Legacy Mines Remediation Act 2023

Legacy mine site and legacy mine feature

• Legacy mine site is defined as land where mining activities were carried out but in respect of which no mining security is held under Part 7, Division 1A of the Environment Protection Act 2019 and where there is no current extractive mineral lease, extractive mineral permit, mineral authority, mineral lease or non‑compliant existing interest (s 4(1)). The Ranger Project Area is explicitly excluded (s 4(2)).
• Legacy mine feature is any plant, infrastructure, engineered feature or other feature (examples given, including waste rock dumps, pits, tailings storage facilities, portals, shafts) that was built or used for a mining activity, is no longer used for a mining activity, and in relation to which no mining security is held under the Environment Protection Act 2019 (s 5).

Mining Remediation Fund

• The Fund is continued (s 7(1)). Interest on money held in the Fund is to be paid into the Fund (s 7(2)). Regulations can prescribe matters in relation to the Fund (s 7(3)).
• The Fund’s statutory purpose is to hold money in trust for the Agency to be used in connection with minimising or remediating environmental harm caused by mining activities on legacy mine sites or by legacy mine features and to conduct related investigations and research (s 8(1)). The Act explicitly forbids using the Fund to carry out remediation for environmental harm where mining security is held or where the mining operator for the relevant mining site caused or contributed to the harm (s 8(2)).

Mining remediation levy

• The levy is a tax on mining activities levied to provide revenue for the Fund and for effective administration of this Act (s 12(1)). The Part does not apply to operators carrying out mining activities under an environmental (mining) licence relating to the Ranger Project Area (s 11).
• A mining operator carrying out mining activities under an environmental (mining) licence must pay an annual levy equal to 1% of the mining security provided by the operator, subject to a regulatory Minister-set minimum threshold rule with a particular statutory effect (s 13(1)-(4)). The levy is non-refundable and failure to pay is a strict liability offence (s 13(5)-(7)).

Ministerial authorisation and statutory preclusion

• The Minister may authorise persons to carry out specified remediation activities and enter land for that purpose (s 16). Authorisations can include a waiver of other statutory approvals prescribed by regulation, allowing the authorisation-holder to perform the activity without obtaining those approvals and without incurring penalty under the governing Act (s 20(1)-(4)). Before granting such an authorisation, the Minister must notify and allow at least 10 business days for comment from the statutory decision-maker who ordinarily grants the prescribed approval, except in cases of immediate risk where notice is to be provided as soon as practicable after authorisation (ss 21-22).

Powers of entry and duties

• An authorised person may enter land with consent, after giving at least 10 business days written notice, or in an emergency (s 16(3)-(4)). On entry, the authorised person may take actions reasonably required to carry out the remediation activity, including excavation, bringing in equipment, making records and sampling (s 17). The authorised person must take reasonable steps to minimise disruption and not remain longer than reasonably necessary (s 18).

Legacy mines officers and their powers

• The CEO may appoint legacy mines officers (s 23). They receive identity cards (s 24), perform inspection, audit and investigative functions (s 25), and can enter land or premises (subject to notice) including Aboriginal land without an Aboriginal Land Act permit (s 26(1)-(3)). They can require assistance and information (s 26(1)(b)-(c)), with failure to comply an offence (s 26(4)-(5)).

Registers, reserved sites and reporting

• The Minister may declare legacy mine sites to be reserved legacy mine sites (s 14). The CEO must maintain a public register of reserved legacy mine sites and may maintain a public register of other legacy mine sites and features (s 15). The CEO must publish an annual statement on Fund operations with specific details by 31 October following each financial year (s 10).

Enforcement, liabilities and procedural constraints

• Offences include obstruction of authorised persons or legacy mines officers (ss 19, 27). Strict liability offences include levy non-payment and some information failures (ss 13(6)-(7), 26(4)-(5), 28(2)-(3)). Part IIAA of the Criminal Code applies to offences under the Act (s 6). Protection from liability for the CEO, legacy mines officers and assistants applies where acts are done in good faith (s 29).

Repeal and continuity

• The Act repeals the Mining Management Act 2001 and certain amending Acts (s 32). The Fund established under the Mining Management Act 2001 is continued under this Act (s 7(1)).

These are the main statutory building blocks and the express constraints on use of public money. The Act mixes targeted levies on present operators with executive authorisation powers to remediate legacy sites where no current title or security exists.

