23 Lease costs
(1) Each party to a lease, or negotiations for a lease, must bear the party’s
own costs in relation to the preparation of the lease.
(2) However, if a party requires the lease to be registered under the Land
Titles Act 1925, the party must pay any fee for registration of the
lease.
(3) For this section, if the lessor has a mortgagee, lessor’s costs include
any fee for, or incidental to obtaining, the mortgagee’s consent to the
lease.
Note If the lessor requires the lease to be registered, the lessor must pay the
costs under s (2) also.
