Law Officers Act 1978

The Act organises three discrete but related law‑officer concepts: the Attorney‑General, the Solicitor for the Northern Territory (Crown Solicitor equivalent), and the Solicitor‑General. Each office has distinct legal status, functions and personnel rules.

Attorney‑General (s 5-7)

• Concept: the political or ministerial office holder designated by the Administrator under the Northern Territory (Self‑Government) Act 1978 (Cth) is the Attorney‑General for the purposes of this Act (s 5). The Act treats statutory references to “Attorney‑General” as references to that officeholder unless a contrary intention appears (s 7).
• Functions: the Attorney‑General is the Territory’s official legal adviser, oversees administration of law and justice, advises on drafting Territory legislation, conducts Territory litigation (or directs the Solicitor or other persons to do so), and, when on the local roll, may practise as if holding an unrestricted practising certificate (s 6(a)-(e)). The Attorney‑General also has powers conferred by law or usage analogous to the Attorney‑General of England where applicable to the Territory (s 6(f)).

Solicitor for the Northern Territory (s 8)

• Concept: a statutory body corporate that acts as solicitor for the Territory and associated persons and bodies (s 8(1)-(3)). It replaces or subsumes functions ordinarily undertaken by a Crown Solicitor; the Act instructs that references to the Crown Solicitor in many instruments include this office (s 8(11)).
• Practice and delegation: the office may act for the Crown, Territory, ministers, Territory bodies, officers and employees, and other persons at the Attorney‑General’s request (s 8(3)(a)-(j)). The CEO can act personally in the Solicitor’s name, or authorise legal practitioner officers to act, and those acts done in the Solicitor’s name under CEO authority are taken to be acts of the Solicitor (s 8(4)-(7)). Authorisations must be published in the Gazette (s 8(10)). Persons authorised are accountable to the CEO and bound by practitioner duties when acting (s 8(6), (9)).

Solicitor‑General (ss 13-15; Div 2 ss 15A-15E)

• Concept and appointment: a senior legal counsel appointed by the Administrator by instrument in writing, must be under 72 and have at least five years’ enrolment as a legal practitioner of the High Court or a Supreme Court (s 13(1)(a)-(b)). Tenure, terms and conditions are as determined by the Administrator subject to Division 2 (s 13(1)). The Public Sector Employment and Management Act 1993 does not apply to the office (s 13(3)).
• Functions: may act as counsel for the Crown and for other persons at the Attorney‑General’s request, perform duties as the Attorney‑General directs, and exercise any powers conferred by Territory or Commonwealth law (s 14(a)-(c)). The Solicitor‑General is entitled to practise as if holding an unrestricted practising certificate (s 14(d)), but must not engage in other legal practice or paid employment without the Attorney‑General’s consent (s 14(e)(i)-(ii)).
• Removal and retirement: mandatory retirement at 72 (s 13(9)); the Administrator must remove the Solicitor‑General only for incapacity (except temporary illness), misbehaviour, or insolvency matters (s 15).
• Entitlements: Division 2 defines ordinary remuneration (s 15A), accrual and grant of long service leave (ss 15B-15C), payment in lieu on cessation with specific entitlements scaled to total service (s 15D), and superannuation contribution obligations imposed on the Territory to avoid a superannuation guarantee shortfall (s 15E).

Ancillary concepts

• Judicial notice: courts must take judicial notice of the signatures of the Attorney‑General, Solicitor‑General and persons signing in the Solicitor’s name (s 15F).
• Transitional provisions: the Act contains specific saving and transitional rules for persons occupying offices at the time of amendments, particularly the 2019 and 2023 amending Acts (ss 16-17; endnotes). These preserve some previous entitlements and treat prior authorisations in force as valid under the new text (s 17(1)-(4)).

Taken together, the Act’s main concepts delineate who may provide legal advice and representation for the Territory, how authority to act is delegated within the Solicitor’s office, the appointment and constraints on the Solicitor‑General, and the leave and superannuation framework for that senior officer. The Act is short on procedural detail beyond publication and entitlement arithmetic; it embeds significant administrative discretion in the Administrator, the Attorney‑General and the CEO.

The Act affects a defined set of actors inside the Northern Territory’s legal and governmental ecosystem, and it creates contingent effects for courts, private persons and external legal agents.

Primary actors named in the Act

• Attorney‑General (s 5-7): the ministerial officeholder designated under the Commonwealth’s Northern Territory (Self‑Government) Act 1978. The Act affects that office by fixing the Territory’s legal advice and litigation responsibilities in that person and allowing practice rights if on the local roll (s 6(e)). It also constrains how other statutes referring to “Attorney‑General” should be read (s 7).
• Solicitor for the Northern Territory (s 8): the statutory body corporate and its CEO, legal staff and authorised officers. The Act affects the office’s capacity to act for the Territory, ministers, bodies and persons at the Attorney‑General’s request (s 8(3)(a)-(j)), the delegation of authority to the CEO and authorised officers (s 8(4)-(7)), and the requirement to publish authorisations in the Gazette (s 8(10)).
• Solicitor‑General (ss 13-15E): the senior counsel appointed by the Administrator. The Act governs the Solicitor‑General’s appointment, tenure, retirement age, functions, prohibition on outside paid employment without consent, long service leave entitlements, payment in lieu rules, and superannuation contributions (ss 13, 14, 15A-15E).

