, seeking either delivery of the copies that should have been deposited or recovery of the Board’s reasonable costs in obtaining those copies (s 14(1)). The District Court may make an order on terms and conditions it considers fit and such an order is a judgment of the Court and may be enforced accordingly (s 14(3)-(4)). Similarly, under s 15, the Board may seek an order compelling provision of assistance from a publisher who failed to comply with a s 18 direction, if the assistance was reasonably necessary and the publisher failed without reasonable excuse. Orders made under s 15 are enforceable as judgments (s 15(3)-(4)).

Criminal prosecutions. While the Act creates criminal offences for failing to comply with directions (see s 9(5) and s 18(6)), it restricts who may commence criminal proceedings. A prosecution under the Act may only be commenced by the Board or by a person authorised in writing by the Board to do so, without limiting the DPP’s functions under the Director of Public Prosecutions Act 1991 (s 16). That bottleneck centralises prosecutorial discretion and reduces the likelihood of third parties or private individuals initiating prosecutions directly.

Court powers on conviction. If a court convicts a person of failing to comply with a direction, the court may, if it considers it appropriate, order the offender to give the missing copies to the State Librarian or to pay the Board’s reasonable costs in obtaining the copies (s 17(1)). If convicted for non‑compliance with an assistance direction under s 18(6), the court may order the offender to provide the assistance required (s 17(2)). Such orders are additional to any other penalty and can be made on terms as the court thinks fit, and are enforceable as a judgment (s 17(3)).

Administrative remedies and exemptions. The State Librarian may grant exemptions by order under s 10. Exemption orders are subsidiary legislation for the purposes of the Interpretation Act 1984 and thus attract the formalities and review mechanisms that apply to regulations (s 10(4)). An exemption ceases to have effect when any condition of the exemption is not being observed (s 10(3)). The Act does not prescribe the grounds on which exemptions must be granted, giving the State Librarian administrative discretion.

Practical enforcement layering. The Act sets out a stepped enforcement model: administrative direction by the State Librarian; civil judicial enforcement by the Board in the District Court for delivery or costs where directions are ignored (s 14); criminal proceedings, subject to Board control over whether to prosecute (s 16); and court‑ordered remedial measures on conviction (s 17). The presence of modest pecuniary fines and the availability of civil cost recovery suggests enforcement emphasis on compliance and rectification rather than punitive measures.

The Act is drafted to sit alongside and amend existing institutional arrangements, and it relies on other statutory frameworks for procedural and interpretive matters.

Library Board of Western Australia Act 1951. The Legal Deposit Act makes consequential amendments to the Library Board Act (Part 6, ss 21-25). These amendments integrate the Legal Deposit Act into the Board’s jurisdiction, functions and powers. For example, section 12 of the Library Board Act is amended to add proceedings under ss 14 and 15 of the Legal Deposit Act to the Board’s statutory remit (s 22). Section 15 of the Library Board Act is amended to state the Board may perform the functions conferred on it under the Legal Deposit Act (s 24). The amendments therefore align institutional authority and enforcement avenues.

Interpretation Act 1984. Exemptions granted by the State Librarian under s 10 are expressly declared to be subsidiary legislation for the purposes of the Interpretation Act 1984, with section 42 of that Act applying to those orders (s 10(4)). That means procedural and publication requirements applicable to regulations and subordinate instruments under the Interpretation Act will apply to State Librarian exemption orders.

Director of Public Prosecutions Act 1991. The Act states it does not limit the functions of the DPP under the Director of Public Prosecutions Act 1991, but it confines who may commence prosecutions under this Act to the Board or persons authorised by the Board (s 16). That cross‑reference recognises the DPP’s general role while keeping prosecutorial initiation for Legal Deposit Act offences within the Board’s control.

Regulations and administrative law. The Governor is empowered to make regulations under s 19(1) to prescribe matters required or convenient to give effect to the Act. Those regulations can set detail on number of copies, timing, formats, access conditions and more (s 19(2)-(3)). The Minister's consultative duty when making regulations (s 20) must be performed “as far as is reasonably practicable” and the Minister can choose the method of consultation appropriate in the circumstances (s 20(2)).