Payors and potential payors

• Mining operators who carry out mining activities under an environmental (mining) licence are the primary payors of the mining remediation levy (s 13(1)). The Part imposing the levy does not apply in relation to an operator whose activities relate to the Ranger Project Area (s 11). The levy base is tied to the operator’s mining security (s 13(2)). The Minister can set a minimum levy amount by Gazette notice with a statutory effect that if the calculated levy is below that minimum the operator is not required to pay (ss 13(3)-(4)). The levy is non‑refundable (s 13(5)).

Owners and occupiers of land

• Owners and occupiers of legacy mine sites, land with legacy mine features, or land affected by legacy mine sites or features will be directly affected by authorised entry, excavation and works (ss 16-18, 17(2)(b)). The Act limits entry to non-residential premises (s 16(2)). Owners/occupiers may be required to provide assistance or information to legacy mines officers (s 26(1)(b)-(c)) and an owner or occupier who does not comply can commit a strict liability offence (s 26(4)-(5)). Where an authorised person exercises entry powers under ministerial authorisation, the owner or occupier must be given at least the statutory notice or consent obtained, except in emergencies (s 16(3)-(4)).

Current and historic mining operators

• Current operators who hold mining security are excluded from having their sites classified as “legacy” (s 4(1)). The Fund may not be used to remediate environmental harm for which mining security is held, nor harm caused by the mining operator for the site (s 8(2)). That allocates costs for remediation of past harm without mining security to the Fund, financed by current operators under the levy. Historic operators (those who no longer hold security and whose sites meet the legacy definition) are the indirect focus of remediation activities, although the Act does not require those historic operators to pay, remediation is funded through the Fund and authorised actions (ss 4-5, 7-9).

Contractors, consultants and researchers

• The Fund may be used to pay for investigative and remediation activities, monitoring, revegetation, stabilisation, clean up, public health mitigation, research and to provide incentives to parties to facilitate remediation (s 9(2)-(3)). Those provisions create procurement opportunities for remediation contractors, environmental consultants, researchers and service providers.

Regulatory decision-makers under other Acts

• The Act allows the Minister to authorise remediation activities that would otherwise require approvals under other Acts (s 20). Where the Minister proposes to grant such an authorisation, the Minister must notify and consider written comments from the statutory decision-maker who normally grants the approval, and must give at least 10 business days for comment (s 21). In emergency cases of imminent risk, notice is to be provided as soon as practicable after authorisation (s 22). Statutory decision-makers therefore will be consulted but do not have a veto under the Act.

Community and the public

• The Chief Executive Officer must publish an annual statement on the Fund’s operations (s 10), and the CEO must maintain a public register of reserved legacy mine sites and may maintain registers of other legacy mine sites and features (s 15). Members of the public are therefore beneficiaries of transparency obligations and may be consulted in reserved-site declaration processes if regulations require it (s 14(2)).

Aboriginal landholders

• The Act expressly permits legacy mines officers to enter land that is Aboriginal land without holding a permit under the Aboriginal Land Act 1978 (s 26(3)(b)). Entry remains subject to the statute’s prior written notice requirement (s 26(2)). The interaction with Aboriginal land rights legislation is explicit in the power provision and therefore affects Aboriginal landholders where legacy mine sites or features are located on Aboriginal land.

Who decides and who enforces

• The Minister has gatekeeping power to authorise remediation activities and to declare reserved legacy mine sites (ss 14, 16). The CEO administers the Fund, publishes the annual statement and maintains registers (ss 7, 10, 15). Legacy mines officers carry out inspections and on-ground enforcement functions (ss 23-26). Criminal and civil enforcement uses Part IIAA Criminal Code and specified penalty regimes set out in the Act (s 6; see penalty provisions across Pt 5-7).

In summary, the Act places payment obligations on current licensed mining operators; gives the Minister and the Agency primary decision-making control over remedial prioritisation and execution; grants powers to legacy mines officers to access, inspect and require assistance on private and Aboriginal land; and creates public reporting and register obligations that affect a wider public and commercial audience.

Duties imposed on payors

• Mining operators holding environmental (mining) licences must pay the annual mining remediation levy determined under s 13 in accordance with the Act and regulations (s 13(1)). The annual levy is generally 1% of the mining security provided by the operator (s 13(2)). The Minister may set a minimum levy amount, but under the statute a computed levy below that minimum results in no obligation to pay (ss 13(3)-(4)). The levy is non-refundable (s 13(5)). Failure to pay the levy where required is a strict liability offence with a maximum penalty of 200 penalty units (s 13(6)-(7)); unpaid levies become debts recoverable in court (s 13(8)).