Secondary actors

• Territory government: financially liable for remuneration, long service leave payments, payment in lieu on cessation, and superannuation contributions required by s 15E. These are explicit territory obligations (ss 15C-15E).
• CEO and agency legal officers: internal legal practitioners authorised to act in the Solicitor’s name, who will be subject to practitioner duties and CEO directions (s 8(4)-(9)). They must comply with the CEO’s directions and the CEO is accountable to the Attorney‑General for acts done under delegation (s 8(6)).
• Courts: required to take judicial notice of signatures of the Attorney‑General, Solicitor‑General and those signing in the Solicitor’s name (s 15F), which affects evidentiary practices and may reduce formal affidavit processes where signatures occur.
• Other statutory officers and bodies: ministers, bodies or authorities established by Territory law, officers or persons employed by the Territory or Territory bodies, and any other person for whom the Attorney‑General requests representation (s 8(3)(a)-(j)). These entities obtain direct access to the Solicitor’s office for representation, which affects their choice of counsel and funding arrangements.
• Australian Government Solicitor: may be engaged as an agent on behalf of clients of the AGS by arrangement (s 8(3)(h)). This permits interjurisdictional legal servicing arrangements under an express statutory head of power.

Tertiary and incidental effects

• Private litigants and third parties: when the Territory is a party, they will encounter the Solicitor for the Northern Territory as the Crown’s solicitor, including authorised employees acting in the Solicitor’s name (s 8(5)-(7)). This impacts service and appearance practice in litigation.
• Employers and superannuation administrators: the Territory must make superannuation contributions for the Solicitor‑General that meet the Superannuation Guarantee threshold and comply with choice‑of‑fund rules (s 15E(1)-(2)). This interacts with federal superannuation administration regimes referenced in the Act.

Who pays and who decides

• The Territory pays salaries, leave and superannuation entitlements for the Solicitor‑General (ss 15C-15E). The Administrator decides appointment and removal (ss 13(1), 15). The Attorney‑General directs the Solicitor‑General’s duties and approves long service leave (ss 14(b), 15C(1)). The CEO manages the Solicitor’s office and delegates authority to legal officers (s 8(4)) and must publish authorisations (s 8(10)).

Who is constrained

• The Solicitor‑General is constrained from outside paid work and outside legal practice without the Attorney‑General’s consent (s 14(e)). The CEO and authorised officers are constrained by CEO directions and professional duties when acting in the Solicitor’s name (s 8(6), (9)).

The Act therefore concentrates decision authority in the Administrator, Attorney‑General and CEO, while downloading operational legal practice to the Solicitor’s office and authorised officers. Financial burden of staff entitlements sits with the Territory for the Solicitor‑General.

The Act establishes statutory duties, privileges and rights for the Attorney‑General, the Solicitor for the Northern Territory and the Solicitor‑General. These provisions determine who may act, under what authority, and with what entitlements.

Attorney‑General: statutory functions and rights (s 6)

• Duties: act as the official legal adviser to the Territory and Executive Council, see to the administration of law and justice, advise on Territory legislation and drafting (s 6(a)-(c)).
• Litigation responsibility: responsible for conduct of litigation on behalf of the Territory and may act through the Solicitor for the Northern Territory or another person as the Attorney‑General determines (s 6(d)). That is, the Attorney‑General retains control over the Territory’s litigation strategy and delegation decisions.
• Practice rights: if the Attorney‑General’s name is on the local roll kept under the Legal Profession Act 2006, the Attorney‑General is entitled to practise as though holding an unrestricted practising certificate (s 6(e)). This creates a statutory bridge between ministerial office and practitioner status where the officeholder retains enrolment.

Solicitor for the Northern Territory: powers, delegation and practitioner status (s 8)

• Rights to act: the office may act as solicitor for the Crown in right of the Territory, the Territory, persons suing or sued on behalf of the Territory, ministers, Territory bodies, officers and employees, a person holding office under Territory law, Australian Government Solicitor by arrangement, and other persons at the Attorney‑General’s request (s 8(3)(a)-(j)).
• Delegation: the CEO may act personally in the Solicitor’s name or authorise an officer who is a legal practitioner to act in the Solicitor’s name by signed instrument (s 8(4)(a)-(b)). Acts done under the CEO’s direction are taken to have been done by the Solicitor for the Northern Territory (s 8(5)).
• Accountability and duties: an authorised person is responsible to the CEO and through the CEO to the Attorney‑General, must comply with CEO directions, and, when acting in the Solicitor’s name, is subject to the duties and obligations that would apply if the CEO or authorised person were a legal practitioner (s 8(6), (9)). The CEO is entitled to practise as if holding an unrestricted practising certificate (s 8(8)).
• Publication: every authorisation under s 8(4) must be published in the Gazette (s 8(10)). This creates an administrative transparency duty.