Crown status. The Act binds the Crown in right of the State and, to the extent the Parliament’s legislative power permits, the Crown in other capacities (s 6). That means State departments and agencies that publish documents in scope may be subject to the deposit and assistance obligations unless an exemption applies.

Interaction of print and internet categories. The Act explicitly excludes documents on the Internet from the definition of “public document” (s 4(1)(b)(i)), while separately defining WA Internet documents (s 5). This bifurcation means that deposit obligations and directions for non‑internet public documents fall under Part 2 and s 8, whereas internet material is addressed by the WA Internet document concept and the interconnected but partially uncommenced provisions (references to s 13 in Parts 2 and 4 suggest a Part 3 regime which remains unproclaimed). However s 18, which governs assistance for non‑print and WA Internet documents, is in force and interacts with the WA Internet document definition in s 5.

Regulatory limits on access. The Act allows regulations to prescribe limitations on access to or use of deposited copies (s 19(3)). This interacts with other public access laws and privacy or copyright regimes in practice, although the Act itself does not displace copyright or other legal restrictions, and the definition of “restriction” excludes legal restrictions recorded in or claimed for a document (s 4(1), restriction).

Uncommenced Part 3. Part 3 is not in operation (uncommenced provisions table). Parts of the Act (e.g. references to s 13 in ss 14 and 9(1)) depend on Part 3. Until Part 3 is proclaimed, the WA Internet deposit mechanism signalled in the Act is not fully realised. This partial operationalisation affects how the WA Internet document definition and s 18 interact with the broader deposit regime.

The Act’s compilation table and uncommenced provisions table supply the statutory history embedded in the document.

• Enactment and commencement. The Legal Deposit Act 2012 received assent on 21 May 2012 (compilation table). Sections 1 and 2 (short title and commencement mechanics) commenced on the day of assent (s 2(a)). The remainder of the Act, other than Part 3, commenced by proclamation on 1 January 2014 as noted in the compilation table and Gazette notice (s 2(b); compilation table).

• Uncommenced provisions. Part 3 of the Act remains unproclaimed and is listed in the uncommenced provisions table. The uncommenced provisions table indicates Part 3 as “To be proclaimed” and notes an amendment reference: “Legal Deposit Act 2012 Pt. 3, No. 33 of 2023 s. 4” suggesting a later amending instrument touched Part 3, but the compilation table confirms Part 3 has not come into operation. The Act therefore has been operationalised in stages, with the internet deposit part not yet proclaimed.

• Consequential amendments. Part 6 of the Act contains consequential amendments to the Library Board of Western Australia Act 1951. Those amendments insert references to proceedings under the Legal Deposit Act, expand the Board’s functions to perform Legal Deposit Act functions and align other sections so that the Board’s statutory instruments and powers encompass Legal Deposit Act activities (ss 21-25). Those amendments are part of the Act as compiled and commenced other than Pt 3.

• Regulations and subsidiary instruments. The Act envisages substantial regulatory detail to be supplied by the Governor under s 19, and it designates State Librarian exemption orders as subsidiary legislation for the purposes of the Interpretation Act (s 10(4)). The Minister is charged with conducting consultation “as far as is reasonably practicable” before making regulations (s 20). The existence of these delegated law mechanisms means the operational detail and many compliance obligations will flow from subordinate instruments made under the Act.

• No judicial amendments or cases recorded in the Act. The text of the Act does not include any recorded judicial interpretation or amendment produced by litigation. The compilation table does not list subsequent amending Acts affecting operative sections other than notes about Pt 3. Any further amendment history beyond what is recorded in the compilation and uncommenced tables is not present in the text provided.

In short, the Legal Deposit Act 2012 was enacted in 2012 with most operative provisions brought into force on 1 January 2014. Part 3, relating to internet deposit powers as signalled in other sections, has not been proclaimed and remains uncommenced. The Act also embeds its operational framework through delegated legislation and by amending the Library Board Act to make the Board the institutional enforcer.

