46 Description and form of deeds (1) A deed between parties has, in effecting its objects, the effect of an indenture although not indented or expressed to be indented. (2) A deed, whether or not being an indenture, may be described as a deed or as a conveyance, deed of exchange, vesting deed, trust instrument, settlement, mortgage, charge, transfer of mortgage, appointment, lease or otherwise according to the nature of the transaction intended to be effected.