Solicitor‑General: functions and constraints (s 13-14)

• Rights: may act as counsel for the Crown and for persons requested by the Attorney‑General, and is entitled to practise as if holding an unrestricted practising certificate for purposes of the Act (s 14(a), (d)). The office can exercise any power conferred by Territory or Commonwealth law (s 14(c)).
• Duties: perform other duties of counsel as the Attorney‑General directs (s 14(b)). The Attorney‑General’s direction power shapes the Solicitor‑General’s practical workload and appearance instructions.
• Constraints: cannot engage in other legal practice or paid employment without the Attorney‑General’s consent (s 14(e)(i)-(ii)). Appointment requirements specify enrolment of five years and age under 72 at appointment (s 13(1)(a)-(b)). Retirement compulsory at 72 (s 13(9)).
• Removal: the Administrator must remove the Solicitor‑General if incapable (except temporary illness), guilty of misbehaviour, or bankrupt/insolvent/compromising creditors or making assignments (s 15(a)-(c)). Removal is a statutory enforcement mechanism affecting tenure security.

Long service leave and superannuation: rights under Division 2 (ss 15A-15E)

• Ordinary remuneration definition: the Solicitor‑General’s ordinary remuneration is the remuneration entitled for service as Solicitor‑General; part‑time service is pro rata (s 15A(1)-(2)). This base feeds leave and in‑lieu payment calculations.
• Entitlement accrual: 3 calendar months of long service leave after completing 10 years of service, and 9 calendar days for each subsequent year (s 15B(1)-(2)). Service can be full or part time; service not accrued while on leave without pay or absent receiving workers’ compensation (s 15B(3)-(4)).
• Grants and payment options: leave may be granted at full pay, half pay with double leave length, or mixed leave plus lump sum (s 15C(2)(a)-(c)). Minimum grant 7 days and leave cannot be split across weekend/public holiday boundaries (ss 15C(4)-(6)). Attorney‑General approval required to take leave (s 15C(1)).
• Payment in lieu: on cessation, payment in lieu applies with specific scales for less than 10 years (s 15D(1)(a)-(d)), and payment excluded where removed for misbehaviour (s 15D(2)). The deceased Solicitor‑General’s personal representative can claim payment (s 15D(3)).
• Superannuation: Territory must contribute each quarter to a complying fund an amount equal to the minimum to avoid an SG shortfall, and comply with choice‑of‑fund rules in the Commonwealth Act (s 15E(1)-(2)). These are statutory employer obligations.

Judicial notice and references (s 15F; s 8(11); s 7)

• Courts must take judicial notice of signatures of the Attorney‑General, Solicitor‑General and persons signing in the name of the Solicitor for the Northern Territory (s 15F). This effect simplifies evidentiary practices for documents executed by those officers.
• In many instruments a reference to the Crown Solicitor includes the Solicitor for the Northern Territory (s 8(11)), and references to Attorney‑General in Territory Acts are to be read as references to the Attorney‑General under this Act where not otherwise apparent (s 7).

Together these duties and rights allocate legal decision‑making and practice rights to specific offices, put organisational accountability lines in place through the CEO and Attorney‑General, and codify pay, leave and superannuation entitlements for the Solicitor‑General. The Act uses a mix of ministerial direction (Attorney‑General), executive appointment or removal (Administrator) and administrative control (CEO, Gazette publication) to structure legal service delivery for the Territory.

The Law Officers Act 1978 is primarily administrative and prescriptive with respect to offices, functions and entitlements; it contains limited explicit punitive or criminal sanctions. Enforcement mechanisms are administrative removal, entitlement denial in certain misconduct cases, publication obligations, and judicial notice; there are no express criminal penalties or civil fines contained in the Act as supplied.

Removal from office (s 15)

• The Administrator is the decision maker with mandatory removal duties where specified grounds exist. The Administrator must remove the Solicitor‑General only if the Solicitor‑General, except by reason of temporary illness, becomes incapable of performing duties, is guilty of misbehaviour, or becomes bankrupt or insolvent, applies for bankruptcy relief, compounds with creditors, or makes an assignment of remuneration for creditor benefit (s 15(a)-(c)). Removal is the principal enforcement mechanism to address incapacity, misconduct or insolvency.
• The Act does not outline procedural hearing rights, burden or standard of proof for misbehaviour or incapacity. The text sets the grounds but leaves the Administrator significant procedural discretion; the Act does not prescribe a statutory process for investigation, notice, representation or appeal against removal.