The Act text supplied contains no reported or recorded litigation history. There are no cases named in the statute, and the Act itself does not reference judicial interpretations, declaratory judgments, or precedents. The statutory architecture, however, sets out likely avenues and forums for litigation should disputes arise.

Forum and remedies. Civil enforcement is vested in the District Court under ss 14 and 15, where the Board may apply for orders that publishers deliver copies or provide assistance, or pay the Board’s reasonable costs in obtaining copies. Any such orders are judgments of the District Court and are enforceable accordingly (s 14(4), s 15(4)). The Act therefore contemplates contested litigation in the District Court where a publisher disputes its obligation or fails to comply with a direction.

Criminal enforcement. The Act creates offences for failure, without reasonable excuse, to comply with directions (s 9(5); s 18(6)). However, prosecutions may only be commenced by the Board or by a person authorised in writing by the Board, although the Act explicitly does not limit the DPP’s statutory functions under the Director of Public Prosecutions Act 1991 (s 16). This design concentrates prosecutorial control with the Board and suggests that criminal litigation under the Act will be initiated primarily by the Board where it decides prosecution is necessary.

Judicial discretion. The Court has broad remedial discretion in both civil and criminal contexts to make orders on terms and conditions to deliver copies, order payment of the Board’s costs, or require the provision of assistance (ss 14(3), 15(3), 17(1)-(3)). These provisions permit courts to fashion equitable or practical remedies beyond monetary penalties.

No cases cited in the Act. Because the Act contains no case law references or annotations reporting cases, the statutory text alone does not supply litigation history. Users seeking actual judicial decisions arising from the Act would need to search court records and legal databases for cases brought under ss 9, 14, 15, 16 or 18 since the Act’s commencement.

Potential for litigation themes. The statutory architecture suggests litigation might be expected around issues such as the definition of “publisher” for WA Internet documents, what constitutes “control over the content of the website” (s 4(1)), the territorial and residency tests for public documents and WA Internet documents (s 4(1), s 5), the scope of “reasonable assistance” under s 18, the meaning of “reasonable excuse” in non‑compliance cases, and whether regulations or State Librarian directions improperly extend or narrow obligations. The Act leaves these interpretive questions to be resolved in judicial settings where disputes are litigated, but the Act itself does not report any such determinations.

No recorded judicial review of State Librarian exemption orders in the Act. Section 10(4) treats exemption orders as subsidiary legislation for Interpretation Act purposes, which creates a procedural architecture for challenge or review via administrative law mechanisms, but the Act does not mention particular review cases or outcomes.

In sum, the Act’s text does not supply litigation history. It defines a litigation pathway , District Court for civil enforcement and criminal proceedings controlled by the Board , and leaves interpretive questions that would be the probable subject of future litigation to courts.

The Act contains several technical provisions and interactions that may catch publishers, librarians and advisers unaware unless read carefully.

Public document excludes ordinary internet documents. The definition of “public document” expressly excludes a document on the Internet (s 4(1)(b)(i)). That means the deposit duty in s 8 does not, as written, apply to ordinary internet material. Internet material has been treated separately as “WA Internet document” under s 5. Given that the Act’s deposit mechanics for WA Internet documents appear to lie in provisions in Part 3 (which is uncommenced), publishers of internet content should not assume that s 8 covers their web publications. However s 18, which concerns assistance for WA Internet documents, is in force and can be used by the State Librarian to require preservation assistance even where full deposit mechanics await proclamation.

Part 3 uncommenced. Part 3 has not been proclaimed (uncommenced provisions table). Several cross‑references in the Act point to s 13 (which is in Part 3) in enforcement provisions (see ss 14 and 9 references to s 13). The absence of Part 3 in force creates an operational gap between the definition of WA Internet document (s 5), the assistance power for WA Internet documents (s 18), and a full deposit directive regime for internet content. Practically, this may mean the State’s ability to compel deposit of internet material is constrained until Part 3 is proclaimed, although assistance directions under s 18 can already be used.

Who is the publisher online? For WA Internet documents, “publisher” is the person who has control over the content of the website or part of the website where the document is located (s 4(1), publisher). The Act does not define “control”. In web ecosystems where content is uploaded by users, hosted by platforms, and moderated by intermediaries, determining who has “control” may be contested. A publisher might be an individual user, a platform operator, or a content owner; liability will turn on factual constructs the Act leaves undefined.

