LEGACY MINES REMEDIATION REGULATIONS 2024

The central concepts introduced or elaborated in the Regulations are the mining remediation levy, the reserved legacy mine site, and the infringement notice offence. The levy is a charge on mining operators calculated not by the extent of environmental harm or the size of the mine but by the amount of security already held under the Environment Protection Act 2019. This creates an interesting incentive: an operator who provides a larger security deposit faces a larger levy, which may discourage voluntary provision of security beyond the minimum required. The levy amount for a given operator can change from year to year if the held security changes, and the pro rata calculation for mid-year licences may produce uneven burdens. The concept of a reserved legacy mine site is central to the Act's intervention power. The Regulations supply the criteria that trigger that power: environmental harm or unacceptable risk, need for remediation, and a cost-benefit threshold ("time and cost involved ... warrants the reservation"). The last criterion is inherently subjective; no dollar value or hours threshold is given. This introduces uncertainty for land owners and title holders who may not know whether their site will be reserved. The procedure for declaration includes a mandatory 28-day public notice period and an invitation for submissions, but the Regulations do not require the Minister to respond to submissions or give reasons for rejecting them. This may reduce the practical value of the consultation. The infringement notice offence concept is standard for regulatory schemes: a person believed on reasonable grounds to have committed an offence can be given a notice offering expiation upon payment of a prescribed amount. Uniquely, the Regulations allow more than one infringement notice for the same offence to be given to the same person, and the person can expiate by paying under any one of the notices. This could create confusion about which notice to pay, particularly if the amounts differ (though the Schedule prescribes fixed penalty units per offence). The term "prescribed amount" means the monetary value of the number of penalty units in the Schedule, which is a standard drafting technique but means the actual dollar figure depends on the current value of a penalty unit under NT law. The definitions section borrows terms from the Mineral Titles Act 2010 (mineral title, title holder) and the Land Title Act 2000 (registered owner), pulling in concepts from land and mining law that may require cross-referencing.

The Regulations directly affect several groups. Mining operators are the primary targets of Part 2: they must pay the remediation levy, apply for instalments if they wish, and receive annual notice of the amount. An operator is defined by the Act, not the Regulations, but refers to the holder of an environmental (mining) licence. All operators with security held under the Environment Protection Act 2019 are captured, regardless of whether their site is actually causing environmental harm. This is a broad net: even compliant operators with clean sites must pay. The levy is not linked to actual remediation cost but to security held, so two operators with identical security pay the same levy even if one site poses far greater risk. The affected include registered owners of land on which a legacy mine site is proposed to be reserved. They receive notice of the proposal and can make submissions, but they have no veto or right to compensation under these Regulations (the Act may provide for compensation elsewhere). Title holders of mineral titles on the same land are similarly notified. These land owners and title holders bear the burden of access for remediation activities without necessarily receiving a direct benefit; the land might be rendered unusable for future mining or other purposes during remediation. The Regulations also affect the individuals named in an authorisation notice under Part 4: the authorised person (likely an officer of the Agency or a contractor) and the individual in charge of remediation activities. They must have their contact details and intended entry point on record, which imposes an administrative burden but provides certainty to land owners. Legacy mines remediation officers are empowered to issue infringement notices under Part 5; they must form a reasonable belief that an offence has occurred. The enforcement agency receives the prescribed amount and may take recovery action under the Fines and Penalties (Recovery) Act 2001 if payment is not made. The Chief Executive Officer can withdraw notices. Ultimately, the Regulations affect taxpayers who fund any shortfall in the levy regime, though the levy is designed to be industry-funded. Because the levy is tied to security held, it does not necessarily cover the full cost of remediating all legacy sites, particularly those without current operators. The Constitution and the Act's operation will determine whether the government bears the residual cost or seeks to recover from former operators.