Duties on owners, occupiers and third parties when authorised activities occur

• An authorised person may only enter with consent, after giving at least 10 business days written notice, or in an emergency (s 16(3)-(4)). On entry, the authorised person may carry out reasonably required actions, including excavation, bringing in equipment, sampling, and making records (s 17(1)-(2)). The authorised person must take reasonable steps to minimise disruption and not remain longer than reasonably necessary (s 18). Persons are criminally liable for intentionally obstructing an authorised person (s 19). Legacy mines officers can require assistance and information, and failing to comply with such a requirement is a strict liability offence (s 26(1)(b)-(c), (4)-(5)).

Duties to provide information to Minister and officers

• The Minister may require an operator to provide specified information about a legacy mine feature located on the operator’s mining site within a time specified (s 28(1)). Non-compliance with such a notice is a strict liability offence with a maximum penalty of 50 penalty units (s 28(2)-(3)). Legacy mines officers may also require information reasonably necessary for their functions (s 26(1)(c)).

Administrative duties and transparency

• The CEO must prepare an annual statement on Fund operations for each financial year detailing the specific purposes for money paid out and the activities carried out for those purposes; the statement must be published on the Agency’s website by 31 October following the end of the financial year (ss 10(1)-(3)). The CEO must maintain and publish a public register of reserved legacy mine sites and may maintain registers of other legacy sites or features (s 15).

Ministerial and executive discretion rights

• The Minister has the right to authorise persons to carry out remediation activities and to enter land; to grant those authorisations without the usual statutory approvals in prescribed circumstances (s 16(1), s 20); and to declare reserved legacy mine sites after following prescribed regulatory criteria and procedures (s 14(1)). The Minister must notify statutory decision-makers and consider written comments in non‑emergency cases (s 21); in imminent risk cases, notice follows authorisation and must be given as soon as practicable (s 22).

Rights of persons subject to entry and remediation

• Owners and occupiers have the right to be given the prescribed notice before entry in non‑emergency situations (s 16(3)), and the Act prohibits entry to residential premises (s 16(2)). An authorised person must take reasonable steps to minimise disruption and not remain longer than necessary (s 18), which creates a statutory expectation of limited interference during remediation activities.

Protections and limits on liability

• Persons acting in good faith in the exercise of powers or the performance of functions as the CEO, a legacy mines officer, or an assistant to a legacy mines officer are not civilly or criminally liable for acts or omissions (s 29(1)). That protection does not affect liability the Territory would have otherwise had (s 29(2)). The Act also applies Part IIAA Criminal Code rules to offences (s 6), so general defences and criminal responsibility principles in that Part apply.

Limits on legal challenge

• A declaration of a reserved legacy mine site cannot be challenged in legal proceedings commenced later than 6 months after publication of the declaration in the Gazette (s 14(3)). This imposes a statutory time limit as to when judicial review or other legal proceedings may be commenced.

Summary

• Duties fall on licensed mining operators (levy payment, information requests), land owners/occupiers (access and assistance obligations), legacy mines officers (inspection, reporting), and the Minister/CEO (fund administration, authorisations, registers, reporting). Rights include access to notice before entry, limits on entry to residential premises, protections for public officers acting in good faith, and limited windows for judicial challenge of reserved-site declarations. Several offences are strict liability; obstruction and some refusals to provide assistance attract higher penalties.

Overview of penalty structure

• The Act establishes a mix of strict liability offences and offences subject to general fault elements, with maximum penalties defined in penalty units and, in some cases, imprisonment. Part IIAA of the Criminal Code applies to offences under the Act (s 6), so the general principles of criminal responsibility and defences in that Code Part are applicable, subject to the Act specifying strict liability where it does.

Specific penalty provisions

• Failure to pay the levy when required under s 13 is an offence with a maximum penalty of 200 penalty units (s 13(6)). Subsection (7) makes this offence one of strict liability.
• Obstructing an authorised person from carrying out a remediation activity is an offence if the conduct is intentional and the defendant is reckless as to the obstruction; the maximum penalty is 200 penalty units or 12 months imprisonment (s 19(1)). There is a defence if the defendant can prove reasonable steps and due diligence to prevent commission of the offence; the defendant bears the legal burden of proof for that matter (s 19(2)-(3)). The section also defines “obstruct” to include hinder and resist (s 19(4)).
• Obstruction of a legacy mines officer is an offence with a maximum of 200 penalty units or 12 months imprisonment (s 27(1)). The subsection applying the strict liability label to the legacy mines officer element (s 27(2)) indicates a narrower strict liability application.
• Failure to comply with a requirement to provide assistance or information to a legacy mines officer is an offence with a maximum of 100 penalty units (s 26(4)). That offence is one of strict liability (s 26(5)), but it is a defence if the defendant establishes a reasonable excuse; the defendant bears the legal burden of proof on that matter (s 26(6)-(7)).
• Failure to return an identity card upon ceasing to be a legacy mines officer attracts a maximum penalty of 20 penalty units and is an offence of strict liability (s 24(5)-(6)).
• Failure by an operator to comply with a Ministerial notice to provide specified information about a legacy mine feature is an offence with a maximum penalty of 50 penalty units and is strict liability (s 28(2)-(3)).