Residency and commissioning tests. A “public document” includes documents commissioned to be printed or produced outside the State by a person resident in the State or whose principal place of business is in the State (s 4(1)(a)(i)). That can capture cross‑border publishing arrangements: commissioning production outside WA does not evade the Act if the commissioning party’s residence or principal place of business is in WA. Conversely, publishers with non‑resident status might not be covered by the public document definition unless the regulations say otherwise.

Regulations can set format and access and can be restrictive. The Governor’s regulations can specify formats, quality and number of copies, and may limit access to deposited copies (s 19(2)-(3)). The regulations can, for example, require particular formats or allow the State Librarian to specify the format for a particular document (s 19(2)(f)). Publishers must be alert to the possibility that the Board may receive deposited copies but access to them may be limited by regulation.

Financial burden is on publishers, including for preservation assistance. Both deposit and assistance duties are “at the publisher’s own expense” (s 8; s 18(2)). If the State Librarian requires assistance involving technical work or provision of software, the publisher bears that cost unless an exemption is granted. The regulations may require the delivery of computer programs necessary to preserve and access deposits (s 18(7)), which could have intellectual property or operational implications for publishers.

Exemptions are cabinet‑style decisions by the State Librarian and are subsidiary legislation. The State Librarian’s power to exempt is broad, and orders are subsidiary legislation for Interpretation Act purposes (s 10(1), (4)). Exemptions can carry conditions and lapse when conditions are not observed (s 10(2)-(3)). The Act does not require that exemptions be publicly advertised beyond the Interpretation Act processes, so publishers seeking certainty should confirm any exemption regime with the State Librarian.

Penalties are modest but civil costs can be ordered. The monetary fines for individuals and bodies corporate are $1 000 and $5 000 respectively for non‑compliance with directions (s 9(5); s 18(6)). However, the Board may pursue civil orders under s 14 to recover the Board’s reasonable costs in obtaining copies, and the District Court may grant those orders and enforce them as judgments (s 14(1)(b), (4)). Costs orders might therefore exceed statutory fines in particular cases.

Prosecutions strictly controlled. Only the Board or a person authorised by the Board may commence criminal proceedings under the Act (s 16). This centralisation means third parties cannot directly bring prosecutions, which may limit external enforcement pressure on publishers.

Temporal identity of WA Internet documents. A WA Internet document is the document at a particular point in time, and if changed significantly becomes a different WA Internet document (s 5(2)). That temporal definition raises evidentiary questions for preservation: to meet deposit or assistance requirements the State Librarian must be able to capture the document at a defined point, and publishers must be prepared to provide versions or snapshots to reflect that temporal identity.

Overlap with other legal restrictions. The Act’s definition of “restriction” excludes legal restrictions recorded in or claimed for the document (s 4(1), restriction). That suggests that copyright and other legal rights are not treated as mere “restrictions” for the purpose of negating deposit obligations. The Act itself does not displace copyright; practical tensions between deposit obligations and intellectual property rights may emerge and will require careful management outside the text of the Act.

Publishers and advisers should translate the Act’s mechanics into operational practices. The following steps are grounded in the text and set out pragmatic actions to reduce compliance risk.

1. Determine whether you are a “publisher” and whether material you produce is a “public document” or a “WA Internet document”.

   • For print and non‑internet media, ask whether the document is printed or produced in the State, or commissioned to be printed outside the State by a person resident in WA or with principal place of business in WA, and whether one or more copies are published in the State (s 4(1), public document).
   • For internet material, apply s 5: a WA Internet document has a publisher resident in WA or whose principal place of business is in WA, or is taken to be such by the regulations. Identify who “has control over the content of the website or the part of the website” because that person will be the publisher for internet material (s 4(1), publisher).

