52 Removal from office
(1) The Minister may remove a commissioner other than the chief
executive officer from office for misbehaviour or physical or mental
incapacity.
(2) If a commissioner other than the chief executive officer—
(b) is absent, except by leave of the Minister, from 3 consecutive
meetings of the commission; or
(c) fails to comply with the commissioner’s obligations under
section 55;
the Minister shall remove the commissioner from office.
(3) Subsection (2) does not apply to a commissioner if the commissioner
is a judge but, if a commissioner being a judge ceases to be a judge,
the Minister may terminate the commissioner’s appointment.