Enforcement path and debt recovery

• Any unpaid part of the levy is a debt due and payable to the Territory and may be recovered in a court of competent jurisdiction (s 13(8)). The Act does not set out administrative withholding powers in the excerpt provided but creates a statutory debt and an offence for non-payment.

Scope of enforcement actors

• Legacy mines officers have powers to require assistance and information, enter land subject to prior written notice, and inspect and investigate legacy mine sites and features (ss 23-26). The Chief Executive Officer is responsible for fund reporting and registers and is the employing authority for legacy mines officers. The Minister has discretion to delegate powers (s 30), which may affect which public official enforces particular duties.

Protections that affect enforcement risk

• The Act provides protection from civil or criminal liability for the CEO, legacy mines officers and persons assisting them when acts are done in good faith in exercise of power or performance of functions (s 29(1)). This reduces personal liability risk for public officers undertaking remediation and enforcement but preserves liability the Territory would have had (s 29(2)).

Implications for compliance and enforcement strategy

• The presence of multiple strict liability offences (levy non-payment, refusal to provide information, failure to comply with officer requirements) increases compliance risk for operators and property owners because fault need not be proven. The higher penalties attached to obstruction powers (including potential imprisonment) create a deterrent against interfering with authorised entry or officer activities (ss 19, 27). The debt-recovery route for unpaid levies (s 13(8)) provides a civil enforcement backstop. The Act’s incorporation of Part IIAA of the Criminal Code (s 6) means ordinary criminal defences remain available where fault elements apply.

Overall, enforcement is structured to prioritise effective collection of the levy, facilitation of entry and remediation, and a relatively strict compliance regime for information and assistance obligations, balanced by statutory protections for public officers acting in good faith.

Relationship with the Environment Protection Act 2019

• The Act repeatedly references the Environment Protection Act 2019 for key concepts: the definition of “environment” (s 3), “environmental harm” (s 3), “environmental (mining) licence”, “mining activity” and “mining security” (s 3). The Act excludes sites where mining security is held under the Environment Protection Act 2019 from the definitions of legacy mine site and legacy mine feature (ss 4(1), 5(c)), and expressly prevents use of the Fund to carry out remediation for environmental harm where mining security is held (s 8(2)(a)). That creates an operational boundary: where mining security exists under the Environment Protection Act 2019, the remediation and funding model set out in this Act does not apply.

Pre-emption of approvals under other Acts

• The Minister may authorise remediation activities that would otherwise require a statutory approval prescribed by regulation, and that authorisation permits the person to carry out the activity without obtaining the prescribed statutory approval (s 20(1)-(2)). The person “incurs no liability to a penalty under the Act governing the statutory approval” for complying with s 20(2) (s 20(3)), and subsections (2)-(3) have effect despite anything to the contrary in the Act governing the statutory approval (s 20(4)). Those provisions create a statutory pre-emption: where a Ministerial authorisation under this Act covers an activity, the authorisation can negate otherwise applicable licensing or approval requirements under another Act. However, the Minister must notify the statutory decision-maker and allow at least 10 business days for comment before granting such an authorisation (s 21), and must notify as soon as practicable after authorising in imminent-risk cases (s 22). This establishes consultation and post-authorisation notice duties, not a requirement to obtain the other Act’s approvals.

Interaction with the Mineral Titles Act 2010

• The definition of legacy mine site expressly refers to the absence of various tenure instruments under the Mineral Titles Act 2010 (extractive mineral lease, extractive mineral permit, mineral authority, mineral lease, non‑compliant existing interest) (s 4(1), (3)). The Act’s note references s 64A of the Mineral Titles Act 2010, which provides that an application for a mineral title may not be made for land that is a reserved legacy mine site (note to s 14(1)). The reserved legacy mine site declaration therefore interacts with title application processes under the Mineral Titles Act 2010.