Denial of entitlements on removal (s 15D(2))

• If removed under s 15(b) for misbehaviour, the Solicitor‑General is not entitled to payment in lieu of long service leave under the specified subparagraphs (s 15D(2)). That is a direct financial consequence attached to removal for misbehaviour. The Act does not define “misbehaviour” in detail, leaving the term to ordinary understanding or other relevant law.

Publication and transparency obligations (s 8(10))

• The CEO must publish every written authorisation made under s 8(4) in the Gazette. Failure to publish may be a compliance breach, but the Act sets the obligation without specifying a sanction. Publication creates an administrative record that supports legal certainty for persons dealing with the Solicitor’s office.

Judicial notice (s 15F)

• Courts are directed to take judicial notice of signatures of the Attorney‑General, Solicitor‑General and persons signing in the name of the Solicitor for the Northern Territory (s 15F). Judicial notice reduces evidentiary friction when signatures are tendered and can be regarded as an enforcement‑adjacent presumption in court procedures.

No express criminalisation or pecuniary penalty provisions

• The Act does not create offences, fines or regulatory sanction regimes for non‑compliance such as failures to pay superannuation or leave. Enforcement of superannuation obligations would be via the usual federal superannuation regime (the Superannuation Guarantee framework referenced in s 15E) rather than within this Act. Similarly, obligations tied to legal profession conduct for the CEO and authorised practitioners are enforced through practitioner obligations (s 8(9)), but enforcement mechanisms are those of the Legal Profession Act 2006 and professional regulatory bodies rather than this Act.

Administrative discretion and enforcement risk

• The Act concentrates enforcement powers in executive actors (Administrator, Attorney‑General, CEO) rather than courts or independent tribunals. Removal, consent to outside practice, approval of leave, and delegation decisions are discretionary or administratively controlled (ss 13, 14(e), 15C(1), 8(4), 8(10)). The Act supplies little procedural prescription for accountability mechanisms beyond publication and prescribed grounds for removal. This creates implementation risk where stakeholders may expect procedural fairness safeguards not explicit in the text.

Interaction with federal enforcement regimes

• Superannuation obligations (s 15E) reference the Superannuation Guarantee legislation (Cth) and its choice‑of‑fund rules (s 15E(1)-(2)). Enforcement of SG obligations would therefore proceed under that federal statutory enforcement framework rather than the Law Officers Act itself.

In sum, the Act’s enforcement architecture relies on administrative removal, financial consequence on removal, professional duties of authorised practitioners, and publication and judicial notice obligations. It does not create a comprehensive statutory sanction regime in the Act itself; instead it relies on existing professional regulation and federal superannuation enforcement mechanisms.

The Act makes multiple express references to Commonwealth and Territory instruments and statutes. Those references shape the Act’s scope and operational intersections with other legal regimes.

Northern Territory (Self‑Government) Act 1978 (Cth) (s 5)

• Appointment and designation of the Attorney‑General for the Northern Territory are made by reference to a person appointed to a Ministerial office under s 36 of the Northern Territory (Self‑Government) Act 1978 (Cth), and who is given the designation “Attorney‑General” under s 34 or another designation specified by the Administrator (s 5). This cross‑reference imports Commonwealth self‑government arrangements into the statutory definition of the Territory Attorney‑General for the purposes of this Act.

Legal Profession Act 2006 (s 6(e); s 8(8); s 14(d))

• The Act ties practice rights to the local roll under the Legal Profession Act 2006. The Attorney‑General may practise as though holding an unrestricted practising certificate if the Attorney‑General’s name is on the local roll (s 6(e)). The CEO and the Solicitor‑General are each entitled to practise as if holding an unrestricted practising certificate issued under the Legal Profession Act 2006 for purposes of exercising powers under this Act (s 8(8); s 14(d)). These cross‑references align status under this Act with professional regulation and imply regulatory oversight and obligations remain governed by the Legal Profession Act and its regulatory scheme.

Superannuation Guarantee (Administration) Act 1992 (Cth) and Retirement Savings Accounts Act 1997 (Cth) (s 15E)

• The Territory’s contribution obligations for the Solicitor‑General’s superannuation are defined by reference to the Superannuation Guarantee (Administration) Act 1992 (Cth). The Territory must contribute each quarter an amount equal to the minimum necessary to avoid an individual SG shortfall and must comply with choice‑of‑fund requirements in Part 3A of that Act (s 15E(1)-(2)). Definitions of “complying superannuation fund”, “complying superannuation scheme”, and RSA are imported from the federal legislation (s 15E(3)). Thus superannuation entitlements and compliance are determined through federal statute and the Territory must meet federal SG standards.

Public Sector Employment and Management Act 1993 (s 13(3))

• The Act expressly exempts the office of Solicitor‑General and a person holding that office from the operation of the Public Sector Employment and Management Act 1993 (s 13(3)). This removes the Solicitor‑General office from the Territory’s general public sector employment framework, which affects leave, appointment procedural requirements, disciplinary processes and related administrative employment frameworks that otherwise would be governed by that Act.

