140 Tenants trading outside core trading hours
(1) The tenant may trade outside the core trading hours of the shopping
centre with the lessor’s agreement provided that the tenant meets the
costs associated with opening and operating the shopping centre for
the additional hours, including any costs of advertising and
promotion.
(2) A cost met by the tenant under subsection (1) must be proportionate
having regard to the costs of opening and operating the shopping
centre and the number of other tenants who are trading outside the
core trading hours with the tenant.