Interaction with Aboriginal Land Act 1978

• The Act allows legacy mines officers to enter land that is Aboriginal land without holding a permit under the Aboriginal Land Act 1978 (s 26(3)). That provision creates a specific override of permit requirements for legacy mines officers and therefore deliberately interacts with Aboriginal land permit regimes. The Act retains a prior written notice requirement for entry (s 26(2)), but the statutory power to enter without an Aboriginal Land Act permit is explicit.

Continuity with Mining Management Act 2001

• The Mining Remediation Fund established under the Mining Management Act 2001 is continued (s 7(1)), but the Act repeals the Mining Management Act 2001 and its amending Acts (s 32). The continuation provision implies a statutory continuity mechanism for the Fund while replacing the prior Act’s broader framework.

Criminal law

• Part IIAA of the Criminal Code applies to offences under this Act (s 6). That embeds general criminal responsibility rules, defences and burden allocation found in the Criminal Code into enforcement under the Act.

Regulatory architecture and delegated instruments

• The Act delegates power to the Administrator to make regulations (s 31). Regulations may prescribe matters in relation to the Fund (s 7(3)), the levy (s 12(2)), reserve-declaration procedures and criteria (s 14(2)), notice content for entry (s 16(5)), and register content (s 15(3)). The wide scope for regulations means that the Act anticipates implementing detail will appear in subordinate legislation, which will interact with the statutory contours established here.

Implications

• The Act is designed to operate alongside, and in some respects override, specific approval regimes under other legislation where the Minister uses the s 20 pathway. It builds on definitions and enforcement tools from the Environment Protection Act 2019, interacts with the Mineral Titles Act 2010 on land status and title applications, permits entry to Aboriginal land without Aboriginal Land Act permits for legacy mines officers, and continues a Fund from the repealed Mining Management Act 2001. Practitioners should therefore examine connected statutory schemes and subordinate instruments (regulations) to understand the full regulatory and approval landscape for any proposed remediation activity.

Statutory commencement and subsequent technical amendments

• Assent date and commencement: The Act (Act No. 35, 2023) received assent on 6 December 2023 and commenced on 1 July 2024 (Gazette notice referenced in the endnotes) (endnotes item 2). The Statute Law Revision and Repeals Act 2026 (Act No. 3, 2026) received assent on 9 February 2026 and commenced on 10 February 2026 (endnotes item 2).
• Repeal of prior legislation: Section 32 of the Act repeals the Mining Management Act 2001 and its 2011 and 2013 amendment Acts, bringing those regimes to an end and continuing the Mining Remediation Fund under this Act (s 7(1) and s 32).

Listed amendments in endnotes

• The endnotes list a specific amendment: s 4 was amended by No. 3, 2026, s 64 (endnotes item 3). The endnotes also indicate that Part 9 headings and various sections (ss 33-36, sch) were repealed by No. 35, 2023, s 36 , the text of the Act as presented notes those repeals in the endnotes (endnotes item 3).

Implications of repeals and continuity

• The Act repeals the prior Mining Management Act 2001 but continues the Mining Remediation Fund that was established under it (s 7(1) and s 32). That suggests continuity for fund monies and obligations previously held under the repealed Act, while centralising the statutory authority for remediation and levy collection in the new Act. Practitioners should review transitional and savings provisions in the repealing instruments and any regulations made under this Act to trace how existing fund balances, accounts, and contractual or security arrangements are treated in practice. The Act text provided does not include detailed transitional provisions; where the repealing legislation or regulations set out transitional mechanics, those will be important to consult.

Regulatory detail to follow by subordinate instrument

• The Act contemplates regulations to prescribe matters in relation to the Fund (s 7(3)), the levy (s 12(2)), reserve declaration procedures (s 14(2)), the notice content for entry (s 16(5)), register content (s 15(3)) and annual statement details (s 10(2)). The practical operation of many parts therefore depends on delegated regulations and Gazette notices, including the Minister’s minimum levy amount (s 13(3)).

Practical note for advisers

• Because the Act both repeals previous mining management legislation and leaves much implementation detail to regulation and Ministerial notice, practitioners should monitor subordinate instruments and Gazette notices for consequential changes, including the Minister’s minimum levy notice, the regulations prescribing statutory approvals that can be dispensed with under s 20, and regulations setting criteria and procedures for reserved legacy mine sites. The endnotes indicate at least one amending instrument in 2026 altering s 4; practitioners must track further amendments and any operative transitional provisions in the Statute Law Revision and Repeals Act 2026 or subsequent instruments.