Supreme Court Act 1979 (NT) and appointments (transitional s 17(3))

• Transitional provision s 17(3) treats a Solicitor‑General appointed before commencement of the 2023 amending Act as having been appointed as a Supreme Court judge under s 32(1)(c) or (d) of the Supreme Court Act 1979 on the day of appointment. This ties prior incumbents to judicial status for certain purposes and affects how pre‑existing appointments are recognised after amendments.

Crown Solicitor references and other instruments (s 8(11))

• The Act provides that in any Act, instrument, award, industrial instrument, contract, pleading or other process a reference to the Crown Solicitor is to be construed as including the Solicitor for the Northern Territory (s 8(11)). This makes the Solicitor for the Northern Territory the statutory equivalent of the Crown Solicitor across a broad range of instruments, affecting contractual interpretation and procedural notices where the Crown Solicitor is named.

Gazette publication requirements and administrative law

• The requirement to publish authorisations in the Gazette (s 8(10)) creates an administrative transparency obligation that interacts with administrative law expectations about information and decision‑making. While the Act does not specify remedies for failure to publish, lack of publication may have operational consequences and may be material in judicial review proceedings in which statutory authorisations are in issue.

Interplay with federal enforcement mechanisms

• Because the Act references federal superannuation law, enforcement of some obligations will be through federal bodies (ATO and SG enforcement mechanisms). Likewise, professional conduct obligations remain within the Legal Profession Act 2006 regulatory system.

Transitional and amendment interaction

• The Act’s transitional sections (ss 16-17) and the endnotes list multiple amending Acts (see Amendment history) that modify provisions, retire prior provisions, and save certain rights of incumbents. Practitioners must interpret the current text in light of those transitional saving provisions to determine which rules apply to incumbents appointed before particular amendments.

In practice, the Act functions as a bridge statute: it delegates Crown legal work to specific Territory offices while importing aspects of Commonwealth professional and superannuation law and exempting the Solicitor‑General from some Territory public sector provisions. Readers must therefore consult the Legal Profession Act, Superannuation Guarantee legislation and any relevant Supreme Court Act provisions to understand the full legal effect of rights and obligations created by the Law Officers Act.

The Act has been subject to a sequence of amendments since its original enactment in 1978. The reprint’s endnotes supply a detailed list of amendment instruments, their assent and commencement dates, and specific insertions or repeals. The key amendments and their mechanical effects are as follows.

Foundational acts and early amendments

• Law Officers Ordinance 1978 and Law Officers Act (No. 2) 1978: original enactment and early formalisation in 1978 (endnotes).
• Transfer of Powers (Law) Act 1979 and related acts effected changes and commencement clarifications in 1980 (endnotes).
• Law Officers Amendment Act 1981 (Act No. 24, 1981) and series of Statute Law Revision Acts through the 1980s and 1990s made various formal and substantive changes (endnotes list Nos 54, 49, 5, 48, 6, etc).

Significant structural and role provisions

• Law Officers Amendment Act 1986 (Act No. 5, 1986) inserted s 13 and ss 14-15 and made other changes to create the office of Solicitor‑General and to define functions and removal grounds. The 1986 amendments established the formal appointment and tenure regime for the Solicitor‑General (endnotes and s 13 insertion note).
• Subsequent consequential amendments ensured the CEO and Solicitor‑General practice entitlements tied to the Legal Profession Act and made technical updates (see Legal Profession (Consequential Amendments) Act 2007, Act No. 7, 2007).

Public sector interface and retirement age

• Public Sector Employment and Management (Consequential Amendments) Act 1993 (Act No. 28, 1993) modified the Act and subsequent acts adjusted the interplay with the Territory public sector machinery (endnotes). Notably, the 2013 Justice Legislation Amendment (Age of Retirement) Act 2013 introduced retirement age changes for judicial and associated offices and is reflected in the Act’s compulsory retirement provisions (s 13(9) and transitional s 16 for certain incumbents).

Recent amendments (2019 and 2023)

• Justice Legislation Amendment Act 2019 (Act No. 1, 2019): included transitional provision s 16 which treats a Solicitor‑General who resigned on or after turning 70 but before 72 in a particular way regarding the age reference in s 13(5) (s 16). This reflects transitional arrangements following amendment to retirement age provisions.
• Judicial and Other Officers’ Entitlements Legislation Amendment Act 2023 (Act No. 14, 2023): a major recent amendment. Commenced 1 June 2023 (endnotes). The 2023 Act:
  • Inserted Part and Division headings (pt 4, div 1 and div 2) and added Division 2 to Part 4 containing ss 15A-15E which provide a bespoke long service leave and superannuation framework for the Solicitor‑General (see s 17 transitional savings for incumbents).
  • Inserted s 15F on judicial notice and restructured many provisions. The List of Amendments (endnotes) shows multiple textual amendments across s 5, s 6, s 8, s 13 and ss 14-15.
  • Saved previous provisions for persons appointed before the commencement of the 2023 Act (s 17(2)-(4)); prior authorisations under s 8(4) taken to remain valid (s 17(1)).

