### 46 False or misleading statements > > (1)  A person shall not make a statement or representation orally or in writing, or provide a document, in relation to an application for legal aid, knowing or believing that the statement, representation or document is false or misleading. > > > > Penalty:  Fine not exceeding 50 penalty units. > > > (2)  Where – > > > > > > (a) a person is convicted of an offence under [subsection (1)](#GS46@Gs1@EN) ; and > > > > > > > (b) legal aid was granted; and > > > > > > > (c) the Commission incurred expenses in providing the legal aid – > > > > a court may, in addition to imposing a penalty in respect of the offence, order the person to pay to the Commission an amount equal to the amount of those expenses incurred by the Commission.