Reported cases and judicial consideration in the text

• The statute text provided contains no references to case law and names no judicial decisions. The endnotes list amendment and repeal instruments but do not record litigation. Therefore, based on the Act text alone, there is no litigation history recorded within the instrument.

Potential litigation vectors suggested by the Act (procedural and substantive risks)

• Time-limited challenges to reserved-site declarations: Section 14(3) provides that a declaration cannot be challenged in legal proceedings commenced later than 6 months after Gazette publication. That creates a constrained window for judicial review or other proceedings, which could give rise to litigation initiated promptly following the publication of a declaration. Legal challenges could address whether the Minister complied with prescribed regulatory procedures or applied the correct criteria (s 14(1)(a)-(b)), but the limitation period limits the period within which such claims can be launched.
• Pre-emption of other statutory approvals: Section 20 allows the Minister to authorise activities that would ordinarily require approvals under other Acts and to permit those activities to proceed without those approvals. A statutory decision-maker or affected third party might litigate the scope or lawfulness of an authorisation where the Minister failed to comply with the notice and consultation requirements in s 21 before authorising, or where the authorisation is alleged to be ultra vires. The Act requires pre-authorisation notice and consideration of written comments (s 21), but does not require agreement. In imminent-risk cases (s 22), the post-authorisation notice requirement could be the focus of litigation about whether the Minister genuinely had reasonable grounds for imminent risk.
• Use of powers over Aboriginal land: Section 26(3) permits entry onto Aboriginal land without an Aboriginal Land Act permit. Affected Aboriginal landholders may litigate the exercise of entry powers if they assert statutory or common law rights have been breached, or if there is non-compliance with the Act’s notice requirements (s 26(2)) or other statutory duties. Litigation could examine the interaction with the Aboriginal Land Act 1978 and whether the Act’s override is properly exercised.
• Strict liability provisions: The imposition of strict liability offences (for levy non-payment, refusal to provide information, failure to comply with officer requirements) may generate constitutional or administrative law argument in appropriate cases about fairness or the proper construction of the offence provisions, although strict liability is a commonly used construct in regulatory statutes. Challenges could concern interpretation and whether particular conduct falls within the statutory definitions (for example, whether a person “obstructs” a legacy mines officer (defined to include hinder and resist) (s 19(4), s 27(3))).
• Crown liability and protections: Section 29 provides that specified public officers are not civilly or criminally liable for acts done in good faith, but preserves liability that the Territory would have had (s 29(2)). Litigation could focus on whether an act was done in good faith, whether the Territory’s liability is preserved, or whether statutory immunity extends beyond what the Act provides.

No specific cases named

• Because the Act text contains no cited decisions, commentators and practitioners must look to subsequent reported decisions (post-enactment) or to parallel litigation in comparable jurisdictions for interpretative guidance. The Act’s incorporation of Part IIAA of the Criminal Code (s 6) means criminal defences and other interpretative issues will be addressed under established criminal law principles.

Practical litigation considerations

• Time-critical litigation is clearly implicated by the 6‑month bar on challenging reserved-site declarations (s 14(3)). Parties contemplating judicial review or other proceedings will need to assess and act swiftly if a reserved declaration is published. Similarly, operators or third parties affected by Ministerial authorisations issued under s 16 (and operating under the s 20 approval waiver) should track notice periods (10 business days under s 21) and the timing of authorisations to preserve review rights. Finally, because many operational details are left to regulations and Gazette notices, litigation may often target the lawfulness of delegated instruments or administrative action implementing the Act.

Counterintuitive minimum-levy effect

• The Minister’s power to determine a minimum levy amount by Gazette notice has a statutory effect that is the opposite of what a practitioner might expect: if the 1% levy calculated under s 13(2) is less than the Gazette minimum, the operator is not required to pay the levy (s 13(3)-(4)). Put bluntly, the “minimum” operates as a floor threshold for exemption, not as a minimum payable amount. This drafting quirk can create an effective de‑minimis threshold that exempts small securities from levy payments. Operators and advisers must check the Gazette notice to know whether they fall below the threshold.

Levy base tied to mining security

• The annual levy is indexed to the mining security provided by the operator (s 13(2)). Because mining security is defined and managed under the Environment Protection Act 2019, levy amounts depend on another Act’s mechanics. Advisers must assess how mining security is calculated and updated under the Environment Protection Act 2019 to anticipate levy liability; that requirement complicates forecasting levy exposure.