Statute law revision and formal amendments

• Multiple Statute Law Revision Acts (1982, 1985, 1999, 2005, 2019) corrected formal drafting, renumbered provisions, or made non‑substantive changes (endnotes section 4). The Interpretation Legislation Amendment Act 2018 made formal changes to headings and sections noted in endnote 4.

List of amendment instruments (select)

• Law Officers Amendment Act 1986 (Act No. 5, 1986) (significant for creating the Solicitor‑General office).
• Public Sector Employment and Management (Consequential Amendments) Act 1993 (Act No. 28, 1993).
• Legal Profession (Consequential Amendments) Act 2007 (Act No. 7, 2007).
• Justice Legislation Amendment (Age of Retirement) Act 2013 (Act No. 5, 2013).
• Justice Legislation Amendment Act 2019 (Act No. 1, 2019).
• Judicial and Other Officers’ Entitlements Legislation Amendment Act 2023 (Act No. 14, 2023).

Practical consequences of amendment history

• The 2023 amendments materially added an express entitlements framework for the Solicitor‑General (ss 15A-15E), making leave, accrual and employer superannuation obligations explicit rather than implicit or governed under more general public sector instruments. Transitional savings preserve pre‑existing arrangements for prior incumbents.
• The Act’s references to and dependencies on the Legal Profession Act 2006 and Commonwealth superannuation legislation have been reinforced by amendment, aligning professional practice and employer superannuation obligations with external legislative regimes.
• Amendment history demonstrates an evolutionary approach: the Act began as a concise structural statute and has been progressively updated to address tenure, retirement, entitlements and interactions with changing public sector frameworks. Practitioners must therefore read the Act in conjunction with the listed amending Acts and saved transitional provisions to ascertain the rules applicable to a particular incumbent or time period.

The text of the Law Officers Act 1978 provided does not include any reported case law or judicial decisions interpreting or applying its provisions. The Act’s endnotes and reprint material list amending legislation and transitional provisions but do not cite any litigation. Consequently, within the provided source there are no named cases, no reported judicial constructions of terms such as “misbehaviour”, “capable of performing duties”, or the procedural requirements for removal, and no decisions on the interplays with the Legal Profession Act 2006 or the Superannuation Guarantee legislation.

Implications of the absence of litigation in the provided text

• Where the Act is silent or uses broad terms (for example, “misbehaviour” at s 15(b) or the absence of detailed removal procedure), courts would normally clarify meaning through case law. Absent that material in the printed Act, administrators and counsel must work from the statutory language and contemporaneous administrative practice.
• The Act’s reliance on other legal regimes (professional regulation, federal superannuation) suggests that litigation about conduct or entitlements will also often arise under the external regimes rather than under this Act. For example, disputes over superannuation contributions would be litigated or administratively resolved via federal SG processes.
• The judicial notice provision (s 15F) affects procedural treatment in courts. In practice, courts will follow the statutory instruction, though interpretation could be the subject of litigation if a party challenges the application of the provision to a disputed signature or authority.

Practical next steps for research

• The Act as supplied does not reveal litigation. If a practitioner requires authoritative judicial interpretation or wants to know how courts have treated the Act’s terms, they must search Northern Territory decisions and any inter‑jurisdictional authority that cites the Act. Also search decisions about removal of statutory officers, judicial status ties under transitional provisions, or disputes over statutory entitlements for the Solicitor‑General.
• For matters implicating the Legal Profession Act 2006 or Superannuation Guarantee (Administration) Act 1992, case law under those statutes may be instructive on practice rights and employer contribution obligations.

In short, the supplied statute contains no litigation history; practitioners should undertake case law research in Northern Territory and related federal contexts to locate judicial interpretation where required.

The Act contains several technical details and drafting features that may generate operational traps if overlooked. These “gotchas” are specific provisions that change immediate legal position, restrict choice, or impose administrative formality.

1. CEO and authorised officers practise rights but are subject to practitioner duties (s 8(4)-(9))

• The CEO may authorise an officer who is a legal practitioner to act in the name of the Solicitor for the Northern Territory (s 8(4)(b)), and that person is entitled to practise as if the CEO were the holder of an unrestricted practising certificate (s 8(8)). However, s 8(9) makes clear that acts done in the Solicitor’s name by the CEO or authorised officer are subject to the duties and obligations that would apply if the CEO or person were a legal practitioner. Practically this means delegated officers must observe practitioner conduct rules even though they act under administrative authorisation. Failure to observe profession duties remains potentially sanctionable under the Legal Profession Act 2006.

2. Publication of authorisations is mandatory (s 8(10))

• Every authorisation under s 8(4) must be published in the Gazette. Omitting publication does not nullify the statutory authorisation explicitly, but the requirement is statutory and failure to comply may create procedural or evidentiary challenges in litigation or raise administrative law issues about transparency and accountability.