The Regulations impose specific duties and confer distinct rights. The key duty is on mining operators to pay the levy as notified. The duty arises upon receipt of the Minister's written notice; the amount is not self-assessed. There is no right to dispute the calculation in the Regulations, though the Act may permit review. Operators have a right to apply for instalment payment. The Minister must approve or deny in writing, and if approved, must specify dates and amounts, with the final instalment due by 15 June. The Regulations do not set criteria for approval or denial, so the Minister has broad discretion. An operator denied instalments must pay the full amount by a date the Minister presumably sets (the Regulations do not state a default payment date for lump sums, only that the Minister gives notice of the amount; the Act likely sets the due date). Another duty is on the Minister before declaring a reserved legacy mine site: the Minister must publish a notice on the Agency's website for 28 days, give copies to the registered owner and title holder, and consider submissions. There is no duty to give reasons for the final decision or to respond to submissions, which limits accountability. The Minister must include specific content in the declaration and give copies to the owner and title holder. The Minister also must maintain a register of reserved legacy mine sites, with entries containing spatial coordinates, name, reason, and effective date. The Regulations give land owners and title holders the right to receive the proposal notice, the declaration, and any authorisation notice (but only if they are the registered owner or title holder; other affected persons such as adjacent land owners are not entitled to notice). They also have the right to make submissions in writing or by audio or video recording. Authorised persons have the right to enter land for remediation activities under the Act, but the Regulations require that a notice containing specified details be given (presumably to the owner or occupier). Individuals in charge of remediation must be named. For infringement notices, a person given a notice has the right to pay the prescribed amount within 28 days to expiate the offence and avoid court proceedings. They also have the right to elect to have the matter dealt with by a court by completing a statement of election and not paying. The notice must include a form for that purpose. If more than one notice for the same offence is given, the person may pay under any one of them. There is no duty to respond to multiple notices. The Chief Executive Officer has the power to withdraw a notice within 28 days and before payment, but there is no right for the person to request withdrawal. The Regulations do not create a right to a hearing or review of the decision to issue a notice.

Part 5 of the Regulations, together with the Schedule, establishes an infringement notice regime for three offences under the primary Act. The prescribed amounts, in penalty units, are: 2 units for an offence against s 24(5) of the Act, 10 units for s 26(4), and 5 units for s 28(2). The Regulations do not reproduce the text of those sections, but a reader would need to consult the Act to know what conduct is prohibited. The infringement notice can be given by a legacy mines remediation officer who believes on reasonable grounds that an offence has been committed. The notice must specify the person's name and address, the date, time and place of the offence, a description of the offence, the prescribed amount, and the enforcement agency to which payment is payable. It must also include a statement explaining expiation, the right to elect court proceedings, and possible enforcement under the Fines and Penalties (Recovery) Act 2001 if the person does nothing. Payment can be made electronically or by cheque, but payment is not effective until the amount is credited (for electronic) or the cheque is cleared on first presentation (for cheque). This timing matters because expiation is complete only when payment is received in accordance with the notice; a bounced cheque could lead to continued exposure. If the prescribed amount is paid in accordance with the notice, the alleged offence is expiated and no further proceedings can be taken. This is a final bar. If the person elects court, the infringement notice regime ceases to apply, and normal prosecution proceeds. The Chief Executive Officer may withdraw an infringement notice by written notice given within 28 days of issue and before payment. Withdrawal presumably means the notice is voided, but the Regulations do not bar re-issuance or subsequent prosecution. Notably, the Regulations permit more than one infringement notice to be given for the same offence to the same person, and the person may expiate by paying under any one of the notices. This could lead to confusion: if two notices with different prescribed amounts are issued (though the Schedule sets fixed amounts per offence), or if payment is made under one notice while another remains outstanding, the Regulations specify that expiation occurs under the paid notice. The Part does not prejudice the start or continuation of proceedings unless the offence is expiated. This preserves the enforcement agency's ability to prosecute even after a notice is issued, unless and until payment is made. The Part also does not require a notice to be given; officers retain discretion. The practical enforcement value of such small penalty units (2 units is currently about $300-400 depending on NT unit value) is questionable for serious environmental harm, but the regime is likely designed for minor procedural breaches rather than major contamination.