Exclusion of sites where mining security exists

• The Fund cannot be used for remediation of environmental harm where mining security is held (s 8(2)(a)) and legacy mine site and feature definitions exclude places where mining security is held (ss 4(1), 5(c)). That implies that some contaminated or hazardous infrastructure on sites where security exists will not be eligible for Fund money, which may leave some remediation responsibility with current operators under the Environment Protection Act 2019 rather than the public Fund.

Ministerial pre-emption of statutory approvals

• Section 20 permits authorised remediation activities to proceed without otherwise applicable statutory approvals under other Acts, and grants that the person incur no penalty under the Act governing the approval for complying with s 20(2)-(4). That changes the usual regulatory pathway for approvals and can reduce procedural safeguards for third parties. Although s 21 mandates notice and an opportunity to comment from the statutory decision-maker, comments are consultative and the Minister retains discretion. Parties relying on normal approval pathways should be aware their usual approval process can be displaced by a Ministerial authorisation.

Limited challenge window for reserved-site declarations

• A declaration under s 14(1) “cannot be challenged in any legal proceedings commenced later than 6 months after the date the declaration is published in the Gazette” (s 14(3)). That provides a relatively short limitation window for judicial review or other proceedings, so affected parties must monitor Gazette publications and act promptly.

Entry to Aboriginal land without permit

• Legacy mines officers may enter Aboriginal land without an Aboriginal Land Act 1978 permit (s 26(3)(b)). That power overrides a statutory permitting requirement in respect of Aboriginal land and may raise sensitive land-rights and procedural concerns. The entry remains conditional on prior written notice (s 26(2)), but interested persons should not assume a separate Aboriginal Land Act permit is required for an authorised entry by a legacy mines officer.

Strict liability offences and civil liabilities

• Several operational offences are strict liability (s 13(7), s 26(5), s 28(3)). Strict liability reduces the mental element required for conviction, increasing compliance risk. Conversely, protection from liability for officers acting in good faith is limited and does not remove potential Territory liability (s 29(1)-(2)). There is no express private compensation scheme in the Act for landowners whose property is affected by remediation works carried out under authorisation; claims for damage would be subject to ordinary law or to any statutory compensation regime under other legislation, if any.

No explicit compensation or restoration obligations set out for owners or occupiers

• The Act allows authorised persons to dig up land and to carry out works and to bring in machinery (s 17) but the text does not set out an express statutory entitlement to compensation for owners or occupiers for land disturbance, loss of use, or damage. The only express protection is for officers acting in good faith (s 29). Affected landowners and occupiers should assess potential compensation claims under common law or other statutory regimes.

Non-residential premises entry restriction

• The Act explicitly prohibits authorised persons from entering residential premises under this Act (s 16(2)). That restricts some remediation activity but may require alternative arrangements for contamination affecting residences.

Ministerial and regulatory discretion

• Many important design choices (criteria for reserved-site declarations, the content of notices, the list of statutory approvals that can be removed under s 20) are left to regulation and Gazette notice (s 7(3), s 12(2), s 14(2), s 16(5), s 15(3)). This shifts much implementation detail outside the Act’s text and introduces regulatory uncertainty until those instruments are made.

Register is permissive for non-reserved sites

• The CEO “may” maintain a public register of legacy mine features and legacy mine sites that are not reserved (s 15(2)). The non-mandatory nature of that provision means public transparency for non-reserved sites depends on executive choice and delegated regulations.

Practical consequence

• These “gotchas” translate into concrete operational risks: unexpected levy exemptions or obligations; displacement of approval pathways; constrained legal challenge windows; powers to enter Aboriginal land without usual permits; and limited clarity on compensation or restoration obligations following authorised works. Parties should read the Act concurrently with relevant regulations, Gazette notices, and the Environment Protection Act 2019 to build an operational compliance picture.

Governance and internal control steps for mining operators

• Determine levy exposure: Identify whether you carry out mining activities under an environmental (mining) licence and whether your activities relate to the Ranger Project Area (s 11). Calculate the annual levy as 1% of the mining security you hold (s 13(2)), and review the Gazette for any Ministerial minimum levy amount to establish whether you fall below the de‑minimis threshold and are exempt (ss 13(3)-(4)). Because the levy is non-refundable and failure to pay is a strict liability offence with a maximum penalty (s 13(5)-(7)), operators should implement accounting and control measures to ensure timely calculation, invoicing and payment of the levy in accordance with the regulations.