3. Solicitor‑General’s tie to Attorney‑General for outside work and leave (s 14(e), s 15C(1))

• The Solicitor‑General must not undertake other legal practice or paid employment except with the Attorney‑General’s consent (s 14(e)). Additionally, long service leave requires Attorney‑General approval to be taken (s 15C(1)). These provisions centralise control in the Attorney‑General and can limit the Solicitor‑General’s outside commitments and leave flexibility.

4. Mandatory retirement at 72 with specific transitional rules (s 13(9); s 16)

• A Solicitor‑General retires from office on the day they attain 72 years (s 13(9)). Transitional s 16 provides a narrow saving for a person who resigned on or after turning 70 but before 72 in a specific 2019 amendment context; readers must check whether transitional savings apply to a particular incumbent.

5. Removal grounds are stated but procedures are unspecified (s 15)

• Statutory removal grounds are set (incapacity except temporary illness, misbehaviour, insolvency) but the Act does not specify investigatory or hearing procedures, notice requirements, or appeal rights. This leaves a procedural lacuna that may be filled by administrative practice or by reference to general administrative law principles, which can create uncertainty or risk of procedural challenge.

6. Payment in lieu limitations on removal for misbehaviour (s 15D(2))

• If the Solicitor‑General is removed under s 15(b) for misbehaviour, payment in lieu of long service leave is excluded for certain scaled entitlements (s 15D(2)). Employers and incumbents must consider the reputational and financial risks of removal for misbehaviour.

7. Long service leave entitlements are unusual in measurement and options (ss 15B-15C)

• The entitlement of 3 calendar months after 10 years and 9 calendar days for each subsequent completed year (s 15B) is precise and differs from standard public sector accruals. Options to take leave at half pay for double time or to accept a part leave/part lump sum payment are permitted (s 15C(2)). Minimum grant is 7 days and leave cannot be split across a weekend or public holiday (s 15C(4)-(6)). These idiosyncrasies require careful leave planning and payroll calculation.

8. Superannuation contribution obligation is defined as the minimum to avoid an SG shortfall (s 15E(1))

• The Territory’s obligation is to contribute the minimum necessary to avoid an individual superannuation guarantee shortfall and to comply with choice‑of‑fund rules (s 15E(1)-(2)). Employers should ensure quarterly calculations, reporting and fund choice processes are accurate to avoid federal SG liabilities.

9. The Solicitor for the Northern Territory is statutory equivalent to Crown Solicitor in many instruments (s 8(11))

• Practitioners drafting contracts, notices or pleadings that reference “Crown Solicitor” must understand that such references include the Solicitor for the Northern Territory (s 8(11)). Failure to update instruments or communications to include the Solicitor’s office could create confusion about service address or authority to act.

10. Public Sector Employment Act non‑application (s 13(3))

• The office and person holding it are exempt from the Public Sector Employment and Management Act 1993 (s 13(3)). This affects entitlements, disciplinary processes and other employment protections ordinarily available to public sector employees. Practitioners should not assume public sector procedures automatically apply to the Solicitor‑General.

11. Judicial notice of signatures (s 15F)

• Courts must take judicial notice of the signatures of the Attorney‑General, the Solicitor‑General and persons signing in the name of the Solicitor for the Northern Territory. Parties should be aware that signatures from those officers are presumptively recognised in court, which affects authentication processes.

12. Transitional savings may preserve older arrangements (s 17(2)-(4))

• The 2023 Act saved pre‑existing provisions for persons appointed before commencement and declared that authorisations in effect under the prior s 8(4) are taken to be valid under the updated text (s 17(1)-(4)). That means incumbents may have different entitlements or status from newly appointed incumbents, and careful attention to effective dates and saved provisions is required.

Collectively, these provisions require careful administrative discipline in delegation, publication, entitlement calculation and procedural handling of removal or leave. The Act’s mixture of precise entitlements and broad administrative discretion creates space for operational error if the specific statutory requirements are not followed.

This section gives practical, source‑grounded steps to comply with the Act’s requirements. Each step identifies the responsible actor(s) and cites the relevant provision.

Administrator (appointment and removal)

• When appointing a Solicitor‑General:
  • Use an instrument in writing specifying period or no limitation, ensure appointee is under 72 years and has been enrolled as a legal practitioner of the High Court or a Supreme Court for at least five years (s 13(1)(a)-(b)). Record these qualifications and the instrument formally.
  • Fix terms and conditions, keeping Division 2 (ss 15A-15E) in view for entitlements. Ensure the appointment instrument is retained for administrative and any future legal review.
• On removal:
  • Base removal only on the statutory grounds (incapacity other than temporary illness, misbehaviour, bankruptcy/insolvency) (s 15(a)-(c)). Document reasons and legal basis; consider providing notice and an opportunity to be heard consistent with administrative law expectations although not prescribed by the Act.