The Regulations explicitly reference several Northern Territory Acts. The mining remediation levy is calculated by reference to mining security held under the Environment Protection Act 2019. That Act governs environmental approvals for mining and requires security to be provided for rehabilitation obligations. By tying the levy to security held, the Regulations create a direct link between the regulatory burden under two separate Acts: an operator who negotiates a higher security under the EP Act will pay a higher levy under these Regulations. This may disincentivise operators from agreeing to security amounts that reflect actual risk, since doing so increases their annual levy. The definition of "mineral title" and "title holder" comes from the Mineral Titles Act 2010, which is the primary statute for mining tenure in the Northern Territory. A person holding a mineral title on or near a proposed reserved legacy mine site is entitled to notice and to make submissions. The definition of "registered owner" comes from the Land Title Act 2000, which means the person recorded on the Torrens register as proprietor of the land. This interaction clarifies who receives notifications but may exclude unregistered interests such as equitable owners or lessees who are not recorded on title. The Fines and Penalties (Recovery) Act 2001 is referenced in the infringement notice template statement: if a person does nothing in response to a notice, enforcement action may be taken under that Act, which provides mechanisms for registering fines and recovering them through enforcement processes including suspension of driver licences and property seizure. The primary Act, the Legacy Mines Remediation Act 2023, is the overarching statute; these Regulations are made under it. The Regulations define the criteria for declaring a reserved legacy mine site under s 14(1)(a), the procedure under s 14(1)(b), the content of the declaration under s 14(2)(a), and the register content under s 15(1) and (3). They also prescribe notice content under s 16(5) for authorisations. The Regulations do not purport to override any other law, but they create a parallel regulatory track distinct from the general environmental remediation powers under the Environment Protection Act 2019. Operators and land owners must navigate both regimes simultaneously. The interaction with the Mineral Titles Act 2010 may be significant: if a reserved legacy mine site overlaps with an existing mineral title, the title holder's rights to explore or mine could be affected, though the Regulations do not address priority or compensation. That would likely be governed by the primary Act or the Mineral Titles Act. The Regulations do not interact with Commonwealth laws such as the Environment Protection and Biodiversity Conservation Act 1999, but legacy mines with national environmental significance may also trigger Commonwealth obligations.

The Legacy Mines Remediation Regulations 2024 were made on 11 June 2024 as Subordinate Legislation No. 10 of 2024. They commenced on 1 July 2024, which is the same day as the commencement of the Legacy Mines Remediation Act 2023 (the Act commenced on that date by virtue of a notice in the Government Gazette G10 of 9 May 2024, and regulation 2 ties the commencement of the Regulations to the commencement of the Act). The Regulations have not been amended since they commenced. The endnotes show no amending legislation. The regulations are in their original form. This is unsurprising given the recent commencement date. There is no indication of pending amendments or transitional provisions. The Regulations are secondary legislation and can be amended by the Minister without a full parliamentary process (subject to disallowance). Any future amendment could change the levy calculation method, the criteria for reserved sites, the infringement notice amounts, or the schedule of offences. Users should check the current version of the Regulations periodically as amendment may occur without great public notice. The original version is as in force at 1 July 2024.

As of the date of the source text (1 July 2024), there is no litigation history associated with these Regulations. They have only just commenced. No court decisions have interpreted the provisions. The Regulations are too new to have generated any case law. However, the underlying Act may have been subject to litigation, but the source does not reference any cases. The Regulations themselves are administrative in nature and likely to be challenged, if at all, on grounds such as procedural fairness in the declaration of reserved sites or the calculation of the levy. The consultation procedure under regulation 7 may be a source of judicial review: the Minister must consider submissions but is not required to provide reasons, which could be challenged under the common law duty to give proper consideration. The delegation of discretion to approve instalments without criteria could also attract review. The infringement notice regime is standard and unlikely to generate novel litigation unless the definition of "reasonable grounds" is disputed or the interaction of multiple notices for the same offence leads to unfairness. Because the Regulations are subordinate legislation, their validity may be challenged if they exceed the regulation-making power under the Act. For example, if the Regulations impose a levy on an operator in a way inconsistent with the Act, a court could strike down the regulation. No such challenge has yet occurred. Potential litigants include mining operators, land owners, and environmental groups. The litigation risk is moderate given the financial impacts. Operators facing large levies or the reservation of their land for remediation may seek to challenge the administrative decisions. Legal practitioners should monitor any proceedings in the Northern Territory Supreme Court or the Northern Territory Civil and Administrative Tribunal (if the Act provides for merits review). The absence of litigation history to date is not a guarantee of future stability.