Information and notice response systems

• Establish processes to respond to Ministerial notices requiring information about legacy mine features on your mining site, with clear internal roles and timelines. A failure to comply with such a notice is a strict liability offence with a penalty (s 28(1)-(3)). Similarly, ensure legal and operational teams can respond to legacy mines officers’ requests for assistance or information, which are enforceable with strict liability penalties (s 26(1)(b)-(c), (4)-(5)).

Landowner and occupier readiness for authorised entry

• If you are an owner or occupier of land that is or may be a legacy mine site or contains legacy mine features, be prepared to receive notices of entry from authorised persons (s 16(3)). The Act requires at least 10 business days prior written notice in non-emergency situations, and emergency entry entitles authorised persons to give oral notice if possible and written notice within 10 business days after entry (s 16(3)-(4)). Maintain records documenting any consent given, notices received, and any disruptions experienced, and be prepared to engage with the Agency or authorised persons about scheduling remediation works in a manner that minimises disruption (s 18). Note that authorised persons may not enter residential premises under the Act (s 16(2)).

Engagement and documentation for Ministerial authorisations

• Where your organisation proposes or is invited to carry out remediation under a Ministerial authorisation, confirm whether the authorisation dispenses with other statutory approvals under s 20 and whether the statutory decision-maker has been given the opportunity to comment under s 21 (at least 10 business days). Document any consultation, approvals, or authorisations carefully because s 20 permits activities to proceed without otherwise applicable approvals, but the Minister must still follow notification procedures in ss 21-22.

Interaction with Aboriginal landholders

• If remediation activity affects Aboriginal land, anticipate that legacy mines officers may conduct entry without an Aboriginal Land Act permit (s 26(3)). Landholders and proponents should engage early and document consultation, seeking to negotiate access and timing given prior written notice obligations (s 26(2)). Consider cultural heritage, native title and other statutory obligations separately and coordinate with relevant authorities.

Contracting and procurement

• For entities intending to bid for remediation work funded by the Fund, build compliance with the Act into contractual terms: indemnities covering acts done in good faith (recognising s 29 gives statutory protection to officers, not private contractors), deliverable schedules aligning with notice periods, and clear scope for remediation works that involves excavation, waste handling, monitoring, revegetation and stabilisation as contemplated by s 9(2). Ensure insurance, OH&S and environmental controls are in place to manage the physical risks of works authorised under the Act (s 17).

Register and reporting monitoring

• Monitor the CEO’s public registers (s 15) and the Agency’s website for the annual Fund statement (s 10(3)). For operators with remediation obligations or third parties seeking Fund payments or incentives (s 9(3)(b)), track reporting requirements and public register listings to align proposals for remediation funding with the Agency’s priorities set out in the registry and annual statement.

Legal and policy steps for prospective claimants and landholders

• If you anticipate contesting a reserved legacy mine site declaration, note the 6‑month limit for commencing legal proceedings after the Gazette publication (s 14(3)). Prepare early to preserve evidence and file timely legal proceedings where appropriate. For rights protection against potential adverse works, document the land’s condition carefully and obtain legal advice early when notice of proposed entry is received.

Operational checklists

• Payment: Confirm levy calculation and payment processes; maintain evidence of payment.
• Notices: Track and store written notices received under ss 16, 21, 22, 28.
• Access: Maintain point-of-contact details for authorised persons and legacy mines officers; establish health and safety induction procedures for visiting authorised personnel and contractors.
• Information compliance: Create a repository for technical reports and legacy feature data to respond promptly to information requests from the Minister or legacy mines officers.
• Legal monitoring: Monitor Gazette notices for minimum levy amounts and publication of reserved legacy mine site declarations; set calendar alerts for the 6-month challenge window.

Regulatory watch and liaison

• Because the Act depends on regulations and Gazette notices for implementation detail (ss 7(3), 12(2), 14(2), 16(5), 15(3)), entities should maintain a regulatory watch and proactively engage with the Agency and Minister’s office when affected. Consider pre-emptive consultation and submissions where regulations affecting notice content, reserve-declaration criteria and the list of statutory approvals to be dispensed with under s 20 are in draft.

Summary

• Compliance requires a mix of financial controls (levy), record-keeping and fast-response systems for notices and information requests, proactive engagement with the Agency and Minister’s processes, and practical site management to facilitate authorised remediation works while preserving rights and potential compensation claims under other laws. Legal advice should be sought where authorisations dispense with statutory approvals, where Aboriginal land is involved, or where reserved-site declarations are made.