Attorney‑General (direction, consent and approvals)

• Legal advice and litigation:
  • Exercise the statutory role as official legal adviser and litigation controller (s 6(a), (d)). Document decisions to direct the Solicitor‑General or to instruct the Solicitor’s office, keeping records that show delegation or instruction.
• Consent and approvals:
  • Grant consent where the Solicitor‑General seeks to engage in other legal practice or paid employment (s 14(e)), and approve long service leave applications properly (s 15C(1)). Decisions should be recorded with reasons to support transparency.

CEO, Solicitor for the Northern Territory and authorised officers (delegation, publication, duties)

• Delegation instrument:
  • The CEO may act personally in the Solicitor’s name or by signed written instrument authorise an officer who is a legal practitioner to act (s 8(4)(a)-(b)). Prepare formal signed authorisations and keep originals.
• Publish authorisations:
  • Ensure every authorisation under s 8(4) is published in the Gazette (s 8(10)). Coordinate with Government Printer or Gazette processes to ensure prompt publication. Maintain copies of the Gazette notices in the agency record.
• Accountability and duty compliance:
  • Ensure any authorised legal practitioner complies with professional duties and with CEO directions (s 8(6), (9)). Maintain internal supervision and professional conduct training. Personal liability and professional discipline remain possible under the Legal Profession Act 2006.

Solicitor‑General (service, leave, superannuation and outside work)

• Eligibility and practice:
  • Ensure you meet eligibility at appointment (enrolment 5+ years, under 72 at appointment) (s 13(1)). Do not engage in other legal practice or paid employment without Attorney‑General consent (s 14(e)); secure written consent if any outside work is contemplated.
• Long service leave bookkeeping and applications:
  • Track service accrual: 3 calendar months after 10 years, then 9 calendar days for each subsequent completed year (s 15B(1)-(2)). If part‑time, use pro rata ordinary remuneration and measure service accordingly (s 15A(2), s 15B(3)). Do not accrue service while on leave without pay or receiving workers’ compensation (s 15B(4)). Apply for leave to the Attorney‑General (s 15C(1)) and specify whether leave will be full pay, half pay for double time, or mixed with lump sums (s 15C(2)). Ensure any leave granted meets minimum lengths (7 days) and does not split across a weekend or public holiday (s 15C(4)-(6)).
• Payment on cessation:
  • On cessation, calculate payment in lieu according to service length (s 15D(1)(a)-(d)). Note exclusions where removed for misbehaviour (s 15D(2)). If deceased, ensure personal representative is paid (s 15D(3)). Base payments on ordinary remuneration (s 15D(4)).
• Superannuation compliance:
  • Ensure the Territory’s payroll makes quarterly contributions equal to the minimum needed to avoid an SG shortfall and complies with choice‑of‑fund requirements (s 15E(1)-(2)). Coordinate with payroll and the Commonwealth superannuation administrators; retain records proving compliance.

Document and record management (across offices)

• Maintain appointment instruments, Gazette notices, written consents, leave approvals and payroll calculations. The Act’s obligations for written instruments (appointment, authorisation) and Gazette publication (s 8(10)) make documentary evidence essential.
• For litigation and court dealings, ensure appropriate signatories: the courts take judicial notice of signatures of the Attorney‑General, the Solicitor‑General and persons signing in the Solicitor’s name (s 15F). Keep exemplars of authorised signatures and Gazette‑published authorisations to pre‑empt challenger arguments about authority.

Contracting and correspondence

• When negotiating contracts or filing pleadings where “Crown Solicitor” is referenced, treat that reference as including the Solicitor for the Northern Territory (s 8(11)). Ensure correspondence addresses, service details and authority statements reflect the statutory position.

Interfacing with other regimes

• Legal practice and professional conduct: coordinate with the regulatory requirements in the Legal Profession Act 2006 where practice rights under this Act are invoked (s 6(e); s 8(8); s 14(d)). Ensure professional indemnity, trust account and conduct obligations are observed.
• Superannuation and payroll: apply the federal SG rules, meet quarterly contribution timing, and comply with choice‑of‑fund obligations found in federal legislation (s 15E(1)-(2)). Use payroll providers or in‑house finance teams familiar with SG compliance and reporting.

Transitional situations

• If an appointment predates amendments, check transitional provisions (s 16 and s 17) to determine which rules apply. For example, s 17 saves prior s 13(5)-(7) for those appointed before the 2023 commencement and treats prior authorisations as valid (s 17(1)-(3)). Keep historical appointment documents accessible to establish entitlement status.

Audit and compliance review

• Institute a periodic compliance review to ensure Gazette publications, appointment records, leave calculations, superannuation contributions and consent records are current and accessible. Given the Act contains precise numeric entitlements and publication obligations, internal audit reduces the risk of administrative error.

These compliance steps are directly drawn from the Act’s text (ss 5-15F) and the transitional savings (ss 16-17). Parties should maintain documentary evidence of authorisations, consents and payments because the Act relies on administrative instruments and does not specify procedural appeal routes for many decisions, leaving administrative law channels as the usual external check.