2. Review the regulations and contact the State Librarian for format and copy requirements.

   • The number of copies, the timing for delivery (not less than 30 days where prescribed), the manner of delivery, format specifications, and quality requirements are to be prescribed by regulation or determined by the State Librarian under s 19 (s 19(2)(a)-(g)). Until you have the current regulations and any State Librarian preferences, you cannot be certain of technical compliance.

3. Maintain an internal register of publications and publication dates.

   • Because s 7 applies to public documents published on or after the operative day and because WA Internet documents are temporally defined (s 5(2)), maintain records of publication dates and versions for web content. This will support responses to any direction under s 9 or s 18 and helps establish timelines in the event of a Board inquiry.

4. Budget for deposit costs and potential assistance costs.

   • Deposit copies and the provision of assistance are explicitly “at the publisher’s own expense” (s 8; s 18(2)). Account for costs of producing the required number of copies, preparation of non‑print formats, and potential costs for providing technical assistance or copies of required programs should the State Librarian direct these under s 18(7).

5. Establish a point of contact for the State Librarian and retain proof of delivery.

   • Directions must be given in writing and signed by the State Librarian (s 9(3); s 18(4)). Keep contact details, retain copies of correspondence, and obtain receipts where the regulations or State Librarian provide for them (s 19(2)(i)). Subsection 19(2)(i) contemplates issuance of receipts and also circumstances where a receipt may not be required, so ascertain local practice with the State Librarian.

6. If you receive a direction from the State Librarian, act promptly.

   • Directions must specify a period of at least 30 days for compliance (s 9(4)(b); s 18(5)(c)). Failure to comply without reasonable excuse exposes the publisher to fines and civil or criminal proceedings (s 9(5); s 18(6)). If compliance is difficult, engage with the State Librarian promptly to seek clarification or request an exemption under s 10, where available.

7. Consider seeking an exemption where appropriate.

   • The State Librarian may exempt persons or classes from s 8 or specified regulatory provisions under s 10. Exemptions may be conditional and are subsidiary legislation subject to the Interpretation Act (s 10(1)-(4)). If the publisher’s business model or legal constraints render compliance impracticable, seek an exemption and document the basis.

8. For WA Internet documents, prepare for preservation assistance obligations.

   • Section 18 enables the State Librarian to direct publishers of non‑print and WA Internet documents to provide reasonable assistance to preserve and access deposited copies, and the regulations may require delivery of computer programs necessary to enable preservation and access (s 18(7)). Prepare plans for secure transfer of files, metadata, and, if necessary, executable or platform‑specific software components, including how to handle intellectual property or security concerns.

9. Audit hosting and control arrangements for web content.

   • Because the “publisher” for internet content is the person with control over website content (s 4(1)), organisations should map who exercises content control across hosted platforms, user‑generated content and third‑party platforms. Where control is shared or ambiguous, document governance arrangements to show whether a party is or is not the publisher for Legal Deposit Act purposes.

10. Keep records and seek legal or library advice if disputes arise.

    • If the Board issues a direction or initiates proceedings, the Act provides for District Court remedies and criminal proceedings subject to Board initiation (ss 14-16). Keep documentary evidence of publication decisions, distribution, and communications with the State Librarian. Early legal advice can assist with arguments on what counts as “reasonable assistance” or “reasonable excuse” for non‑compliance.

11. Monitor regulatory developments and Part 3 proclamation.

    • Substantive operational detail is likely to be set in regulations under s 19 and in Part 3 when proclaimed. Publishers should monitor official gazettes and the State Librarian’s guidance for any forthcoming regulations or changes to the WA Internet deposit regime.

12. Consider IP and security implications before providing software.

    • If a direction under s 18(7) requires a copy of a computer program, engage IP counsel and technical teams to assess disclosure risks, licensing terms, and secure transfer. The Act permits such a requirement but does not itself resolve interface with copyright or trade secret law; those matters must be managed in compliance with other legal obligations and, where necessary, through negotiated conditions with the State Librarian.

These steps are grounded in the Act’s text and aim to translate statutory obligations into manageable compliance practices for publishers. Where uncertainty remains, particularly on the status of WA Internet deposit obligations pending Part 3 proclamation, proactive engagement with the State Librarian and attention to regulations is the practical path to reduce enforcement risk.
