10 What is a continuous occupation lease?
(1) A continuous occupation lease is a lease for premises for a term of
less than 6 months if—
(a) the tenant was in occupation of the premises with the owner’s
consent when the lease was entered into; and
(b) the tenant has been in continuous occupation of the premises
with the owner’s consent for at least 6 months.
(2) However, a proposed lease is not a continuous occupation lease.