Several provisions in the Regulations contain traps for the unwary. The levy calculation is tied to the amount of security held under the Environment Protection Act 2019 on 1 July of each year. If an operator disputes the security amount or negotiates a variation during the year, the levy for that year is fixed on 1 July. Operators should ensure their security amount is correct before that date, since a reduction after 1 July will not reduce the levy. Conversely, an operator who increases security after 1 July may still pay the lower levy for that year. The pro rata calculation for mid-year licence grants is vague: it says the levy is calculated "on a pro rata basis by reference to the amount of security the mining operator must provide on the grant" but does not specify the fraction - presumably days remaining in the financial year divided by 365, but this is not stated. Operators should seek written clarification from the Minister. The instalment approval criteria are entirely unspecified, giving the Minister discretion to deny even a reasonable request. There is no right of review. For reserved legacy mine sites, the criterion "time and cost involved ... warrants the reservation" is subjective. The Minister may interpret this loosely, potentially designating sites where remediation will be fast and cheap, simply to get the regulatory framework started. Land owners and title holders should monitor the Agency website for proposed declarations, even if they are not the registered owner; if the mineral title holder is not current, notice may go to a company that no longer exists. The 28-day submission period may be inadequate for complex sites where technical reports are needed. Submissions can be in audio or video recording, but the Regulations do not require the Minister to provide transcription or acknowledge receipt. There is no obligation to give the submitter a copy of the final declaration, only to the registered owner and title holder. Under Part 4, a notice authorising remediation activities must include the name and contact details of the authorised person and the individual in charge. If either changes during the activities, a new notice may be required; failure to update may make the entry unauthorised. The map must clearly indicate location and boundaries; a vague map could lead to trespass claims. For infringement notices, if more than one notice is given for the same offence, the person must pay under at least one to expiate, but if they pay under one, the others are not automatically withdrawn. The Regulations say expiation occurs under the paid notice, but other notices may remain on record unless the agency reconciles them. The 28-day payment period runs from the date the notice is given, not received. If the notice is given by post, the person may have less time to act. Payment by cheque is risky: payment is not effected until the cheque is cleared on first presentation. If the cheque bounces, the person is still liable and may have missed the 28-day window. The Chief Executive Officer can withdraw a notice only within 28 days and before payment; after that, the notice cannot be withdrawn. A person who believes the notice was wrongly issued has no mechanism to seek withdrawal; they must either pay (expiating) or elect court. Finally, the Schedule prescribes penalty units for three provisions, but the Regulations do not define those provisions. Users must cross-reference the Act to know what s 24(5), s 26(4), and s 28(2) prohibit. One of those may be a strict liability offence, and a breach could be committed inadvertently.

Compliance with the Legacy Mines Remediation Regulations 2024 depends on which role a person or entity occupies. Mining operators must first ensure they are aware of the levy. The Minister is required to give written notice of the amount as soon as practicable after 1 July each year. Operators should verify that their contact details are current with the Agency and designate a person to receive the notice. Upon receipt, the operator must pay the levy in full by the due date (the Regulations do not specify a date for lump sum payment; the notice should include one). If the operator wants to pay by instalments, they must submit a written application to the Minister before the due date. The application should set out the proposed instalment schedule; the Minister will then approve or deny in writing. If approved, the operator must strictly adhere to the dates and amounts specified, with the final instalment by 15 June. Operators who receive a pro rata levy for a mid-year licence should confirm the calculation method with the Minister to avoid underpayment. Operators should keep records of all notices received and payments made for audit purposes. Operators should also monitor the Agency website for proposed reserved legacy mine site declarations. If an operator holds a mineral title on or near the proposed site, they are entitled to receive a copy of the notice. They should review the description, coordinates, and reason for reservation, and consider making a submission within 28 days. Submissions can be in writing or by audio/video recording; they should clearly state any objections or supporting information. If a site is declared reserved, the operator may be subject to access for remediation activities. They should ensure that any authorisation notice includes the required details before allowing entry. Land owners who are not operators face similar duties: they must keep their address with the Agency up to date to receive notices. They should review any proposed declaration and make submissions if they wish. They should check that the authorisation notice includes a map of the land and the proposed place of entry. If the entry point damages property or disrupts operations, the land owner should document and seek recourse under the Act (which may provide for compensation). Persons who receive an infringement notice must decide within 28 days whether to pay the prescribed amount or elect court. The safest course for minor alleged offences is to pay on time using a method that provides immediate cleared funds (direct debit rather than cheque). If the person believes they did not commit the offence, they should not pay; they should complete the statement of election and notify the enforcement agency that they elect court. The election must be made on the form provided in the notice. The person should keep a copy of the election and proof of sending. If they do nothing, enforcement under the Fines and Penalties (Recovery) Act 2001 may proceed. The Agency and its officers must comply with procedural requirements: the Minister must publish notices for 28 days and consider submissions before declaring a reserved site. Officers must have reasonable grounds before issuing an infringement notice and must include all required content. The Chief Executive Officer must act within 28 days to withdraw a notice if appropriate. The register of reserved legacy mine sites must be maintained with the specified information. Failure to follow these procedures may render decisions invalid and subject to judicial review.
